  • HAÏTI : « Si la mission a du succès, les autorités n’auront pas à se tourner à nouveau vers la communauté internationale pour maintenir la paix »

    Rosy est responsable de programmes du Réseau National de Défense des Droits Humains (RNDDH), une organisation de la société civile qui œuvre pour l’instauration d’un État de droit en Haïti.

    Suite à la démission du premier ministre de facto Ariel Henry en avril, un Conseil présidentiel de transition a été nommé pour tenter d’entamer le processus de rétablissement de la paix dans un pays assiégé par les gangs. En proie à des divisions internes, il a fallu attendre le mois de juin pour que le conseil nomme un nouveau premier ministre, l’universitaire et praticien du développement Garry Conille. Le même mois, le premier contingent de la Mission multinationale de soutien à la sécurité des Nations unies, dirigée par le Kenya et longtemps retardée, a commencé à arriver. Compte tenu de la longue histoire d’échecs des interventions internationales en Haïti, la société civile est sceptique et exige que la mission soit fortement axée sur les droits humains.

    Qu’est-ce qui a changé depuis la démission du premier ministre de facto Ariel Henry ?

    Après l’avoir soutenu tout au long de son gouvernement, la communauté internationale a finalement retiré son soutien à Henry, qui a démissionné dans la honte. Il était un prédateur des droits humains et nous étions donc heureux de le voir partir, même si ce n’était pas de la manière dont nous l’aurions souhaité.

    Un Conseil présidentiel de transition a été mis sur pied avec la participation de la communauté internationale via la Communauté caribéenne (CARICOM), l’organisation régionale. Il compte en son sein des personnalités issues de secteurs qui n’inspirent pas confiance à la population haïtienne. La seule femme qui fait partie du Conseil a un rôle d’observateur et tous les candidats au poste de premier ministre auditionnés étaient des hommes.

    Un mois après l’installation de ce conseil, avec le peuple haïtien dévasté par l’insécurité et les bandes armées, un premier ministre a enfin été élu : Garry Conille, lui aussi soutenu par la communauté internationale. La prochaine étape logique est la mise en place d’un gouvernement de transition.

    Qu’attend la société civile du nouveau premier ministre ?

    Nous attendons du nouveau Premier ministre qu’il tienne sa première promesse : celle d’établir un gouvernement dans lequel les femmes n’auront pas un rôle symbolique mais occuperont des postes de pouvoir. Et nous espérons que des femmes ayant un agenda de lutte pour les droits des femmes dans le contexte de la transition seront choisies. Il est important de respecter le quota minimal de 30% de femmes dans les organes de décision – sans pour autant s’y arrêter, puisque plus de la moitié de la population haïtienne sont des femmes –, mais il est également important que les femmes qui occupent ces postes s’impliquent dans la lutte contre les violences sexuelles et sexistes, les discriminations et les injustices sociales subies par les femmes.

    Nous espérons aussi que les décisions qui seront prises par ce gouvernement à venir tiendront compte des priorités de la population : combattre l’insécurité, lutter contre l’impunité dont ont toujours bénéficié les bandits armés et mettre les victimes de l’insécurité au cœur des décisions, ainsi qu’organiser les élections.

    Et, sachant que cette transition a une obligation de résultat, tout doit être mis en œuvre pour que la feuille de route du Conseil et du premier ministre soit réalisée.

    Quelle est la situation en matière de sécurité et de droits humains ?

    La situation des droits humains sur le terrain est très préoccupante : les vols, assassinats, viols, viols collectifs, massacres, attaques armées et enlèvements contre rançon, et les incendies des maisons et des véhicules de la population sont monnaie courante.

    Deux grandes coalitions de gangs armés qui jadis se battaient entre elles, le « G-9 an Fanmi e Alye » dirigé par Jimmy Chérizier, alias Barbecue, et le « G-Pèp », dirigé par Gabriel Jean Pierre, alias Ti Gabriel ou Gabo, se sont regroupées autour d’une fédération et s’attaquent à la population civile pour asseoir leur pouvoir.

    Les conséquences sur la vie et la sécurité de la population haïtienne sont énormes : les bandits armés contrôlent la circulation des biens et des services ainsi que les approvisionnements en carburant et en médicaments et sèment la terreur. Certaines zones se sont complètement vidées de leur population. Des victimes de l’insécurité vivent dans des camps d’accueil surpeuplés, dans la promiscuité et exposés à toutes sortes d’exactions et de maladies contagieuses.

    Les écoles ne fonctionnent pas toutes. Des milliers d’enfants en âge d’être scolarisés et de jeunes qui devaient fréquenter l’université viennent de perdre une année académique. Des hôpitaux et centres de santé ont dû fermer leurs portes en raison de l’insécurité. Des alertes à la crise alimentaire aigüe ont été lancées : en Haïti, nous vivons une crise humanitaire sans précédent. Et, si aucune mesure n’est prise, elle s’aggravera.

    Dans un pays appauvri, où le système éducatif n’était déjà pas inclusif et où les droits sociaux ont toujours été considérés comme des produits à se procurer, le fossé de l’accès à l’éducation et à des soins de santé de qualité se creuse. Les femmes, les enfants et les personnes vivant avec une déficience physique, sensorielle ou même cognitive, ont été les premiers touchés par les conséquences néfastes du chaos instauré par les bandits armés, avec la complicité de l’institution policière et des autorités au pouvoir dirigé par Henry.

    Dans ce contexte de violation massive et continue des droits humains, le Conseil présidentiel de transition n’a pas encore prouvé qu’il comprend la nécessité d’agir vite.

    Comment la nouvelle mission internationale a-t-elle été créée et en quoi diffère-t-elle de ses prédécesseurs ?

    Le 6 octobre 2022, Henry avait sollicité l’envoi d’une « force robuste » en vue, selon ses dires, « de combattre l’insécurité, rétablir la paix et de réaliser les élections ». Près d’une année plus tard, le 2 octobre 2023, le Conseil de sécurité des Nations Unies a adopté une résolution autorisant le déploiement d’une force baptisée Mission Multinationale d’Appui à la Sécurité, après que le Kenya eut accepté d’en assurer le leadership.

    La mission a mis du temps à se mettre en place. Elle est en train de commencer, mais nous restons sceptiques.

    Elle sera la onzième mission depuis 1993. Toutes ses prédécesseuses ont été impliquées dans la commission de violations des droits humains à l’encontre de la population haïtienne : exécutions sommaires, bastonnades et atteintes à l’intégrité physique et psychique, marchandage sexuel, viols sur mineurs.es et sur femmes. Et la seule sanction à laquelle s’exposaient les auteurs de ces violations était le rapatriement.

    L’Organisations des Nations Unis a apporté le choléra, dont la propagation a causé la mort de plus de 10.000 personnes, et n’a accepté ses responsabilités que du bout des lèvres. Les promesses de dédommagement n’ont jamais été tenues.

    Les résultats des différentes missions en Haïti, qui ont coûté des millions de dollars, sont maigres. Les institutions policières et judiciaires, ainsi que l’organe électoral qu’on leur a toujours demandé de renforcer, n’ont jamais été aussi dysfonctionnels. Le calcul coût-bénéfice et leur implication dans les violations des droits humains suggèrent qu’elles sont contre-productives.

    Il faut toutefois reconnaitre que la population, fatiguée de l’insécurité qui lui vole sa vie et son humanité et ayant perdu confiance dans le système pénal haïtien, place ses espoirs dans cette force internationale. Actuellement, la police ne traque pas les bandits notoires, les tribunaux ne les jugent pas, même par contumace, alors que plusieurs centaines de victimes de massacres, accompagnées par le RNDDH, ont porté plainte contre leurs agresseurs. Les rares fois où ils sont emprisonnés, ils s’évadent ou passent des années en détention, sans que les faits qui leur sont reprochés ne soient jamais élucidés et sans que les victimes ne reçoivent justice.

    Comment la mission internationale doit-elle agir pour contribuer à une paix durable ?

    Avec six autres organisations de la société civile haïtienne, nous avons réfléchi à cette question et formulé des recommandations. Celles-ci portent notamment sur la définition des objectifs de la mission et la prise en compte des préoccupations des organisations de défense des droits humains dans l’élaboration du cadre réglementaire et du plan stratégique de sécurité de la mission.

    La résolution étant restée muette ou ayant utilisé des termes sibyllins sur certaines questions importantes, nous insistons sur la nécessité d’aborder les obligations des agents.es relatives à la gestion des eaux, aux normes déontologiques et de transparence, ainsi qu’aux mécanismes de monitoring et de suivi des comportements des agents.

    Nous recommandons également l’établissement de mécanismes de prévention des actes de violations des droits humains et la mise en place d’un mécanisme de plaintes pour les éventuelles victimes. Il est essentiel que les pays pourvoyeurs d’agents.es s’engagent à tout mettre en œuvre pour que les exactions soient punies et que les garanties judiciaires des victimes soient protégées et respectées.

    Plus que toute autre chose, nous espérons que la mission mènera ses opérations sur le terrain avec la participation des policiers.ères haïtiens, qui y gagneront en formation et en tactiques de lutte contre les bandes armées, afin qu’au départ de cette mission, les autorités haïtiennes n’aient pas à se tourner à nouveau vers la communauté internationale pour maintenir la paix et la sécurité.

  • HAITI: ‘Gangs control the country instead of the authorities’

    With 38 years of experience, Nancy is a Haitian-born journalist renowned for her work for press freedom. She is the recipient of numerous awards, including UNESCO’s Jean Dominique Prize for Press Freedom.

    What’s the current security situation in Haiti?

    The situation is untenable, to use the exact words of Volker Türk, the United Nations (UN) High Commissioner for Human Rights. Despite a state of emergency and a succession of curfews the government has declared since 4 March to try to regain control of the capital, Port-au-Prince, not a week goes by without kidnappings. Violence is a daily occurrence.

