  • IRAN: ‘The regime is executing protesters to create fear and suppress any attempt at new mobilisation’

    How has repression escalated since the 2022 protests?

    Repression by the regime of the Islamic Republic has escalated with executions of protesters, aimed at creating fear to suppress any attempt at new mobilisations such as the Woman, Life, Freedom nationwide protests triggered by Mahsa Amini’s death.

    Recently, four young Kurds from the western provinces of Iran were hanged on unproven charges of cooperation with the Komala Party of Iranian Kurdistan. Their families demanded a pardon until the last moment, but their requests went unheard.

    The Islamic Republic has always been at odds with ethnic minorities. Forty-five years since the Islamic Revolution, this conflict is as alive as on the first day. If anything, it has become worse.

    Of course, the death threat that comes with ramping up executions is not directed only at ethnic minorities. Every excluded group in Iran is under threat. The regime founded after the 1979 Islamic revolution was grounded on the aim of protecting the interests of Shia Muslim men. This means that everyone except Shia Muslim men is oppressed by design. This includes all women and LGBTQI+ people and sexual minorities, children and religious and ethnic minorities.

    Throughout 45 years there have been several spikes in executions of people from minority groups as well as political activists opposing the Islamic Republic. This trend has been ongoing from the onset, and it was even worse at the beginning. In the first decade of the Islamic Republic thousands of young dissidents were secretly executed or shot.

    On top of this, ethnic and religious minorities such as Bahais, Balochs, Kurds and Sunni Arabs experience daily discrimination and marginalisation, which sometimes cost people their lives.

    Additionally, the regime of the Islamic Republic supports Hamas and other terrorist Islamic groups and has no qualms about it. It laments the killing of children in Gaza while it has killed so many during the protests that erupted in Iran in September 2022. But ideologies shouldn’t matter: the massacre of children by any regime or group is a despicable act.

    Is there any space for civil society to operate in Iran?

    Young people in Iran continue resisting, despite the severe economic pressure and the suppression of activism. Even if this involves making sacrifices in their careers, education or social lives, young women continue defying the mandatory hijab. Nationwide protests may have decreased, but young people continue resisting the arbitrary and inhumane laws of the Islamic Republic.

    The struggle continues under the surface. Although the Islamic Republic and its Islamic Revolutionary Guard Corps severely suppress any attempt at a protest, people have not stopped fighting. The fact that they continue embracing civil resistance despite the potentially serious costs is very encouraging.

    Many of our fighters, whom I would like to mention, are in Tehran’s Evin prison with long sentences. Sarvenaz Ahmadi, Anisha Asadollahi, Keyvan Mohtadi, Sepideh Rashnu, Nasim Soltanbeygi and many others are in the frontlines of this struggle, spending the years of their youth in prison. And what cost would be higher than paying with years of your life?

    I try to support their struggle by raising awareness on international platforms and amplifying their voices. But the main struggle is being carried on by young Iranians in Iran. From afar, we can only admire their struggles and broadcast them to the world.

    How has the international community reacted to the escalation of repression in Iran?

    Unfortunately, the international community has maintained a shameful silence and indifference. As people were being executed, the 2023 Nobel Peace Prize winner, Narges Mohammadi, and several other civil activists wrote to the United Nations (UN) on the human rights crisis that Iranians face. And still, UN Deputy High Commissioner for Human Rights Nada Al-Nashif recently travelled to Iran despite activists warning that this could be used as propaganda by the government.

    The Iranian people will not forget the indifference and self-interest of the international community. This is as much of a historical disgrace as the silence in the face of the crimes that are being committed in Gaza.

    Many members of the international community are perhaps more involved in domestic and regional interests, and it seems that, contrary to their proclaimed slogans, they are not really concerned about genocide, the killing of children and people’s oppression. This is very unfortunate.

    We neither forgive nor forget.

  • IRAN: ‘The regime uses executions to maintain its grip on power through fear and intimidation’

    CIVICUS speaks with Jasmin Ramsey, Deputy Director of the Center for Human Rights in Iran (CHRI), about the ongoing wave of executions as part of the Iranian regime’s effort to suppress dissent and discourage further protests.

    Founded in 2008, CHRI is an independent civil society organisation that works to protect and promote human rights in Iran. Headquartered in New York, it researches and documents human rights violations throughout Iran, and provides governments, the United Nations, think tanks, global media and research centres around the world with detailed information, analysis and policy recommendations. CHRI’s approach is strictly nonpartisan, operating within the framework of international human rights law.

    What has led to the current wave of executions in Iran?

    Executions in Iran are not just a pillar of the founding of the Islamic Republic, but a ruthless tool wielded by the regime to maintain its grip on power through fear and intimidation. Although the vast majority of the more than 834 people who were hanged in Iran in 2023 were accused of drug offences or other non-political activities, the increase in executions after the protests, and the growing number of political prisoners among those executed in recent years, underscore the regime’s desperation to crush dissent. It is determined to prevent the emergence of another grassroots movement such as the Woman, Life, Freedom protests triggered by the September 2022 killing of Mahsa Amini at the hands of the morality police.

    This wave of state-sanctioned killings has galvanised civil society to unite in condemnation. Women prisoners of conscience, in particular, have shown remarkable resilience, leading calls against the death penalty among Iranian civil society through joint statements and hunger strikes.

    Iranian civil society is uniting to demand not just a cessation of executions, but the abolition of the death penalty. No matter how much the regime uses force and violence, it has failed to quell the desire for fundamental and systemic change in Iran. At every turn, society is pushing back against state policies that are repressive and discordant with the desires and beliefs of much of the population.

    Alongside increasing executions, how else has the regime reacted to the protests?

    Repression in various forms has escalated significantly since the emergence of the Woman, Life, Freedom movement in 2022, manifesting in various forms such as increased arrests and detentions of peaceful activists and family members seeking justice for victims of state violence.

    The government is also pushing for a law to impose harsher penalties on women appearing in public without the mandated hijab. This proposed law burdens citizens, encourages vigilante violence and increases women’s vulnerability to abuse through increased surveillance and state security forces deployed on the streets.

    Is there any space for civil society in Iran?

    While technically there might some room for civil society to operate in Iran, as established in legislation, the reality is starkly different. Article 27 of Iran’s constitution allows for public gatherings and marches under some conditions, but protests critical of the state are swiftly suppressed, often with violence. Fundamental rights such as freedoms of speech, expression and the press are severely curtailed, and peaceful activism is often treated as a threat to national security.

    Despite these challenges, activists and citizens persist in reclaiming their rights, using a variety of methods such as social media posts, prison letters and acts of civil disobedience, like women defying the state’s forced hijab law by walking the streets unveiled. Despite facing repression and economic hardships exacerbated by governmental corruption and sanctions, their determination remains strong.

    I am grateful to be doing this work in a place of safety, where, at least for now, I am shielded from the dangers faced by activists in Iran. I consider myself fortunate to learn from the courageous Iranians, especially women, who persist and resist despite immense risks. CHRI’s mission is to amplify their voices and advocate for civil society’s demands internationally, a task that comes with its own set of challenges. However, these challenges pale in comparison to the dangers faced by those on the frontlines in Iran.

    What should international allies do to support the struggle for freedoms in Iran?

    During the initial surge of the Woman, Life, Freedom movement, there was a heightened international focus on the events unfolding in Iran. This sparked hope for more substantial action from governments with influence over the Islamic Republic. At that time, we outlined steps for the international community to pressure Iran to cease its violent crackdown on protests.

    Among our recommendations, we emphasised the need for governments that have diplomatic relations with the Islamic Republic to recall their ambassadors in protest against the killing of protesters and hanging of prisoners. We asked them to summon Iran’s diplomats to communicate directly their outrage and warn that further costs and isolation would ensue unless the Iranian authorities halted executions, annulled death sentences, ceased torture under custody, released prisoners and respected due process for those accused.

    We urged the international community to designate the Islamic Revolutionary Guard Corps as a terrorist organisation and impose or expand human rights sanctions against Iranian officials and entities associated with rights violations and freeze the assets of officials who violated human rights, including Supreme Leader Ayatollah Ali Khamenei, and many more.

    We also asked parliamentarians around the world to sponsor individual political prisoners, particularly those facing execution, to publicise their cases and the unjust nature of their prosecution or sentences and publicly demand their safety and release, both on the international stage and directly with Iranian ambassadors and other Islamic Republic officials.

    Additionally, we urged states to suspend negotiations over Iran’s nuclear deal, which could provide increased revenue to the Iranian state and therefore increase its repressive capacity. We demanded it be expelled for multilateral bodies and various international platforms and associations, particularly those whose principles it blatantly violates. We also asked governments to support the United Nations (UN) Fact-Finding Mission on Iran and assist those fleeing Islamic Republic persecution, and asked tech companies to support safe digital communications for the Iranian people.

    This roadmap remains relevant today. It is crucial for international allies to rally behind the UN’s independent international Fact-Finding Mission, tasked with investigating atrocities committed by the regime since the onset of the violent repression of the protests in September 2022. As the Fact-Finding Mission presents its first report to the UN Human Rights Council in mid-March, a united, multilateral approach to supporting its mandate is essential for holding the Iranian government accountable and advancing the struggle for justice and human rights in Iran.

  • IRAN: ‘Women and queer people are at the forefront of the struggle against religious despotism’

    CIVICUS speaks with Asal Abasian about their experiences as a queer and feminist activist in Iran and in exile.

    Asal is an Iranian journalist and queer feminist activist. After receiving threats, they fled Iran in 2021. They first stayed in Turkey, where they freelanced with various foreign-based Persian language media outlets and Turkish media. They’re currently based in Paris, France. In Iran, same-sex relations are illegal and LGBTQI+ people can face the death penalty.

    What was your life like in Iran and why did you leave?

    My experience in Iran was challenging, uncomfortable and at times traumatic. However, my work as a cultural journalist focused on creativity, opening up new spaces that could escape the overt repression of traditional religious anti-queer social norms, showcasing diversity and expressions of transgression.

    Navigating this was challenging because the editorial world was a closed, misogynistic, male-dominated work environment, and because the state constantly monitored our actions. Despite these obstacles, the medium of culture, which I mainly covered, allowed for a certain degree of freedom.

    On a personal level, I embodied this challenge by pushing against the norms and visibly wearing my queer identity even in uncomfortable situations. Living in Iran as a queer person is difficult. If a same-sex relationship is exposed, it is punishable by death. Same-sex marriage is a distant dream. There’s a long way to go for the realisation of freedom for the queer community in Iran. Even if a queer person has a progressive and supportive family, the laws are against them and society is strongly queerphobic.

    Have you found safety in exile?

    Unfortunately, misogyny and homophobia exist everywhere. However, at least in a western country I have no fear of being arrested and imprisoned for my journalism or queer identity.

    But discrimination is a universal problem. In France, of course, homophobia is not as intense as in Iran and the Middle East because of protective laws, but it still exists. There are reactionary and dogmatic people everywhere, and I believe this oppression, with varying degrees of intensity, is universal.

    Living as an immigrant in the west, you can experience the intersection of oppression. Sometimes the treatment of immigrants, especially queer immigrants, is filled with violence and devoid of empathy and kindness. It seems the system is set up in such a way that immigrants are constantly discouraged from their journey and pushed back.

    Has the situation in Iran changed since you left?

    Sadly, the situation has not improved. But after the Woman, Life, Freedom movement triggered by the murder of Mahsa Jina Amini by the morality police in September 2022, women and the queer community have found more courage to fight against patriarchy and religious despotism.

    Women and queer people are at the forefront of this struggle. Change hasn’t come from the regime, but from people’s resistance against its oppression and tyranny. The fact that women are now at the forefront of civil struggles in Iran is very encouraging because no oppressive force can deter or push them back from their goal of freedom.

    However, the situation could be improved by spreading the ideas of inclusivity, equality and dignity through public education and cultural development. Much education takes place in schools, and much is also the responsibility of the media and the free flow of information. This is something we aspire to realise in countries like Afghanistan and Iran.

    What does Pride Month mean to you? Do you see a future where it could happen in Iran?

    Pride Month reminds me of the long and arduous journey of the queer movement up to this day. The fight against discrimination and oppression is a legacy we, the queer community, are proud of.

    As a member of the queer community in Iran, I hope for a day when Pride marches take place in the cities of Iran, and queer people can express their identities with pride, freely and without fear.

    But we are still a long way from that day. The problem is that the Islamic regime represents a segment of Iranian society. Part of society is very conservative and reactionary, making the possibility of change towards freedom and a safe space for queer people almost impossible. However, we remain hopeful and continue to fight for that day to come.

  • IRAQ: ‘Tolerance for abuses against LGBTQI+ people has now been made explicit through legislation’

    Sarah SanbarCIVICUS discusses the criminalisation of same-sex relations in Iraq with Sarah Sanbar, researcher at Human Rights Watch’s Middle East and North Africa division.

    The Iraqi parliament recently passed a law criminalising LGBTQI+ people, punishing same-sex relations with between 10 and 15 years in prison and transgender identities with sentences of one to three years. The original proposal included even harsher penalties, but lawmakers introduced amendments in response to strong criticism. Supporters claim the law upholds deeply held religious values, while critics condemn it for institutionalising discrimination and enabling serious human rights abuses.

    What led to recent legislative changes criminalising LGBTQI+ people?

    On 27 April 2024, the Iraqi parliament passed an amendment to the country’s 1988 anti-prostitution law, effectively criminalising same-sex relations and transgender identities. The amendment states that same-sex relations are punishable with between 10 and 15 years in prison, and provides for one to three years’ imprisonment for those who undergo or perform gender-affirming medical procedures.

    The law also punishes those who ‘imitate women’ with a seven-year prison sentence and a fine of between 10 and 15 million Iraqi dinars (approx. US$7,700 to US$11,500) and criminalises the ‘promotion of homosexuality’, a vague and undefined expression.

    The passing of this law follows years of steadily increasing hostile rhetoric against LGBTQI+ people. Prominent politicians and media personalities have consistently spread harmful stereotypes, tropes and disinformation. They often claim homosexuality is a western import that goes against traditional Iraqi values.

