KOSOVO: ‘Civil society plays a crucial role in maintaining communication in difficult times’
CIVICUS speaks with Milica Andric Rakic, project manager at New Social Initiative (NSI), about intensifying inter-ethnic violence and deteriorating civic space in Kosovo.NSI is a civil society organisation (CSO) that seeks to empower non-majority communities to participate in Kosovo’s social and institutional life and increase trust among communities by helping people to deal with past events and promoting the normalisation of relations between Kosovo and Serbia.
What’s the current human rights and security situation in Kosovo?
The situation in Kosovo is highly volatile. Kosovo declared independence from Serbia in 2008, but to this day Serbia doesn’t recognise Kosovo as an independent state and continues to claim it as an autonomous province of Serbia. The longstanding impasse in negotiations is straining inter-ethnic relations within Kosovo, between Kosovar Serbian and Albanian communities. Unlike past tensions that eventually subsided, the security situation has steadily worsened over the past two years.
Human rights are generally upheld in Kosovo, although rather selectively. For example, successive governments have refused to implement constitutional court decisions regarding the ownership of an Orthodox monastery’s extensive land and the establishment of an association of Serbian-majority municipalities, two longstanding demands of the Kosovo Serb community. There have been break-ins at Orthodox churches and police arrests of Kosovar Serbs without a prosecutor’s order. While the overall human rights situation isn’t bad, there are specific areas where the government fails to respect the law and court orders.
What was the significance ofviolence in Banjska on 24 September?
The attack occurred in the context of increased tensions in north Kosovo, which included the resignations of thousands of Kosovar Serbs working in the public sector, including the mayors of four municipalities. On 24 September 2023, Serb militants carried out an attack against the Kosovo police in the village of Banjska, in north Kosovo.
North Kosovo’s population is 90 per cent Serbian but its police force is mainly Albanian, which leads to a level of mistrust and tensions that pose a threat of violence. Those involved in the attack had a secessionist political agenda. While secession isn’t an imminent threat, it’s definitely a motivating factor, and many on-the-ground processes have had a disintegrative effect.
What role is civil society playing in normalising relations between Serbia and Kosovo?
It seems that civil society has been the only healthy player in Serbian-Albanian relations. It has played a crucial role in maintaining communication in difficult times. We’ve acted as mediators between the international community and Kosovar and Serbian governments, trying to understand the perspectives of all sides.
From 2011 to 2017, effective dialogue and integrative processes were underway, albeit with slow implementation and numerous challenges. The European Union (EU) played a special facilitating role in the negotiations, motivating both sides through the promise of potential EU membership.
But now the only trend we are witnessing is towards disintegration. The lack of proper dialogue over the past two years indicates a need for a political change on at least one side to move the process forward.
How is NSI working towards peacebuilding in Kosovo?
As an umbrella organisation, we engage Kosovars in inter-community dialogue through various projects. One initiative promotes reconciliation by creating connections and fostering cooperation among young Kosovar Serbs and Albanians. As there are limited organic opportunities for them to meet, the responsibility for creating personal inter-ethnic ties lies largely on the shoulders of local CSOs. If a Kosovar Serbian and an Albanian know each other, there’s an 80 per cent probability that they’ve met at a civil society activity.
Another programme focuses on multiculturalism and bilingualism. Albanian and Serbian are both official languages in Kosovo, and our goal is to increase social acceptance and promote the learning of both. For almost 40 years we haven’t been taught each other’s language in school, which has led to a significant linguistic gap. It should be noted that Albanian and Serbian are very different languages and can both be challenging to learn.
We have a transitional justice programme, where we collaborate with associations that represent various categories of war victims, including families of missing people and internally displaced people. This regional project involves Kosovo, North Macedonia and Serbia. We support these associations to expand their work from truth-seeking to regional reconciliation, simultaneously enhancing their financial sustainability by securing funding for new projects. We have also participated and proposed policies in the Ministry of Justice’s working group to draft a national strategy for transitional justice.
Moreover, we’ve organised diverse artistic activities, including a joint photo exhibition, ‘All Our Tears’, in which photographers captured images of war victims in Kosovo, North Macedonia and Serbia. The exhibition was showcased in cities including Kosovo’s capital Prishtina, Serbia’s capital Belgrade and at the Council of Europe in Strasbourg. Additionally, we have supported regional theatre projects that raise transitional justice issues through performance.
What challenges do you face in doing your work, and what further support do you need?
There has been a significant narrowing of civic space in Kosovo, marked by delegitimising campaigns targeting CSOs, political opponents and critics of the government, mainly through online harassment. Our organisation, along with some staff, has faced such attacks.
Engaging with the government on policy matters has been challenging, as our recommendations regarding the Kosovar Serb community are often ignored or poorly implemented. It’s evident that the government’s outreach to the Kosovar Serb community is influenced more by international pressure than a genuine willingness to engage. The contacts we maintain with government representatives are often facilitated by outside parties, either from embassies or European think tanks that hold roundtable discussions where we can directly discuss issues of the local Serb community with the government.
Kosovar civil society has sufficient funding opportunities. What we really need is support to maintain our relevance, especially when governments attempt to exclude CSOs from political decision-making processes. Whenever there’s an attempt to narrow civic space, the international community should demonstrate that it’s willing to support local CSOs, signalling their importance and thereby putting pressure on the government to take them into consideration.

LATVIA: ‘The legalisation of same-sex civil partnerships has brought instant conservative backlash’

CIVICUS speakswith Kaspars Zālītis, a human rights activist and board member of Mozaika,about therecent legalisation ofsame-sex civil partnerships in Latvia.
Founded in 2006, Mozaika is the oldest LGBTQI+ civil society organisation (CSO) in Latvia. It promotes gender equality and anti-discrimination, raises awareness of diverse sexual orientations, gender identities and expressions of identity, promotes an understanding of diverse family models and their legal recognition and advocates for the harmonisation of Latvian laws with international standards.
How significant is the legalisation of same-sex civil partnerships in Latvia?
The Latvian parliament’s decision to legalise same-sex civil partnerships is historic, particularly considering the nine unsuccessful attempts that preceded it, spread over 24 years.
The decision, which involves eight separate pieces of legislation granting various rights to people in same-sex civil partnerships, is the first step, and a very significant one, to pave the way for further recognition of LGBTQI+ human rights in Latvia. This victory stands as a collective achievement of LGBTQI+ organisations working in tandem with legislators and shows how cooperation between civil society and politicians can foster positive change.
We have some wonderful politicians who facilitated the adoption of this package of laws, while we take the credit for having persuaded them to include LGBTQI+ issues on their agenda. Latvia’s first out LGBTQI+ president has also greatly contributed to a positive image and representation of the community.
Have you experienced backlash?
We’ve experienced instant conservative backlash and the issue is not yet settled. The civil partnership bill was passed by a small majority, and opposition parties asked the president not to promulgate it so they could have time to collect signatures for a referendum to repeal it.
As of today, seven out of eight amended laws have already been signed and are set to come into force on 1 January 2024, allowing people in same-sex civil unions to enjoy some social security and tax benefits and hospital visiting rights. However, the crucial piece of legislation that would allow notaries to register same-sex civil partnerships has been put on hold while the opposition seeks to collect the more than 155,000 signatures needed to call a referendum.
If called, the referendum will be binding if at least 50 per cent of the people who voted in the last election show up and vote. And if a majority of them rejects the law, it will be repealed.
The Latvian LGBTQI+ community is hopeful that this move won’t succeed. Hopefully there will be no referendum, or not enough people will vote in it if there is one, or they will vote against the repeal. We hope the president will be able to promulgate the law so that it can come into force by mid-2024.
How is Mozaika working to advance LGBTQI+ rights in Latvia?
Mozaika is Latvia’s only LGBTQI+ advocacy organisation and for a long time it was the only LGBTQ+ organisation in Latvia. We held a monopoly on LGBTQ+ issues, which resulted in some issues being overlooked due to resource constraints. Thankfully, several new LGBTQI+ organisations have recently been established to bridge the gaps.
Over 18 years, Mozaika has done a lot of work in advocacy, organising Pride events, conducting capacity development for civil society and providing training for the police and other professions. We have continuously engaged in conversations and raised awareness about LGBTQI+ issues among the public. Our efforts have led to a significant improvement in social attitudes toward LGBTQI+ people. In 2015, only nine per cent of people had a positive attitude, with around half neutral. A recent poll indicates a shift, with 25 per cent now expressing a positive attitude, while half maintain a neutral stance.
How do you connect with the international LGBTQI+ movement, and what further support do you need?
We cooperate closely with regional LGBTQI+ organisations to exchange best practices and learn from each other. One of the greatest examples of our cooperation is the annual Baltic Pride, rotating between the capitals of Estonia, Latvia and Lithuania, with Latvia’s capital Riga hosting the event in 2024. Mozaika is also a part of international umbrella organisations, including ILGA-Europe.
Like every CSO, we struggle with funding sustainability to maintain our activities and ensure financial independence. Given that LGBTQI+ issues are still not popular among local funders, Latvian LGBTQI+ organisations face additional challenges. Even though we’ve achieved significant milestones, we urge the international community to keep monitoring the political situation in Latvia to avert a broader conservative backlash that could jeopardise our accomplishments.
What are your next steps?
The positive changes witnessed since our founding in 2006 reflect the extensive and strategic character of our work. We’re going to persist in litigation on various fronts, such as addressing inheritance rights, seeking recognition for same-sex couples who have married or registered abroad and advocating for the recognition of the children of same-sex families. We’ll also keep working to combat the rising trend of online hate speech and anti-LGBTQI+ propaganda.