    People are holed up in their homes, most schools are closed and economic activity is severely affected. The same goes for roads, where gangs have been imposing their law for more than three months and many drivers are out of work. Virtually all the capital’s infrastructure has been destroyed or seriously affected by gang attacks.

    An attack on the National Penitentiary on 2 March came as a great shock to Haitians, even though they are used to living under the constant threat of violence. More than 4,500 inmates are believed to have escaped, including prominent gang members and people arrested in connection with the assassination of President Jovenel Moïse in July 2021. There have been widespread looting and attacks, particularly against the National Library, which was stormed on 3 April.

    On the evening of 2 April, heavily armed bandits looted dozens of homes and seized private vehicles in the villages of Tecina and Théodat, in Tabarre municipality, northeast of Port-au-Prince. The vast majority of the population, already living in extreme poverty, have now been plunged into hell and left to fend for themselves.

    As for the police, despite some efforts, they are neither equipped nor numerous enough to deal with such a situation of urban guerrilla warfare against heavily armed gangs. There are currently around 23 gangs operating in the Port-au-Prince metropolitan area, divided into two major coalitions: G-Pèp, led by Gabriel Jean Pierre, known as Ti Gabriel, and G9 Family and Allies, led by Jimmy Chérizier, alias Barbecue. However, UN experts estimate there are between 150 and 200 gangs throughout Haiti.

    According to the UN, since the start of the year, 1,193 people have been killed and 692 injured as a result of gang violence. The health system is on the verge of collapse, and hospitals often lack the capacity to treat the injured. The economy is suffocating as the gangs impose restrictions on people’s movements. The main supplier of drinking water has stopped deliveries. The situation has led to a major food crisis: almost half of Haiti’s 11 million inhabitants need some form of food assistance.

    How did the gangs become so powerful?

    The gangs have powerful backers in government and the private sector. Under former de facto Prime Minister Ariel Henry, who resigned in March, the government funded 30 per cent of the members of the G9. It wouldn’t be surprising if some people, both in the private sector and former senior government officials, have continued to fund them, particularly those who have been sanctioned by the international community.

    A UN expert report published in 2023 also singled out former president Michel Martelly, in power between 2011 and 2016, as well as several prominent business leaders and legislators, as providing resources to armed gangs, whether in kind or in cash.

    The proliferation of gangs began under Martelly and intensified after Moïse’s assassination. By 2019, some 162 armed groups had been identified, more than half of them operating in the metropolitan area. In total, they are said to potentially have over 3,000 soldiers armed with firearms, including adolescents and children.

    Under Moïse, numerous massacres took place, such as the La Saline massacre in 2018, the Bel Air massacre in 2019 and the Cité Soleil massacre in 2020. All took place in neighbourhoods with significant electoral power where members of the opposition lived, and these crimes all went unpunished.

    In 2020, the situation worsened when Chérizier, a former police officer, federated the gangs with the G9 Family, allied to the nine most powerful gangs in the region. This enabled him to control a large part of Port-au-Prince – all while being covertly financed by high-ranking government officials.

    The federation of gangs was even hailed by the UN Secretary-General’s Special Representative in Haiti, who claimed that federating the gangs had reduced the number of homicides by 12 per cent in three months. This caused such a scandal that she was forced to retract her statement, describing it as a ‘misinterpretation‘.

    A year after the assassination of Moïse, as the situation worsened, the UN Security Council unanimously adopted a resolution establishing a sanctions regime that targeted gang leaders and those who financed them. Chérizier was the only gang leader named in an annex to the resolution, but to date no action has been taken against him.

    On 29 February 2024, the situation in the capital took a decisive turn for the worse when Chérizier announced, in a video posted on social media, the reconstitution of the coalition of armed groups known as Viv Ansanm (Living Together). In the video, he claimed responsibility for the tensions that have shaken Port-au-Prince and declared that the gangs’ primary objective was to overthrow the government. He also stated that a hunt was now on for ministers and the Director General of the National Police. He wanted to arrest them and prevent Henry, who was in Puerto Rico, returning to the country. Police officers were killed, police stations were attacked and several flights were cancelled following an assault by gangs at Toussaint Louverture international airport, which has since been closed.

    Chérizier claims to be launching a revolution to liberate the Haitian people from the authorities and the oligarchs. But the gangs have targeted every stratum of society, as well as the poor districts of Port-au-Prince and many state structures that serve the poor, such as the main public hospital. The destruction is such that the UN refers to Haiti as ‘a state on the brink of collapse’.

    By December 2023, more than 310,000 people had been displaced within Haiti. According to the International Organization for Migration, more than 50,000 people left Port-au-Prince in three weeks in March 2024. The scale of the disaster is staggering, and all the countries that had promised police or military aid are absent. Haiti has been abandoned to its sad fate and gangs are controlling the country instead of the authorities.

    Why hasn’t the government reacted to the growing gang threat?

    Four years ago, the Haitian National Police officially had a force of 15,498 police officers, among them only 1,711 women, although the actual number of officers was estimated to be much lower. Moreover, the humanitarian programme put in place by the Biden-Harris administration to make it easier for Haitians to live in the USA has put the police at risk of losing up to a third of its workforce to emigration.

    Against this backdrop, chaos and violence have reached unprecedented levels. Since Moïse’s assassination, the government has been unable to establish order with the police, and the army has only had around 2,000 soldiers. No legislative or general elections have been held since 2016. As a result, there are no longer any elected representatives, as the terms in office of the previously elected ones have expired. Critics of Henry, who was very unpopular, considered his government illegitimate.

    In October 2022, Henry appealed to the international community, requesting the intervention of a foreign force. Given his unpopularity, this aroused public mistrust, as people feared this intervention would strengthen an illegitimate government accused of colluding with gangs. What’s more, the composition of this mission turned into a headache.

    Almost a year later, the UN Security Council adopted a resolution authorising the use of force by an international security assistance mission in Haiti. Neither Canada nor the USA wanted to intervene directly, stressing that the solution had to come from Haitians themselves. But Haitians have been unable to reach agreement, and what’s more, they fear foreign intervention, given the catastrophic interventions led by the UN since 2004. Canada, which had been asked by the USA to take the lead in the intervention, withdrew in March 2023, passing the leadership on to Kenya.

    Deployment of a multinational intervention force was due to begin on 1 January 2024. Last July, Kenya offered to lead the mission with a thousand police officers. Antigua and Barbuda, Bahamas and Jamaica had pledged to send security personnel, and more recently Belize and Guyana did as well. Canada has also pledged to participate in the mission. For its part, the US government pledged to fund the mission to the tune of at least US$100 million.

    As the gangs extended their hold over Port-au-Prince and formed an alliance with the declared aim of overthrowing Henry, he planned to travel to Kenya to sign a reciprocity agreement. While he was away, Chérizier’s criminal gangs launched their attacks on police stations, the airport and prisons. They threatened civil war if Henry returned to Haiti. He resigned on 11 March 2024. The next day, Kenya suspended the dispatch of police to Haiti.

    Who is in charge today, and what are the chances of democracy being restored?

    In the wake of Henry’s resignation, the government declared a state of emergency. On the same day, it was announced that a Presidential Transitional Council (PTC) had been formed to restore order. The Council is made up of nine members: seven voting members and two observers. It includes representatives of the main political parties, civil society and the private sector. Its 22-month mandate is due to end on 7 February 2026 after it has organised ‘democratic, free and credible elections’.

    There are already a number of obstacles to achieving this goal. First, how can security be re-established when the gangs are still receiving weapons from the USA? The latest twist is that when Henry issued the decree announcing the formation of the PTC, it didn’t include any of the members’ names. Since then, the organisations of the PTC’s appointed representatives have expressed their disagreement with the government decree published in the official gazette on 12 April 2024. Finally, the decree formalising the appointment of PTC members was published on 16 April.

    In addition, the Council wishes to be sworn in at the National Palace before the nation, even though the Palace has been targeted by gangs on several occasions. Who will provide security? How can peace be restored to Haiti in a context of such political uncertainty and economic fragility? Will the members of the Council, some of whom are frenemies, be able to look beyond their own interests for the benefit of the nation? And who will rebuild the country after so many young people have left? Will the diaspora finally be called upon?

    Further, the possibility of famine looms on the horizon and the World Food Programme fears that its food stocks will run out by the end of April.

    Finally, how can gangs be persuaded to lay down their arms when they are making millions from kidnappings and arms sales? Crime is a very lucrative business for gangs and for citizens facing great poverty.

    How can we restore justice and punish those who have committed so many crimes against humanity? As the saying goes, no justice, no peace. Finally, what about the gangs’ political ambitions? On 11 March, Chérizier declared that it would be ‘the Viv Ansanm alliance, along with the Haitian people, who will elect the person who will lead the country’. Will the PTC have to negotiate with the gangs?

    The challenges facing the PTC are therefore significant, and one of the most arduous will be to find a way of articulating a request for external aid without losing Haiti’s sovereignty.

  • HAITI: ‘If the mission succeeds, the authorities won’t have to turn again to the international community to maintain peace’

    Rosy is Head of Programmes at the National Human Rights Defence Network (RNDDH), a civil society organisation working to support the establishment of the rule of law in Haiti.

    Following the resignation of de facto prime minister Ariel Henry in April, a Transitional Presidential Council was appointed to try to start the process of restoring peace in gang-besieged Haiti. Riven by internal divisions, it took until June for the council to appoint a new prime minister, academic and development practitioner Garry Conille. In the same month, the first contingent of a long-delayed Kenya-led United Nations Multinational Security Support Mission began to arrive. Given the long history of failed international interventions in Haiti, civil society is sceptical, and demands that the mission has a strong human rights focus.

    What has changed since the resignation of de facto prime minister Ariel Henry?

    After supporting him throughout his government, the international community finally withdrew its support for Henry, who resigned in disgrace. He was a human rights predator, so we are glad to see him go, even if it wasn’t in the way we would have liked.

    A Transitional Presidential Council was set up with the involvement of the international community through the Caribbean Community (CARICOM), the regional organisation. It’s made up of people who don’t inspire confidence among Haitian people. The only woman on the Council has an observer role, and all the candidates for prime minister it interviewed were men.