    This rhetoric has increasingly translated into government action. For example, on 8 August 2023, the Communications and Media Commission issued a directive ordering all media outlets to replace the term ‘homosexuality’ with ‘sexual deviance’ in all published and broadcast language. The directive also banned the use of the word ‘gender’, which shows how the crackdown on LGBTQI+ rights is intertwined with broader issues, and is also used to target and silence women’s rights organisations working on gender-based violence.

    Sadly, as in many other countries, LGBTQI+ people in Iraq are being used as political pawns and scapegoats to distract from the government’s failure to provide for its people. Tensions are growing between the more conservative and religious groups in society and government and those that take a more secular approach to governance. The fact that conservatives have gained increasing support in successive elections allows laws like this to be passed. Such a law probably wouldn’t have been passed even a few years ago.

    What’s the situation of LGBTQI+ people in Iraq, and how do you expect it to change?

    The situation of LGBTQI+ people is extremely unsafe. Threats to their physical safety, including harassment, assault, arbitrary detention, kidnappings and killings, come from society at large – including family and community members as well as strangers – and from armed groups and state personnel. Human Rights Watch has documented cases of abductions, rape, torture and killings by armed groups. Impunity is widespread, and the government’s failure to hold perpetrators accountable sends the message that this violence is acceptable.

    With the passage of the new law, the already dire situation is expected to worsen. Tolerance for abuses has now been made explicit through legislation. As a result, an increase in violence is to be expected, along with an increase in the number of LGBTQI+ Iraqis fleeing the country to seek safety elsewhere. Unfortunately, it is becoming even harder for LGBTQI+ Iraqis to ensure their physical safety in the country, let alone lead fulfilling lives, find love, make friends and build links with others in their community.

    What are the challenges facing Iraqi LGBTQI+ rights organisations?

    The space for LGBTQI+ organisations in Iraq has long been extremely limited. For example, in May 2023, a court in the Kurdistan Region ordered the closure of Rasan, one of the few groups willing to publicly advocate for LGBTQI+ rights in the region. The reason the court gave for its closure was its activities ‘in the field of homosexuality’, and one piece of evidence cited was its use of rainbow colours in its logo.

    Organisations such as Rasan have previously been targeted under vaguely worded morality and public indecency laws that restrict freedom of expression. By criminalising the ‘promotion of homosexuality’, the new law makes the work of LGBTQI+ organisations even more dangerous. Any action in support of LGBTQI+ rights could be perceived as ‘promoting homosexuality’, which could lead to activities being banned or organisations being shut down. It will be almost impossible for LGBTQI+ rights organisations to operate openly.

    In addition, all civil society organisations in Iraq must register with the Directorate of NGOs, a process that includes submitting bylaws, lists of activities and sources of funding. But now, it is essentially impossible for LGBTQI+ organisations to operate transparently, because they can’t openly state their intention to support LGBTQI+ people without risking closure or prosecution. This leaves two options: stop working, or operate clandestinely with the risk of arrest hanging over them.

    Given the restrictive legal and social environment, many organisations operate from abroad. IraQueer, one of the most prominent LGBTQI+ advocacy groups, is based in Sweden.

    But despite the challenges, LGBTQI+ organisations continue to advocate for LGBTQI+ rights, help people fleeing persecution and work with foreign governments to put pressure on Iraq to roll back discriminatory policies. And they have made significant achievements, facilitating the safe passage of people fleeing persecution and broadening coalitions to advocate for LGBTQI+ rights internationally. Their perseverance in the face of adversity is inspiring.

    What international support do local LGBTQI+ groups need?

    Global organisations should use their capacity to sound the alarm and advocate for the repeal of the new law and the reversal of other discriminatory measures, and for impunity for violence against LGBTQI+ people in Iraq to be addressed.

    An effective strategy could be to focus on human rights violations. Equal protection from violence and equal access to justice are required under international law, including the International Covenant on Civil and Political Rights and the Arab Charter on Human Rights, both of which Iraq has signed. Advocacy for LGBTQI+ rights as human rights can put greater pressure on the Iraqi government to fulfil its obligations.

    It’s also essential to provide resources and support to local organisations in Iraq and in host countries where LGBTQI+ Iraqis seek refuge, to ensure people have access to basic needs and community support, and can live full lives without fear.

  • IRELAND: ‘The referendums failed because the government overlooked the need to engage affected communities’

    SinéadMurrayCIVICUS speaks with Sinéad Murray, Communications, Membership and Information Officer at Treoir, about Ireland’s recent unsuccessful Family and Care Referendums.

    Set up in 1976, Treoir, is a federation of Irish civil society organisations (CSOs) that promote the rights and best interests of unmarried parents and their children in order to achieve legal and societal equality.

    What were the recent referendums held in Ireland about, and why were they important?

    The two referendums held on 8 March were aimed at changing the constitution, which was drafted in 1937 and heavily influenced by traditional social values regarding women, religion and family. Several referendums were held in the past few years to remove outdated concepts and replace them with more inclusive ones that reflect the modernisation of our society, and these two referendums were part of this trend.

    Although 40 per cent of families in Ireland are not based on marriage, article 41 of the Constitution of Ireland defines family on the basis of marriage. It only offers full protections to families based on traditional Catholic values, leaving out other family types, including single-parent or lone-parent families, cohabiting couples with or without children and kinship care families, in which the extended family steps in to take care of a child when a parent isn’t available.

    The Family Amendment sought to rectify this by providing greater constitutional protections and societal recognition to diverse family types and promoting gender equality in caregiving roles. The Care Amendment aimed to address the sexist language in a clause of article 41 that is colloquially known as the ‘women’s place in the home’ clause. It implies that women who work outside the home are neglecting their domestic duties.

    Although over time progress has been made in removing legislative discrimination against non-marital families, discrimination and inequality persist. For instance, lone-parent families face higher rates of poverty and housing insecurity. Further, since the 1930s, the government has regularly cited the constitutional definition of family to justify its discriminatory policies against non-marital families.

    Feminists have long campaigned against these constitutional clauses because they have contributed to a considerable amount of legislation that prevented women’s equality. To add insult to injury, article 41 doesn’t even recognise rights or provide protection for women who stay in the home, including married women, lone mothers, stay-at-home mothers and female family carers.

    Instead of simply deleting the article, the proposed amendment aimed to establish a positive, rights-based, gender-neutral, modern obligation of the state to protect caregiving, which is still overwhelmingly done by women.

    Unfortunately, neither amendment was passed. Sixty-seven per cent of voters rejected the Family Amendment and 74 per cent voted against the Care Amendment.

    What can the results be attributed to?

    Opinion polls indicated that around 20 per cent of voters would reject the amendments regardless of how they were worded or what arguments they heard in the campaign. I would argue this corresponds roughly to the conservative and far-right electorate. Although conservative and traditional voters likely contributed to the referendums’ outcome, they were far from its primary drivers.

    The numbers clearly indicate that many people who voted no in these two referendums had voted yes in the successful referendums on same-sex marriage in 2015 and on abortion in 2018. We need to understand why. Exit polls revealed the main reasons behind the two no votes in the 2024 referendums: a lack of clarity or information, a rushed process, lack of public consultation, a change perceived as insufficient and a general distrust in the current government.

    It was the government’s misunderstanding of past referendum successes that led to the lack of clarity and structure in this process. They took the progressive vote for granted and underestimated the importance of the actual wording and public engagement.

    The government published the wording for both referendums in December 2023, leaving a remarkably short window for campaign activities. It gave itself only six weeks to educate the public about the referendum process, communicate what was being voted on and try to persuade people to approve the changes. This limited timeframe posed logistical and political challenges.

    Surprisingly, the chosen wording deviated from the terms proposed by the Citizen’s Assembly – a body made up of randomly selected citizens tasked with deliberating on key political issues – and the Joint Oireachtas (Ireland’s two houses in parliament) Committee on Gender Equality. The Care Referendum, for instance, focused solely on protecting family care instead of encompassing care provided in the broader community. The government’s commitment to ‘strive’ to support care rather than being mandated to do so also raised concerns. The formulation for the Family referendum included terms such as ‘durable relationships’ that were undefined and caused further confusion.

    The rather abstract language used in both referendums also failed to afford enforceable new rights to the people concerned. If passed, the amendments wouldn’t have led to immediate, practical improvements in the lives of family carers or non-marital families – they would only have given them the right to challenge government decisions in court, which is a costly, intimidating and lengthy process. If the abortion referendum had only given women the right to go to court to demand an abortion, it likely wouldn’t have passed either.

    This lack of tangible benefits left many uncertain whether to vote in favour, strengthening the campaign against and allowing for misinformation to proliferate, driven particularly by far-right groups.

    Lack of trust in the current government exacerbated uncertainty. Public perceptions of the government’s failure to address pressing issues such as the housing and cost of living crises contributed to scepticism about the proposed changes.

    In essence, results were driven by a combination of factors and underscored the importance of clear communication, grassroots engagement and addressing public concerns in referendum campaigns.

    What should the government have learned from the successful referendums on abortion and same-sex marriage?

    The most serious mistake was to think that because they were on the same line of progressive, inclusive and rights-expanding change, the new referendums would produce the same result as the referendums on abortion and same-sex marriage. The government shouldn’t have taken a yes vote for granted.

    The government clearly misread the situation following the legalisation of same-sex marriage and abortion. In fact, the outcomes on abortion and same-sex marriage were far from preordained: they were the result of extensive, years-long grassroots mobilisation. Thousands of people advocated and protested for same-sex marriage and abortion for many years. Campaigns centred in the personal experiences of women and LGBTQI+ people affected by Ireland’s restrictive laws. Thousands of LGBTQI+ people spoke up about the stigma and discrimination they and their loved ones continued to face even after the passage of the 2011 civil partnership law. High profile cases such as that of Savita Halappanavar, who died after being refused an abortion, galvanised tens of thousands of women to speak out. The purpose was clear and the benefits of the referendums were obvious.

    The promise of tangible rights also motivated supporters. They knew that even if removing the constitutional ban on abortion would not result in abortions becoming legal overnight, the government had published a clear legislative plan for if the referendum passed. During the referendum campaign, it also said it would push for the legalisation of abortion up to 12 weeks into pregnancy. This gave people certainty about what they were voting for. Similarly, it was clear that same-sex couples after the referendum campaign would have the same rights and responsibilities associated with marriage as opposite-sex couples.

    The government didn’t see this, and so it overlooked the need to engage affected communities. Mobilising these groups is the most important asset in a referendum campaign and this was lost in the Family and Care referendums by the wording. The government also failed to clearly articulate the benefits of a yes vote. Unlike previous campaigns, the Family and Care referendums lacked a compelling narrative to rally public support. Legal or statistical arguments don’t persuade voters – personal stories do. But without the affected communities on board, those personal stories were hard to share. When those stories were shared, it was hard to definitely show how the referendum would adequately address the discrimination people faced. Lacking strong grassroots support, the Family and Care referendums faced great challenges in mobilising public opinion.

    Who campaigned for, and who campaigned against the proposed changes?

    Despite these shortcomings, most political parties supported a yes vote for both amendments, a common stance in Irish referendums. Although at Treoir we believed the government’s wording fell short, we still advocated for the change as we believed it was a step towards greater equality. Along with the National Women’s Council, One Family and Family Carers Ireland we led a campaign formed by 20 CSOs pushing for two yes votes.

    Only two political parties – both of which hold a small number of seats in the Dáil, the lower house of parliament – opposed the changes: Aontú and Independent Ireland. Their campaign focused on the confusing wording chosen by the government, and used the regular slogan of campaigners against change in referendums – ‘Don't know? Vote no!’. For them, the referendum was a cover to push for increased immigration or the legalisation of polygamy in Ireland. They also argued that the ‘women’s place in the home’ clause was a positive element of the constitution and removing terms like ‘mother’ and ‘women’ was part of an agenda to eradicate the concept of biological women. This stance was also supported by the Catholic Bishops Conference and the Iona Institute, a Catholic pressure group.

    Additionally, a third campaign emerged in support of a mixed vote, with the Free Legal Advice Centre among its supporters. They viewed the Family Amendment as an improvement but expressed reservations about the Care Amendment, arguing it would not provide any new rights and would perpetuate harmful stereotypes about women and people with disabilities. Equality Not Care, a group formed during the campaign, advocated for a no vote on the Care Amendment due to the impacts on people with disabilities, who would be considered as ‘subjects’ of care rather than independent rights-holders.

    What’s next in the struggle for gender rights in Ireland?

    The referendum campaign highlighted many of the issues that need to be urgently addressed, including the disproportionate number of lone-parent families, with 80 per cent of those headed by women facing poverty and housing insecurity. There’s also a need for a public childcare system, which would be essential for gender equality and hugely beneficial for lone parent families, along with real support for all types of carers, support for independent living for people with disabilities and family justice reform.

    Following this defeat, another referendum on these articles is highly unlikely any time soon. However, changing the constitution wasn’t civil society’s primary focus to begin with. Moving forward, we should concentrate our efforts in pushing for legislative measures rather than constitutional amendments.

  • ISRAEL: ‘We dream of hundreds of thousands demonstrating for democracy, equality and human rights’

    DebbieGild HayoCIVICUS speaks about currentprotests against judicial changes in Israel with Debbie Gild-Hayo, Director of Public Advocacy of the Association for Civil Rights in Israel (ACRI).

    Founded in 1972, ACRI is an oldest and largest human rights civil society organisation (CSO) in Israel. It advocates for the human rights and civil liberties of everyone living in Israel and in the Occupied Palestinian Territories.

    What are the judicial changes being proposed, and what is wrong with them?

    The government led by Prime Minister Benjamin Netanyahu is promoting several pieces of legislation concerning the judicial system. The one that has advanced most and is the most controversial at the moment concerns the makeup of the Judicial Selection Committee. This committee chooses judges for the High Court, which also plays the role of a Constitutional Court, and also all other courts.