LITHUANIA: ‘Civil society must humanise the public narrative around irregular migration’
CIVICUS speaks about a new law enabling pushbacks of asylum seekers at the Belarus-Lithuania border withMėta Adutavičiūtė, head of Advocacy at the Human Rights Monitoring Institute (HRMI).Established in 2003, HRMI is a Lithuanian human rights civil society organisation (CSO) thatadvocates for national laws and policies consistent with the state’s international human rights obligations and works to ensure the effective enjoyment of human rights.
What are the main points of the new legislation allowing for the pushback of asylum seekers?
The amended Law on State Border and its Protection, passed in April 2023, recognises and enables the practice that began in August 2021 of discouraging people from attempting to cross the border at non-designated places and returning them to Belarus once they have crossed the border into Lithuanian territory.
The amended law provides legal ground for pushbacks without the need to declare a state of emergency. Now pushbacks can be carried out on the government’s decision any time it considers there is an extraordinary situation caused by a ‘mass influx of aliens’. A novelty introduced by the law are the civilian volunteer units to support border guards. Both are allowed, under certain circumstances, to use coercive measures. The State Border Guard Service has recently announced a call for this volunteer service.
What are the issues around pushbacks?
According to both Lithuanian and international refugee law, unlawful entry should not be penalised when a person is eligible to request asylum in a country. However, pushbacks are being carried out with regard to people who might have genuine grounds for asylum, such as those coming from Afghanistan and Syria.
Under the amended law, the State Border Guard Service should perform an individualised assessment to determine whether a person is fleeing persecution and is in fact a refugee as defined in the 1951 Refugee Convention. However, the procedure for such an assessment hasn’t yet been established, and there are good reasons to doubt that border guards can carry out an assessment properly. In our opinion, the decision on whether a person has grounds to request protection should be made by the migration department, while state border officers should only find out whether a person intends to seek asylum and register asylum applications.
Our preliminary assessment is that although the provisions of the law shouldn’t apply to people fleeing military aggression, armed conflict or persecution or trying to enter Lithuania for humanitarian reasons, people continue to be pushed back without an individualised assessment of their circumstances and without any human rights safeguards being applied.
How has HRMI advocated against the new law?
HRMI submitted comments to the draft law and alternative proposals, urging lawmakers to refrain from legalising pushback practices and instead ensure access to asylum procedures for all people irrespective of their means of entry.
We also continue advocating for the rights of migrants and asylum seekers by raising public awareness on the current disturbing situation.
Our next steps are to closely monitor the implementation of the new legislation and prepare a comprehensive report based on interviews with asylum seekers. Meanwhile, our colleagues and volunteers from Sienos Grupė provide humanitarian aid to migrants and asylum seekers stuck at the border.
Additionally, HRMI has a strategic litigation programme that includes 17 cases. The purpose of this programme is to seek justice for asylum applicants and call for judicial review of the most pressing legal issues in the Lithuanian migration and asylum system.
What obstacles does Lithuanian civil society working on migration face?
Even though there are no legal restrictions on the work of CSOs helping migrants and refugees, one of our largest challenges is that the public generally approves of restrictive government policies and practices and only a minority support a human rights-based approach in managing increased irregular migration. The government’s strategy of deterrence, constantly picturing migrants and asylum seekers as a threat, has largely influenced the public. Opinion polls conducted in 2021 indicated growing negative attitudes towards migrants and refugees. This is why civil society’s advocacy efforts must focus not only on laws and policies, but also on humanising the public narrative around irregular migration.
Moreover, lack of information makes it difficult for CSOs to assess the full implications of this law for asylum seekers. Official statistics only include the people who were pushed back on specific days, and there are no statistics available of people who were let in and provided with the opportunity to lodge asylum applications. We also don’t have access to demographic data such as countries of origin, gender, age and other individual characteristics that could allow us to identify the specific vulnerabilities of people who were pushed back.
How has the international community reacted to the new policy?
Many international organisations and media outlets immediately contacted us seeking information and requesting our assessment of the situation. A strong statement came from the Human Rights Commissioner of the Council of Europe, Dunja Mijatović, who called on the Lithuanian parliament to reject the amendments and ensure that the legislative process is guided by human rights standards with a robust, human rights-compliant and protection-oriented legal framework. The law was also criticised by the United Nations High Commissioner for Refugees. In contrast, the reaction from the European Union has been lacking.
Overall, however, we are grateful for the crucial international support we have received in our advocacy efforts, as well as for legal advice provided by our allies. It is very important they remain engaged and continue monitoring the developments on the border.

MIGRANTS’ RIGHTS: ‘Europe instrumentalises human suffering to deter migration’
CIVICUS speaks about the situation of migrants and refugees in Greece with Maya Thomas-Davis, an Advocacy and Communications Officer at the Legal Centre Lesvos AMKE, a Greek civil society organisation that provides free legal information and assistance to migrants who arrive by sea to Lesvos, where the Centre is based. The Legal Centre also documents violations of migrants’ rights, advocates for safe and legal migration routes and engages in advocacy and strategic litigation to hold the Greek government, member states of the European Union (EU) and European institutions accountable for their treatment of migrants.

What kind of work does the Legal Centre Lesvos do, and how have you managed under the pandemic?
The Legal Centre Lesvos (LCL) is a civil non-profit legal and political organisation based on principles of solidarity, not charity. Since August 2016, it has provided access to legal information, assistance and representation to migrants arriving by sea on the Greek island of Lesvos. LCL also works towards collective justice and structural change as part of movements resisting Europe’s border imperialism on many fronts, including through advocacy and strategic litigation. LCL was founded following the March 2016 EU-Turkey statement, an agreement of questionable legality through which the European Union turned people seeking freedom, safety and dignity into commodities and bargaining chips: agreeing to pay 6 billion euros to Erdogan’s authoritarian regime in exchange for Turkey acting as a border guard to fortress Europe. This ‘deal’ transformed the island of Lesvos into a site of indefinite imprisonment for migrants. LCL provides access to legal information and assistance in solidarity with migrants trapped here, without losing sight of the fact that migration to Europe is intimately connected with the continent’s imperialist past and present and the interests of global capitalism; that the brutal violations witnessed here are always political choices; and that the people most affected are the most important political actors in challenging and resisting this.
LCL has an open-door policy, meaning that nobody is turned away or refused legal information or assistance because their case is not ‘strong’ enough, or is unsuitable for strategic litigation. We maintain this position because we believe that, as a bare minimum, everyone has the right to understand the legal framework they are subject to, particularly in the context of asylum law, where consequences can be a matter of life or death.
To facilitate access to information, prior to the introduction of COVID-19 restrictions LCL had been running regular group information sessions about asylum procedures, in multiple languages. This is certainly one aspect of our work where the pandemic has created difficulties. In Lesvos lockdown measures have been in place since March 2020, varying in degrees of intensity. Group information sessions have been impossible due to limitations on office capacity mandated by restrictions. We have managed to keep the open-door policy in place with strict appointment schedules, with many of us working from home at least some of the time, and we are trying to continue to facilitate broader access to information through other means, such as through updates in multiple languages on our website and social media.
How did the situation of migrants and refugees evolve in 2020 as a result of the pandemic?
The Greek state’s unlawful suspension of the right to asylum on 1 March 2020 and its violent border fortification – with the EU praising Greece as Europe’s ‘shield’ and The European Border and Coast Guard Agency, also known as Frontex, providing increased material support – coincided with the escalation of the COVID-19 pandemic in Europe. Although the EU has been perpetrating violence against migrants at its borders for many years, including through pushbacks, it seems Greek and EU officials believed the pandemic would provide the perfect cover to escalate their attack on migrants in the Aegean, with complete impunity.
Since March 2020, the official number of arrivals by sea to Greece has drastically dropped by a reported 85 per cent as compared to 2019. In the same timeframe, numerous reports and investigations have revealed a systematic practice of collective expulsions on the part of Greek authorities, carried out through a consistent modus operandi, with Frontex’s documented complicity. In every account shared with LCL by pushback survivors, Greek authorities have summarily expelled migrants from Greek territory without registering arrival or facilitating access to asylum procedures. Whether in the middle of the sea or following a landing on an Aegean island, Greek authorities forcibly transfer migrants towards Turkish waters before abandoning them at sea on motorless, unseaworthy dinghies or life rafts, with absolute disregard for whether they live or die. Despite numerous reports, statements, investigations and denunciations of this ongoing attack against migrants, pushbacks at the Aegean Sea border continue with impunity, functioning as an unofficial implementation of the EU-Turkey deal’s objectives while the Turkish border remains officially closed.
Meanwhile in Lesvos, pandemic-related restrictions have only compounded the situation of police violence, discrimination and effective mass detention for migrants. COVID-19-related restrictions, including curfews and the requirement to carry a justification for movement, have been applied in an unjustifiably discriminatory manner. Recently, on 15 February 2021, for example, the curfew for the general population of Lesvos was lifted from 6pm to 9pm, yet for migrants living in the camp a separate regime of restrictions remains in place: people are subject to a more stringent curfew starting at 5pm and only one family member can leave the camp once a week except for medical or legal appointments. Even with written justification, permission to leave the camp is often arbitrarily denied. The police disproportionately target racialised people in checking documents and justifications for movement as well as in imposing fines.
Meanwhile changes in the operations of the Regional Asylum Office and the European Asylum Support Office (EASO) in Lesvos, which had been conducting remote interviews with applicants for international protection, have led to further procedural violations. These include obstacles in access to legal aid at first instance and to file appeals within deadlines due to pandemic-related movement restrictions and restricted access to EASO offices; failure to ensure the requisite confidentiality of interviews due to remote interviews via telephone or video being held in inadequate facilities; and inability to comprehensively present grounds for applications due to practical and technical disruptions of asylum interviews.
As for the sanitary situation, the state has systematically failed to evacuate individuals at risk from overcrowded, unsanitary camps in Lesvos, where distancing measures are impossible. Like the previous Moria camp, which burned down in September 2020, the new reception and identification centre in Mavrovouni/Karatepe – widely known as ‘Moria 2.0’ – is not fit for human habitation. As if conditions of inadequate shelter, healthcare, privacy, food, electricity, running water, hot showers, toilets and other hygiene facilities were not bad enough, since 1926 and until its hasty transformation into a camp in September 2020, the site of Moria 2.0 had been a military firing range, and the Greek government has admitted that a high concentration of lead has been found in samples taken from the site. Lead poisoning causes organ damage, cancer and developmental harm in foetuses and children. There is no level of lead exposure known to be without harmful effects. In such conditions, the Greek state’s failure to transfer people who are disproportionately exposed to danger and death in the inhumane conditions of Moria 2.0 to appropriate living conditions amounts to an attack on migrants’ lives.
Which would you say are main rights violations that migrants and refugees face in Lesvos?
That hundreds of people have been, and continue to be, forcibly transferred then abandoned in the middle of the sea by Greek authorities without means to call for rescue, on unseaworthy, motorless dinghies and life rafts, constitutes a spectacular form of state violence against migrants. Beyond rights violations, LCL’s position is that the constituent elements of the consistent modus operandi of collective expulsions in the Aegean, along with the widespread and systematic nature of this attack, amount to crimes against humanity. The practice of systematic pushbacks with impunity reveals the extent to which fortress Europe treats migrants’ lives as disposable, in a manner that has historically accompanied the commission of atrocity crimes.
The same disregard for migrants’ lives is inherent in the conditions in camps and detention centres people are forced to endure in Lesvos, which are violations of the right to freedom from inhumane and degrading treatment and torture, the rights to liberty and security, to private and family life, to effective remedy, to freedom from discrimination and to life. It is inherent in people being forced to wait in limbo for years, cut off from family, friends, community and purpose, without being able to move forwards or backwards. It is inherent in the EU increasingly prioritising and funding mass effective detention of migrants, through ‘hotspot’ systems, accelerated border procedures, forcible deportations, border militarisation and border externalisation through deals of questionable legality with third countries and by making aid and other financial packages conditional on border fortification.
While the violence of pushbacks in the Aegean is scandalous and should be treated as such, it is by no means an aberration from the logic of Europe’s border regime, which instrumentalises human suffering for the purpose of deterring migration, at any cost. Even if due process and reception standards mandated by the Common European Asylum System were complied with in Lesvos, many people would still be excluded, and the system would remain violent and fundamentally insufficient to secure the conditions of human flourishing that everyone deserves. For this reason, while the LCL will continue to document, denounce and seek redress for the systematic rights violations in Lesvos, we are conscious that we must simultaneously organise for systemic change: Europe’s human rights framework cannot fail people it was never designed to protect.
What is your position regarding refugee protests over living conditions in camps and blockages of asylum requests?
LCL has always acted and organised in solidarity with migrant-led resistance. Over the years this has taken many forms, including protests, hunger strikes, collective publications, assemblies and occupations. The state has responded with attempts to collectively punish organised resistance by migrants in Lesvos. A case in point is that of the Moria 35 a few years ago. But there are many more recent examples of this. Of course, such resistance can be understood as an exercise of human rights such as the rights to the freedoms of association, peaceful assembly and expression, and as a legal organisation, this is always one way of viewing and supporting this kind of action. However, in Lesvos – where rights are systematically violated with complete impunity, where conditions of misery are deliberately imposed, where the situation always seems to get progressively worse just when it already seemed as bad as could be imagined – organised resistance is also in many ways often the only remaining option.
What kind of support would you need from international civil society to continue doing your work?
Over the past year, the Greek state brought in new legislation on the registration of civil society organisations, introducing onerous, complex registration and certification requirements that present unnecessary, disproportionate barriers for organisations working in solidarity with migrants in Greece. This will certainly make the work of LCL harder as, of course, it is designed to. The Expert Council on NGO Law of the Conference of INGOs of the Council of Europe has already expressed its concerns on these new requirements, and further challenges to these measures would be a welcome form of support from international civil society.
In general, international support and solidarity is needed in the struggle against the increasingly hostile environment for migrants and those working in solidarity with migrants in Greece. Far-right disinformation campaigns making allegations of criminality against migrants and migrant solidarity organisations are increasingly reflected in Greek state practice, such as in the Greek police’s identification of four human rights and migrant solidarity groups in an investigation that accuses them of espionage, forming and membership of a criminal organisation; the Greek state’s systematic prosecution of migrants for facilitation of illegal entry/exit; its perverse decision to prosecute the father of a six-year-old child who tragically drowned in a shipwreck near Samos in November 2020 for endangering his son’s life; and its decision to bring criminal charges against a woman who set herself on fire in desperation in Moria 2.0 in February 2021. Such measures to frame migrants and those who act in solidarity with them as criminals and threats to the nation is a deliberate and effective tactic to obscure the fact that it is states that possess the monopoly on violence and to distract from their systematic violations of migrants’ rights.
More broadly, it is clear from the legislative proposals contained in the ‘new’ EU migration and asylum pact that the EU will attempt to roll out the model that has been tested in the laboratory of Lesvos and the other Greek ‘hotspot’ islands, across Europe’s external borders – including detention on arrival; accelerated border procedures in detention based on nationality and asylum recognition rates; deportation sponsorship as a form of ‘solidarity’ between member states; and expanded use of migrants’ personal and biometric data. A new ‘controlled’ camp is set to be constructed in Lesvos this year, in a location that is a known forest fire danger zone and is intentionally remote. Internationalist solidarity will always be our best weapon to organise resistance from below to all these measures.