    A month after the council was established, with Haitian people ravaged by insecurity and armed gangs, a prime minister was finally chosen: Garry Conille, backed by the international community. The next logical step is to set up a transitional government.

    What does civil society expect from the new prime minister?

    We expect the new prime minister to keep his first promise: to form a government where women don’t play a symbolic role but are in positions of power. And we hope women will be chosen with an agenda to fight for women’s rights in the context of the transition. It’s important to respect the minimum 30 per cent quota of women in decision-making bodies – without this being the ceiling, since over half of Haiti’s population is female – but it’s also important that the women who occupy these positions be involved in the fight against sexual and gender-based violence, discrimination and the social injustices suffered by women.

    We hope the new government’s decisions will take people’s priorities into account’: fighting against insecurity and against the impunity that benefits armed bandits, putting the victims of insecurity at the centre of decision-making and organising elections.

    And since this transition must produce results, everything must be done to ensure the roadmap drawn up by the Council and prime minister is implemented.

    What’s the security and human rights situation like?

    The human rights situation on the ground is very concerning: robberies, murders, rapes, gang rapes, massacres, armed attacks, kidnappings for ransom and the burning of people’s homes and vehicles are commonplace.

    Two large coalitions of armed gangs, formerly at war with each other – G-9 an Fanmi e Alye, led by Jimmy Chérizier, alias Barbecue, and G-Pèp, led by Gabriel Jean Pierre, alias Ti Gabriel or Gabo – have joined forces and are attacking civilians as they seek to consolidate their power.

    The consequences for the lives and security of Haitian people are enormous: armed bandits control the movement of goods and services, including fuel and medical supplies, and sow terror. Some areas have been completely emptied of their population. The victims of insecurity are living in overcrowded camps, in promiscuity, exposed to all kinds of abuse and contagious diseases.

    Not all schools are functioning. Thousands of school-age children and young people who should be attending university have lost an academic year. Hospitals and health centres have been forced to close due to insecurity. Warnings of an acute food crisis have been issued. Haiti is facing an unprecedented humanitarian crisis. And if nothing is done about it, it will only get worse.

    In an impoverished country where the education system was already not inclusive and social rights have always been seen as commodities to be bought, the gap in access to education and quality healthcare is widening. Women, children and people with physical, sensory or cognitive disabilities have been the first to suffer the harmful consequences of the chaos created by armed bandits, with the complicity of the police and Henry’s government.

    Against this backdrop of massive and continuing human rights violations, the Transitional Presidential Council has yet to demonstrate that it understands the need to act quickly.

    How was the new international mission set up and how does it differ from its predecessors?

    On 6 October 2022, Henry called for a ‘robust force’ to be sent, in his words, ‘to combat insecurity, restore peace and conduct elections’. Almost a year later, on 2 October 2023, the United Nations Security Council adopted a resolution authorising the deployment of a force called the Multinational Security Support Mission, after Kenya agreed to take the lead.

    Setting up the mission has taken a long time. It is now up and running, but we remain sceptical.

    This will be the 11th mission since 1993. All its predecessors have been implicated in human rights violations against the Haitian people, including summary executions, beatings and attacks on physical and mental integrity, sexual trafficking and rape of minors and women. The only punishment for these violations has been repatriation.

    The United Nations brought cholera, the spread of which caused the deaths of over 10,000 people, and paid only lip service to its responsibility. Promises of reparations have never been fulfilled.

    The results of the various missions to Haiti, which have cost millions of dollars, have been meagre. The police and judicial institutions, and the electoral body they were supposed to strengthen, have never been more dysfunctional. The cost-benefit calculation of these missions and their involvement in human rights abuses suggest they are counterproductive.

    However, it must be acknowledged that many people, tired of the insecurity that robs them of their lives and their humanity, and having lost confidence in the Haitian criminal justice system, are pinning their hopes on this international force. At present, the police don’t pursue notorious bandits and the courts don’t try them, even in absentia, despite the fact that several hundred victims of massacres, supported by RNDDH, have filed complaints against their attackers. On the rare occasions they are arrested, they escape or spend years in prison without charges against them ever being cleared up and without their victims receiving justice.

    How can the international mission contribute to sustainable peace?

    Alongside six other Haitian civil society organisations, we have reflected on this question and come up with several recommendations. These include defining the mission’s objectives and ensuring the concerns of human rights organisations are taken into account in the development of the mission’s legal framework and strategic security plan.

    As the United Nations’ resolution is silent or says little on some important issues, we stress the need to address the obligations of security agents in relation to water management, ethical standards and transparency, as well as mechanisms for monitoring and following up on their conduct.

    We also recommend the establishment of mechanisms to prevent human rights abuses and a means for victims to have complaints heard. It is essential that countries that provide those coming to Haiti commit themselves to doing everything possible to ensure abuses are punished and the legal guarantees of victims are protected and respected.

    Above all, we hope the mission will carry out its operations on the ground with the participation of Haitian police officers, who will benefit from training in tactics to fight armed gangs, so when the mission leaves, Haitian authorities won’t have to turn again to the international community to maintain peace and security.

  • HAITI: ‘There is opportunity for a meaningful shift from foreign interference to true leadership of Haitian people’

    Ellie HappelCIVICUS speaks with Ellie Happel, professor of the Global Justice Clinic and Director of the Haiti Project at New York University School of Law. Ellie lived and worked in Haiti for several years, and her work continues to focus on solidarity with social movements in Haiti and racial and environmental justice.

    What have been the key political developments since the assassination of President Jovenel Moïse in July 2021?

    As an American, I want to begin by emphasising the role the US government has played in creating the present situation. The history of unproductive and oppressive foreign intervention is long.

    To understand the context of the Moïse presidency, however, we have to at least go back to 2010. Following the earthquake that devastated Haiti in January 2010, the USA and other external actors called for elections. People did not have their voting cards; more than two million people had lost their homes. But elections went ahead. The US government intervened in the second round of Haiti’s presidential elections, calling for candidate and founder of the PHTK party, Michel Martelly, to be put into the second round. Martelly was subsequently elected.

    During the Martelly presidency we saw a decline in political, economic and social conditions. Corruption was well documented and rampant. Martelly failed to hold elections and ended up ruling by decree. He hand-selected Moïse as his successor. The US government strongly supported both the Martelly and Moïse administrations despite the increasing violence, the destruction of Haitian government institutions, the corruption and the impunity that occurred under their rule.

    Moïse’s death is not the biggest problem that Haiti faces. During his tenure, Moïse effectively destroyed Haitian institutions. Haitian people rose up against the PHTK regime in protest, and they were met with violence and repression. There is evidence of government implication in mass killings – massacres – of people in areas that were known to oppose PHTK.

    Two weeks prior to Moïse’s assassination, a prominent activist and a widely known journalist were murdered in Haiti. Diego Charles and Antoinette Duclair were calling for accountability. They were active in the movement to build a better Haiti. They were killed with impunity.

    It is clear that the present crisis did not originate in Moïse’s assassination. It is the result of failed foreign policies and of the way the Haitian government repressed and halted opposition protests demanding accountability for corruption and violence, and demanding change.

    What currently gives me hope is the work of the Commission for Haitian Solution to the Crisis, which was created prior to Moïse’s assassination. The Commission is a broad group of political parties and civil society organisations (CSOs) that came together to work collectively to rebuild the government. This presents an opportunity for a meaningful shift from foreign interference to true leadership of Haitian people.

    What is your view on the postponement of elections and the constitutional referendum, and what are the prospects of democratic votes taking place?

    In the current climate, elections are not the next step in addressing Haiti’s political crisis. Elections should not occur until the conditions for a fair, free and legitimate vote are met. The elections of the past 11 years demonstrate that they are not an automatic means of achieving representative democracy.

    Today, there are many hurdles to holding elections. The first is one of governance: elections must be overseen by a governing body that has legitimacy, and that is respected by the Haitian people. It would be impossible for the de facto government to organise elections. The second is gang violence. It’s estimated that more than half of Port-au-Prince is under the control of gangs.  When the provisional electoral council was preparing for elections a few months back, its staff could not access a number of voting centres due to gang control. Third, eligible Haitian voters should have voter ID cards.

    The US government and others should affirm the right of the Haitian people to self-determination. The USA should neither insist on nor support elections without evidence of concrete measures to ensure that they are free, fair, inclusive and perceived as legitimate. Haitian CSOs and the Commission will indicate when the conditions exist for free, fair and legitimate elections.

    Is there a migration crisis caused by the situation in Haiti? How can the challenges faced by Haitian migrants be addressed?

    What we call the ‘migration crisis’ is a strong example of how US foreign policy and immigration policy towards Haiti have long been affected by anti-Black racism.

    Many Haitians who left the country following the earthquake in 2010 first moved to South America. Many have subsequently left. The economies of Brazil and Chile worsened, and Haitian migrants encountered racism and a lack of economic opportunity. Families and individuals have travelled northward by foot, boat and bus towards the Mexico-USA border.

    For many years now, the US government has not allowed Haitian migrants and other migrants to enter the USA. They are expelling people without an asylum interview – a ‘credible fear’ interview, which is required under international law – back to Haiti.

    The US government must stop using Title 42, a public health provision, as a pretext to expel migrants. The US government should instead offer humanitarian assistance and support Haitian family reunification and relocation in the USA.

    It is impossible to justify deportation to Haiti right now, for the same reasons that the US government has advised US citizens not to travel there. There are estimates of nearly 1,000 documented cases of kidnapping in 2021. Friends explain that anyone is at risk. Kidnappings are no longer targeted, but school kids and street merchants and pedestrians are being held hostage to demand money. The US government has not only declared Haiti unsafe for travel, but in May 2021, the US Department of Homeland Security designated Haiti for Temporary Protected Status, allowing eligible Haitian nationals residing in the USA to apply to remain there because Haiti cannot safely repatriate its nationals.