    The government wants the ruling coalition to have a majority in the Judicial Selection Committee so it can control the appointment of judges. It currently has to make compromises and reach agreements between all members of the committee, political and professional, to nominate judges. If the change is adopted, the nomination process will be totally political and will prioritise judges’ allegiance to the government over their professionalism.

    The reform would also diminish the authority of the High Court to conduct judicial review of Basic Laws – which have the status of a constitution in Israel – drafted by the Knesset, Israel’s parliament. For example, the coalition wants to pass a new Basic Law that will release ultra-Orthodox people from obligatory military duty, making their religious studies equivalent to army service. The High Court has already stated that this kind of arrangement would violate the principle of equality. But if the reform passes, then these kinds of unconstitutional amendments to Basic Laws will be possible and the High Court will not be able to intervene.

    Another bill concerns regular laws passed by the Knesset that contradict Basic Laws. The bill determines that in order to annul an unconstitutional statute the High Court will need 80 per cent of its members to agree, which is practically impossible to achieve. On top of that, the bill includes an override clause, which determines that even if the High Court recognises legislation as unconstitutional, the Knesset will have the power to override its decision with a simple majority of 61 of its 120 members.

    It’s important in this context to remember that Israel has a 20 per cent Arab population, so even if a majority of 80 out of 120 Knesset votes were needed for the override clause, like some suggestions that are on the table and quite widely accepted, it would still keep Arabs completely out of the law-making process in the most harming and controversial moments. The government wants to be able to pass laws deemed unconstitutional with a simple majority of 61 members, which could potentially harm an enormous part of the population.

    The government also seeks to change the status of legal advisors in ministries, turning them from independent advisors into politically nominated counsel whose rulings would have non-binding status.

    All of these bills would harm the independence of the judicial system and its ability to defend human rights, and specifically the rights of minorities.

    How would you describe the protests against the changes?

    I would describe them as amazing. As a human rights organisation, it is our dream to have hundreds of thousands of people demonstrating for democracy, equality and human rights. We wouldn’t have thought it possible only a short while ago. People are now attending parliamentary discussions – which, believe me, is incredible. I have been doing this job for a long time, and I used to always be there alone or with a few colleagues at most.

    I think many people felt threatened personally by the reform initiative. This is what usually brings people out to the street. A lot of people who have never been involved in politics before are now mobilising.

    In the last few months, I have talked to members of the Knesset as well as to protesters and advocated for other issues besides the judicial changes that are also harming democracy and human rights in Israel to be included on the agenda. Everything that is related to the occupation is excluded from the mainstream agenda. There is a perception that those demonstrating with Palestinian flags harm the protest.

    But a few things are slowly widening the protesters’ agenda. For instance, people have been speaking up against the creation of a militia of armed citizens to support the police. It is a good sign that criticism is starting to go beyond the judicial changes.

    Protesters include people of all ages and various professional groups, including doctors, social workers and teachers, as well as youth and student groups. But it is undeniable that most are middle or upper-middle class. A deep split has existed in Israeli society for many years, but now it has come to its peak. On the one hand you have the more liberal population and on the other the right-wing nationalist segment, including five per cent of the population who are settlers and 10 per cent who are ultra-Orthodox believers.

    How has the government reacted to the protests?

    From my point of view, there hasn’t been much repression. There are frequent clashes between police and protesters and there have been cases of police brutality, but the level of violence has not been that high. I have seen the police in action in other places, such as East Jerusalem, and they are much more violent. In this case, they have given quite a lot of room to protesters.

    The main thing the government has attempted to do is to delegitimise the protests, referring to protesters as ‘anarchists’, ‘leftists’, ‘a minority against the country’ and so forth, disregarding the fact that hundreds of thousands are protesting every week and many of the people opposing the reforms and deeming them non-democratic are public officials, including members of security forces, or have positions in the financial system. The government also claims protesters are violent, but I personally have never seen such non-violent protesters in my life. If you just look at the protests against the pensions system changes taking place in Paris right now, there is no comparison.

    What role are CSOs playing?

    CSOs have been fully involved in many ways. CSOs are doing advocacy and campaigns, explaining to the public what this judicial reform is about, talking to the press and writing reports. They are also going to the courts when any rights violation occurs, especially regarding freedoms of speech and assembly, and to the police to defend arrested people. And they also take part in the parliamentary legislation procedures, including by attending committee sessions.

    Do you think the protests will force the government to backtrack?

    Protests have put a lot of pressure on the government, influencing Israel’s financial situation and bringing international support, which is also threatening to the government. But we have not stopped the process, but rather slowed it down. The government started pushing all these bills at once and ended up at the end of the Knesset session with only one passed, which protects Netanyahu’s position by limiting the ways a sitting prime minister can be declared unfit for office.

    The judicial reform has been put off for a month, during which time its terms are supposed to be negotiated. The next session will take place in May, and it’s likely that there won’t be an agreement so the ruling coalition will accuse the opposition of obstruction and go on to push the bills forward. Even if there is an agreement between the coalition and the opposition, or part of it, about the details of the reform, it is not certain that the public will accept it.

    If the bills pass, then there will be petitions against them and the High Court might deem them unconstitutional, which will farther intensify the controversy between the sides, and deepen the constitutional clash.

    I don’t think protesters will give up. The worst worst-case scenario is that the ongoing constitutional clash will be accompanied by clashes on the streets. I don’t know what form they will take, whether it will be strikes, people refusing to join the army and the reserves, violent clashes on the street, or general chaos. The far right is more violent than its opponents, and we have already witnessed far-right violence in protests and attacks against Arabs on the streets. The ongoing clash could turn into a catastrophe, maybe also escalating to another major outbreak of violence in the Israel-Palestine conflict, as we saw two years ago in May.

    What forms of international support does Israeli civil society currently need?

    International pressure seems to be one of the only things really influencing this government because Israel is dependent on international support, and financial support in particular. Since the government has a legislative majority, it can theoretically pass all these laws, and the only thing stopping it, or slowing it down at least, seems to be financial pressure within Israel – for example, some high-tech companies have already said that they will relocate or have started to open new companies in other countries – and outside financial or other international pressure.

    Another worry is that although many people are on the streets now and protests seem to be very wide, they do not, and probably will not in the future, deal with the less mainstream issues, such as the rights of the Arab population in Israel and occupation issues. In fact, the Knesset has just passed an amendment to the Disengagement Law that would allow the reestablishment of former West Bank settlements that were evacuated in 2005. This was barely an issue in Israeli public debate. This is just one example. CSOs are currently, and will probably continue to be, the only ones dealing with these issues on the national level, and will also probably be attacked because of this.

  • ITALY: ‘Accusing activists of vandalism is much easier than implementing renewable energy policies’

    GabriellaAbbateCIVICUS speaks with Gabriella Abbate of Last Generation about climate activism and its criminalisation in Italy, a country that has recently experienced both drought and devastating floods.

    Last Generation is an international network of climate activists using civil disobedience to compel governments to address the climate emergency by enabling citizen participation and financially supporting the global south as a primary victim of climate change that it hasn’t caused.

    Why are climate protests on the rise in Italy?

    Italy is heavily affected by climate and ecological crises: it experienced 310 climate disasters in 2022 alone, one of the main reasons behind them being the use of fossil fuels. The Italian government’s funding of fossil fuels has been steadily increasing, reaching €2.8 billion (approx. US$3 billion) between 2019 and 2021 and comprising 90 per cent of Italy’s total investment in fossil energy. Italy is the world’s sixth largest fossil energy lender, ahead even of Russia and Saudi Arabia.

    In reaction to these energy policies, transnational activist networks including Last Generation, Extinction Rebellion and Scientists Rebellion are organising climate protests throughout Italy. They all use nonviolent civil disobedience tactics such as roadblocks, soiling with washable and vegetable-based paint and gluing. Last Generation is currently protesting to demand that the Italian government immediately cease public funding for fossil fuels and respect the agreements made by European Union member states in the 2030 climate and energy framework to increase the share of renewable energies, improve energy efficiency and cut greenhouse gas emissions.

    What challenges are climate protesters facing in Italy?

    A major challenge has been the criticism of our ways of protesting and the way we have been portrayed by the media. I think it is much easier to present someone as a vandal than to try to understand the root causes of the anger driving their action. The media and the state strongly exploit people’s lack of awareness regarding the innocuous materials used in the actions, such as vegetable charcoal, which leads to plenty of misinformation. However, more and more people are still joining our movement, perhaps driven by personal fear of the climate catastrophe, but also due to the realisation that the label of ‘eco vandalism’ is only a facade to mask the problem and that the negative consequences of our actions are minor and superficial.

    On the other hand, the consequences of our activism being portrayed as violent and as acts of vandalism have been profound. There are currently three Last Generation activists facing trial for spraying the Senate building in Rome. They’re accused of ‘criminal damage’ and risk up to three years in prison. Never mind that the paint they used in the protest was washable.

    In April, the Italian government introduced a new law specifically to punish climate actions seen as damaging monuments or cultural sites with fines ranging from €20,000 to €40,000 (approx. US$21,500 to US$43,000) and possible imprisonment for those caught in the act. In this regard, it should be noted that an essential part of Last Generation’s activism is to draw attention to one’s responsibility for one’s choices, which ends up accentuating the consequences of the actions we take. We take responsibility by not running away after an action, and this puts us in an even riskier position. Another tool used by the Italian state is indictment for ‘criminal conspiracy’, a charge historically used against the mafia.

    The Italian government criminalises climate activists because by doing so it can continue avoiding its responsibilities regarding the wellbeing of its citizens. Accusing activists of vandalism is much easier than implementing renewable energy policies.

    How does Last Generation support activists so they can continue mobilising for climate action?

    Last Generation supports prosecuted activists by using funds from donations to pay their legal fees and hire experts to help them navigate court proceedings. We also share information about their cases on social media to gather international solidarity and support.

    How do you connect with the global climate movement?

    Last Generation is part of the A22 coalition, an international network of nonviolent civil disobedience campaigners, all of which demand their governments adopt measures to address ecoclimate collapse. The coalition was established in 2022 and it already includes at least 10 different campaigns advocating with governments in Europe, the Pacific and the USA.

    Within the coalition we share not only strategies and best practices but also victories, such as that obtained in the Netherlands last month. In April, following months of continuous campaigning by our Dutch allies, Schiphol Airport decided to ban private jets and night flights from 2025. It is setting new rules that establish clear limits on noise and emissions and has dropped plans to build an additional runway.

    This network is a great source of support. We help each other increase the visibility of our campaigns. It has certainly helped us attract more people to Non Paghiamo il Fossile (We Don’t Pay for Fossil) and other environmental campaigns in Italy and beyond.

  • JAMAICA: ‘After 20 years of advocacy, now there is sustained public conversation around LGBTQI+ rights’

    CIVICUS speaks with Karen Lloyd, Associate Director of J-FLAG, about the situation of LGBTQI+ rights in Jamaica and the significance of a recent report by the Inter-American Commission on Human Rights (IACHR) that held the Jamaican government responsible for violating rights. J-FLAG is a human rights and social justice organisation that advocates for the rights, livelihood and wellbeing of LGBTQI+ people in Jamaica.

    What is the current situation of LGBTQI+ people in Jamaica?

    Gender and sexuality-based discrimination continue to be of concern and impacts on people in many ways, including their right to work, education, health, life and equality before the law. The law does not protect people from discrimination on the basis of their sexual orientation or gender identity, and same-sex intimacy is criminalised.

    In April 2011, the Jamaican government passed the Charter of Fundamental Rights and Freedoms, but calls to include sexual orientation and gender identity as grounds for non-discrimination went unheard. The 2012 National Survey on Attitudes and Perceptions towards Same-Sex Relations, commissioned by J-FLAG, found that one in five Jamaicans respected LGBTQI+ people and supported the inclusion of sexual orientation as a ground for non-discrimination. In addition, about one-third of the population believed the government was not doing enough to protect LGBTQI+ people from violence and discrimination.

    Members of the Jamaican LGBTQI+ community are routinely deprived of their human rights and suffer from widespread discrimination, exclusion, violent attacks, police abuse, joblessness and a distinct lack of legal protection, among other issues. Many LGBTQI+ Jamaicans live in fear because of discriminatory policies, laws and attitudes and the lack of political will to protect their human rights. Since 2009, over 600 cases of abuse and violence have been reported to J-FLAG, and the National Survey carried out in 2015 revealed a 12 per cent rate of tolerance toward LGBTQI+ people among the public.

    A 2016 report found that out of 316 LGBTQI+ Jamaicans, 32 per cent had reported being threatened with physical violence over the previous five years and 12 per cent had reported being attacked; 23.7 per cent reported being threatened with sexual violence and 19 per cent being sexually assaulted. However, 41 per cent had not reported these incidents because they did not think the police would do anything, and 30 per cent thought the matter was too minor. One in four feared a homophobic reaction from the police and one out of five felt too embarrassed and did not want anyone to know.

    This reality is compounded by homophobia and transphobia as well as by laws criminalising same-sex intimacy between men, weak and largely inaccessible anti-discrimination legislation, weak protections against sexual and domestic violence and lack of legal recognition of same-sex relationships.

    In February 2021, the IACHR issued a report on LGBTQI+ rights in Jamaica. What was the significance of this?

    Several sections of the Offences Against the Person Act (OAPA) of 1864 prohibit sexual activities between men. Section 76 criminalises buggery, section 77 criminalises any attempt to commit buggery and section 79 criminalises acts of gross indecency, which can include kissing, hand holding and other acts of male-to-male intimacy. Men convicted of buggery face a maximum of 10 years of hard labour. This and other laws relating to sexual offences that precede the Charter of Fundamental Rights and Freedoms are protected from rights-based challenges.

    In the cases examined by the IACHR, the petitioners – Mr Gareth Henry, who is gay and Ms Simone Edwards, who is a lesbian – alleged that Jamaica was in violation of its obligation under the American Convention on Human Rights by continuing to criminalise private consensual sexual activity between adult males and by protecting these laws from being challenged. They claimed that this perpetuates Jamaica’s culture of violent homophobia and encourages the state and the general population to persecute not only male homosexuals, but also the broader LGBTQI+ community. They said they had both been victims of homophobic attacks. 