MIGRATION: ‘The spread of COVID-19 is no excuse to confront vulnerable people with more violence’
CIVICUS speaks with Maddalena Avon, project coordinator at the Centre for Peace Studies (CPS) about the situation of migrants and refugees in Europe under the pandemic and the ways in which civil society is responding to increasing border pushbacks from hostile European governments.
CPS is a civil society organisation (CSO) that promotes non-violence and social change through education, research, advocacy, campaigning and activism. Founded in 1996, it works in three areas: asylum, integration and human security; peace education and non-violence affirmation; and combating inequalities. CPS is an active member of the Border Violence Monitoring Network, an independent network of CSOs based mostly in the Balkans and Greece, monitoring human rights violations at the external borders of the European Union and advocating to stop the violence against people on the move.

What have been the key trends in migration in Europe, and specifically in the Balkans, under the pandemic?
The landscape of asylum access has changed drastically since pandemic restrictions came into force. The Border Violence Monitoring Network (BVMN) had already reported on asylum as an eroded set of rights, but due process for international protection claims has been further challenged in recent months under the health emergency.
Firstly, persistent pushbacks from borders continue to deny people access to claim international protection, with states performing collective expulsion. Secondly, government decisions to pause or close asylum offices with no effective alternative or remedy have placed refugees and other migrants in an effective limbo and at risk of pushback. Accordingly, the development of COVID-19 measures has allowed countries such as Croatia, Greece and Hungary to further restrict internationally mandated access to protection.
In the midst of the escalating COVID-19 outbreak, the European Union (EU) launched its Joint Action Plan for Human Rights. However, the intention of this communication exhibits acute divergence from the reality on the ground. Most notably, violations of fundamental rights continue by EU member states and non-EU countries that have various EU agreements on migration, asylum and border security, alongside funded camp systems. Rather than assisting vulnerable communities in this precarious period, policy and guidance have allowed the strengthening of borders across a majority of member states to erode further the rights to asylum, due process and humane treatment.
According to a recent report by the BVMN, in March and April 2020 Slovenia saw a decrease in the number of irregular border crossings compared to the first two months of 2021 and the same period in 2019, and this was reflected in the much lower number of people detained at police stations due to irregular border crossings. The trend of collective expulsions to Croatia, however, remained consistently high. In early 2020, during the COVID-19 outbreak and subsequent restrictions, Slovenia continued to systematically deny asylum rights and used its readmission agreement with Croatia – which allows it to hand people over to the Croatian police if there is proof that they illegally crossed the border within the last 48 hours – to deport large numbers of people, although the readmission agreement does not apply if the person has asked for asylum or is a potential asylum seeker. It has continued to do so despite full knowledge of the high risk of torture and further illegal pushback to Bosnia and Herzegovina.
In Croatia, as elsewhere, the pandemic has changed many things, but some aspects, such as its pushback regime, have unfortunately stayed the same. The only difference is that these violent collective expulsions now attract less attention, as all eyes are on the pandemic and human rights monitors have not been allowed in the field due to health restrictions. Pushbacks and violence at borders have persisted: in one case out of the hundreds documented by the BVMN, a group including a severely injured person and a minor was beaten with batons by Croatian officers, who also burnt their clothes, and the group was pushed back into Bosnia and Herzegovina.
A relatively new development in pushback practices is the tagging of groups with orange spray paint, as reported by No Name Kitchen, a grassroots organisation and member of the BVMN that provides direct assistance to people on the move in border towns along the Balkan Route. Chain pushbacks from Slovenia via Croatia, with migrants being sent back the same way they came, have also continued.
Reports of increased brutality during pushbacks are worrying due to the increased autonomy that state authorities have gained under the pandemic. Pushbacks are illegal and the spread of COVID-19 is no excuse to confront vulnerable people with even more violence.
How are the CPS and the BVMN responding to these trends?
The value of the work done by the BVMN lies in the interconnection of a variety of methods: field work, including trustful contact with people in border areas, testimony collection and advocacy work with clear demands being presented to institutions to hold them accountable for certain actions. Legal work is also essential, when people who have survived human rights violations want to seek justice. Each of the BVMN’s partners has its own strength in one or more of these working methods, and our collective strength is to combine all of them with a comprehensive approach.
Within the network, CPS conducts research that feeds into our awareness-raising and advocacy efforts on access to the asylum system, protection of refugees’ human rights, illegal conduct of the police, the criminalisation of solidarity and integration, with a focus on employment and education.
On integration, two of our big successes has been the Danube Compass, a web tool including all information relevant to the integration of refugees and migrants into Croatian society, and our non-formal education programme for asylum seekers, Let’s Talk about Society, which introduces our new community members to Croatian society and institutions, informs them of their rights and encourages their active participation in society.
Within the network, CPS is a strong legal actor, as we have so far filed 12 criminal complaints against unknown perpetrators in police uniforms. Through strategic litigation, we prevented an extradition and succeeded in filing two lawsuits against the Republic of Croatia at the European Court of Human Rights. As a result of our advocacy, several EU and international institutions, including the United Nations Refugee Agency, started questioning and condemning the practices of the Croatian authorities.
As a consequence of our public exposure of illegal practices towards refugees, we experienced a lot of pressure, and were banned from entering and working in asylum centres. This made our work more difficult but has not compromised our autonomy.
Do you see any progress in holding Frontex, the European border agency, accountable for its failure to protect human rights?
Frontex has faced severe allegations of human rights violations coming from different actors and institutions, and civil society has come together around multiple campaigns and actions on the matter, including #DefundFrontex. Supported by 22 CSOs and networks, including the BVMN, this campaign calls for the agency to be defunded and its budget redirected towards building a government-led and funded European civil sea rescue programme.
The main challenge is that Frontex operates in a grey legal zone and is perceived to have no responsibility for its actions – responsibility always lies with the member state in which Frontex operates. The agency’s rules are made in a way that allows for it to be largely unaccountable. However, we are seeing small steps towards a change in that regard, for example with the active engagement of the European Ombudsman.
How can civil society put pressure on the EU so that its commitment to human rights extends to migrants and refugees, and how can it encourage member states to respect their rights?
One of the ways that BVMN members found to bring together multiple strengths and be louder on key demands is the building of transborder networks. We believe that the active involvement of civil society in each border area, country and village can make a real difference on the public’s influence. Being loud on the rights of refugees and migrants is extremely important. It’s also important to connect a variety of struggles that are highly interconnected and take place across borders, such as struggles on climate change and women’s rights.