    The USA should halt deportations to Haiti. And the USA and other countries in the Americas must begin to recognise, address and repair the anti-Black discrimination that characterises their immigration policies.

    What should the international community, and especially the USA, do to improve the situation?

    First, the international community should take the lead of Haitian CSOs and engage in a serious and supportive way with the Commission for a Haitian Solution to the Crisis. Daniel Foote, the US special envoy for Haiti, resigned in protest eight weeks into the job; he said that his colleagues at the State Department were not interested in supporting Haitian-led solutions. The USA should play the role of encouraging consensus building and facilitating conversations to move things forward without interfering.

    Second, all deportations to Haiti must stop. They are not only in violation of international law. They are also highly immoral and unjust.

    Foreigners, myself included, are not best placed to prescribe solutions in Haiti: instead, we must support those created by Haitian people and Haitian organisations. It is time for the Haitian people to decide on the path forward, and we need to actively support, and follow.

  • HONDURAS: ‘The ruling of the Inter-American Court marks a before and after for LGBTQI+ people’

    CIVICUS speaks with Indyra Mendoza, founder and general coordinator of Red Lésbica Cattrachas (Cattrachas Lesbian Network), a lesbian feminist organisation dedicated to defending the human rights of LGBTQI+ people in Honduras. In March 2021 the Inter-American Court of Human Rights (IACtHR)made a ruling in the case of Vicky Hernández. Vicky, a trans woman, and human rights defender, was murdered between the night of 28 June and the early morning of 29 June 2009, in the city of San Pedro Sula, Honduras, while a curfew was in force following a coup. Her killing came in a context of enormous discrimination and violence, including by the security forces, against LGBTQI+ people.

    What was the process that resulted in the IACtHR ruling? What was the role of Cattrachas?

    Cattrachas Lesbian Network’s Violence Observatory recorded Vicky’s case and immediately identified it as a potential strategic litigation case, as it was one of the first murders of an LGBTQI+ person following the coup d’état.

    Even before the coup, Cattrachas had identified a pattern of non-lethal violence against transgender women by police officers. And while we had already recorded 20 violent deaths of LGBTQI+ people between 1998 and 2008, the killings of transgender women increased after the 2009 coup. The Observatory recorded a total of 15 violent deaths of transgender women, most of which occurred during curfews or states of exception decreed illegally by the government, when state security forces were in absolute control of the streets.

    In Vicky’s case, Cattrachas learned that no autopsy had been performed, so we contacted her family and found out that very few investigative steps had been taken. On 23 December 2012, Cattrachas filed the initial petition for Vicky’s murder with the Inter-American Commission on Human Rights. Robert F. Kennedy Human Rights, a USA-based human rights organisation, later joined in. The Commission issued its merits report, which established that human rights violations had taken place, on 7 December 2018 and sent the case to the IACtHR on 30 April 2019. The public hearing was held on 11 and 12 November 2020. 

    Finally, on 26 March 2021, the IACtHR issued a ruling declaring the State of Honduras responsible for the violation of Vicky’s rights to life, personal integrity, equality and non-discrimination, recognition of legal personality, personal liberty, privacy, freedom of expression and name. It also ruled that the State of Honduras failed to comply with the obligation established in article 7.a of the Inter-American Convention on the Prevention, Punishment, and Eradication of Violence against Women, also known as the Convention of Belém Do Pará. Additionally, the IACtHR established that Vicky’s death was not investigated with due diligence, and therefore condemned Honduras for the violation of due process, judicial protection and the obligation established in article 7.b of the Convention. Finally, the Court declared that the right to personal integrity of Vicky’s relatives had also been violated. The ruling was notified on 28 June 2021, 12 years after the coup d’état and the transfemicide of Vicky Hernández.

    The resolution of this case was exceptional. What was the reason for this exception?

    Its resolution was exceptional because of the multiple intersectionalities of violence present in Vicky’s life. Vicky was a young Honduran transgender woman and human rights defender, a sex worker living with HIV, with limited economic resources, and at some point in her life, precarious employment had forced her to emigrate. Vicky’s is the first case of lethal violence against an LGBTQI+ person that occurred at the intersection of two relevant contexts: the 2009 coup d’état and the context of structural violence that LGBTQI+ people, and particularly transgender women, face in Honduras.

    The case allowed the Court to reiterate standards on the right to gender identity, equality, and non-discrimination, and to insist that, in contexts of historical violence, subordination, and discrimination, in this case against transgender people, international commitments impose a reinforced responsibility on the state. Furthermore, through an evolutionary interpretation, the Court established that transgender women are women, and are therefore protected by the Convention of Belém Do Pará.

    What is the significance of this ruling for LGBTQI+ people in Honduras?

    The ruling in Vicky’s case marks a before and after, as it establishes guarantees of non-repetition that must be turned into public policy in favour of LGBTQI+ people.

    The measures set by the ruling include the establishment of an educational scholarship for transgender persons, which will bear the name of Vicky Hernández, the implementation of education, awareness-raising and training plan for the Honduran security forces, the adoption of protocols for the diagnosis, data collection, monitoring and investigation of cases of violence against LGBTQI+ people, and the adoption of a procedure to recognise gender identity in identity papers and public records. This procedure should be guided by the standards of Advisory Opinion 24/17, which implies that it should not require any law, should be expeditious, should not require pathologising tests, should not require a historical record of changes, and should be, as far as possible, free of charge.

    More than a decade after the murder of Vicky Hernández, what is the situation of LGBTQI+ people in Honduras?

    LGBTQI+ people in Honduras face constitutional and legal limitations based on sexual orientation, gender expression and gender identity that prohibit us from accessing equal marriage as well as the recognition of marriage celebrated abroad, de facto union, adoption, intimate visits in prisons, change of name based on gender identity and blood donation. Specifically, in relation to changing names, the IACtHR ruling in Vicky’s case mandates the state to establish an adequate and effective procedure to recognise the identity of transgender people.

    Honduras is the country with the highest rate of violent deaths of LGBTQI+ people in Latin America and the Caribbean. Since the transfemicide of Vicky, to date 388 LGBTQI+ people have been murdered in Honduras and one person is missing; 221 of those people are gay, 112 are transgender and 46 are lesbian. Only 83 cases have been prosecuted, resulting in 11 acquittals and 34 convictions, which reflects a 91 percent impunity rate.

    In sum, LGBTQI+ people face not only major legal obstacles but also a very high level of lethal violence and lack of access to justice.

  • HONDURAS: ‘We must address the roots of the conflict: the handing over of natural resources’

    Edy TaboraCIVICUS speaks about the criminalisation of environmental, land and territorial defenders in Honduras with Edy Tábora, director of the law firm Justicia para los Pueblos (Justice for the Peoples) and coordinator of the group of defence lawyers of eight defenders of the Guapinol river who were recently released from detention.

    Why were the Guapinol defenders criminalised?

    The case of the eight Guapinol comrades deprived of their freedom is one of the most revealing expressions of the conflicts around mining and energy and the dispossession of land and natural resources in Honduras. Along with that of Berta Cáceres, the Guapinol case is one of the most significant ones.

    Berta’s case, which culminated in her assassination, was the first in a new wave of criminalisation surrounding dispossession projects following the 2009 military coup. Her case displayed all the typical elements: stigmatisation, surveillance, rupture of the social fabric, criminalisation. The same pattern can be seen in many parts of Honduras.

    After the coup, there was a privately conducted exploration of mineral deposits and businesspeople realised there was a lot of money to be made here. In the case of Guapinol, the process kicked off with the granting of an iron oxide mining concession – one of the largest in the country – to Los Pinares, a holding company registered in Panama, owned by an extremely wealthy Honduran family. Its mining business was developed jointly with the US company Nucor.

    Nucor claims to have withdrawn from the project in late 2019 due to the conflict triggered by the criminalisation of the Guapinol defenders, but there is no evidence of this and we do not believe it to be true. Los Pinares is simply the mining arm of a company whose power comes from airport concessions at home and abroad. It is a company with high-level political connections, and with so much power that in 2013 it succeeded in getting the National Congress to change the delimitation of the core zone of a national park.

    On 22 April 2013, the day before a new mining law came into force, applications were submitted for the two mining concessions related to the Guapinol case, both located in the core zone of the Montaña de Botaderos National Park. This had been declared a national park in 2012, as part of a ‘friendly settlement’ with the relatives of Carlos Escaleras, a social leader and environmental defender active in the 1980s and 1990s, who was assassinated for defending this mountain. The statute of the national park, which bears the name of Carlos Escaleras, prohibited the granting of mining concessions in its core zone and even its buffer zone.

    However, in 2014, engineers began to arrive on the mountain to collect information and check how deep down metal was deposited. People noticed this, began to demand an explanation and organised in the Municipal Committee of Public and Common Goods of Tocoa.

    In June 2016 they began to file complaints; some were filed by the Guapinol defenders who ended up in prison. They requested information from the institutions in charge of granting mining permits but only obtained some information in November 2019, after three years of back and forth. Tired of not getting answers, in June 2018 people started protesting at the Municipality of Tocoa Colón. It was then that systematic surveillance by the national police and Los Pinares security began.

    In August 2018, the Honduran Council of Private Enterprise held press conferences in which it complained to the government about an alleged loss of 20 billion dollars caused by ‘vandals’ protesting in various parts of Honduras.

    Criminalisation was a nationwide strategy, but the criminalisation of the Guapinol comrades was the most serious case. On 8 September 2018, the Public Prosecutor’s Office presented the first accusation against 18 comrades for the crimes of usurpation, damage and usurpation of public space. Los Pinares appeared in the hearings as the accuser. Fourteen comrades were put on trial and all their cases were closed, but the fact that they were accused enabled the illegal eviction, in October 2018, of the Camp for Water and Life, one of many set up around Honduras. This was one of four charges brought by the Public Prosecutor’s Office as part of the strategy to criminalise resistance movements against mining and energy projects.