    The report by the IACHR concluded that the Jamaican government was responsible for these violations of their rights. The last we heard about it, the Attorney General’s department had acknowledged the decision and was preparing a response. For civil society, it reinforced ongoing calls for amendments to the OAPA and became part of existing engagement with policymakers to have it changed. Advocacy efforts with legislators have continued to be difficult, however, because they are unwilling to be publicly associated with a call for repeal due to potential backlash by religious extremist groups and some members of the public.

    How is J-FLAG working to try to improve the situation?

    J-FLAG is the foremost human rights and social justice organisation in Jamaica advocating for the rights, livelihood and wellbeing of LGBTQI+ people in Jamaica. Our work seeks to build a Jamaican society that respects and protects the rights of everyone. Our board and staff are committed to promoting social change, empowering the LGBTQI+ community and building tolerance for and acceptance of LGBTQI+ people. We promote the values of all-inclusivity, diversity, equality, fairness and love. These values are at the heart of all we do, as we seek to become effective agents of social change.

    To achieve our goals, we work on four main areas. First, we seek to improve the provision of non-discriminatory health services, engage key stakeholders and employees to address employment-related discrimination, and provide LGBTQI+ young people with a dedicated organisation that focuses on issues that directly affect their life outcomes.

    Second, we seek to increase participation in policy development and review processes by empowering young LGBTQI+ people and youth leaders and increasing collaboration among the LGBTQI+ young people involved in mainstream youth organisations.

    Third, we create service packages for LGBTQI+ Jamaicans aimed at increasing their access to information and counselling, reducing homelessness, increasing access to non-discriminatory social services, and increasing access to safe entertainment and networking.

    Fourth, we advocate for the human rights of LGBTQI+ people by legitimising the needs of the community, sensitising the population and parliamentarians around human rights, stigma and discrimination, increasing the capacity of LGBTQI+ leaders, civil society organisations (CSOs) and other stakeholders and duty-bearers to be better equipped to respond to the needs of LGBTQI+ people, and increasing the visibility of the experiences and the issues affecting them. 

    What have been some of your achievements and lessons learned so far?

    Our achievements over the past decade included the training of over 700 healthcare workers, in partnership with the Ministry of Health and Wellness, on how to treat LGBTQI+ clients; successful mass media campaigns such as We Are Jamaicans, #iChooseLove and #OutLoudJA, which sought to raise awareness about LGBTQI+ people among the general population; Our public Pride celebrations; four national surveys on attitudes and perceptions of the public on LGBTQI+ people and issues; the provision of capacity building for CSOs and youth leaders; and numerous research and publications on LGBTQI+ issues.

    Since our inaugural Pride event in 2015, Jamaica has held annual celebrations during the ‘Emancipendence’ period – the holidays celebrating both the end of slavery and independence from British colonial rule. The first thing to note is that Jamaica Pride has been conceptualised and implemented through a culturally appropriate lens; for example, it does not include a parade and instead takes the form of a diverse set of events and activities that are important to Jamaicans, including a sports day, church service, trade show, concert, party events and a day of service. At our inaugural Pride in 2015, the keynote speaker at our opening ceremony was the Mayor of Kingston, Dr. Angela Brown-Burke, which meant to signal that the community had allies among policymakers and parliamentarians.

    Another success has been having mainstream dancehall artistes such as Tanya Stephens, D’Angel, Jada Kingdom, Tifa, Ishawna, Yanique Curvy Diva and Stacious perform at Pride events. This focused national attention on our celebrations and signalled a positive shift regarding cultural spaces that had been highly contested.

    For the first time this year, J-FLAG did not host all the Pride events itself; instead, it provided financial and logistical support for members of the community to spearhead their own events. Dubbed #PrideShare, the initiative featured events led by community members, including arts events and a lip-sync battle, whose success indicated that our efforts are a step in the right direction.

    After 20 years of advocacy, now there is sustained public conversation around LGBTQI+ rights, increasing public tolerance and a growing willingness among parliamentarians, policymakers and key decision-makers to engage with the local LGBTQI+ community, including steps in working with LGBTQI+ rights organisations and advocates to improve the lives of members of the community. Notably, J-FLAG has built and sustained a significant partnership with the Ministry of Health that has led to the training and sensitisation of over 500 healthcare workers to fight stigma and discrimination in the health sector.

    Notwithstanding these gains, the movement has been dogged by sluggish law and policy reform, limited availability of spaces for community mobilisation and engagement, limited financial support to address homelessness and displacement, and low engagement of LGBTQI+ people living in rural areas. J-FLAG in particular has outlined the need for greater support in strengthening community systems as a means of scaling up advocacy efforts and ensuring wider reach and greater impact.

    How can international civil society best support the struggle of LGBQTI+ people in Jamaica and more generally in the Caribbean?

    International civil society can support the local and regional movement in many ways, including by giving us a seat at the table during global conversations, and understanding that we are the experts on what is happening in our societies. Where possible, it should also support our resourcing efforts with international donors. It can also help by sharing best practices and relevant research and raising awareness about the issues we face in Jamaica and the Caribbean among wider audiences.

  • JAMAICA: ‘Laws that discriminate against LGBTQI+ people send a signal about our place in society’

    J-FLAG is a human rights and social justice organisation that advocates for the rights, livelihood and well- being of lesbian, gay, bisexual and transgender people in Jamaica.

    What is the current situation of LGBTQI+ people in Jamaica?

    We continue to face challenges even as we note that there has been progress in the form of moderately increasing positive attitudes towards the community. Based on the 2019 Awareness, Attitude and Perception Survey commissioned by J-FLAG, there was a small but noticeable increase of five percentage points in tolerant and positive attitudes towards LGBTQI+ Jamaicans, from 20 to 25 per cent. A 10-year analysis of the human rights violations being reported to J-FLAG shows a decline in mob violence, arson and murder.

    However, there continues to be reports of verbal harassment, threats, physical violence and displacement of LGBTQI+ Jamaicans by their family and members of their community. According to the 2019 Community Needs Assessment commissioned by J-FLAG, one in five LGBTQI+ Jamaicans have been displaced at some point in their lives, and 46.8 per cent of LGBTQI+ Jamaicans have experienced discrimination.

    That being said, there has been a noticeable increase in the willingness of LGBTQI+ Jamaicans to be more visible and a decline in openly homophobic rhetoric among politicians and key decision-makers, and in violently homophobic lyrics in popular music genres. These qualitative shifts suggest that we are slowly moving in a positive direction as a society, even though the most vulnerable members of the community often continue to face the most severe manifestations of homophobia.

    Do you think there are enough mechanisms in place to address homophobia in Jamaica?

    Quite the opposite: there are specific legislative provisions that are discriminatory. For example, section 76 of the Offences Against the Person Act criminalises anal sex regardless of consent and section 79 generally criminalises male-to-male intimacy. Although these laws are hardly enforced, they send a signal about our place in society. In addition, same-sex couples are deliberately excluded from laws that recognise unmarried couples and provide benefits and protections, including against domestic violence, to people in those relationships.

    Jamaican law does not prohibit discrimination by private people and groups, including companies, on the basis of sexual orientation or gender identity. While some steps have been taken to prohibit sexual orientation discrimination in policy, this has not always translated into better protection for LGBTQI+ Jamaicans. In addition, there continues to be a reticence among community members to report crimes and violence against them to the police because of experiences of discrimination that they’ve had or are aware of.

    It is critical for the Jamaican government to do more to ensure the inclusion of LGBTQI+ Jamaicans. A 2020 study done by the Caribbean Policy Research Institute revealed that billions of dollars are lost because of discrimination against the community. Beyond this economic burden, the continued exclusion faced by the community puts Jamaica at odds with its international human rights commitments and obligations. The success of our national development plan, Vision 2030, is endangered by this exclusion.

    What work does J-FLAG do, and what challenges has it faced?

    J-FLAG uses a range of approaches to advocate for greater inclusion of LGBTQI+ Jamaicans within society. We continue to agitate for law and policy reform so that criminalising and discriminatory laws are changed and protective laws and policies are introduced. Recognising the need to engender cultural change, we do online and traditional media campaigns to promote tolerance and inclusion.

    We have also invested heavily in building the capacity of members and allies so they can do their personal advocacy independently from us. This has led to increasing visibility among community members, contributing to our efforts to change hearts and minds.

    We also do research around issues facing the community to ensure our advocacy is evidence-based and we are able to act as a repository of knowledge for those who would like to support our work. Additionally, we do capacity building training and sensitisation sessions for a range of public and private groups to improve their engagement with members of the community. Finally, we have hosted seven incident-free PrideJA celebrations since 2015 and are now planning the eighth.

    The major challenge we have faced is fear among a wide range of stakeholders to openly or quietly engage with our work. There are low levels of political will to effect legal and policy change. Community members are reticent to engage with us openly because of fears of discrimination. Various public and private organisations prefer not to work with an openly LGBTQI+ organisation. There has been consistent, though in recent years not as visible, opposition by extremist religious groups.

    Within Jamaican society there are mixed views about our work, but support for it has grown significantly over the last five to 10 years. Some people are curious, others are willing to engage and learn, but among a significant mass there continues to be distrust or outright opposition. 

    How can Commonwealth countries work together to advance LGBTQI+ rights?

    Given the similarities across many Commonwealth countries, there is an opportunity for dialogue and experience-sharing, particularly with countries such as Bahamas, Belize and Trinidad and Tobago, which have taken different routes to decriminalisation.

    As a body, the Commonwealth has a majority of countries from the global south, which while it presents its own challenges, also affords the opportunity to discuss and do work around LGBTQI+ rights with respect for each country’s cultural experiences. Within such a space, there is less potential for global north and western countries to be regarded as pushing ‘a foreign agenda’, and it is more likely for honest and difficult conversations about LGBTQI+ inclusion to happen and for collaboration to emerge. The only challenge will be whether the heads of government of these countries are willing to engage in these conversations.

    International organisations should maintain lines of communication with local organisations such as J-FLAG and TransWave Jamaica, which works on trans health and wellbeing, to develop an informed understanding of LGBTQI+ issues in the Jamaican context and use their various platforms to share that understanding with a wide range of actors. It would also be useful for them to assist in forging partnerships among organisations and movements in places like Jamaica and other parts of the world and offer support to ensure that the Jamaican movement is sustained.

  • JAMAICA: ‘We must establish a republic – where the people are sovereign and not the Queen’

    Rosalea HamiltonCIVICUS speaks about the movement to make Jamaica a republic with Professor Rosalea Hamilton, founding director of the Institute of Law and Economics and member of the Advocates Network.

    The Advocates Network is a non-partisan alliance of individuals and organisations advocating for human rights and good government in Jamaica.

    What are the goals of the movement for republicanism in Jamaica?

    To understand the goals, let’s break down the concept of republicanism. It means different things to different people. Perhaps the most popular, widespread view of a republic is a state without a monarch. This is the view held by many countries across the region that have removed Queen Elizabeth II as head of state, Barbados being the most recent case, and declared themselves a republic. But the other concept of a republic, as a state in which the people are sovereign, is typically ignored or downplayed.

    Since Barbados became a republic in November 2021, the republican conversation, which had started in Jamaica around 1995, gained momentum. Having learned from the experience of our Caribbean neighbours, many of us now view the concept of a republic as involving not just the removal of the Queen but also the establishment of a state where the people are sovereign and not the Queen.

    Although we have a representative, democratic form of government, it does not effectively represent the will of the people. Therefore, a core objective in creating a republic would be to strengthen and deepen our representative democracy to ensure we have a government of, by and for the people.

    So for those of us who are part of the Advocates Network, our goal is not just removing the Queen as head of state, which we see as a necessary first step, but also deepening our democracy and ensuring the establishment of a state where the Jamaican people are sovereign.

    What explains the recent momentum of the movement for republicanism in Jamaica?

    Most recently, the movement gathered strength in response to the royal visit to Jamaica in March 2022, which was viewed as inappropriate not only because it was during the throes of the pandemic, but because we were – and still are – grappling with pre-existing issues that have been exacerbated due to the pandemic. These include high murder rates, undereducated children, child abuse, gender-based violence and inadequate housing. Many of us in the Advocates Network are actively involved in tackling these problems, which we view as rooted in our colonial past. We think it’s time not only to move away from the monarchy, but also fix these colonial legacy problems. 

    The royal visit was therefore seen as a distraction. But it also provided an opportunity for Jamaicans to learn more about the royal family and their active role in the trafficking and enslavement of Africans. Jamaicans became more aware of the details of past atrocities and have begun questioning the role of the Queen as head of state after 60 years of independence. Social media has played a big role in helping to build awareness and deepen understanding.

    But there are also several other factors at play. The world is changing. For us in the Caribbean and across the Black African world, something shifted with the murder of George Floyd in the USA and the Black Lives Matter movement. As the entire world saw the video of a white man kneeling on the neck of a Black man, we found that our Governor-General – the official who represents the Queen in Jamaica – was wearing an insignia with a white angel standing on the head of a devil depicted as Black. It was a shocking reminder of the link between our colonial past and our institutions today.

    That woke people up. The George Floyd murder, and the many racist incidents that followed in the USA, the UK and elsewhere in Europe, reminded us that we still live in a world where people are treated as less than human based on the colour of their skin. The unheard calls for reparations are becoming louder as we try to come to grips with a past that is still with us.

    The movement for republicanism can therefore be seen as a rejection of our colonial past and its modern-day expressions in the form of racism, discrimination, inequity and more.

    In light of the recent Commonwealth Heads of Government meeting, what do you think the relationship between Caribbean countries and the UK will look like going forward?

    A lot will depend on how the UK responds to the growing calls of Caribbean people and our governments for a different relationship than we have had in the past. The formal position of Caribbean governments is to engage in a reparatory process. Governments may choose to be patient with this process, but increasingly many Caribbean people are demanding a formal apology and reparations, as was evident during the royal visits to the region. Many are saying it’s time!