NORTHERN CYPRUS: ‘Civil society is not involved in decision-making and is considered a nuisance’
CIVICUS speaks with DeryaBeyatlı, Director of the Human Rights Platform,about the space for civil society in Northern Cyprus and the prospects for reunification in the context of the 2023 Cyprus and Turkish presidential elections.Established in 2021, theHuman Rights Platform isa Turkish-Cypriot civil society umbrella organisation bringing together seven human rights organisations guided by the vision of an egalitarian, democratic and inclusive society where human rights and fundamental freedoms are protected and accessible for everyone.
What do you make of the results of the Cyprus presidential election?
In the latest presidential election, held in February 2023, we saw a rise of nationalist and racist rhetoric. In response to losing ground, the left-wing Progressive Party of Working People (AKEL) supported a candidate who was more nationalistic than the party itself, but was still defeated in the runoff by Nicos Christodoulides, who was backed by centrists and right-wing parties.
It is clear to me that over the past few years Cyprus has been affected by the same shift towards radical right-wing politics that we’ve seen elsewhere in Europe.
What does the Human Rights Platform work on?
One of the main objectives of the Human Rights Platform is to document human rights violations committed by the government of Northern Cyprus, which is largely controlled by the Turkish authorities. I have observed that both society and the local authorities are becoming more racist, largely in reaction to the inflow of Black students who are lured with the promise of a job in Europe and trafficked into the northern part of Cyprus. Only in 2020 was human trafficking recognised as a crime in Northern Cyprus, and yet more than two years later, there has been only one court verdict in a case involving this crime. The authorities are unwilling to deal with human trafficking crimes and other human rights violations and keep blaming the victims instead.
What is the current state of reunification talks?
Ever since 1974, Cyprus has been split along ethnic lines, with Greek and Turkish Cypriots living on either side of the Green Line, a buffer zone under United Nations (UN) control. Christodoulides assumed that reunification talks might resume due to Turkey’s rapprochement with the west in search of relief to address damage caused by recent earthquakes and right after being elected said that the reunification of Cyprus is his priority. However, I think neither him nor Ersin Tatar, the current president of Northern Cyprus, who has strongly advocated for a two-state solution for many years, nor the Turkish and Greek guarantors are actually interested in the reunification of Cyprus.
The two-state formula currently advocated by Tatar was put on the table back in 2002 by Rauf Denktash, the founding president of Northern Cyprus, and was widely rejected by UN member states, with the exception of Turkey. Turkish President Recep Tayyip Erdoğan has repeatedly expressed his support for the two-state solution, so I don´t think his re-election changes anything.
Reunification talks are currently on hold and I’m afraid we’re headed towards permanent division. Neither Turkey nor the Republic of Cyprus (RoC) are eager to give up the power they exercise and share it with Turkish Cypriots. We are in a sandwich position, where Turkey interferes with the local matters of Northern Cyprus and the RoC discriminates against Turkish-speaking citizens of the island.
One of the numerous human rights implications of the division of Cyprus is that there are around 30,000 children of mixed marriages who cannot get RoC citizenship and hence become European Union (EU) citizens. Despite Turkish language being an official language of the RoC, official documents and legislation are all in the Greek language, leaving Turkish Cypriots out. Turkish Cypriots cannot open a bank account or establish an association unless they live in government-controlled areas. And the list goes on.
What obstacles does civil society face in Northern Cyprus?
The division of the island creates challenging civic space conditions in Northern Cyprus, where the Human Rights Platform is registered. We face many obstacles due to the fact that we work in areas not under the effective control of the government of RoC. It’s very difficult to make our voices heard and get access to funding available to EU member states because we are not legally registered in a member state. Yet we cannot do so, since we do not reside in the government-controlled areas. Our only funding opportunity is the Financial Aid instrument of the European Commission (EC), which is highly competitive and offers limited funds to civil society.
The local authorities of Northern Cyprus prefer directing EU funds towards infrastructure and economic development, and regard supporting civil society as unnecessary and therefore a complete waste of funds. Turkish Cypriot civil society organisations (CSOs) aren’t involved in decision-making mechanisms and are considered a nuisance. Meanwhile, local public funds are only available to government-sponsored non-governmental organisations, also known as GONGOs, that are under the effective control of the Turkish Embassy and the Turkish Cypriot political leadership.
Perceived by local authorities as a threat, Turkish Cypriot civil society is silenced and sometimes attacked on mainstream media. Public TV, radio and news agencies are almost inaccessible for us. CSOs working to protect human rights and safeguard democracy in Northern Cyprus are systematically marginalised. Since we maintain relationships with the EC, EU member states and the USA, we are often regarded as ‘foreign agents’ and threatened and blackmailed, sometimes openly but mostly discreetly. A widely used tactic is the use of fake social media accounts promoting extremely nationalistic content and blaming Turkish Cypriot civil society activists for trading the country to the Greeks or to imperialistic powers.
What international support do Turkish Cypriot human rights CSOs need?
Most international intergovernmental organisations and their agencies prefer to ignore our presence. Since we are in a place the existence of which they don’t recognise, they refuse to even meet with us, let alone hear us out. We need both political and financial support in order to get stronger and become more effective in our struggle to uphold democracy and human rights in Northern Cyprus.

POLAND: ‘Civil society played a crucial role in ensuring the fairness of the election’
CIVICUS speaks about Poland’s 15 October parliamentary election with Sonia Horonziak and Filip Pazderski, coordinator and head of the Democracy and Civil Society Programme at the Institute of Public Affairs (IPA).Founded in 1995, IPA is a leading Polish think tank and an independent centre for policy research and analysis that works to contribute to informed public debate on key Polish, European and global policy issues.
What were the main campaign issues?
The campaign was vicious, featuring hateful rhetoric, particularly directed at groups such as migrants. Opposition leaders, notably Donald Tusk, the head of the Civic Coalition, were targeted in every speech and interview given by members of the ruling Law and Justice party (PiS), even when it was completely unrelated to the subject matter.
Despite the emotional nature of the campaign, opposition parties’ messaging focused on reversing the regressive changes introduced by PiS, in power since 2015. Their electoral promises included restoring the rule of law and improving cooperation with the European Union (EU) and international partners such as Ukraine, with whom relations have deteriorated in recent months. At times, however, they were caught in the trap set by the ruling party, especially regarding migration issues, and their rhetoric wasn’t always fair toward migrants. Nonetheless, the PiS campaign was way more aggressive and hateful.
To react to that, in the final phase of the campaign the leaders of democratic opposition parties began to strongly emphasise their desire to temper social emotions and conflicts and bridge divisions. These were messages responding to the expectations of Poles, particularly from the group of undecided voters whose support was being fought for.
What factors influenced the outcome of the election?
Firstly, it’s crucial to note that, even though the official campaign started only weeks before the elections, PiS’s unofficial campaign has been underway for months, dominating the pre-election narrative. To this end, the ruling party extensively used public resources and received support from companies owned or controlled by the State Treasury. During the official campaign period, the public broadcaster exhibited a clear bias in favour of PiS, undermining the chances of any other party. Constant monitoring of the main news programme of the public TV broadcaster shows that PiS politicians were shown more often and only in a good light. By contrast, opposition party representatives were depicted only badly, and some very badly.
Moreover, during the electoral campaign PiS introduced the idea of a referendum, which was clearly unconstitutional, on issues aligned with its political agenda. In the referendum, people were asked whether they approved of the privatisation of state-owned enterprises, an increase in the retirement age, the admission of immigrants under the EU relocation mechanism and the removal of the barricade on Poland's border with Belarus.
The referendum allowed state-owned companies to engage in the electoral race and provide funding to the ruling party. This wasn’t subject to control or limitations, further contributing to an uneven and biased race in favour of PiS.
However, the results favoured opposition parties, which secured enough seats to form a coalition excluding PiS. This indicated that people had grown tired of the hateful rhetoric and propaganda spread by the government. An IPA survey carried out earlier this year showed a significant increase in dissatisfaction with the country's political and economic situation. It was particularly high among young people and women, which contributed to their views being expressed at ballot boxes and the final outcome of the elections.
No one expected PiS to gain enough votes to rule alone, but two possible outcomes were predicted. In one of them, PiS would be able to form a majority coalition with the far-right Confederation grouping. In the other, which eventually materialised, opposition parties would have the opportunity to govern together. A more even race might have yielded even higher results for the opposition bloc.
How different are the parties that form the winning coalition?
Each of the three groups forming the winning coalition – the Civic Coalition, the Third Way and the Left – comprises multiple parties. This raises the question of whether they will be able to stay together and form a unified front, or whether they will eventually split. Even though they have shared objectives, particularly those of restoring the rule of law and addressing corruption by implementing the EU’s whistleblower directive, they are divided on several issues.
While all parties oppose the strict abortion ban introduced by PiS, the Third Way is more conservative on women’s rights, in contrast to the Left, which holds more liberal and progressive views. Harmonising positions on social contributions also presents a significant challenge: while all agree that over the past eight years PiS has drained the public budget, there is no agreement as to which social groups should receive continued support and which should see their assistance reduced. The Polish People’s Party, a member of the Third Way, could prioritise agricultural workers, while the Left might want to focus on upholding minority rights and the Civic Coalition may emphasise support for older people. But the interests of these groups can ultimately be reconciled, perhaps as a result of a compromise leaving some of the expectations of members of these groups unanswered. It will be a little more difficult to align policies aimed at supporting business activities, a particularly important issue for the Civic Coalition and the Third Way. And for entrepreneurs, the reduction of the tax burden is mostly an important issue, while the Left's ideas may lead to tax increases.
There might also be tensions when it comes to appointing key positions and achieving a fair distribution of posts among coalition members, as several ambitious party leaders are vying for prominent roles.
But opposition parties know people expect change. We hope they’ll be wise and prioritise crucial reforms in areas such as the rule of law and tackling corruption over personal and political disagreements. This election result also marks Poland's return to the centre of European policy debates and the possibility of unlocking much-needed funds from the EU’s National Recovery Plan.
How did Polish civil society, including your organisation, engage with the electoral process?
Civil society played a crucial role in ensuring the fairness of the election. Several organisations conducted extensive training for thousands of people who volunteered to become electoral observers, empowering them to oversee the elections and ensure compliance with the law. Civil society educated voters on election participation and organised several extensive campaigns to encourage turnout, especially dedicated to women and young people, resulting in a remarkable 74.4 per cent voter turnout, a record in Poland. Civil society engagement particularly contributed to increased participation by women and young people, with turnout among young people 20 per cent higher compared to previous elections. We did our best to increase people’s engagement because it’s essential to achieve a truly representative democracy.
Another area of civil society involvement was in relation to the referendum. Almost all major civil society organisations (CSOs), including IPA, stated that the referendum was unconstitutional, manipulative, violated human rights and solely served the interests of the ruling party. We worked to inform and encourage people to vote in the parliamentary election while boycotting the referendum. This had a positive outcome: for the referendum, turnout was only 40 per cent, below the minimum validity threshold of 50 per cent, so its results were non-binding.
Do you think the government’s relationship with civil societywill change under the new administration?
Expectations are high for the new government to improve relations with CSOs. The PiS government propagated a narrative that part of civil society was politicised and worked against the interests of Polish nation. It was hostile towards organisations whose objectives didn’t align with government policies. During calls for public funds from ministries and government agencies, numerous well-established and renowned CSOs were excluded while organisations that had only existed for a few months or weeks and were clearly linked to PiS or its supporters were granted large amounts of money.
Over the past eight years, civic space in Poland has not only shrunk but also shifted towards increasing support of CSOs aligned with the government’s ideology. These organisations have often received long-term support that will enable them to sustain their activities long after a change of government. Certain segments of civil society, mostly those working on human rights, anti-discrimination, LGBTQI+ rights, migrants and refugees, environmental protection and watchdog activities, have faced harassment as well as insufficient support.
The major opposition parties have pledged collaboration with civil society and the implementation of policies formulated by CSOs across Poland in 17 thematic areas. The new government is expected to remain open to international cooperation, and not to marginalise independent CSOs but instead incorporate them into the political process, including on decision-making regarding the introduction or amendment of laws. There’s also a hope for fairer competition for public funds. We need to work on equal and non-discriminatory tools to support civil society and ensure its sustainability.
What forms of international support does Polish civil society currently need?
International solidarity has always played a crucial role for Polish civil society, particularly during the last eight years, when many CSOs wouldn’t have survived without it. The hope is that international CSOs and agencies, including those from the EU and the USA, will keep providing support and collaborating with Polish CSOs and the new government. This support is particularly important in the areas of democracy, the rule of law and anti-corruption.
The international community might mistakenly believe that the positive election outcome resolves all issues in Poland, potentially diverting attention to other problematic regimes. We have already been through this once, when after 2010 many foreign donors left Poland, deeming their job finished. Shortly afterwards, populist-nationalist forces returned to power and it turned out that legal mechanisms and democratic standards were not strong enough to stop them taking control of the state.
We need to understand this is just one victory, and there is much work ahead for both Polish civil society and the international community. Some donors have already withdrawn support for activities to defend and improve civic space across Europe. It is crucial for other donors, including private foundations, to step in and support each EU member so the union can develop and thrive.