    In January 2019, in response to a complaint filed by Los Pinares, the Public Prosecutor’s Office filed another indictment against 32 people, including eight Guapinol comrades. The nature of the charges changed: it was no longer about usurpation of public space but about organised crime. Human rights defenders were now treated as taking part in organised crime, with charges including criminal association, theft, damage, unjust deprivation of liberty and aggravated arson. The case was assigned to the Specialised Court for Organised Crime, which meant it was transferred from local to national jurisdiction, in violation of the right to be tried by one’s natural judge. 

    Of the 32, a first group voluntarily submitted to trial in February 2019 and was kept in prison for only 10 days before the accusations against them were dismissed. The Guapinol eight, however, despite having voluntarily submitted to trial, were subjected to arbitrary detention from 26 August 2019 until 24 February 2022, when they finally regained their freedom.

    What did civil society do to secure their release?

    During the pandemic, Guapinol was one of the most high-profile cases globally. Not even the pandemic could stop our comrades’ defence. We quickly moved our activities online, and by late April 2020 we were already filing habeas corpus writs for our comrades’ right to health, alongside international organisations. Even under these conditions, we managed to set up discussions with important organisations, and three months after the pandemic began, we restarted our advocacy work, which meant that by the time the trial started, the case had become very well known around the world.

    Initially the case was promoted by the Coalition Against Impunity, which brings together more than 50 Honduran civil society organisations (CSOs). Later, many CSOs joined a kind of international support group for the case.

    First, we publicly denounced the violence and criminalisation against the Municipal Committee. Second, before our comrades were imprisoned, we documented the irregular granting of concessions for natural resources. Third, alongside several Honduran CSOs, we organised our comrades’ legal defence. A working group was then organised including national and international CSOs to support the defence. A lot of advocacy work was done, both nationally and internationally, to convince the public that this was a very important case and to counter the company’s account of the violence allegedly committed by our comrades.

    Documentary and testimonial work was crucial to expose our comrades’ real activism. We had many meetings with international CSOs. Canadian, US and European organisations and academics reported on the concession and the legal process. International CSOs filed amicus curiae – friend of the court – briefs with Honduran courts. We participated in multiple forums with national and international organisations.

    Many actions converged to create a powerful wave of demands for our comrades’ release. CIVICUS’s and Amnesty International’s campaigns, for example, allowed us to reach wider audiences. When the trial came, the case was widely known, and less than 24 hours after the end of the trial, in which our comrades were convicted with two thirds of the court’s votes, the Supreme Court of Justice annulled the whole process and ordered them to be released.

    This was an unprecedented decision, surely motivated by the strength of the demand for their freedom and by the evidence presented, both in and out of court, which demonstrated that our comrades were innocent and that they fight for a just cause that is of great interest to humanity.

    Are there other cases like the Guapinol case in Honduras?

    There are many defenders criminalised for defending land, including some from the Garífuna people, a marginalised minority, but they are not in prison. Many comrades were also imprisoned for defending democracy in the aftermath of 2017’s electoral fraud: around 30 people were imprisoned in maximum security prisons, but they are currently free. Most pending cases are being closed as a result of an amnesty issued by the National Congress in February 2022.

    In that sense, the Guapinol case was an exception, because this amnesty did not apply to them. What’s important about this case is that we managed to close the process by defending ourselves even with the highly questionable tools offered by the Honduran judicial system.

    However, there were other cases at the same time as Guapinol, such as that of the Indigenous comrades of the Lenca people in the department of La Paz, who were accused of forced displacement. They were imprisoned for more than a year for a crime that is the craziest thing I have ever heard: they were accused of displacing landowners. The Public Prosecutor’s narrative uses the made-up concept of ‘reverse racism’, according to which Indigenous peoples can also commit discrimination against minorities within their communities – the minority in this case being the landowners.

    Do you view Guapinol as part of a pattern of criminalisation against environmental defenders?

    We have detected patterns of criminalisation by sector in the cases we have monitored. For example, between 2011 and 2016 one of the most criminalised sectors was the student movement mobilised in defence of public education. Some 350 students, mostly university students, were criminalised.

    In the case of environmental defenders, we were able to document several patterns of criminalisation. Again and again, prosecutions were initiated only a few days after pronouncements by companies or employers’ organisations. The behaviour of the police and the Public Prosecutor’s Office has also been similar in all cases, with an initial focus on eviction and accusations changing over time following the same pattern. The narrative peddled by companies is always the same as well, often because they share the same lawyers.

    Criminalisation follows different patterns depending on the interests affected. The crimes people are accused of when challenging mining interests differ from those used to dispossess communities of land for the construction of tourism megaprojects or the plantation of African palm in the Atlantic zone, and from those used against peasants claiming access to land and crops.

    However, all the groups criminalised over the past 15 years have something in common: their resistance to the project, promoted since the 2000s, of handing over natural resources to private companies. Land grabbing was politically supported the state following the coup: from that moment on, national regulations were made more flexible to facilitate dispossession and the national police and the security forces of the Public Prosecutor’s Office and the judiciary were placed at the service of the private sector, which used them to criminalise land rights defenders.

    Has there been any improvement in the situation of environmental defenders since the new government came to power in January 2022?

    The new government brought several positive changes. First, while we had already achieved the closure of several emblematic cases, it decreed an amnesty that resulted in the closure of most legal proceedings against defenders, although there are still some cases pending.

    Second, the new government has put an end to the state’s stigmatisation of land struggles, which used to make use of information obtained by state security forces. And third, for the time being the government has not tackled conflicts with violence. People who protest are not being repressed.

    In recent years state violence was deployed to manage social protest, private violence was reflected in the assassination of defenders, and hybrid violence was seen in the area of surveillance. Over the four years of the current government we may no longer witness violent management of social protests, but there is a chance that state violence will be replaced by private corporate violence.

    What are the challenges ahead?

    The challenge right now is to address the causes of criminalisation. We have worked to defend and support our comrades criminalised by the state and private companies, but we have never been able to address what’s at the root of the conflict: the handing over of natural resources. Preventing the criminalisation of defenders is a big step, but we must address the issue of concessions, which in fact continue. Approved projects are waiting to be implemented. If we don’t seize the moment to address this problem, then when the government’s political colour changes, private companies will come back stronger and criminalisation will intensify.

    Moreover, social movements are worn out after 12 years of resistance against the handing over of natural resources. There must be accountability, reparations for victims and guarantees of legal security for defenders to be able to do their work. The hostile legal framework for exercising rights and defending human rights that has been established in recent decades must be reversed.

  • HORN OF AFRICA: ‘De-escalation must be the primary objective’

    Mengistu AssefaCIVICUS speaks with Mengistu Assefa, Program Manager at the Center for the Advancement of Rights and Democracy (CARD), about a port deal between Ethiopia and Somaliland and the possibility of it escalating into an armed conflict with Somalia.

    CARD is an Ethiopian civil society organisation that advocates for democracy and human rights through citizen empowerment.

    What’s the relevance of the recent port deal between Ethiopia and Somaliland?

    Following Eritrea’s independence in 1993, Ethiopia became a landlocked nation, placed in a challenging position for international trade. Since then, Djibouti has emerged as its primary access point to the sea, handling over 95 per cent of its trade volume. This dependence comes at a cost, with Ethiopia paying more than US$1 billion annually in fees to Djibouti’s ports and infrastructure. With its estimated population of 126 million, the second largest in Africa, Ethiopia views sea access as critical for its economic, political and demographic future.

    To achieve this, on 1 January 2024 the Ethiopian federal government signed a memorandum of understanding (MoU) on commercial port access with Somaliland, a self-proclaimed autonomous territory that is internationally recognised as part of Somalia.

    While this MoU is not a legally binding agreement, it carries significant implications for the region because it walks a tightrope between cooperation and recognition. For Somaliland, the MoU represents a potential step towards international recognition of its de facto autonomy. Although the agreement’s full details remain undisclosed, it also reportedly grants Ethiopia access to Somaliland’s Red Sea coast, potentially including a military base. Ethiopian authorities have not been explicit about Somaliland’s recognition, saying the MoU allows for an ‘in-depth assessment’ of Somaliland’s quest for recognition.

    Somalia vehemently rejects the MoU, viewing it as a violation of its territorial integrity and political sovereignty. It is actively mobilising diplomatic pressure against the deal. Somali president Hassan Sheik Mohamed has visited Egypt and Eritrea, Ethiopia’s long-standing competitors, seeking support. Additionally, the Arab League, of which Somalia is a member, has denounced the MoU. Egypt’s leader, already locked in negotiations with Ethiopia over a Nile dam project, has assured Somalia of potential support if requested, further escalating regional tensions.

    What’s the political status of Somaliland?

    Somaliland, with an estimated population of five million, broke away from Somalia and declared its independence in 1991 after 30 years of civil war. It fought for its independence based on the argument that it had a distinct historical heritage. Somaliland was a UK protectorate, while Somalia was under Italian control. For Somalilanders, this is enough argument to prove they are different territories. Moreover, in June 1960 Somaliland was briefly recognised as an independent state by around 35 nations for a span of five days, before it relinquished its sovereignty to reunite with the Somali Republic.

    Somaliland declared its independence more than three decades ago but Somalia has never recognised it. Neither has any international organisation. Even so, Somaliland has managed to become a stable, functional state. It established its own army and democratic institutions and has held six elections with peaceful transitions of power.

    In late 2022 and early 2023, a local armed movement, the Dhulbahante militias, rose against Somaliland’s government, declaring its intention to rejoin Somalia. This uprising posed significant political and security challenges to the Somaliland government, partly contributing to the postponement of 2023 elections. It cast a shadow of instability over Somaliland’s bid for international recognition, which hinges on its ability to demonstrate long-term stability and democratic institutions.

    Could the port deal lead to international recognition of Somaliland’s independence?

    Somaliland has made clear that a binding legal agreement could only be signed once it is officially recognised as an independent nation state. But the Ethiopian side of the story is quite different. Ethiopia hasn’t ruled out the possibility of that happening but hasn’t explicitly said it would take a stance on the recognition of Somaliland. The signing of a binding legal international agreement with Somaliland would however result in Ethiopia’s de facto recognition of its independence.