    The voices are getting louder, not only in the Caribbean but in the USA and other parts of the world. The rejection by the majority of the Commonwealth heads of government of Kamina Johnson Smith, the candidate for Secretary-General who was openly backed by the UK, is indicative of this changing relationship with the UK.

    If the UK doesn’t respond positively and continues its racist, discriminatory policies, the relationship is likely to become more antagonistic.

    But I am hopeful things will change. An important part of our response to the royal visit was an open letter listing 60 historical reasons for an apology and reparations from the UK and its royal family. It was a way to bring to their attention the horrors of the past, because we are not sure they understand our history.

    It may be working. I noted that at a Commonwealth conference, Prince Charles said he’s still learning about the past. Most of us are still learning, and unlearning, what we were taught about the past.

    The UK has a great opportunity to rebuild this historic relationship on less exploitative and more humane terms. Engaging in a meaningful reparatory justice process can create a framework to build a mutually beneficial relationship that puts the past behind us and enable us to build a better future for generations to come. 

    How is the Advocates Network working towards these goals?

    We are advocates for human rights and good governance, issues that are central to creating a people-centred republic. So we are actively engaged in public education and building public awareness about what it will take to create a republic where the Jamaican people are sovereign. Right now, we are organising online forums. We won’t stop until we are on the right path to creating a meaningful republic. As we say: ‘Wi Naa Ease Up!’

    Public education is key! The 60 reasons appended to the open letter to the royals was to educate not just the royals about our history but also our fellow Jamaicans. We want Jamaicans to understand the many reasons we must remove the Queen as head of state. It’s simply unacceptable to have a head of state who refuses to formally apologise for an atrocity that the United Nations has labelled as constituting crimes against humanity.

    The major obstacle to overcome is to shift the mindset of Jamaicans to see themselves as owners of Jamaica with sovereign responsibility to determine the future of Jamaica. If we make this shift, a meaningful republic that can better address the pressing issues facing Jamaicans will be within our grasp.

    What international help do the movement and its people need?

    The work involved in creating a meaningful republic as well as pursuing reparatory justice is indeed challenging. It’s a heavy burden. It’s a painful burden to confront our past and change our society. Unearthing the past to guide our future is heavy lifting.

    Collaboration, especially in disseminating information, is important for our education campaign, including through interviews by a global south organisation based in South Africa, such as CIVICUS.

    Financial resources are helpful, but in-kind support is as important and will certainly help us to reduce the burden. Access to research materials, educational opportunities, media facilitation, technological assistance and international forums will be helpful. We welcome opportunities to amplify our voices in collaboration with individuals and organisations with similar objectives in other countries.

  • JAPAN: ‘Each victory brings backlash, but LGBTQI+ people will keep fighting for equality and dignity'

    AkiraNishiyamaCIVICUS speaks about the struggle for LGBTQI+ rights in Japan withAkira Nishiyama, Deputy Secretary General of the Japan Alliance for Legislation to Remove Social Barriers based on Sexual Orientation and Gender Identity (Japan Alliance for LGBT Legislation, J-ALL).

    Founded in 2015, J-ALL seeks to remove social barriers based on sexual orientation and gender identity (SOGI). It does so by convening consultations, producing research, developing policy proposals, raising awareness among the public and lobbying government officials and legislators.

    What are the implications of recent court rulings on same-sex marriage in Japan?

    In 2019, five lawsuits were filed at Japanese district courts addressing same-sex marriage. Four out of five court rulings were positive. Nagoya and Sapporo district courts declared that not allowing same-sex marriage was against the Constitution, while Fukuoka and Tokyo district courts ruled that it was ‘in a state of unconstitutionality’.

    The Osaka court was the only one to rule negatively on the three constitutional clauses in question. Clause 1 of article 24 says that marriage shall be based on the mutual consent of both sexes, and the court argued that this clause pertains to heterosexual couples only and doesn’t guarantee same-sex marriage. The court affirmed that legal protection for same-sex relationships hasn’t been fully discussed yet and therefore the Civil Code and Family Register Act, which doesn’t recognise same-sex marriage, is not against clause 2 of article 24, which upholds individual dignity and the essential equality of sexes in matters of marriage and family. Finally, the court argued that there are now minimal differences in the treatment of heterosexual and same-sex couples, and so the lack of recognition of same-sex marriage doesn’t violate article 14, which guarantees equality under the law.

    Have you seen any positive change in public attitudes to LGBTQI+ people?

    Since the lawsuits were filed, there have been significant societal changes. Various surveys indicate public support for same-sex marriage, and over 300 municipalities have introduced a partnership system for same-sex couples.

    According to the 2019 research led by Professor Kazuya Kawaguchi from Hiroshima Shudo University, almost 65 per cent of the population supports same-sex marriage, with the percentage reaching 80 per cent among people in their 20s and 30s. Also, almost 88 per cent support legislation prohibiting bullying and discrimination against sexual minorities. Similar results have been observed in other studies.

    How positive is the recently adopted law against discrimination?

    The law passed in June 2023 is not an anti-discrimination law based on the grounds of sexual orientation and gender identity (SOGI), because it lacks the tools to address actual cases of discrimination. It should be understood as a ‘SOGI Understanding Law’: it primarily aims to promote public awareness of sexual and gender diversity. It mandates the government to create a basic implementation plan and operational guidelines, publish an annual white paper to monitor progress, conduct academic research and establish a liaison council to coordinate policy implementation. It also encourages ‘efforts’ by national and local governments, employers and schools to promote understanding through awareness-raising, setting up consultation services, educational activities and other necessary measures.

    LGBTQI+ groups are concerned that article 12, which states that in implementing the measures each actor shall pay attention to ensure that all citizens can live with ‘peace of mind’ regardless of SOGI, may be interpreted by right-wing groups intentionally to mean that if one person raises concerns, local government cannot implement those measures. However, during the legislative session it was clarified that article 12 was added to emphasise a guiding principle stipulated in article 3, which declares that all citizens, irrespective of their SOGI, are respected as irreplaceable individuals who share basic human rights equally, and unjust discrimination based on SOGI is inexcusable.

    Japanese civil society is still uncertain whether this law will have a positive impact, given that the implementation plan and guidelines are yet to be formulated. We hope that the law will be interpretated and applied in accordance with the guiding principles based on a thorough understanding of the legislator’s intention.

    Have these legal changes been met with an anti-rights backlash?

    This year, anti-LGBTQI+ remarks made by a former secretary of the prime minister in February and Japan’s hosting of the G7 Summit in May accelerated a social movement urging anti-discrimination legislation. As a result, there has been heightened criticism from some conservative members of the ruling Liberal Democratic Party (LDP) and religious groups.

    Anti-transgender discourse has surged by exploiting women’s anxieties. It has gone along the lines of ‘if the law is passed, men claiming to be women will be able to come into women’s public toilets and baths (‘Sento’ in Japanese)’. A new caucus was formed within the LDP, allegedly to protect the peace of mind and safety of women and the fairness of women’s sports. Members of this caucus submitted a request to the Ministry of Justice to keep the ‘compulsory sterilisation’ requirement for legal gender recognition. The LGBTQI+ community must continue discussions on how to counter this backlash.

    What are the next steps in your struggle?

    Three crucial steps should be taken. First, a proper anti-discrimination law banning discrimination on the basis of SOGI must be enacted. Second, marriage equality must be recognised.

    And third, inhumane requirements for legal gender recognition must be removed through the revision of the Act on Special Cases in Handling Gender Status of Persons with Gender Identity Disorder or the approval of new legislation. The compulsory sterilisation requirement has been criticised both domestically and internationally. Recommendations to eliminate it were formulated by various states at Japan’s Universal Periodic Review by the United Nations Human Rights Council in January 2023. However, the Japanese government did not accept these recommendations. A Supreme Court ruling on the constitutionality of this requirement is expected by the end of this year, and we hope it’ll mark the beginning of a movement to amend Japan’s gender recognition law.

    While many other things must be done to protect the human rights of LGBTQI+ people in Japan, we believe it’s crucial to first amend and enact laws on these three issues.

    What international support do you receive, and what is needed?

    At the international level, LGBTQI+ organisations from G7 member states, including us, have formed a new civic engagement group named ‘Pride7’ (P7) to highlight human rights violations related to SOGI globally and propose policy recommendations at G7 summits. In March, we organised the P7 summit with activists from G7 and global south countries and, as a result, handed the P7 communiqué to the governments of Japan, the UK and the USA. Additionally, 15 embassies in Japan released a joint video message ahead of the G7 Summit in Hiroshima, urging protection for the rights of LGBTQI+ people and expressing intolerance towards discrimination. With substantial support from the international community, we aim to pass on the P7 presidency to Italy, the host of the 2024 G7 summit.

  • JAPAN: ‘Links between politics and the religious right have impeded progress on LGBTQI+ rights’

    Akira NishiyamaCIVICUS speaks with Akira Nishiyama, executive officer of the Japan Alliance for Legislation to Remove Social Barriers based on Sexual Orientation and Gender Identity (Japan Alliance for LGBT Legislation, J-ALL).

    J-ALL was founded in 2015 to advocate for legislation to remove the barriers LGBTQI+ people experience due to their sexual orientation or gender identity in Japan. It focuses on raising awareness among the public, producing research and convening consultations, developing policy proposals and lobbying with government officials and legislators.

    What is the situation of LGBTQI+ people in Japan?

    LGBTQI+ people are estimated to make up between three and 10 per cent of Japan’s population. Many are closeted for fear of discrimination and prejudice. According to recent research, over half of teenagers who identify as LGBTQI+ have been bullied, and only about 10 per cent of LGBTQI+ people are able to come out at their workplace. The rate of LGBTQI+ people who have considered suicide is about twice as high as among their heterosexual counterparts and the rate of those who attempt suicide is six times higher – and 10 times higher among transgender people.

    Such a vulnerable status is caused by the absence of a law at the national level that prohibits discrimination on grounds of sexual orientation and gender identity (SOGI) and raises awareness of LGBTQI+ and SOGI issues. We believe that an anti-discrimination law would enable us to solve social problems such as bullying and SOGI-based discrimination due to prejudice or misunderstanding and effectively deter and remedy human rights violations. It would force governmental agencies, educational institutions and private companies to prepare preventive schemes so that SOGI-related human rights violations would not take place, and make consultation services available.

    Additionally, Japan’s Act on Special Cases in Handling Gender Status of Persons with Gender Identity Disorder sets strict conditions to change one’s legal gender status. Under this law, a person with a so-called ‘gender identity disorder’ must be diagnosed by two or more psychiatrists and must fulfil five conditions to request the family court to make a ruling towards change of their gender status, which is still thought of in binary terms: they must be above 18 years of age, not be married at the time of the gender change, have no children who are still minors, have no reproductive glands, or only reproductive glands that have permanently lost their function, and have body parts that appear to resemble the genitals of the other gender.

    These conditions are considered too strict compared to those of other countries. In 2015, 12 United Nations organisations issued a joint statement asking the Japanese government to ensure the legal recognition of the gender identity of transgender people without such abusive requirements, but the Japanese government has not yet made any moves in that direction.

    What work does J-ALL do?

    J-ALL was established in April 2015 in response to a call from politicians and the LGBTQI+ community to reach a consensus and make effective policy recommendations. For the previous decade or so, civil society organisations (CSOs) in Japan had been lobbying separately on LGBTQI+ and SOGI-related issues.

    J-ALL is an umbrella organisation with 96 member CSOs from throughout Japan. It is run by directors who are leaders of CSOs in various regions. Its secretariat is managed by executive officers who specialise in lobbying, public relations and international affairs, as well as student interns.

    Our lobbying activities have succeeded in pushing forward several SOGI-related laws. For instance, in October 2018 the Tokyo Metropolitan Government adopted an ordinance that protects LGBTQI+ people from SOGI-based discrimination in line with the Olympic Charter. This ordinance clearly stipulates anti-discrimination based on SOGI and was the first ordinance of its kind at the prefectural level.

    In addition, in May 2019 the Japanese government amended the law on harassment. The amended version requires private entities and municipal governments to set guidelines to prohibit harassment and outing based on SOGI in the workplace.

    As the only CSO aimed at proposing SOGI-related bills, J-ALL is pushing politicians and governmental officers at both national and municipal levels by working together with Rengo – the Japanese Trade Union Confederation and a member of the International Trade Union Confederation – eminent scholars and researchers of labour law and international human rights law, and activists fighting to eliminate all kinds of discrimination, including discrimination against women. In recent years, around 40 companies have signed a statement to support the LGBT Equality Law, which would ban anti-LGBTQI+ discrimination. Economic federations have also declared the necessity for legislation on SOGI.

    Have you faced any anti-rights backlash?

    As the social movement to promote the rights of LGBTQI+ people has grown, backlash by religious right-wing groups, ultra-conservative politicians and trans-exclusionary radical feminists (TERF) groups has also grown. For instance, several politicians gave discriminatory speeches against LGBTQI+ people in response to discussions regarding the anti-discrimination bill agreed on by LGBT Giren, a nonpartisan political caucus set up to discuss SOGI-related human rights violations in 2021. Bashing against transgender women and LGBTQI+ people based on heteronormativity, conventional understandings of the family and stereotypical images of women are prevalent in both the real world and the internet.

    Japan has not made much progress on gender inequality, let alone LGBTQI+ rights and SOGI-related issues. This is because the Japanese government is closely connected with religious right-wing groups based on the values of male chauvinism and a patriarchal view of the family. Because of these close ties, ruling politicians have long ignored the existence of people with diverse sexualities and gender identities and have sustained a social system that lacks SOGI-related education and allows for SOGI-based human rights violations. As a result, LGBTQI+ people face wide-ranging challenges such as prejudice, bullying and harassment, and victims of SOGI-related human rights violations are not protected by the law.

    We believe that Japanese civil society needs to recognise this connection between mainstream politics and the religious right in order to tackle human rights issues in earnest. It is also important to learn about which groups of people are marginalised by the current social systems built by the majority and what kind of human rights violations they face, and to take actions such as electoral participation and making public comments based on these concerns.

    How is civil society working to achieve marriage equality, and what was the significance of the recent verdicts of the Sapporo and Osaka district courts?