POLAND: ‘In reaction to conservative backlash, public support for LGBTQI+ rights is on the rise’

CIVICUS speaks about 2023 Pride and Polish LGBTQI+ rights organisations’ response to the conservative backlash against LGBTQI+ rights with Annamaria Linczowska, advocacy and litigation officer at Campaign Against Homophobia (KPH).
Founded 2001, KPH is a Polish LGBTQI+ civil society organisation (CSO) working to counter violence and discrimination based on sexual orientation and gender identity through political, social and legal advocacy.

POLAND: ‘right-wing backlash is just one side of the coin, the other being the active mobilisation of rights-oriented civil society’
CIVICUS speaks with Krzysztof Śmiszek, a member of the Polish Parliament and chair of the Parliament’s Intergroup on LGBTI Rights, the first of its kind in Poland, about the situation of LGBTQI+ rights and activist responses to the anti-rights backlash.Before entering politics in 2019, Krzysztof had been an activist for almost 20 years. He is also a member of Justice and Human Rights Committee, the European Union Committee and the Polish delegation to the Parliamentary Assembly of theCouncil of Europe.
What is the situation of LGBTQI+ rights in Poland?
The situation for the LGBTQI+ community is really hard and complicated. In the last six years there wasn’t any progress at the legislative level so there are plenty of issues that remain unsolved, such as same-sex marriage, special legal procedures for the recognition of trans people’s identities and the prosecution of homophobic speech and hate crimes.
In 2015 the reins of Poland were taken over by a right-wing government and, in my opinion, the government is now using racism, xenophobia and homophobia to divide society. Since 2015 we have witnessed a rise in homophobic and transphobic speech as well as intolerant actions aimed at the LGBTQI+ community. The current government is not going to pass any legislation to make the lives of LGBTQI+ people easier.
I believe that the LGBTQI+ community has become a scapegoat: it is them that the government blames for any problem. A few years ago, it was refugees who played this part, and now they are also being targeted once again. The government also used to blame women’s rights organisations for everything, and now the LGBTQI+ community is being accused of the worse.
These are very hard times for the LGBTQI+ community in Poland, because whenever you tune in public TV, read the newspaper, or navigate government websites, you see it being used as a scapegoat. We are witnessing more and more hate crimes and incidents around Poland. Last year we had presidential election and the current president campaigned on an extremely ideological homophobic platform, and he won, which means that politicians and the government now believe that homophobic and transphobic discourse brings popularity.
Are there any reasons for optimism in such a bleak context?
There surely are, because right-wing backlash is just one side of the coin, the other being the active mobilisation of rights-oriented civil society. After six years of witnessing hate speech, people who normally would not have been interested in LGBTQI+ issues have started to care. Civil society is much more progressive and open than the politicians in power. As an activist I see a huge energy that goes beyond the big cities in Poland: there are formal and informal initiatives springing up everywhere.
Although we are going through hard times, the strong civil society reaction against the government’s intolerance and homophobic discourse and agenda makes me feel optimistic. This year we had around 20 Pride events throughout the country. There is positive mobilisation within society, compared to the situation 20 years ago, when I first became an activist.
So the situation is more complex than you would think: while Poland does have its homophobic side, with organisations fuelled with a lot of money coming from the right wing, there is also a big movement supporting LGBTQI+ organisations and activists with money, time, energy and solidarity.
LGBTQI+ activism is using a wide range of tactics, from perfectly designed social media awareness campaigns including short movies about the normal lives of rainbow families to building connections with potential allies, even unlikely ones. A while ago an organisation working against homophobia allied with progressive Catholics, which was really smart because Poland is still regarded as a majority Catholic country. It was very wise to involve someone considered as ‘the enemy’ in the movement. There are also ongoing collaborations with politicians.
All the while the government spreads hate, younger generations, people between 18 and 29 years old, are increasingly normalising LGBTQI+ rights and actively and fully supporting the LGBTQI+ agenda. Of course, this does not mean that all young people are gay-friendly: as everyone else, they are divided between openness to European values and the intolerance of the radical right wing.
What is the Intergroup on LGBTI Rights, what are its goals and priorities, and what work does it do?
The Intergroup on LGBTI Rights includes members of different parties represented in Parliament who meet and discuss about LGBTQI+ issues. When I organise the group meetings, I perceive the interest of civil society: they want to participate and have contact with politicians. As an activist and now a politician, I view this as the wisest way to ensure progress on our agenda because having activists put pressure on politicians is something that actually works.
One of our priorities is making Parliament a safe place for the LGBTQI+ community. We believe that Parliament belongs to voters, and as LGBTQI+ people are voters, they have the full right to be present in Parliament and have contact with politicians.
The main challenge the Intergroup faces is to listen to the worries of the LGBTQI+ community and translate them into legislative proposals. And whenever there is a practical problem with the administration or related to action by public authorities, we are informed by representatives of the LGBTQI+ community and try to shed light on the issue with the help of the media. Politicians and parliamentarians have the power to bring media attention to specific issues.
As for our tactics, we organise press conferences and invite government representatives, we collaborate with the European Union and the European Parliament, where there’s also an LGBTQI+ group, we keep in touch with international partners and we try to make international audiences aware of what is going on in Poland. For example, when facing proposals to declare ‘LGBT-free zones’ throughout Poland, we brought it to the attention of the European Council and showed it proof that the Polish authorities were discriminating against the LGBTQI+ community. This is something that as politicians we are able to do.
Is that why you decided to enter politics? Having had experience as both an activist and a legislator, do you think you have been able to tackle the same problem from different angles?
As an activist I was the one knocking on politicians’ doors and it was their choice to be open to my arguments or not. After doing this for 20 years I thought ‘enough is enough’ and decided that I should now be the one opening doors for LGBTQI+ activists. That was my motivation to get into Parliament, along with the fact that I just did not agree with what was going on in Poland in terms of respect for fundamental human rights, under attack by right-wing politicians.
I belong to The Left, a centre-left political coalition that was founded to compete in the 2019 parliamentary election. Many of my friends who were also elected to Parliament are now recruiting people from civil society. As a result, now there are feminists who used to work at feminist civil society organisations, people who were involved in ecological movements and people like me, coming from the LGBTQI+ movement, who are playing a role in political institutions. All of us are tired of being just activists, and are now translating our experiences into the language of Parliament.

SLOVAKIA: ‘The election result may reinforce the country’s image as a problematic EU member’
CIVICUS speaks with Michal Piško, Director of Transparency International Slovensko, about Slovakia’s recent first-round presidential election and the upcoming runoff.Transparency International Slovensko is a Slovak civil society organisation aimed at increasing institutional transparency and combatting corruption.
What’s at stake in this presidential election?
Slovakia’s presidency holds limited powers, although it has strong legitimacy arising from its direct popular election. Its most significant powers include vetoing laws – which a parliamentary majority can relatively easily overcome – and appointing some key state positions, such as constitutional judges.
However, it can become a key player in critical junctures, as seen at the beginning of 2024. The governing coalition pushed for a harmful amendment to the Criminal Code in a fast-track legislative procedure. The new rules would have complicated the investigation and punishment of serious corruption cases by significantly shortening penalties and statutes of limitations. The current president, Zuzana Čaputová, challenged the amendment in the Constitutional Court, which partially suspended it coming into effect.
The role of the president is also crucial beyond their formal competencies, particularly in significant public debates.
What are the main campaign issues and the candidates’ positions?
The first round of the presidential election was held on 23 March. Čaputová decided not to run for re-election. Ivan Korčok, a pro-European former foreign minister who emerged as a civic candidate that was later backed by opposition parties, challenged Prime Minister Robert Fico’s ally and current speaker of parliament, Peter Pellegrini. Representing the opposition and the government coalition respectively, they will now compete in the runoff that will take place on 6 April.
The central campaign Issue is the role of the president: whether they are meant to be closely aligned with the government or provide a counterbalance. Given that the current administration is led by a four-time Prime Minister known for his aggressive rhetoric and actions undermining the rule of law, it has been key to have a critical president playing an active role. If Pellegrini wins, it would bolster the government’s capacity to implement its controversial policies.
How free and fair has the election process been so far?
Transparency International Slovakia, a well-known anti-corruption organisation, has been actively monitoring the transparency and fairness of election campaigns and financing for a long time.
Unfortunately, the current campaign cannot be considered transparent or fair, particularly because of Pellegrini’s failure to disclose donor information and the significant lack of information on his campaign expenses.
The process has also been marred by negative campaigning orchestrated by politicians or hidden sources targeting Korčok, portraying him as a war promoter. It has also been distorted by the parallel election campaign for the European Parliament, in which both coalition and opposition parties indirectly support or criticise presidential candidates.
What can we expect in the runoff?
In the first round, pre-election opinion polls generally underestimated voter turnout and Korčok’s performance. Despite expectations, first-round voter turnout exceeded 50 per cent, a notable increase compared to previous years. Another surprise was Korčok’s relatively significant result, with more than 42 per cent of the vote and a 5.5-point lead over Pellegrini. Most pollsters expected more balanced results.
However, the situation could still change in the runoff, as Pellegrini may receive the support of third-placed candidate Štefan Harabin’s anti-west and anti-system voters.
Right now, both candidates seem to have fairly balanced chances of success. While Pellegrini is primarily targeting his messaging at anti-system voters, Korčok is attempting to mobilise pro-European voters.
It is still unclear which candidate most Hungarian voters, who make up almost 10 per cent of Slovakia’s population, will support. Historically, they have leaned towards pro-European and democratic politicians, but their decision may also be influenced by the fact that Hungary’s authoritarian Prime Minister, Viktor Orbán, is aligned with the current Slovak government.
Despite Pellegrini not being openly pro-Russia, his victory would strengthen the current government’s position and reinforce Slovakia’s image as a problematic country with anti-democratic tendencies within the European Union. It would also intensify the existing division within the Visegrad Group, a Central European alliance of four countries, two of which – the Czech Republic and Poland – would continue leaning towards the west, while Hungary and Slovakia would further lean towards Russia.