    Looking at the bigger picture, this deal could affect the regional security architecture, particularly when it comes to fighting Al-Shabaab, an Islamist terrorist group based in Somalia and allied with Al-Qaeda. Al-Shabaab is perceived as a global security threat and has explicitly targeted Ethiopia. Consequently, Ethiopia is engaged in fighting Al-Shabaab in Somalia alongside the Somali army. If Ethiopia recognises Somaliland, Somalia will likely force Ethiopia to pull out its troops. However, as Somalia cannot take charge of its security on its own, Ethiopia could use it as leverage to force Somalia to back down from a strong reaction.

    Ethiopia’s potential recognition of Somaliland carries significant implications. Located in a strategically crucial area along the Gulf of Eden, where Houthis and pirates constantly attack international ships, Somaliland’s 850-kilometre coastline attracts interest from various countries seeking a potential military base. Ethiopia’s explicit recognition of Somaliland could trigger a domino effect, with other countries following suit, although recognition would likely face significant hurdles at the African Union (AU).

    The AU adheres to the principle of respecting colonial borders and has expressed concerns about setting a precedent for secessionist movements in other African states, including Morocco and Nigeria. Ethiopia will likely weigh this carefully before explicitly recognising Somaliland’s independence. However, the rapidly shifting landscape of international interests suggests that it’s not an impossibility. This possibility is further amplified by the growing involvement of great and emerging powers in the Red Sea region, driven by economic and security interests.

    Could tensions escalate into a conflict between Ethiopia and Somalia?

    Ethiopia and Somalia have had difficult relations in the past. In 1964, they clashed in a three-month border conflict. This initial skirmish foreshadowed a larger and bloodier conflict that erupted between 1977 and 1978. During this period, Somalia invaded Ethiopia with the intent of annexing the Ogaden region, inhabited by ethnic Somalis. The conflict quickly became a proxy war for the contenders of the Cold War, with the western bloc supporting Somalia and the Soviet Union backing Ethiopia. Ultimately, Ethiopia repelled the Somali army.

    In 2006, the Islamic Courts Union (ICU), a group aiming to unite all Somalis across Ethiopia, Somalia and Somaliland under Islamic rule, gained control of Mogadishu, Somalia’s capital. This development raised concerns in Ethiopia, which perceived it as a threat to its national security and regional stability. Supported by the USA in the context of the ‘war on terror’, Ethiopia militarily intervened in Somalia and removed the ICU from power.

    Several years later, Ethiopia and Somalia signed a bilateral agreement aimed at stabilising the region. This agreement facilitated the deployment of Ethiopian security forces to assist the Somali National Army in its fight against Al-Shabaab and support the ongoing Somali transition process. It’s important to note that these Ethiopian troops are currently integrated into the AU Transition Mission in Somalia, a peacekeeping mission.

    Since October 2023, Ethiopia has declared its intention to gain access to the sea by peaceful means. In exchange for access Ethiopia has offered Djibouti, Eritrea and Somalia land-swaps and stakes in a successful state-owned business such as Ethiopian Airlines, Africa’s biggest and most successful airline, and even in the Grand Ethiopian Renaissance Dam. But none of these countries accepted Ethiopia’s offer, leaving Somaliland as a seemingly more amenable option.

    Somalia viewed Ethiopia’s signing of the port deal with Somaliland as betrayal. It reacted strongly and aggressively because it considers it an encroachment on its territory and an act against its sovereignty.

    Ethiopia’s recognition of Somaliland’s independence could open a Pandora’s box. In fear that it could lead to regional and global recognition, Somalia said that if Ethiopia moved forward in implementing the agreement, consequences would follow.

    This all brings us to the final and crucial point: where will this take the region? While the possibility of conflict cannot be entirely dismissed, it’s important to consider various factors and perspectives to assess its likelihood.

    First, military capabilities and intentions play a role. While Somalia’s military power is not comparable to Ethiopia’s, the potential for escalation and regional instability cannot be ignored. Additionally, Ethiopia’s stated commitment to peaceful resolutions needs to be weighed against its historical engagements and potential strategic calculations.

    Second, the international community’s role matters. The Horn of Africa and the Red Sea region are already grappling with complex conflicts and any further instability would have significant repercussions. International pressure and diplomatic efforts to de-escalate tensions and promote dialogue will be crucial in preventing conflict.

    Further, Somalia’s response to the MoU adds another layer of complexity. Its seeking of support from Ethiopia’s historical competitors, such as Egypt and Eritrea, as well as regional entities such as the Arab League, could potentially lead to increased diplomatic pressure against Ethiopia. This, in turn, could further strain relations between the two countries for the foreseeable future.

    Finally, the MoU is likely to ignite discussions about the status of Somaliland, both within the AU and at the United Nations Security Council.

    What should the international community do to address this potential crisis?

    The international community plays a crucial role in navigating the complex situation surrounding Ethiopia’s pursuit of sea access and its MoU with Somaliland. It is essential to engage with all stakeholders, particularly the Somali government and Somaliland’s authorities. It should be a top priority to facilitate negotiations to find a lasting solution that ensures both peaceful coexistence and normalised relations, as people in the Horn of Africa are ultimately bearing the brunt of this disagreement.

    Regardless of the outcome, be it Somaliland’s reunification with Somalia or its international recognition as a separate state, the two countries must establish a mutually agreeable arrangement for peaceful coexistence. The international community can play the role of facilitating a genuine conversation between the two. This is of course easier said than done, given the historical complexities of their relationship and the vested interests of various states and organisations, including western nations and other international players, who prioritise their security and economic interests in the region.

    International involvement should also aim to support Ethiopia and Somalia in reaching a mutually agreeable solution. This requires careful diplomacy to avoid exacerbating existing tensions or creating new problems. It’s also essential to urge those with vested interests in the region to avoid exploiting this situation for their agendas. De-escalation must be the primary objective.

  • INDIA: ‘Civil society organisations are at the forefront of the fight against gender-based violence’

    Kavitha RaviCIVICUS discusses the recent wave of protests against gender-based violence (GBV) in India with Dr Kavitha Ravi, a member of the Indian Medical Association (IMA).

    Protests erupted across India after a 31-year-old female medical trainee was raped and murdered in a Kolkata hospital on 9 August. The IMA called a strike, with protests held in major cities including Kolkata and Mumbai. While the official strike has ended, many doctors, particularly junior doctors, remain on strike and protests continue to demand justice, accountability and safer working conditions for women.

    What triggered the recent protests against GBV in India?

    Protests erupted after the tragic rape and murder of a young female doctor at the R G Kar Medical College in Kolkata on 9 August. This horrific incident shocked the nation and sparked widespread outrage. In response, a coalition of doctors, medical associations such as the IMA and various resident and faculty associations joined together in a nationwide strike to demand justice for the victim and better safety measures for health workers, particularly women who face significant risks in the workplace.

    Protesters are calling for major reforms, including the adoption of a Hospital Protection Act, which would designate hospitals as safe zones and introduce measures to create a safer environment for health workers. Their demands are part of a larger movement to comprehensively address GBV, prevent similar tragedies in the future and create a safer and more supportive working environment for everyone in the health sector.

    What steps have been taken so far to ensure justice and the safety of female health workers?

    The judicial system has acted swiftly by transferring the case to a higher authority to ensure a thorough investigation after concerns were raised about the police’s initial inquiry, which was not accepted by the students or the victim’s family. They were sceptical, believing the police might be favouring the college authorities and supporting the accused.

    This decision aims to ensure a detailed investigation so justice can be done. The Supreme Court of India is also overseeing the case to monitor its progress, address any issues that may arise and ensure all necessary steps are taken to uphold justice.

    In parallel, several initiatives are underway to improve the safety of female health workers. The Ministry of Health has proposed establishing a committee to review and improve safety protocols in health facilities. There are also plans to increase security in hospitals and establish a new national taskforce dedicated to improving safety through better infrastructure, advanced technology and additional security measures. However, despite these efforts, more needs to be done to combat GBV and ensure that these measures effectively protect female health workers.

    How have the authorities responded to the protests?

    The authorities have taken a mixed approach to the nationwide strike, combining concessions with new measures to address immediate concerns. The Health Ministry has drawn up a detailed plan to increase security in central government hospitals. This includes installing high-resolution CCTV cameras, monitoring access points with identification badges, deploying trained security personnel for constant patrolling and securing duty rooms for female staff. Hospitals are also encouraged to develop and regularly update emergency response plans and conduct mock drills.

    In response to these measures, the IMA suspended its strike. However, other doctors’ associations have continued to protest for more substantial reforms. Many people remain dissatisfied, particularly after recent incidents of police violence. While the Supreme Court’s intervention may have temporarily eased the tensions, protesters remain concerned about the new measures’ effectiveness and full implementation.

    Why is GBV so prevalent in India, and what’s being done about it?

    Deep-rooted cultural, social, economic and legal factors account for the high prevalence of GBV in India. This is a patriarchal country where traditional gender roles and the subjugation of women are deeply entrenched. Women tend to be economically dependent on men, which traps them in abusive relationships that make it difficult for them to seek help or escape. Intergenerational cycles of violence perpetuate the problem, as children who witness or experience abuse may come to see such behaviour as normal.

    Low literacy rates, particularly in rural areas, further limit women’s understanding of their rights and the available support. When they do seek justice, the system often fails to protect the victims or hold perpetrators accountable. Systemic failures in law enforcement and justice help perpetuate GBV.

    Many initiatives and campaigns have helped highlight and address this issue. But it has not been easy. A lack of consistent political will and weak implementation of policies have hindered substantial change. Feminist and social justice movements often face resistance from conservative parts of society, making it difficult to change these deeply entrenched cultural norms.