    There is a CSO, Marriage For ALL Japan, that has been working actively and specifically to achieve the legalisation of same-sex marriage in Japan. In 2019 this organisation filed lawsuits in five districts – Fukuoka, Nagoya, Osaka, Sapporo and Tokyo – and has been conducting awareness-raising activities across the nation.

    In March 2021, the Sapporo District Court ruled that not allowing same-sex marriage was unconstitutional. After a careful scrutiny of the scientific and medical arguments currently used to deny legal benefits to same-sex couples, the Sapporo District Court reasoned that the failure to allow ‘even a certain degree’ of legal benefits to same-sex couples based on their sexual orientation is against Article 14 of the Constitution, which stipulates equality under the law. Although the court dismissed the plaintiffs’ claim for compensation, its verdict was viewed as a step that would surely accelerate the movement to legalise same-sex marriage in Japan.

    But then in June 2022, the Osaka District Court concluded that not allowing same-sex marriages does not violate Article 14, given that the legal disadvantages faced by same-sex couples can be compensated by wills or other means. In addition, the court emphasised that the gap between the benefits enjoyed by heterosexual and same-sex couples has been minimised by the recognition of same-sex partnerships at the municipal level. This, however, overlooks the fact that the municipal system of partnership recognition is not legally binding.

    The Osaka District Court also claimed that the ‘true’ elimination of discrimination and prejudice should be achieved by constructing a social system through the democratic process of free discussion by the people. This was criticised by civil society as an abdication of the judiciary’s crucial role as the bastion of human rights. Also under fire is the court’s claim that marriage is purely for the purpose of reproduction.

    How can the international community support LGBTQI+ people fighting for their rights in Japan?

    Since 2020 J-ALL has been running a global campaign, Equality Act Japan (EAJ), alongside Human Rights Watch and other global human rights organisations. We would like you to sign the petition found in our website to ask the Japanese government to enact the LGBT Equality Act.

  • KENYA: ‘People are discouraged from voting when they think that voices do not matter’

    Ken OgemboCIVICUS speaks about the recent presidential election in Kenya with Ken Ogembo, programme manager of Siasa Place.

    Siasa Place is a civil society organisation (CSO) founded in 2015 with the aim of promoting youth participation in politics. It educates people about the importance of voting and how the government can be held accountable.

    Did you observe an increase in civic space restrictions around the 9 August election?

    We observed several civic space restrictions during the election. The media did not provide fair coverage to all candidates, and the most popular candidates had a clear advantage because everything they did was widely covered and they got a lot of propaganda. Media are powerful tools that can be used to influence the views of people and in this case were used to promote some parties and bring down others. Social media was also used to spread misinformation that influenced many people’s voting decisions.

    Further, there was violence in some counties, which we believe was organised to spark fear. As a result, people no longer felt comfortable attending campaigns for some candidates because of fear they could be attacked. 

    There were also cases of candidates being attacked. Some female politicians were attacked and assaulted; unfortunately not much was done to protect them or follow up on their cases. William Ruto, announced as the winner of the election, was also attacked in Kisumu. His vehicles were destroyed but fortunately he was not hurt. 

    There was also a situation in Kakamega county between the two main coalitions, Kenya Kwanza and Azimio la Umoja: they were fighting over access to a stadium and a number of people got hurt in the process.

    However, I do not believe violence was serious or widespread to the point that we could say it was what marked the electoral process.

    Why was there such low voter turnout?

    There are a number of factors that could have possibly contributed to it, but I think it is first and foremost about people being demotivated from voting because they do not see any change happening as a result of elections. Government corruption is pervasive no matter who is in the government, and economic performance is consistently poor. Public services are of very low quality: there are not enough healthcare facilities, doctors are often going on strike, markets are dirty. Youth unemployment continues to be very high, and most people don’t think this will change, so many do not see any reason for voting.

    We also need to look at how candidates are nominated. Presidential candidate Raila Odinga’s party, Azimio la Umoja, did not conduct democratic internal processes in most of its strongholds and often nominated people who had long been in power and had performed dismally. People are discouraged from voting when they think their voices do not matter.

    I would also say it is also ignorance that drives young people away from the polls. They should understand that regardless of whether they get out to vote, a government will get elected and will rule over them. The fact that they did not vote takes away their moral authority to question those in power. Of course they still have a constitutional right to do so, but their questioning will lack substance and they will not have any alternative to offer.

    Through our engagement with young people, we have noticed they lack confidence in the Independent Electoral and Boundaries Commission (IBEC), the institution that manages elections, which many consider unable to deliver free and fair elections. They view it as pointless to go out and vote if the IBEC can’t ensure their votes will count.

    This is probably a mistake, because there have been improvements in the electoral process, including by making it clear that the results received from voting stations are final. However, the IBEC still has a lot of work to do make people trust the electoral process.

    Finally, I think the government played a huge role by not providing any civic education. It only started doing the basics when it was already too late, as most people who didn’t vote had already made up their minds not to. And when the government did, the content was not of the right kind, in the sense that would make people understand why voting is important and how to play their role as citizens.

    Has civil society been able to play its role in the electoral process?

    Civil society’s role has been somewhat restricted. Many CSOs would need more support and resources to play their full range of roles during elections. During this election we saw many CSOs unable to provide civic education programmes because of lack of funding and government support.

    Our job as civil society is to advocate on people’s behalf, inform them about the process and raise awareness of their rights. But most of us were denied the right to do our work due to lack of resources. My organisation, Siasa Place, played a key role in the previous election because it received the required resources in time. But this year the support we needed came about two months before the elections, which is rather late for us to start doing our work at the community level. This affected our role, but we hope things will improve in the coming years. We need government and civil society to work together to inform people around elections so they know what they are doing.

    There were also cases of CSOs being instrumentalised by political parties to influence voters. That defeats the whole purpose of having an active civil society. We urge the concerned CSOs to remember their original goals and mission and refocus on them. We should be the voice of marginalised people and communities, not of political parties. It is our duty to hold political parties accountable, not root for them at elections.

    Given the very close result, do you think there could be a recount or even an election re-run?

    If the defeated candidate can convince the court that there have been irregularities so gross that they have affected the outcome, then the court could nullify the results. But if votes are recounted and the result comes out the same, there won’t be a need for a rerun.

  • KENYA: ‘The government has put all the burden of addressing homophobia on civil society’

    Stephen OkwanyCIVICUS speaks about the situation ofLGBTQI+rights in Kenya and the ongoing impacts of the British colonial legacy with Stephen Okwany, programme director of Talanta Africa.

    Talanta Africa is a civil society organisation (CSO) that uses art to promote the rights of LGBTQI+ people and advocates for an inclusive society in which LGBTQI+ and young people have a say in the decisions that affect their lives.

    What is the current situation of LGBTQI+ people in Kenya?

    The Kenyan LGBTQI+ community continues to celebrate amazing gains brought by progressive organising and its focus on opening conversations around queer lived realities, discussing bodily autonomy and deconstructing cis hate.

    This has been met with mixed reactions from different quarters. Our gains have elicited organised opposition from anti-gender and anti-rights movements highly resourced by illiberal populists and very active in the religious, cultural and legal arenas. These movements perpetrate organised rights violations against LGBTQI+ people, including by promoting conversion therapy practices, profiling LGBTQI+ people and queer activists, deliberately denying access to basic human rights such as healthcare and education, perpetrating online attacks and outing queer people, and even through the murder of queer people, the most recent case being that of Sheila Lumumba, a 25-year-old non-binary lesbian who was attacked, sexually assaulted and killed in her home on 17 April.

    How does legislation discriminate against Kenyan LGBTQI+ people?

    The Kenyan government recognises the existence of queer people in the country. However, there are still regressive laws in place that threaten the existence of the queer movement, such as Sections 162-165 of the Penal Code, which discriminate against consensual same-sex relationships and criminalise those who live on the proceeds of sex work, limiting the independence of LGBTQI+ sex workers in Kenya.

    Additionally, queer people and collectives face restrictions on their freedoms of association and peaceful assembly, as the government shies away from registering queer collectives and the police typically use excessive force to disrupt queer parades.

    The government has not put in place mechanisms to address homophobia. The burden to do so has been left to civil society. Queer survivors of deliberate homophobic attacks have been denied justice by a judicial system built upon cis hate and in violation of the provisions to integrate LGBTQI+ community members as equal participants in the Kenyan development process. No progress can be achieved if a section of the population continues to be excluded on the basis of prejudiced perceptions.

    How does your organisation work to counter those perceptions?

    Talanta Africa is an artivist collective of queer human rights defenders. We put the power of strategic communications tools such as arts, culture, media and tech at the service of queer storytelling to promote a change in narratives and improve the civic space of LGBTQI+ people.

    Our organisation is largely a strategic communications platform that convenes queer people who believe that silence is too high a price to pay in the face of injustice and inequality. We believe that conscious art and culture play a key role in shaping narratives and telling stories while also countering regressive narratives that advance cis hate.

    Not surprisingly, our work has been met with extreme opposition and has been branded as a queer ‘recruitment’ process. This has resulted in attacks on our offices, the intimidation of our artivists, the profiling of our work and intentional exclusion from activist spaces and platforms.

    How can Kenya and other Commonwealth countries work together to advance LGBTQI+ rights?

    Commonwealth countries should establish multilateral instruments to affirm and advance the bodily autonomy of LGBTQI+ people. These could provide a platform for auditing legal instruments at a country level and assessing the development and implementation of new legal frameworks to replace regressive legal provisions.

    International organisations have a mandate to raise human rights awareness, including of the human rights of LGBTQI+ people, and denounce human rights violations, including those faced by LGBTQI+ community. To do so, they must promote progressive queer narratives. They must be deliberate in resourcing queer-affirming spaces through the equal rights and equal opportunities framework.

  • KENYA: ‘We have concerns about state functions being used to dictate and define morality’

    IvyWerimbaCIVICUS speaks about LGBTQI+ rights in Kenya and the criminalisation of activism with Ivy Werimba, Communications and Advocacy Officer at galck+.

    galck+ is a national coalition of Kenyan LGBTQI+ organisations advocating for issues related to sexual orientation, gender identity and gender expression and representing LGBTQI+ voices across the country.

    How significant is the recent Supreme Court ruling in favour of allowing the National Gay and Lesbian Human Rights Commission (NGLHRC) to register? Has it brought any anti-rights backlash?

    The Supreme Court’s decision to uphold the lower court rulings was highly significant. This decision sets an important precedent for future cases involving discrimination against marginalised communities and underscores the importance of the judiciary in upholding the rule of law and protecting human rights. It was the first of its kind by the Supreme Court of Kenya. We applaud their decision to uphold the Constitution.

    There has been a lot of backlash from various societal leaders and there is now a Family Protection Bill that’s been created and awaiting being gazetted. This bill, which closely resembles the anti-homosexuality bills of Ghana, Nigeria and Uganda, has given fodder to the opposition, which is rallying support for it online and continuing to spread misinformation and disinformation by tying it to other issues that political leaders refuse to address, such as the poor economy, the rise in teenage pregnancies and alcohol abuse, election violence and election violations, widespread corruption and unrest in secondary schools.

    The NGLHRC fought for 10 years to register because its name contained the words ‘gay’ and ‘lesbian’. Has galck+ faced similar challenges?

    No, our struggle has been different. As a coalition made up of 18 member organisations catering to people of diverse sexual orientation, gender identity, gender expression and sex characteristics, we changed our name in 2022. We are now galck+ and our name is no longer an abbreviation. galck+ reflects the growth and intersectionality we have witnessed in the Kenyan LGBTQI+ movement, with inclusion and diversity at the heart of what we do. Our updated resolve is to create a space that doesn’t feel segmented since our fight for freedom and love is the same regardless of what makes us different from each other.

    How do you manage to work in a context where being LGBTQI+ is illegal?

    Our work in Kenya is not hindered by the illegality of being openly LGBTQI+. Although Kenya is a patriarchal, conservative and sexist state, the perception of a person’s gender or sexuality is what gets people in trouble. Through its existence and work, the LGBTQI+ community in Kenya continues to challenge conformity to societal norms that expect men to be courageous and women to be homemakers.

    There have been significant milestones in establishing laws and policies that support gender equality and social inclusion. However, several factors – including limited resources, weak links among ministries and between the national and county levels, negative pervasive norms and attitudes about inclusion – hinder the effective implementation of laws and policies.

    Despite all these tribulations, we use our work and our spaces to push back on these norms and celebrate the limited but important progress made on the rights of LGBTQI+ people in Kenya over the last 10 years. This has largely been obtained through victories in court, where Kenyan activists have challenged criminalising provisions and the treatment of LGBTQI+ people and organisations. This includes a case that established that the use of forced anal exams is illegal, a case that upheld the right of LGBTQI+ people to form and register organisations and a case that upheld the right to change gender on legal documents. The Family Protection Bill threatens to destroy all this progress and so our work continues to be a reminder that the freedoms we fight for are for all Kenyans, and not only for the LGBTQI+ community.

    Do prohibitions of ‘same-sex behaviour’ apply in practice?

    Violence and discrimination against LGBTQI+ people in Kenya are a harsh reality. Despite claims that sexual orientation and gender identity are non-issues, LGBTQI+ people in Kenya experience stigma, discrimination, physical and verbal abuse, assault, harassment, eviction from their homes, loss of their jobs, suspension or expulsion from school and many other rights violations that significantly affect their wellbeing and quality of life.

    The Penal Code’s sections 162(a), 162(c) and 165 criminalise sexual activities that are perceived to be against the ‘order of nature’. While these sections apply to all Kenyans, they are selectively used to criminalise same-sex relationships. The ambiguous language used in these sections also makes it difficult to define ‘gross indecency’ since it criminalises even innocent actions like hugging or holding hands between people of the same sex. These laws also affect the transgender and intersex communities. The misguided narrative that limits people’s understanding of the difference between sexual orientation and gender identity leads many Kenyans to assume that transgender and intersex people are homosexual or bisexual.