SLOVAKIA: ‘We hope the government’s attempts to stifle activism will ultimately fail’
CIVICUS discusses democracy, civic space and media freedoms in Slovakia with Rasto Kužel, Executive Director of MEMO 98, a leading media monitoring organisation with 25 years of experience. MEMO 98’s mission is to provide people with fair and comprehensive information on public affairs, empowering them to engage in their communities and hold authorities accountable.The Slovak government recently proposed major changes to public television and radio, sparking condemnation from civil society, journalists’ organisations, the political opposition, international media organisations and regional institutions. Media freedoms have been in the spotlight since the 2018 murder of journalist Jan Kuciak, which led to the resignation of pro-Russian populist Prime Minister Robert Fico and the election of a short-lived anti-corruption government. However, Fico and his Smer partyreturned to power in 2023, and an ally of the prime minister was elected president in April 2024. In a polarised political environment, Fico was the target of an assassination attempt on 15 May.
How is the government proposing to change the media system and why is this controversial?
The new government proposes significant changes to the public television and radio system. These changes include restructuring the management of the public broadcaster RTVS, which currently generally enjoys editorial independence.
Initial criticism, particularly from the European Union and Slovak journalists and civil society, led to some revisions of the draft law, which, if passed, would mean the end of RTVS. However, the aim remains the same – to designate a government-friendly director and increase government control over the public broadcaster. This would effectively turn public television and radio into state-controlled entities.
While never fully free from political pressure, RTVS has performed its public service duties generally well, in line with the existing legislation. The media regulator didn’t find its news and current affairs programmes breached impartiality or objectivity rules. There’s no need to replace the current management. This is just a politically motivated move to replace RTVS’s independent director with someone loyal to the government.
This pattern of media capture mirrors developments in neighbouring countries such as Hungary and Poland, where it’s been used to control state institutions and democratic processes. Critics argue that proposed changes in Slovakia are part of a wider strategy to undermine democratic institutions, including an independent judiciary, free media and civil society.
What other concerns have been raised by civil society and the opposition?
Since this government took office, democratic institutions and the rule of law have been seriously threatened. The government is actively trying to obstruct legal proceedings against its members, including Fico and his defence minister, who are accused of involvement in criminal activities. Legal and parliamentary manoeuvres have been used to block corruption charges. The General Prosecutor has invoked special provisions in the Penal Code to stop legal charges against people close to the ruling coalition, and parliament failed to strip Fico of his immunity when he was a regular member of the previous parliament. This sparked widespread protests, particularly against the dismantling of the special prosecutor’s office investigating corruption.
This year, the focus has shifted to concerns about civic space and media freedom. The government is pushing through a law requiring organisations that receive over €5,000 (approx. US$5,400) in foreign funding to disclose their sources. This is reminiscent of tactics used by authoritarian regimes such as Russia to stifle dissent.
Public and private broadcasters involved in critical reporting have been targeted. A big protest is being planned at a major private TV station, where it has emerged that the owners are pressuring the station to tone down its coverage critical of the government. This channel, known for its critical and objective journalism, faces threats against its ability to fulfil this role.
The government’s pro-Russian stance is particularly worrying given Slovakia’s proximity to the conflict in Ukraine. This shift towards Russia has already damaged Slovakia’s standing in the European Union (EU) and NATO, particularly after Fico revealed sensitive information to please pro-Russian groups at home. There’s wider concern that Slovakia’s security will be compromised if Russia isn’t stopped in Ukraine. Despite strong public support for the EU and NATO, the government is undermining efforts to support Ukraine and uphold democratic values. Its vague talk of peace suggests a reluctance to provide military support and puts Slovakia’s credibility and security at risk.
How have foreign policy disputes exacerbated political polarisation, and with what consequences?
Slovakia’s 2024 presidential election exacerbated existing divisions, driven by tactics to mobilise voters through fear and disinformation. The ruling parties targeted the opposition candidate, an independent and former foreign minister known for his strong pro-European and pro-Atlantic stance, by falsely portraying him as pro-war. They claimed that a vote for him would drag Slovakia into the Ukraine conflict, suggesting that Slovak people would be drafted and sent to war. This narrative was misleading and manipulative.
The campaign was marked by negativity and fuelled polarisation, a strategy that has become a hallmark of the current government. Smear campaigns targeted not only political opponents but also the media. Fico has frequently used derogatory language, referring to his opponents as ‘pigs’ and ‘prostitutes’, further inflaming tensions.
This toxic political environment culminated in a shocking event: an assassination attempt on Fico. The government had adopted a tactic of holding meetings with supporters outside the capital. During one of these meetings, in the small town of Handlová, a 71-year-old pensioner with controversial affiliations opened fire on Fico, hitting him four times. This violent incident underlines the dangerous consequences of embracing such a divisive and aggressive rhetoric.
What was the public reaction to the assassination attempt, and what are its implications?
The assassination attempt was a deplorable event and was condemned by many sectors of Slovak society. MEMO 98 and many other civil society groups immediately condemned the violence, describing it as an attack on democracy. Despite our political disagreements with Fico’s pro-Russian policies, we strongly believe violence has no place in a democracy. The government was democratically elected and its authority should not be undermined by such violent attacks. We called for a moment of reflection and urged society and politicians not to exploit this incident for political gain.
But this wasn’t an isolated incident. It followed a series of tragic, violent events, including the murder of journalist Jan Kuciak and his fiancée in 2018 and the murder of two LGBTQI+ people. These crimes shocked the nation and highlighted the dangerous levels of polarisation and hatred that political rhetoric has fuelled.
The attempt on Fico’s life has already led to heightened tensions and a blame game between political factions. Members of the ruling coalition have accused the opposition and media of creating a climate of hatred despite their own history of using inflammatory, derogatory and divisive language.
It’s also contributing to the further deterioration of democratic institutions. We are already seeing increased attacks on independent media and civil society. The government is using the incident to justify further crackdowns on dissent. Journalists are being accused of escalating tensions simply for asking probing and critical questions.
There’s urgent need for a return to civil discourse and a renewed commitment to democratic principles. It’s vital for society to promote healing and rebuild trust in our democratic institutions.
What is civil society doing to protect democracy, and how can the international community support its efforts?
Civil society working to protect democracy is astonished at the speed with which the government has been dismantling institutions and targeting its critics. While we saw this coming, we were still surprised by these attempts to dismantle democratic institutions and have been forced to hold the line and engage in activism. But we are committed to upholding the rule of law and maintaining democratic institutions, and we hope the government’s attempts to stifle activism will ultimately fail.
The international community’s support and attention will be crucial. Current illiberal, populist and authoritarian trends transcend borders and require a global response. The challenges posed by the growing influence of social media and the decline of independent media require collective action. There’s a great need for solidarity and effective sharing and coordination, particularly at the regional level. International allies can support our efforts by raising awareness, providing platforms for our voices and fostering a network of solidarity and shared strategies.

Solidarity protests with Palestinian people banned in at least 12 EU countries
Protests banned on grounds of protecting ‘public order’ and ‘security’
- Authorities have resorted to excessive force in multiple countries, including the use of pepper spray, kettling and the deployment of police dogs
- Palestinian flags and scarves also widely banned
- European and international NGOs urge the Commission to act on restrictions
The European Civic Forum, Civil Liberties Union for Europe, CIVICUS, European Network Against Racism and Solidar are calling on the European Commission to address at the highest political level the unlawful restrictions on the right to freedom of peaceful assembly and expression imposed by member states since the dramatic escalation of violence in Israel and Palestine last year.
A new analysis, published by the European Civic Forum, shows that European governments have repeatedly cracked down on individuals and organisations expressing solidarity with the Palestinian people in marches, demonstrations and cultural activities.
Six months on from 7 October, people in Europe have continued to take to the streets to peacefully protest against the violence, to show solidarity with the victims and to call for the respect of human rights and international law.
These protests are unfolding amid an increase in hate speech and hate crimes targeting both Jewish and Muslim communities in Europe. Palestinians, people of Arab descent, and Muslim people (and those perceived as such) have been disproportionately affected by these restrictions, with racial profiling sometimes being used as justification. With tensions and polarisation in society rising, it is all the more important that authorities act responsibly and ensure that everyone’s rights are respected and that people are allowed to protest freely and peacefully.
An alarming pattern of restrictions
In at least 12 EU member states, authorities have taken disproportionate measures, including the pre-emptive banning of protests based on apparent risk to “public order” and “security”. Such cases have been documented in Austria, Bulgaria, Czech Republic, Estonia, Finland, France, Germany, Hungary, Italy, Latvia, Poland and Sweden. In several member states, the courts have overturned protest bans.
The crackdown has also included the use of excessive force in at least seven member states, including pepper spray, deployment of police dogs, physical aggression, and kettling tactics, perpetuating a climate of fear and intimidation and violating international human rights standards.
Case studies from Italy and Germany reveal some of the disproportionate measures taken by authorities to quell protests supporting Palestine. In Milan, Italian police used batons to disperse pro-Palestine demonstrators who gathered despite an official ban on protests on International Holocaust Remembrance Day on 27 January. Other incidents of excessive force have been recorded in Austria, Belgium, France, Greece and the Netherlands.
Restrictions on freedom of expression have also been imposed, targeting symbols associated with Palestine. The Palestinian flag and wearing the Keffiyeh, along with other symbols indicating support for Palestine, have reportedly been banned in countries such as Germany, Italy, and Spain, further limiting the ability of individuals to express solidarity.
Several member states, including Austria, Germany and France have conflated legitimate criticism of Israeli authorities with antisemitism and silenced the voice of Palestinian and Jewish activists, for example by cancelling events. In Germany alone, 139 cases of cultural repressions (October 7th- January 31st) were documented, including instances where access to venues was withdrawn or events were cancelled, smear campaigns, and threats of defunding were made for expressing views on Palestine.
Restrictions have been documented in the UK,[1] where the government has repeatedly smeared protesters and put pressure on the police to further restrict protests. Recently, the home secretary James Cleverly proposed to further limit protest rights by increasing the minimum notice period of six days to support police with large-scale protests. Last year, then-home secretary Suella Braverman wrote to police chiefs, encouraging them to “consider” whether using the chant “From the river to the sea, Palestine will be free” could be considered a racially aggravated offence. In addition, she labelled the demonstrations in solidarity with Palestinians as “hate marches”. More recently, Prime Minister Rishi Sunak, delivered an address in which he appeared to echo Braverman’s sentiments, later summoning police chiefs to Downing Street to criticise their handling of protests.
“In the context of the ruling of the International Court of Justice (ICJ) on the plausibility of genocide and the new tragic developments on the ground in Gaza and across Israel/Palestine, people continue to protest and to urgently call for accountability and justice.
“However, our monitoring shows that rather than listening to the people, European governments are repeatedly opting to limit civic space and to silence individuals and organisations expressing solidarity with the Palestinian people,” said Aarti Narsee, Senior Policy and Advocacy Officer at the European Civic Forum.
In light of our monitoring, we strongly urge European governments to adhere to their international legal obligations and safeguard the rights to peaceful assembly and freedom of expression. It is imperative that authorities refrain from resorting to excessive force and instead prioritise the preservation of democratic principles and space.
We call on the European Commission to address these restrictions on peaceful assembly and expression in the Annual Rule of Law Cycle and make recommendations to member states to respect the right to peaceful assembly at all times, as per international law.