    To combat GBV effectively, we need a comprehensive approach that includes better education, legal reform, economic empowerment and cultural change. Civil society organisations are at the forefront of this fight, actively advocating for stronger laws, better enforcement and increased public awareness. Continued and robust efforts are essential to address this widespread problem and ensure meaningful change.

  • INDIA: ‘The once-cosmopolitan state of Manipur is now divided into two rival communities’

    CIVICUS speaks about ethnic violence and a humanitarian crisis in the Indian state of Manipur withMangneo Lhungdim and Sulekha Thapa, Executive Director and Deputy Director of Oasis India.

    Founded in 1994, Oasis India is a civil society organisation (CSO) working to prevent human trafficking and other forms of violence against women and children and support people so they can flourish in their community. Oasis India has also been involved inemergency relief work in Manipur.

     

    What triggered ethnic violence in Manipur state?

    Manipur and a few other northeastern states of India endured severe ethnic violence until the mid-1990s and into the early 2000s. But over the past two decades rights-based reconciliation and development efforts gained momentum, including infrastructure development initiatives that ultimately benefited local communities.

    In this new context, the conflict between the majority Meitei people living in the Imphal Valley and the Kuki-Zo tribal community from the surrounding hills, now into its eighth month, could definitely have been prevented. As retired military and police officers have claimed, public order could and should have been restored within the first month of the conflict in May 2023. The state administration, supported by central security forces, had the capacity to contain the violence and prevent further displacement and killings.

    The conflict is believed to be a collateral outcome of valley Meitei people demanding inclusion on the Scheduled Tribes list under the Constitution of India, which tribal communities interpreted as an attempt to grab their land. On 3 May 2023, the tribals of Manipur, under the aegis of All Tribal Students Union Manipur, carried out a protest march in most hill districts, including Churachandpur. Violent incidents during the Churachandpur march spiralled and spread statewide, turning into senseless killings, arson and displacement.

    It’s difficult to identify particular reasons behind this outbreak of violence since the media coverage was initially limited and subsequent reports by independent journalists gave mixed messages and focused primarily on day-to-day events. Nevertheless, the government must fully acknowledge its responsibility and admit that it bears significant blame for such escalation of a latent ethnic conflict.

    The once-cosmopolitan state of Manipur is now divided into two rival communities and there’s no prospect of the conflict ending any time soon, as there are no substantial peacebuilding efforts by the state or national government. The only hope of restoring normality in life and livelihoods in Manipur comes from collaborative efforts undertaken by local CSOs and leaders.

    What’s the current situation on the ground?

    The situation is relatively more stable now than during the initial three to four months of the conflict, but it still remains challenging. The deployment of over 50,000 central security personnel has led to increased militarisation.

    The violence affects every aspect of the lives of people of all ages.

    Agriculture is the primary occupation in the region, but a majority of farmers missed the sowing and harvest seasons due to curfew regulations and lack of resources. This has deprived them of earnings to meet the basic needs of their families and resulted in shortages of staples.

    Over 60,000 people have been forcibly displaced and currently stay in camps where CSOs are the primary providers of humanitarian aid. Road communications from Manipur’s capital city, Imphal, to affected districts are severed, which complicates the delivery of relief and affects local businesses.

    The strict curfew forced schools to close, causing children to miss several months of education and delaying the start of the new academic year. Healthcare services have also been disrupted. Even burying the dead was impossible for a long period, though some improvement has been noted over the past few days, when the remains of 64 people were taken back to their homelands.

    The emotional impact on the residents of Manipur is profound. People have lived in fear and anxiety for a long time, and many have lost family members or their homes.

    How has Indian civil society, including Oasis, worked to address the humanitarian crisis?

    Several Indian CSOs have responded to the humanitarian needs in both the hills and valley districts of Manipur. In the hill districts, the primary providers have been local churches, national aid agencies, volunteers and philanthropic organisations. Many families continue to rely on supplies and assistance provided by civil society and the neighbouring states of Assam, Mizoram and Nagaland.

    Civil society is working to improve the lives of internally displaced people sheltered in relief camps. Those in Churachandpur, for instance, receive vocational training, including tailoring and computer courses. Those who already have specific skills are provided with craft materials such as wool and weaving sets, to knit sweaters and woollen caps, while others have received bamboo wood and plastic knitting wire to make stools. This has become a source of income for many people, making a huge difference in their lives.

     

    What challenges have you faced in doing your work?

    For Oasis India and various aid agencies, the primary challenge has been delivering relief to the valley areas of Manipur, as the national highway was cut off, making it impossible to transport essential supplies without a security convoy. Food and hygiene kits were mainly sourced from neighbouring Mizoram and Nagaland, incurring high costs and taking 15 to 17 hours on a rough road to deliver supplies to tribal districts.

    Over time, Oasis started to assist people in relief camps but could only help displaced people from the Kuki-Zo tribes. Despite efforts by our senior management to overcome obstacles, there have continued to be security challenges in reaching out to the Meitei community.

    Yet another significant problem lies in mobilising resources for relief from national and international donors. The conflict’s nature as being between ethnic communities, which has been projected as having a political colour, has caused many funders to shy away.

    What should be done to resolve the conflict, and how should the international community help?

    International aid is insufficient. Since May 2023, neither the European Commission’s Civil Protection and Humanitarian Aid Operations department nor the United Nations Children's Fund have stepped in to provide humanitarian assistance to Manipur. The same is true for the Prime Minister National Relief Fund and the Prime Minister's Citizen Assistance and Relief in Emergency Situations Fund. The international community must collaborate with local CSOs that continue taking the lead in providing aid.

    For a genuine resolution to the conflict, both the Kuki-Zo and Meitei communities must come to the table, engage in dialogue and avoid any hate speech, and collaborate to establish peaceful coexistence. To facilitate this, a ceasefire should be agreed at all buffer zones. Given the loss of trust in the state government by the tribal Kuki-Zo people, an independent empowered authority could potentially broker a ceasefire between the two warring communities. There are enough sensible people and peace-loving activists in both communities who can play critical roles in bringing about reconciliation and peace.

    To put an end to the violence and prevent its repetition, perpetrators, regardless of ethnicity, should be held accountable. The Supreme Court has ordered the formation of at least 42 special investigation teams to prosecute conflict-related crimes, so at least there’s hope in this regard.

  • IRAN: ‘Mahsa Amini’s case was a spark in a flammable situation’

    sohbraCIVICUS speaks with Sohrab Razaghi, executive director of Volunteer Activists (VA), about the currentwomen-led protests, the state of civil society and the prospects for change in Iran.

    VA is an independent civil society organisation (CSO) based in the Netherlands, whose primary aims are building capacity among activists and CSOs, facilitating information exchange among civil society activists, community peacebuilding and advocating for the expansion of democracy and human rights in Iran and more generally in the Middle East. VA is the successor of a pioneer Iranian CSO, the Iranian Civil Society, Training and Research Centre, founded in 2001 and based in Tehran until 2007.

    What is the situation of Iranian civil society today?

    Civil society in Iran has become weaker over the past few years. Civic activism has grown but organised civil society has become weaker and has been marginalised. Following President Ebrahim Raisi’s ascent to power in 2021, civic space has shrunk dramatically. The establishment and operation of CSOs has been legally obstructed and any CSO not following the policies of Iranian authorities has been eliminated.

    Following significantteachers’ protests in May 2022 there was a major crackdown against the Iranian Teachers’ Trade Association and many of its leaders and activists were arrested. This was just one example of many.

    The ongoing crackdown follows a predictable sequence: first, the authorities exploit toxic narratives and disseminate false accusations to malign civil society and create internal conflict within civic movements. Then they repress the smaller remaining groups, arresting and detaining their leaders and activists.

    The authorities have attacked all institutions and organisations that are the expression of social power, eliminating the possibility of further organising. To fill up the space, they set up fake CSOs organised and led by government officials, often affiliated with the Iranian Revolutionary Guard Corps. These are often local, community-oriented organisations that involve local communities by approaching the mosques and charities that support them.

    What made the death of Mahsa Amini a turning point?

    Mahsa Amini’s case was a spark in a flammable situation. She was a young member of an ethnic minority who was visiting Tehran, was violently arrested by the morality police and died under custody. All these elements together made her case relatable for many Iranians. She was only 22 years old, a woman, a member of an ethnic minority and a Sunni Muslim, which is a religious minority in Iran. Many Iranians identify with at least one and possibly many of these elements of Mahsa’s identity and resent the policies aimed at suppressing them. As a result, large groups that feel discriminated against and suppressed mobilised.

    This happened in a context of high poverty and repression, with a government that acts with impunity because it knows it won’t be held accountable. For years, instead of trying to meet the needs of their citizens, the authorities have cracked down on all sorts of protests. With Raisi coming to power, any hope for change was gone.

    In what ways have these protests been different from previous ones?

    The current protests are very different from previous ones, including recent protests that took place in2017 and2019. First, protesters are mostly between 15 and 25 years old. This is possibly their first engagement in a civic movement. They have grown up in the digital world and are using in the real world what they learned playing video games – only that in the real world, there is no respawning! So many are getting killed.

    Second, protesters are primarily women and students. And some of their acts of protest, such as female protesters burning headscarves and cutting their hair, are unprecedented. Their demands are also different from those of previous civic movements. Whereas in 2017 and 2019 demands were mostly economic, now they are cultural: their main demand is for freedom to lead a different lifestyle than the authorities allow them to have. The shout ‘Women, Life, Liberty’ has become a protest cry and a slogan of solidarity both inside Iran and internationally.

    Third, support from Iranians in the diaspora and media coverage have both drastically increased. This time the events have received major media coverage since the outset, with the protests on front pages all over the world. For the first time, on 23 October, 80,000 Iranians from the diaspora gathered in Berlin to support protesters and demonstrate against the Iranian regime. This support is unprecedented. 

    Finally, public discourse about the protests has shifted. In the past, dominant discourse highlighted the non-violent character of the protests, but this time there have been calls for retaliation and to use violence to defend the protests. Violence is no longer taboo: some elites and influencers inside and outside Iran are advocating for it. This is extremely concerning, considering that it may legitimise violence by the Iranian authorities, which could resort to even more violence in response.