    Although few people have been charged under these laws, they are often used to justify violence and discrimination against LGBTQI+ people, creating a perception that they are criminals. This is a perception that subsets of the state and religious institutions advance to further perpetuate human rights violations and acts of violence.

    In other words, there is a connection between legal prohibitions and violence against LGBTQI+ people, even if the laws are not consistently applied. This hostility is underpinned by discriminatory laws, including the law that criminalises same-sex activities and other laws used by the state to target LGBTQI+ people.

    These laws also create a culture of fear and secrecy among LGBTQI+ people, making them vulnerable to harassment, assault and other forms of violence. In addition, the inconsistent application of these laws can lead to arbitrary arrests and prosecution, including under laws criminalising ‘loitering’, ‘solicitation’ and ‘impersonation’, to extort money or sex from LGBTQI+ people, or to deny services to LGBTQI+ survivors of violence.

    How are LGBTQI+ organisations in Kenya working to change this?

    LGBTQ+ organisations in Kenya are working to change discriminatory laws and social norms by engaging in various advocacy and awareness-raising campaigns, providing legal aid, sharing security directives with our constituents and offering healthcare services to the LGBTQI+ community. These organisations are also working to create safe spaces for LGBTQI+ people to express themselves, network and access information.

    Some of the main issues on the LGBTQI+ agenda in Kenya include the repeal of discriminatory laws such as Penal Code sections 162(a), 162(c) and 165 and the promotion of laws and policies that are intersectional for LGBTQI+ people and organisations, including the Employment Act (2007), which recognises the rights of employees to basic conditions of employment, the Sexual Offences Act (2006), which outlaws all forms of sexual violence, and the National Gender and Equality Commission Act (2011), which spells out the National Gender Equality Commission’s function, which is to promote, monitor and facilitate gender equality and freedom from discrimination in the country’s laws at the national and county levels.

    Other issues include ending violence and discrimination against LGBTQI+ people, addressing the challenges faced by transgender people, and promoting education and awareness on issues affecting the LGBTQ+ community.

    Do you see your struggle as part of a bigger regional or global struggle?

    Yes, the Kenyan LGBTQI+ movement is part of the regional and global struggle to achieve various goals ratified in regional and international agreements such as Resolution 275 of the African Commission on Human and Peoples’ Rights – on protecting people against violence and other human rights violations on the basis of sexual orientation and gender identity – and reducing inequalities, as laid out in the Sustainable Development Goals.

    The Kenyan government has adopted legal and policy frameworks aimed at promoting gender equality and reducing discrimination based on sexual orientation and gender identity. Such initiatives include the Kenya Vision 2030, which highlights the government’s commitment to reducing income inequality through economic growth, job creation and social safety nets. In addition, Kenya has adopted several legal and policy frameworks aimed at promoting gender equality and reducing discrimination based on sexual orientation and gender identity.

    However, significant inequalities still exist, particularly in the wake of the pro-religious government that has been openly homophobic, inciting violence that threatens the lives of queer people. There is a lot of uncertainty regarding the new government’s impact on LGBTQI+ organising and funding, with concerns about the evangelisation of the state and state functions being used to dictate and define morality.

    Despite these challenges, the Kenyan LGBTQI+ movement remains resilient. We are mobilising together and collaborating with LGBTQI+ organisations in other countries in the region, including Nigeria, South Africa and Uganda, on issues such as the anti-homosexuality bills of Ghana, Nigeria and Uganda, that are now spreading to Kenya, Malawi, Zambia and many other African countries, and exchanging best practices.

    To continue doing this, we need various forms of support, including in raising awareness around the issues brought about by state and non-state-sponsored homophobia and flexible funding to respond to rising insecurity and mental health issues. We need our allies working on other thematic areas to highlight intersectionalities, showing how these regressive laws will affect sexual health and reproductive rights, children’s rights, the economy and more.

  • LATVIA: ‘The legalisation of same-sex civil partnerships has brought instant conservative backlash’

    CIVICUS speakswith Kaspars Zālītis, a human rights activist and board member of Mozaika,about therecent legalisation ofsame-sex civil partnerships in Latvia.

    Founded in 2006, Mozaika is the oldest LGBTQI+ civil society organisation (CSO) in Latvia. It promotes gender equality and anti-discrimination, raises awareness of diverse sexual orientations, gender identities and expressions of identity, promotes an understanding of diverse family models and their legal recognition and advocates for the harmonisation of Latvian laws with international standards.

     

    How significant is the legalisation of same-sex civil partnerships in Latvia?

    The Latvian parliament’s decision to legalise same-sex civil partnerships is historic, particularly considering the nine unsuccessful attempts that preceded it, spread over 24 years.

    The decision, which involves eight separate pieces of legislation granting various rights to people in same-sex civil partnerships, is the first step, and a very significant one, to pave the way for further recognition of LGBTQI+ human rights in Latvia. This victory stands as a collective achievement of LGBTQI+ organisations working in tandem with legislators and shows how cooperation between civil society and politicians can foster positive change.

    We have some wonderful politicians who facilitated the adoption of this package of laws, while we take the credit for having persuaded them to include LGBTQI+ issues on their agenda. Latvia’s first out LGBTQI+ president has also greatly contributed to a positive image and representation of the community.

    Have you experienced backlash?

    We’ve experienced instant conservative backlash and the issue is not yet settled. The civil partnership bill was passed by a small majority, and opposition parties asked the president not to promulgate it so they could have time to collect signatures for a referendum to repeal it.

    As of today, seven out of eight amended laws have already been signed and are set to come into force on 1 January 2024, allowing people in same-sex civil unions to enjoy some social security and tax benefits and hospital visiting rights. However, the crucial piece of legislation that would allow notaries to register same-sex civil partnerships has been put on hold while the opposition seeks to collect the more than 155,000 signatures needed to call a referendum.

    If called, the referendum will be binding if at least 50 per cent of the people who voted in the last election show up and vote. And if a majority of them rejects the law, it will be repealed.

    The Latvian LGBTQI+ community is hopeful that this move won’t succeed. Hopefully there will be no referendum, or not enough people will vote in it if there is one, or they will vote against the repeal. We hope the president will be able to promulgate the law so that it can come into force by mid-2024.

    How is Mozaika working to advance LGBTQI+ rights in Latvia?

    Mozaika is Latvia’s only LGBTQI+ advocacy organisation and for a long time it was the only LGBTQ+ organisation in Latvia. We held a monopoly on LGBTQ+ issues, which resulted in some issues being overlooked due to resource constraints. Thankfully, several new LGBTQI+ organisations have recently been established to bridge the gaps.

    Over 18 years, Mozaika has done a lot of work in advocacy, organising Pride events, conducting capacity development for civil society and providing training for the police and other professions. We have continuously engaged in conversations and raised awareness about LGBTQI+ issues among the public. Our efforts have led to a significant improvement in social attitudes toward LGBTQI+ people. In 2015, only nine per cent of people had a positive attitude, with around half neutral. A recent poll indicates a shift, with 25 per cent now expressing a positive attitude, while half maintain a neutral stance.

    How do you connect with the international LGBTQI+ movement, and what further support do you need?

    We cooperate closely with regional LGBTQI+ organisations to exchange best practices and learn from each other. One of the greatest examples of our cooperation is the annual Baltic Pride, rotating between the capitals of Estonia, Latvia and Lithuania, with Latvia’s capital Riga hosting the event in 2024. Mozaika is also a part of international umbrella organisations, including ILGA-Europe.

    Like every CSO, we struggle with funding sustainability to maintain our activities and ensure financial independence. Given that LGBTQI+ issues are still not popular among local funders, Latvian LGBTQI+ organisations face additional challenges. Even though we’ve achieved significant milestones, we urge the international community to keep monitoring the political situation in Latvia to avert a broader conservative backlash that could jeopardise our accomplishments.

    What are your next steps?

    The positive changes witnessed since our founding in 2006 reflect the extensive and strategic character of our work. We’re going to persist in litigation on various fronts, such as addressing inheritance rights, seeking recognition for same-sex couples who have married or registered abroad and advocating for the recognition of the children of same-sex families. We’ll also keep working to combat the rising trend of online hate speech and anti-LGBTQI+ propaganda.

  • LEBANON: ‘The humanitarian emergency is escalating as local communities struggle to support the displaced’

    CIVICUS discusses the crisis in Lebanon with Zaher Sahloul, co-founder of MedGlobal, a US-based civil society organisation (CSO) that provides relief to victims of war, disaster and displacement, and supports excluded communities worldwide.

    The humanitarian crisis in Lebanon has escalated significantly due to Israeli airstrikes, with the growing number of internally displaced people further straining an already fragile social services system. The health system is struggling to protect its facilities and staff in conflict zones, deal with trauma and provide essential services to displaced people. Alongside the domestic civil society response, an influx of external support, including from civil society, is proving essential to contain the crisis.

  • LEBANON: ‘The main culprits of the current crisis are bank owners and their greed for profit’

    Alaa KhorchidCIVICUS speaks about Lebanon’s ongoing financial crisis and the situation of depositors who are unable to access their savings with Alaa Khorchid, head of Depositors’ Outcry Association. 

    Depositors’ Outcry Association is a citizens’ group that formed in 2019 to support depositors’ attempts to withdraw their savings from Lebanese banks after their accounts were frozen in response to the financial crisis.

    Who is to blame for the situation Lebanese depositors are currently in?

    Lebanese depositors are desperate because their savings have been frozen, so they cannot withdraw them from banks. The way they are being mistreated is outrageous. If a depositor simply complains loudly, bank staff call the police on them. Even if they have a million dollars in the bank, depositors are unable to get medical treatment or pay for their kids’ university fees. Banks are only allowing them to withdraw US$140 a month, and are told if they have an issue with that limit, they can go ahead and file a lawsuit.

    The main culprits of the current crisis are bank owners, whose greed for profit got us to this point. What they did was a scam. They sent representatives abroad to convince Lebanese expatriates and foreigners to invest their money in Lebanese banks even though they knew we were heading into a crisis, while they smuggled their own money to France, the USA or the Gulf countries, where their investments amount to billions.

    Also responsible are state authorities, starting with Riad Salameh, governor of the Banque du Liban (BdL), Lebanon’s central bank. He should have regulated banks and held them accountable three years ago, but he didn’t.

    The government is responsible for not applying the laws on banks owners. They should have forced them to return depositors’ money out of their own pockets, but instead allowed them to smuggle their money abroad.

    The courts also have their share of responsibility, as they have thousands of cases pending, years after they’ve been filed. When cases filed by depositors in Lebanon reach a certain point they are shelved, while in France and the UK depositors managed to win their cases and get their money back.

    How have people organised to get their money back?

    People got together to fight collectively through organisations such asDepositors’ Outcry Association, which formed in 2019. Asan association, we have filed lawsuits against the BdL governor as well as the Association of Banks in Lebanon (ABL) and one bank, the Société Générale de Banque au Liban (SGBL), that smuggled US$1.2 billion out of the country. All these lawsuits have been pending for years because most of the judiciary has been bribed by the banks. 

    We also support depositors by mediating between them and the banks. For example, we have a list of cancer patients that we shared with the banks to try and convince them to release some of their funds to enable people to pay for treatment. Some banks, but not all, have responded positively.

    Some depositors have gone the banks to get their money by whatever means. One of them was Sali Hafiz, whom we supported. Hafiz asked for our help; a lawyer and members of the association went inside the bank with her and over 100 members were outside the bank to cheer for her and ensure her safety. We also helped a retired serviceman in Chtoura retrieve some of his savings from the bank. The association’s lawyer follows up with depositors, and when a depositor enters a bank to try to get some of their money back, we spread the word among our supporters so people gather outside in support and make it harder for others to enter the bank or for security to kick them out.

    It is worth noting that not all the organisations out there are supporting depositors. There are several organisations funded by ABL or SGBL, which obviously always side with the banks. The same applies to local media, which continues to accept money from the banks in the form of advertising. Depositors have had their accounts blocked for three years on the grounds that there is no money to give them back, but the banks still find money to pay for advertising.

    What needs to change so the situation can be resolved?

    We don’t have a functioning governance system. Banks have retained people’s savings for three years and the BdL has allowed this to continue, while the judiciary has protected the banks by withholding thousands of cases without reaching a conclusion. Many judges have a financial incentive to behave this way: they got bank loans worth millions of US dollars, which they are now repaying in Lebanese lira at a ridiculous exchange rate – they will end up paying 10 per cent of the original amount. This is a real scandal.

    The first change needed is to replace the BdL governor. He is the one behind the financial policies issued in 2017 and 2018. He brought cash in from correspondent banks and loaned it to the state without any guarantees. He spent US$100 billion without ever being held accountable. He considers himself above the law: he faces multiple lawsuits but he simply refuses to show up in court. 

    What are the implications of the recently passed Banking Secrecy Law?

    Parliament passed an amended Banking Secrecy Law that will lift secrecy on the bank accounts belonging to public officials and major bankers. We find the new law acceptable, although we hoped it would apply retroactively. As we told the head of the Parliament’s Finance and Budget Committee, we want to clarify what happened to the funds the political and financial elite transferred abroad after 17 October 2019, estimated at between US$13 and 15 billion. We want to understand who smuggled them and where to. But the new law won’t solve all the issues as there is no trust in the banking system.

    Another bill, the Capital Control Law, is set to be discussed in parliament, but there is still no final draft to comment on. Unfortunately, it is a bit too late to discuss capital controls, once capital has been massively smuggled abroad. Capital controls should have come a week, even a month into the crisis, but not after three years. Banks have smuggled the funds of the elite abroad because there were no legal impediments. The latest update we heard regarding the capital control law is that there will be no separate capital control law and it will be part of a larger recovery roadmap consisting of many changes in addition to capital control. We consider the potential recovery roadmap as a death sentence to depositors.

    What do you think about the conditions imposed by the International Monetary Fund (IMF) for approving a US$3 billion loan?

    According to the government, one of the IMF’s main conditions is to write off US$70 billion of depositors’ funds. If that is what the IMF wants in exchange for giving the state a US$3 billion loan, then of course we are against it. The IMF can’t ask the state and BdL to write off as much funds to ensure they get repaid for their loan. Some members of parliament promised us they would refuse to pass any legislation to that effect.