SWITZERLAND: ‘Right-wing populists pose a true threat when other parties meet their demands’
CIVICUS speaks withLea Schlenker, board member of Operation Libero,about the rise of right-wing populism in Switzerland’s recent elections.Founded in 2014, Operation Libero is a Swiss civil society organisation working to preserve and advance liberal democracy by campaigning against populist initiatives and advocating for an open, progressive and just society.
How concerning are the results of the 22 October Swiss federal election?
On 22 October, the right-wing Swiss People’s Party (SVP) came first, securing 62 out of 200 parliamentary seats, nine more than it previously had. The SVP is becoming increasingly extremist, and its election victory shouldn’t lead us to trivialise the racism and hatred they stoked during the campaign. We shouldn’t normalise the fact that they called queer people ‘sick’ and let far-right extremists manage their campaign accounts on social media. We shouldn’t endorse them by posing in photos at the Federal Palace with the leader of Switzerland’s largest party.
The outcome of this election leaves us deeply concerned about issues such as climate change and asylum policies and the treatment of refugees.
The trend of the rising far right is not exclusive to Switzerland – it is being observed globally. Right-wing parties instrumentalise legitimate citizen concerns, such as inflation or the ongoing war in Europe, to spread misinformation and target minorities. Under the guise of what they call a ‘culture war’, right-wing populists stoke unfounded fears of ‘cancel culture’ and ‘foreign infiltration’. This is very worrying. As a political movement that defends fundamental rights and combats right-wing populism from a liberal perspective, we believe our work is now more necessary than ever.
How did Operation Libero engage with the election?
We launched a campaign called ‘Du hast die Wahl’ (‘It’s your Choice’). Our goal was to persuade as many progressive people as possible to participate in the elections and stand up for their values by emphasising the importance of their voice. The SVP is attacking our liberal achievements, including the freedom of religion, the right to abortion, women’s bodily autonomy and equal rights. Some SVP members deny climate change, while others flirt with autocrats like Vladimir Putin. It is our mission to thwart these attacks on democratic values.
During the campaign, we distributed stickers and used billboards across Switzerland. The design incorporated a white background on the left side and a black background on the right side, symbolising a clear choice. The design, resembling voting ballots, visually reinforced the choice people faced in the election: equal rights or sexism, populism or democracy, isolation or openness, SVP or the future. We deliberately wrote ‘future’ in white lettering on a black background, sparking a lot of public debate and challenging either black or white stereotypes. Our campaign was funded exclusively by donations from members and supporters.

Another important element of our campaign was the petition ‘Wahlen ohne Hass’ (‘Elections without Hate’), which we ran in collaboration with the National Coalition Building Institute. We advocated for elections free from hate speech targeting any minority group. This petition was primarily a response to the racist and xenophobic rhetoric employed by right-wing populists during the campaign. The SVP manipulated police reports to refer to isolated incidents as widespread trends. The impact of our petition was further amplified by the Federal Commission against Racism, which described the SVP campaign as ‘racist, xenophobic, and inflammatory’.
On election day, we rented a truck and drove it to the capital, Bern. The truck displayed the message we wanted to convey to the public: that we reject the normalisation of the SVP’s discourse and its effect of shifting the whole political spectrum rightwards.

What can be done to prevent further advances of the Swiss far right?
Right-wing populists pose a true threat when other parties meet their demands, a trend already observed in countries such as Germany. It would be a great mistake for conservative parties to respond to the election results by aligning even more closely with the SVP. The SVP must be treated as a radical outsider so that it remains a minority – albeit a large one that received 28 per cent of the vote. Swiss liberals must distance themselves from the SVP, which often conceals its populist and extremist nature behind a conservative facade.
Non-extremist parties must urgently form a coalition for an open and progressive Switzerland even if they maintain fundamental differences on specific issues. To counter the SVP’s initiatives on immigration, downsizing public media and promoting ‘neutrality’, Switzerland requires a robust progressive coalition. This is feasible, despite the SVP’s electoral advances, if conservative parties refuse to become their allies.
With a mostly conservative and right-wing parliament, it will be challenging to implement progressive reforms for a more open and equal society. But we remain hopeful because there are numerous political activists and forces aligned with our democratic vision.
How does Operation Libero work to protect human rights and safeguard democracy?
Since its foundation in 2014, Operation Libero has been dedicated to defending liberal and inclusive democracy, advocating for equal rights and fostering European collaboration. We scale up our campaigning every time our liberal democracy or its underlying values come under attack, which unfortunately occurs with regularity.
Operation Libero was founded to stop right-wing populist advances but we have expanded our mission to actively shape the country through two current initiatives. Firstly, we are working to build a broad alliance to break deadlocks in relations between Switzerland and the European Union (EU) by promoting a popular initiative to embed the objectives of cooperation with the EU in the Swiss Federal Constitution. We want to have close ties with the unique peace and freedom project that is the EU. The Europe Initiative already has the support of 11 organisations.
And in May we started collecting signatures for the Democracy Initiative, which addresses a fundamental democratic challenge: the fact that Switzerland currently excludes from citizenship, and therefore from the political decision-making process, around a quarter of its permanent resident population. Including all these people as fellow citizens with equal political rights is essential for Switzerland to become a democracy worthy of the name.

SYRIA: ‘We spread the culture of human rights in a country with one of the world’s worst human rights records’
CIVICUS speaks about Syria’s ongoing civil war and human rights crisis and its prospects for democratic change with Fadel Abdul Ghany, founder and Executive Director of the Syrian Network for Human Rights (SNHR).Founded in 2011, SNHR is a human rights civil society organisation (CSO) that works to monitor and document human rights violations, protect victims’ rights and hold perpetrators accountable, promoting the conditions for transitional justice and democratic change.
What is the current security situation in Syria?
We have a team of approximately 22 people in Syria that daily monitors and documents human rights violations, including extrajudicial killings, arbitrary arrests, enforced disappearances, torture and forced displacement. We have published daily reports on the civilian death toll for a decade. In September 2023, 55 civilians, including 12 children, were killed. Ninety-seven were killed in August, 55 in July and 42 in June. In the first half of 2023, 501 civilians lost their lives due to the ongoing conflict. Our monthly reports also cover arbitrary arrests, with 223 cases reported in August and 204 in September.
We document crimes committed by all armed groups involved in the conflict, categorising them by perpetrator. From March 2011 to June 2023, a total of 230,465 civilian deaths were reported, with over 87 per cent attributed to Syrian regime forces and Iranian militias, three per cent to Russian forces and two per cent to ISIS. Based on our reporting and news of grave and pervasive violations no territory in Syria can be considered safe or secure.
What are the working conditions for your colleagues in Syria?
We consider ourselves on the frontline because we document violations on the ground and identify perpetrators. Our team operates discreetly in Syria, either from the office or from their homes using fantasy names. We safeguard their identities for security reasons. Their safety is more important than any documentation.
Our team faces intense pressure, and if arbitrarily arrested, they risk severe torture by the regime led by Bashar al-Assad or other parties. We do our best to protect and provide security education to our staff. Our IT infrastructure is highly secure, and we’ve implemented measures to thwart cyber-attacks, which have included Russian attempts to hack our website.
What’s the situation for Syrian refugees?
Many Syrians aren’t safe in other countries either. In Lebanon and Turkey, refugees face the risk of forced return to Syria in violation of international law, specifically the 1951 Refugee Convention. Conditions are dire, with Syrians often blamed for economic hardship in host countries, even though Lebanon and Turkey receive substantial funding from the European Union and other donors to welcome refugees.
The feeling of insecurity and lack of proper protection in neighbouring countries, which host over 70 per cent of refugees, drive Syrians towards-called ‘death boats’ to seek safety elsewhere in Europe. The international community should better distribute the responsibility of welcoming refugees, because the current allocation isn’t fair.
What should the international community do to address Syria’s dire human rights and humanitarian situation?
The international community must intensify efforts to achieve a political transition and end Syria’s 13-year-long conflict, which is taking a lot of lives and causing immense suffering, with widespread torture and forced displacement of half the Syrian population. Any prospect of political transition has been absent due to insufficient international pressure on all parties in the conflict, and particularly on the Assad regime, leaving the Syrian people and the conflict largely neglected.
The international community must actively support efforts to fight impunity. The Assad regime has got away with numerous war crimes and crimes against humanity. There should be a collective effort to bring justice. If accountability is to be achieved, it also requires a political transition leading to the establishment of independent local courts.
Chinese and Russian veto power at the United Nations Security Council obstructs the referral of war crimes to the International Criminal Court. With limited universal jurisdiction, only 27 sentences have been issued in Germany and other countries against Syrian war criminals, mostly from non-state terrorist groups such as Al-Nusra or ISIS.
True accountability requires dismantling the Assad regime, the Syrian National Army, the Syrian Democratic Forces, the Islamist organisation of Hay’at Tahrir al-Sham and other non-elected entities ruling Syria through fear.
Aid should be directed to people affected by the recent earthquake and those displaced in northwest and northeast Syria. Continuous assistance is also vital for Middle Eastern states hosting most Syrian refugees. Such comprehensive support on a large scale is essential for advancing the Syrian movement toward democracy.
How is Syrian civil society working for a transition to democracy?
Syrian civil society continues to protest to demand respect for human rights, investigates rights violations and expose perpetrators based on the principle of equality and promote human rights through education. We work hard to spread the culture of human rights in a country with one of the world’s worst human rights records and to get rid of a decades-long dictatorship.
SNHR publishes reports and statements urging a halt to violations and providing recommendations to other states. We conduct in-depth bilateral meetings with various foreign ministries, including those of France, Germany, the Netherlands, the UK and the USA, and convene other high-level meetings. We actively participate in and organise advocacy events. The most recent, held on 21 September, focused on human rights violations and avenues for accountability and was co-hosted by the USA and co-sponsored by France, Germany, Qatar and the UK.
I believe the international community should also provide substantial financial and logistical support to active Syrian CSOs that have played a significant role in the Syrian civil war and have, to some extent, replaced the state.
What has triggered recent protests across Syria?
Since early August, many regime-controlled areas of Syria have witnessed peaceful civil demonstrations. People took to the streets because they felt even more hopeless following Assad’s interview with Sky News Arabia on 9 August. He didn’t apologise nor did he express any willingness to change the way he’s ruling the country. Instead, he said that if he could go back to 2011, he would kill even more people than he did.
There are ongoing protests in areas of northern Syria that aren’t controlled by the regime. Protesters seek to hold the Syrian regime responsible for the worsening economic, social and political conditions. Their calls echo those of the 2011 Arab Spring: they demand an end to family rule and a transition to democracy, freedom of speech, the release of illegally detained people and accountability for perpetrators. Their major message is that Assad must go.
We have monitored and documented multiple vicious methods used by the regime’s security forces to suppress protests, including arrest, torture, enforced disappearances and prosecution of hundreds of protesters. The regime uses its media outlets to slander protesters or anyone criticising it as traitors or collaborators working with foreign entities. The Syrian regime has also attempted to stage counter-demonstrations with loyalists chanting pro-regime slogans and threatening anyone opposing the regime.

TURKEY: ‘Civilian refugees should not be used as political bargaining chips’
CIVICUS speaks with Bassam Alahmad, co-founder and executive director of Syrians for Truth and Justice (STJ), about the Turkish plan to return one million refugees to Syria.STJ is a civil society organisation (CSO) dedicated to documenting human rights violations to contribute to the prospects for justice, as well as training human rights activists and building capacity in areas including digital security and civic engagement.
Why is the Turkish government making plans to return a million Syrian refugees to Syria?
We do not know the exact reason behind the plan to return a million Syrians to Turkish-administered regions of Syria. But there are several possible reasons we can think of. First, Turkey will hold general elections next year, and every time elections approach, the ruling Justice and Development Party will try to draw attention outside Turkey in any way possible – by attacking other nations, creating problems with neighbouring countries or groups of people – to hide domestic failures.
Second, the decision may be part of a wider strategy by the Turkish government concerning its engagement with northeast and northwest Syria, which aims to decrease the presence of Kurds and other populations who it doesn’t view as ‘Turkey’s allies’ – people that Turkey does not like having at its borders. To achieve this, Turkey will make claims that these populations are ‘terrorists’.
The decision announced to return a million Syrians from Turkey back to Syria therefore hits two birds with one stone. It would allow the Turkish government to show its domestic opposition that it is tackling the ‘problem’ while also using Syrians against Syrians in the northeast and northwest parts of Syria.
To sum up, there is no specific reason we know of, but we can assume that demographic engineering in northeast and northwest Syria and Turkey’s domestic politics are all at play.
How has this announcement impacted on Syrian refugees in Turkey?
This policy has really affected Syrian refugees in Turkey. Every single day there is at least one case of assault against a Syrian person – sometimes more. Incidents of racism and cases of deportation and violence at the border, and even of murder, have been verified. Hundreds of organisations and media outlets have verified racist attacks against Syrians.
Why are these attacks happening? Because the Turkish government is telling people that it has already spent too much on Syrians, and Turkish citizens are resenting it. The Turkish government is also telling people that it has freed areas in Syria from terrorists and they are now safe for return, so Turkish citizens are increasingly putting pressure on Syrian refugees to leave. Turkish public opinion turning against Syrians makes them vulnerable to racism and deportation.
The discourse that Turkish president Recep Tayyip Erdoğan is disseminating is affecting Syrian refugees very negatively. And the problem is that it is not true. The United Nations, the Independent International Commission of Inquiry on the Syrian Arab Republic, Amnesty International and many others have all said that Syria is not safe.
How do you assess Turkey’s immigration policy?
Many countries and organisations say that Turkey should be thanked for its treatment of Syrian refugees; however, Turkey’s 2016 agreement with the European Union was a really bad one, because as a result Syrian refugees were trapped or detained in Turkey so that the Turkish government could receive money for hosting them.
Syrian refugees and asylum seekers have been used as political game pieces ever since. Following this agreement, in which Europeans agreed to pay money to Turkey to keep Syrians from advancing through Greece and further into Europe, there have been multiple instances of disagreements between Europe and Turkey leading to threats against refugees.
This is not good. You can’t keep using civilian refugees as political bargaining chips, using them against Turkey, or against the Kurds in northeast and northwest Syria, or against the Americans in northeast Syria. But the 2016 agreement gave the Turkey government leverage to use refugees as a political card, and they have used it. And by the way, Turkey is not the only country using refugees this way, and Syrian refugees are not the only refugees who have been used. Afghan, Iraqi and other refugees have had similar experiences, but this is especially true for Syrian refugees.
Do you think the attitude of the Turkish government points to a broader European pattern?
Of course, the Turkish refugee policy has a lot in common with refugee policies around the world. I do not want to say that all European governments treat refugees the same way as the Turkish government, but occasionally there are similarities.
In particular, we all saw how European governments treated Ukrainian refugees – this was good. But they don’t treat Syrian refugees the same way. European countries gave Turkey money to keep Syrian refugees in Turkey, while they opened their doors to Ukrainian refugees.
We do not want to paint all the Turkish and European politicians and policies with the same brush, but there are patterns of racist refugee policies and racist attacks against refugees that are important to recognise.
How has Syrian civil society responded to the announcement by the Turkish government?
Unfortunately, the civil society response has not been unified. Many Syrian CSOs that do not have employees or offices in Turkey have published reports about this plan; however, Syrian CSOs in Turkey have not been able to speak out, for a number of reasons. In some cases, organisations are politically aligned with Turkey and welcome these policies. But many others want to speak out against these policies – the racism, the deportations, the military actions against Syrians within Syria – but they are unable to for security reasons.
In other words, some people don’t want to speak up because they are essentially in agreement with Turkish policies, while others would want to but cannot because it is dangerous, as they are in Turkey, where speaking out may result in deportation or arrest. There are also some Turkish organisations that address these issues, but many do not have the interests of Syrian refugees in mind.
It is key for Turkish organisations to speak out and insist that Syria is not safe for refugees to return. There has been limited discussion about Turkey’s rights violations against Syrians, and this should not be the case. Both domestic and international civil society should speak out against violations occurring in Turkey and committed by Turkey.

TURKEY: ‘The government does not tolerate opinions different from its own’
CIVICUS speaks with lawyer Eren Keskin, chair of the Human Rights Association (IHD), about the Turkish government’s attacks on critical media and the state of press freedoms in the context of Turkey’s current elections.Founded in 1986, IHD is one of Turkey’s oldest and largest human rights civil society organisations. It documents human rights violations and campaigns for the protection of human rights and civic freedoms in Turkey.
What are the conditions for journalism in Turkey?
Problems in the area of freedom of expression have existed in Turkey since the foundation of the republic. From the very beginning there were issues that the republic’s official ideology of Turkish-Islamic synthesis prohibited speaking about. Issues such as the Kurdish conflict, the 1915 Armenian Genocide and, later on, Turkey’s military presence in Cyprus, have long been forbidden topics.
What’s changed under the present government of the Justice and Development Party (AKP) and the Nationalist Movement Party is that the opposition’s freedom of expression has been severely restricted across the board. As a result, obstacles have mounted for opposition journalists to express their views.
The government does not tolerate opinions different from its own. It recklessly issues arrest warrants for articles, speeches and social media messages if they express diverging opinions. The state of Turkey recognises freedom of expression in its domestic legislation and is bound to respect it as a state party to the European Convention on Human Rights, but it continues to violate its own laws and the international conventions and covenants it has signed.
What tactics does the government use against independent media and how have you been affected?
Because it does not tolerate any kind of diverging opinion, the government is extremely aggressive towards independent media and the free press, the majority of which are Kurdish media outlets.
Dissident journalists are commonly charged with making propaganda for an illegal organisation. Particularly with news reports on the Kurdish war, most lawsuits are filed on charges of making propaganda for the Kurdish political movement or Kurdish armed forces. Apart from this, a large number of cases are filed on charges of insulting the president, insulting the forces of the state and inciting the public to hatred and enmity.
Many journalists are under arrest or subject to international travel bans merely for expressing their thoughts in writing. There is almost no journalist who is not being subjected to judicial control.
I was once the volunteer editor-in-chief of the daily Özgür Gündem, one of the newspapers that has faced the most repression, and have stood trial in 143 cases just because my name appeared on the newspaper as volunteer editor-in-chief.
I’ve been sentenced to a total of 26 years and nine months in prison for alleged crimes such as membership of an illegal organisation, making propaganda for an illegal organisation and insulting the president, even for articles I did not write. These sentences are pending a decision of the Court of Cassation. As soon as they are final, I may go to prison. I have also been unable to travel abroad for six years now because of an international travel ban.
Has the intensification of repression affected the popularity of the president in any way?
Considering that the ruling regime is the main culprit for all the rights violations currently taking place in Turkey, and that power is concentrated in the hands of President Recep Tayyip Erdoğan, it must be admitted that the main perpetrator of rights violations is the president himself. The judiciary is completely dependent on the president. Judges and prosecutors render compliant decisions out of fear. Where judges and prosecutors are afraid, it is unthinkable for the judiciary to be independent.
The president’s attitude towards the press, especially the opposition press, and the language of hatred and violence he uses, does not detract from his popularity but is instead a major reason his followers support him. However, we think that a large part of society, hopefully a growing part, is also disturbed by his blatant violations of freedom of expression.
What do you make of the results of the 14 May general election?
The AKP had relative success in the presidential and parliamentary elections held on 14 May. The president did better than expected, considering the economic situation and the criticism he’s faced over the response to the earthquakes in February. His party has maintained control of parliament. But he didn’t win re-election outright: he received 49.5 per cent of the vote while his opposition challenger, Kemal Kılıçdaroğlu of the Republican People’s Party (CHP) received almost 45 per cent. Now there’s going to be a runoff on 28 May.
None of this should come as a surprise. Society has become extremely polarised, especially as a result of Erdoğan’s rhetoric of fear, hatred and violence. We also witnessed many practices that violated the constitution and electoral laws, such as government ministers becoming parliamentary candidates without resigning and therefore using state resources for campaigning. The ruling party monopolises a large part of the media and used it exclusively on its own behalf. The elections were therefore held under extremely unequal conditions.
It’s hard to predict what the outcome of the runoff will be. The election may end in favour of Erdoğan or Kılıçdaroğlu. Much will depend on the practices that develop during the election.
How will the situation of vulnerable minorities in Turkey be affected by the election results?
Erdoğan uses language that is completely against human rights and the AKP has retained its parliamentary majority by coalescing with an extremist party. The situation will become dangerous if Erdoğan wins once again, especially for women, LGBTQI+ people and Kurdish people.
Withdrawal from the Istanbul Convention – the Council of Europe Convention on Preventing and Combating Violence Against Women and Domestic Violence – has already affected the feminist movement a lot. Now Law No. 6,284 on violence against women is being questioned. This poses a great danger for women and LGBTQI+ people.
Similarly, if Erdoğan wins again, pro-security approaches to the Kurdish issue will continue to dominate, preventing progress towards peace.
As for Syrian asylum-seekers, the AKP presents itself as having provided a good environment for them, but it is not really the case. Asylum-seekers in Turkey do not qualify as refugees because of the state’s reservation to the 1951 Refugee Convention. They are subjected to racist attacks. They work as cheap labour in extremely difficult conditions. Women and girls live under permanent risk of violence. An AKP win will not give them a chance.
But it must be noted that the CHP’s proposal regarding refugees is not any more democratic or inclusive, and its discourse also has racist overtones. Therefore, first and foremost, the discriminatory, double-standard approach to the Refugee Convention should be questioned.
What kinds of domestic or international support do Turkish independent media and journalists currently receive, and what more would you need?
Journalists working in independent media in Turkey, and especially in Kurdistan, are clearly not receiving sufficient international support. The Republic of Turkey is a state party to many international conventions that guarantee freedoms of expression and the press. The state has committed to respecting them on paper, but it violates them in practice. All these conventions have monitoring mechanisms, but unfortunately, they are not being properly implemented for Turkey. In this sense, the European Union has left Turkey alone.
We believe that Turkey should be questioned more, especially by western media organisations and by Turkey’s co-signatory states of international rights conventions, to contribute to the lifting of repressive measures against the dissident press.