    But a reform requested by the IMF that is most important to us, and which ABL rejects, is the restructuring of banks. We hope that banks will be restructured and a timeline for repaying depositors will be released.

    At the beginning of the crisis, BdL had US$34 billion. Today, it has US$8 billion. Those billions are gone due to governance failures. If the same policies remain in place, nothing will work, regardless of whether the IMF gives the state a loan of US$3 or 10 billion. The first step to get out of this crisis should be to guarantee deposits, because the crisis wasn’t the depositors’ fault.

    In the past 15 years banks made over US$35 billion in profit, which was transferred abroad. We demand a forensic audit of each bank to find out which had profits, and how much. There are 40 banks in Lebanon. Why are they being treated as one? We should examine each separately.

  • LEBANON: ‘The world seems to be starting to forget Syrian refugees’

    Founded in 1968, Anera is a US-registered civil society organisation (CSO) dedicated to helping refugees and others hurt by conflicts in Jordan, Lebanon and Palestine (West Bank and Gaza). Working with partners on the ground, it mobilises resources for immediate emergency relief and for sustainable, long-term health, education and economic development.

    What is the situation of Syrian refugees in Lebanon?

    The human rights situation of Syrian refugees is getting worse by the minute. Freedom to work is almost non-existent. Right from the start Syrians were officially not allowed to work in most sectors, so they typically rely on informal jobs in services, agriculture or construction, where they get no insurance or benefits and are exposed to all kinds of labour abuses.

    While the situation for Syrian refugees in Lebanon has always been difficult, COVID-19 and the subsequent lockdown hit them very hard economically. As well as affecting host communities, the pandemic impacted on Syrian refugees with extra severity. Because Lebanese labour laws relegate refugees to the informal economy, they are dependent on gig work and daily jobs, usually in the service sectors. So they were particularly affected by the shutdown of the entertainment and food industries. 

    Because of school closures due to COVID-19 as well as ongoing teachers’ strikes to demand unpaid salaries, Syrian refugees have no place to study. Their freedom of movement has also been affected: everywhere in Lebanon there are notices warning that Syrians are only allowed to move around at certain hours. It’s starting to feel like full-blown segregation.

    It should be noted that Lebanon is already extremely segregated politically and religiously and has an extremely toxic and traumatic relationship with Syria. The presence of a large, mostly Sunni Muslim, Syrian community only adds to the political tension, to the point that violent clashes could erupt any time.

    With Lebanon’s ongoingeconomic crisis, the situation is hard for everyone, both locals and refugees. But on top of struggling economically, refugees are also facing growing xenophobia. Because Lebanese communities are struggling to put food on their tables, the narrative of refugees being a burden on society is becoming increasingly popular. When the Lebanese currency and politics were more stable, someone on an average salary could feed a whole middle-class family, but now they can barely get some petrol for their car. The idea that Syrian refugees are taking everything from Lebanese people is widespread, and reactions are becoming increasingly hostile and violent. When people see international funding going towards Syrian refugees, they get enraged.

    Many people think refugees are taking away potential aid that should go to Lebanese people. So on top of the livelihood challenges, refugees also face stigma, negativity and hostility, all of which affects their psyches. This isn’t happening just in Lebanon.Turkey is another example of this. The scenario is the same throughout the region: Syrian refugees are being blamed for everything.

    International factors such as fluctuations of the US dollar, political turmoil everywhere and the war in Ukraine are also affecting funding for Syrian refugees. So when it is most needed, funding is going to decrease. We have recently received a message that part of the assistance for Syrian refugees will be cancelled.

    Which are the most vulnerable groups of refugees, and why?

    Syrian women are for sure the most vulnerable among Syrian refugees, for several reasons. Their access to sexual and reproductive health centres, and to education, is truly low. There’s a general lack of knowledge and awareness of these issues and early marriage is frequent. In refugee camps such as those in Bekaa, Syrian women and girls are often exposed to gender-based and sexual violence. Those living in tent settlements know their chances of reporting sexual harassment and being heard are very, very low. Being a Syrian female refugee in Lebanon means dealing with toxicity and violence at all levels. 

    Children and young people are next in terms of their vulnerability. We are talking about early marriage, child labour and no prospects of accessing education or future employment opportunities. They have no access to proper medical attention either. If they get into an accident, they will wait in line for hours to be seen by a doctor. The most dangerous thing, however, is their lack of prospects. 

    What is Lebanon’s status regarding international refugee law?

    Lebanon hasn’t even signed the1951 Refugee Convention and is violating refugees’ rights by pushing them to ‘willingly’ go back to Syria. Lebanon should be bound by international law to protect these refugees, not to return them to unsafe territory.

    Unlike Turkey, the tents and places where Syrian refugees mostly live in Lebanon are privately owned. These private owners are Lebanese people profiting from refugees, who they make pay rent. They must pay electricity to have one bulb they can switch on and off inside the tents. They must be the only refugees on the planet who have to pay rent for the space they occupy!

    These rights violations are enabled by the fact that Lebanon has not signed the Refugee Convention. Syrian refugees are not officially considered refugees, which deprives them of their basic rights as refugees. This grey area is very dangerous.

    Refugees themselves aren’t aware of the laws that could protect them. They come from a country where they were never encouraged to inform themselves about and claim their basic human rights – which was one of the reasons they left. Upon arrival in Lebanon, they aren’t informed about their basic rights, so they are mostly unaware of them. And even if they knew what their rights are under international law, they have no guarantee these rights are going to be protected in Lebanon because nothing binds the Lebanese state to that law. 

    How does Anera promote the human rights of refugees?

    Anera is a humanitarian and development organisation. We are not a rights-based organisation, but we contribute to the protection of the basic human rights of refugees. Our role is to fill in the gaps left by the government to help refugees access education, work and healthcare, among other rights. 

    We work across several sectors, from livelihoods to food security. We try to create synergies between them to address several needs at once. We work with refugee families in both the north and south of Lebanon through agriculture support. We provide them with tools and technical education to grow and sell their produce. As for food security, we have programme in partnership with the United Nations Office for the Coordination of Humanitarian Affairs in Lebanon that provides hundreds of families with regular food parcels and cash assistance so they can purchase what they need. 

    One of our biggest programmes distributes free medicine. Each year we help mobilise medical supply shipments worth millions of dollars from international partners around the world and distribute them to refugee centres.

    We work to prevent child marriage through a cash transfer programme, using cash assistance as an incentive for families to keep their girls in school. And throughout our operations, we make sure all our partners abide by all humanitarian guidelines and standards when it comes to child protection and protection from sexual exploitation and abuse. Towards that end, we offer training and constantly do monitoring work. While we don’t directly provide safe spaces for victims and survivors, we work closely with other CSOs and grassroots groups that do so.

    It is worth mentioning that we always take the community aspect into consideration so as to balance things. For instance, our food programme also distributes food to the Lebanese population. 

    What challenges do you face?

    Thepolitical situation in Lebanon is very challenging. The fact that the government often has a hostile attitude towards Syrian refugees and is trying to return them to unsafe territories is a big obstacle. Government corruption also has a negative impact on our work with refugee communities, as it affects us on an organisational and funding level. 

    We also face challenges coming from the refugee communities where we work. An example of conflict happened recently in the context of a project on child marriage that we implemented due to the increase in child marriages among Syrian refugees in Lebanon. Because of the economic crisis, more families are encouraged to marry off their daughters at a younger age. Our project faced pushback by the refugees themselves. It seems that toxic coping mechanisms such as child marriage are easier for them in the short term.

    What support do organisations working with Syrian refugees need from the international community?

    Everyone in Lebanon is vulnerable right now: Syrian refugees, Palestinian refugees and Lebanese people. The situation of Syrian refugees is stagnant right now, but everything else is worsening. 

    What’s needed is more advocacy and more funding for all communities to balance the help provided and avoid conflict. We need to calm things down and bring stability. We could also use some technical support at a government level when it comes to refugee management.

    The narrative around Syrian refugees needs to change so they are not viewed as a burden but as human beings in need of help.

    The question all Syrian refugees ask themselves is what’s next. If the situation in Syria doesn’t get better and Syrians are forced to leave Lebanon, they will try to get to Europe, or anywhere else offering some kind of opportunity. We need more global engagement to determine what will happen next. Collective work is vital.

    The world seems to be starting to forget these refugees. The topic trended on social media for a while at the beginning but then attention was captured by floods in Nigeria, war in Ukraine andrepression in Iran. No one is talking about Syrian refugees anymore.

    So much is going on in the planet. There are so many crises erupting all at once. But the fact that new crises are happening doesn’t mean the situation of Syrian refugees has improved and the issue disappeared.

    The international community must remember Syrian refugees and the Syrian crisis. Human rights defenders must advocate for the rights of Syrian refugees – because if they don’t, who will?

  • LESOTHO: ‘We must work hand in hand to promote democracy and hold our leaders accountable’

    LESOTHO ELECTIONCIVICUS speaks about the 7 October election in Lesotho with Libakiso Matlho, executive director of Women and Law in Southern Africa Research and Education Trust-Lesotho (WLSA). 

    WLSA is a civil society organisation (CSO) based in Southern Africa and working to promote women’s leadership and eradicate gender-based violence. It contributed to the recent election process by providing voter education. 

    How would you assess the recent election   in  Lesotho in terms of its   transparency   and fairness?

    Looking at the overall proceedings I would say they were transparent and fair. The Independent Electoral Commission (IEC) did a good job. All candidates were given a  platform to share their manifestos as well as their campaigning approaches at different  levels, including through the media  and public gatherings. Independent candidates did not face any threats. Nobody experienced any restrictions in terms of the exercise of their right to reach out to members of the community and potential voters. Voters were free to attend candidates’ forums and political party rallies.

    There were two major challenges, however. One concerned voter civic education, which started a bit later than normal and therefore lasted only about three or four weeks, so it was not as broad as should have been.

     The other challenge had to do with the dynamics of the campaign, which was affected by conflict among candidates during public forums. Some participants invited to take part in the discussions also caused chaos. This  unfortunately led to a few discussions being cancelled before all the candidates could present their manifestos in some areas, especially those that were marked as hotspots.

    Do you foresee any election-related conflict?

    It is hard to predict, but this election seems to have been a bit different from others in the past, which makes me wonder.

    Around 65 political parties and 2,560 candidates competed in the 7 October election. For a small country with a population of two million, that is a huge number of people. And many might find it difficult to accept the outcome if things do not happen according to their expectations. 

    The election itself was peaceful, but political tension mounted as votes were counted over the following days. The results were announced on 11 October: the opposition Revolution for Prosperity party came first but was short of a majority, with 56 of 120 seats, while the incumbent All Basotho Convention party (ABC) came second. It is not clear whether ABC will contest the results and its supporters will take to the streets in protest. If this happens, clashes with rival parties might occur and security force repression could follow.

    I would not rule conflict out but rather consider it as likely to happen as not.

    Do you think the failure to pass constitutional reforms had an impact on the election results?

    I think the failure to pass the Omnibus Constitutional Bill, which had been years in the making, probably had a strong impact on the electoral process, and will definitely have an impact on what happens next.

    The bill sought to amend key provisions regarding political parties, candidate selection, floor-crossing in parliament, the appointment of senior officials and the role of the prime minister, whose removal would require a two-thirds majority. In May, all major parties in parliament committed to pass the bill by the end of June, but disagreements held it up much longer.

    One of the key issues of contention concerned the electoral law, which only allows party leaders to submit a proportional representation party list. With the current system, 80 members of parliament are elected in constituencies and 40 are elected through a proportional division of votes. Small parties are negatively affected because to get some proportional representation seats, they are forced to come together into a list with larger parties, and if they are unable to merge with other parties they are left out.

    Another key issue wasthe politicisation of the security sector, which contributes to political instability. The reforms proposed a way to deal with this.

    The reforms were eventually passed as parliament was reconvened for an urgent session but, following a series of legal challenges, the Constitutional Court declared them null and void at the last minute before the election.

    The failure to pass the reforms will also contribute to continuing difficulties in maintaining coalition governments. Lesotho has had coalition governments since 2012 that have never served a full five-year term due to conflicts that led to their dissolution. In 2017 ABC formed a six-party coalition government, but because of internal conflict Prime Minister Tom Thabane was forced to resign in 2020 and was replaced by Moeketsi Majoro.

    Coalitions have not made for stable and effective governments. The coalition-forming process also confuses voters because ideologies are not a big factor when putting them together. This makes voters a bit sceptical that their parties will remain faithful to their mandate.

    These were some of the issues the reform was meant to address, but unfortunately they remain unaddressed to this day.

    What did voters expect from the election?

    One of the expectations voters place on political parties is that they will work on improving service delivery. This includes fixing infrastructure and providing access to water and electricity, among other things. Lesotho also has high rates of unemployment and widespread problems of gender-based violence and femicides, as well as high crime rates that people hope will be addressed by the new government.

    Basotho people are not happy with the way the public sector has been managed over the years. Employment is mostly driven by nepotism and political affinities. People are uneasy because political parties on the campaign trail are quick to promise they will fix these things but once in power they fail to deliver.

    We have also seen a lot of instability in a key industry, the textile industry, with COVID-19 only making things worse. People were already dealing with bad working conditions and when the pandemic hit many were fired unfairly. This led to worker strikes and has negatively affected foreign investment. Elected leaders need to find means of retaining foreign investment while ensuring good work conditions.

    How can the international community support civil society’s work to strengthen democracy in Lesotho?

    During the election, civil society faced the challenge that almost all funding for civic education came from the IEC, that is, from the government budget. This could potentially compromise civil society’s watchdog role. Additionally, these funds are never sufficient to allow civil society to conduct its work thoroughly.

    The international community should support capacity building so that civil society can conduct robust advocacy during and after the election period. Collaboration between international and local CSOs is also important. For the recent election local CSOs took on voter education alone, without any involvement by international CSOs. We must work hand in hand to promote democracy in our countries and hold our leaders accountable.