    How has the government cracked down on the protests, and why have protests continued regardless?

    The government has used multiple tactics. First, it deploys riot police and security forces that use violence to physically prevent and dissolve protests. As a result, over 7,000 protesters have been arrested, many have been beaten and over 200 have been killed. Second, it has restricted internet access for over four weeks now, limiting the free exchange of information while increasing the circulation of disinformation and official propaganda. Third, it has used the same narrative tactics it normally uses against civil society, linking the protests to foreign intelligence forces.

    The government’s reaction has been as repressive as towards previous movements. However, these protesters are more resilient, so the crackdown has not been as effective as previous ones. Two sources of this resilience are decentralisation and spontaneity: protests are held locally rather than in a central place, and they are not centrally organised – they are organised by small groups and happen rather spontaneously during the day or night at random hours, with protesters quickly dispersing afterwards.

    Additionally, the fact that there are so many children and young students among protesters has somewhat limited the violence. Many children and adolescents have been killed, but the death toll would likely have been much higher had they not been among protesters. And many of these young people are students, therefore part of the middle class – which means there is a cultural middle class that continues to support the protests.

    What is the likelihood of these protests leading to change?

    We can identify five possible scenarios – and only one of them leads to regime change.

    In the first scenario, the crackdown succeeds and protests end. This would result in widespread hopelessness and disappointment.

    In the second, the authorities make concessions and the mandatory hijab rules are repealed. This would lead to the recognition of some limited freedoms, but not to regime change.

    In the third, neither the authorities nor the protesters prevail, leading to continuing violence and bloody conflict. Protesters go into an armed offensive and the situation escalates into a civil war-like situation.

    In the fourth, military groups seize power and suppress both protesters and established authorities to pursue their own goals.

    In the fifth scenario, mass mobilisation leads to regime change.

    What happens will depend on the capacity of protesters – the resources they can gather, the groups they can bring together, the leadership they build and the collective narrative they produce out of compelling personal stories – and international influences and pressures.

    In the current situation, scenarios one to three are the most likely. The movement has not entered a revolutionary stage. There are not massive gaps in the regime – neither in its repressive machinery nor in its will to crack down on protests. And the protests have not been massive nor widely representative of the make-up of society. We have not seen hundreds of thousands or even tens of thousands on the streets, and we have not seen protests by various ethnic or religious minorities, and by different social classes. Strikes are typically the heart of social movement action in Iran, and we have not yet seen strikes by major branches and sectors of the economy.

    What can women’s rights supporters and democracy activists from around the world do to support civil society in Iran?

    International civil society as a collective should be more vocal. We need a unified collective of civil society echoing the voices of Iranian activists and advocates for democracy and human rights in Iran. In addition, actions of solidarity are needed as well as networks to exchange knowledge, experience and skills so Iranian activists can learn from civic movements internationally and be more effective.

    Regarding the immediate response, there are various needs, such as juvenile justice support, including legal support, wellbeing and mental health support, as well as training and awareness raising on civic activism in Iran.

    The main goal should be to support Iranian protesters and activists so their voice is heard and the crackdown does not succeed, while supporting the victims of the crackdown. International pressure is instrumental, not only from governments but also from civil society as a change leader. A close connection between international civil society, Iranian activists in diaspora, Iranian civil society and the media is also essential.

  • IRAN: ‘The severity of the crackdown only shows how scared the regime is of the protest movement’

    SohrabRazaghiCIVICUS speaks with Sohrab Razaghi, executive director of Volunteer Activists (VA), about the situation in Iran on the anniversary of the anti-regime protests sparked by the death of Mahsa Amini at the hands of morality police.

    VA is an independent civil society organisation (CSO) based in the Netherlands, whose primary aims are building capacity among activists and CSOs, facilitating information exchange among civil society activists, community peacebuilding and advocating for the expansion of democracy and human rights in Iran and more generally in the Middle East. VA is the successor of a pioneer Iranian CSO, the Iranian Civil Society, Training and Research Centre, founded in 2001 and based in Tehran until 2007.

    What is the situation in Iran one year on from the start of the protest wave?

    The situation in Iran is complex. While last year’s massive protests made people hope for change, the crackdown on the protests caused hopelessness. The authorities were mostly able to suppress the protests and regain control of the streets, forcing people back into their homes.

    Moreover, while the ‘Women, Life, Freedom’ protest movement had an appealing chant and vision, it lacked a long-term plan that could lead to change. Over the past year, it has been unable to translate its slogan into a political programme and was therefore unable to mobilise other social and political forces around its goals.

    But despite the authorities’ success in regaining control, we have continued to see acts of civil disobedience across Iran. Activists, artists and academics express themselves through social media and make public displays of protest not wearing hijab. The fact that the voices of protesters have not been silenced sustains hope for change.

    A concerning development, however, is the increasing gap between established civil society and the protest movement. CSOs were hesitant to participate in the protests when they began, and this gap has only increased since. There is even a lack of a common vocabulary in calling for mobilisation and articulating demands. Established CSOs disagree with what they view as radical moves by the protest movement, as they have a more conservative view of society and the future. A possible explanation for this divergence may be the generation gap, as the protest movement is formed by much younger activists.

    To reassert control, the authorities have imposed stricter control over media, universities, unions and other associations. In essence, civic space has shrunk dramatically over the past year, with the authorities purging most sectors of everyone who disagrees with them.

    Internationally there was a huge wave of support for the protest movement from governments, civil society and media, particularly early on. This was extremely helpful for echoing the voices of Iranian protesters and pressuring the authorities to meet their demands. But as the authorities regained control of the streets, we have seen a change in the approach of western governments. They are returning to diplomacy and negotiations with Iran, slowly normalising their relations. This has boosted the Iranian regime’s confidence, re-legitimising it and giving it space to spread its propaganda.

    What tactics has the government used to limit further mobilisation?

    The number one tactic of the regime to crack down on protests has been to arrest protesters. Over the past year, thousands have been arrested, including over 20,000 who were arrested during the protests. Some have been given long jail sentences.

    The second tactic has been the prevention of organising and networking. Even small communities have been actively prevented from getting together. Online networking has been limited by censorship, filtering and hacking. Leaders and activists trying to establish any form of group are arrested and their work is disrupted. They threaten activists with jail and even death. They also target their personal life by demanding that they be fired or suspended from work or university. Many teachers and professors who supported the protest movement have been fired and students expelled.

    To reach those who may not have joined the protest yet, the authorities spread propaganda, fake news and conspiracy theories that delegitimise the protest movement. Some communities fear the protest movement as a result.

    To prevent the development of a political alternative to the regime, the authorities have targeted the opposition within and outside Iran. Their main aim seems to be to sow division among opposition groups and force them to deal with issues internal to the opposition movement instead of focusing on developing an alternative coalition. Iranian cyber forces have supported these efforts through hacking and social media manipulation.

    What forms has resistance taken in response?

    Iranian activists have pursued two strategies in response. First, the protest movement sought to widen its scope to increase its resilience. By mobilising excluded ethnic groups such as Baloch and Kurdish people, the protest movement expanded to more cities and communities, making the crackdown more difficult. Second, the protest movement tried to stay on the streets for as long as possible, hoping to create division among crackdown forces.

    Internationally, the movement’s main strategy was to try to isolate the regime by forcing the severance of as many diplomatic connections as possible. For example, it successfully advocated for Iran to be removed from the United Nations Commission on the Status of Women and it also sought to force the closure of Iranian embassies in western states.

    How have Iranian organisations from the diaspora or in exile supported the protest movement in Iran?

    We have observed two phases in the involvement of the diaspora and exiled Iranian organisations in the protest movement. In the first phase, they organised large-scale solidarity mobilisations and projects in support of the ‘Women, Life, Freedom’ protests in Iran. Over 80,000 Iranians from the diaspora participated in the solidarity protest in Berlin in Germany, for example.

    After this initial phase, however, each political group in exile tried to present itself as the leader of the protest movement. This broke the solidarity and unity of the movement. Instead of fighting against the regime, some diaspora groups mostly fought each other. Independent activists and organisations in the diaspora that didn’t want to be caught in this fight decreased their involvement. For the protest movement to succeed, opposition groups and political movements need to get better at resolving their conflicts, reaching compromises and building a unified anti-regime coalition.

    Has the crackdown intensified as the first anniversary approaches?

    Civil society activists have continued to be arrested and organisations put under pressure and shut down. But as the first anniversary approaches, we are seeing repression increase, particularly in universities and among journalists. Universities have recently fired more lecturers and professors and expelled more students who participated in last year’s protests. Student associations have been shut down long ago and any form of student organising is banned.

    Journalists are also being heavily repressed. The authorities are disrupting reporting and coverage of protest actions and calls for protests around 16 September. They are threatening and arresting journalists, prosecuting them and handing them heavy sentences.

    Independent lawyers, who have been instrumental in supporting arrested and imprisoned activists, are also being threatened. Lawyers have played key roles in defending activists in court and spreading information about their trials, informing the public on the authorities’ repression. As a result, they are being threatened with losing their licences or being arrested.

    Is Iran closer to change now than a year ago?

    I think we are multiple steps closer to change than before. Iranians are less scared of the consequences of their activism. They dare to take action against the regime. The voice of protest is louder and the severity of the crackdown only shows how scared the regime is of the protest movement. The regime understands it won’t be easy to shut down this protest movement, which threatens the legitimacy and therefore the existence of the regime.

    We also see a major lifestyle change. People on the streets are now dressed differently and are less afraid of showing their lifestyle in public. Although political change is minimal, cultural change following last year’s protests is clearly visible. This change shouldn’t be underestimated.

    What needs to happen for political change to take place?

    Iranians need to realise the power of being together. Change comes from power, and power comes from organising and acting together. To bring about change, we need social power and to create social power, organising is essential. By forming associations, organisations and networks, Iranians can demand and achieve change.

    For this to happen, three types of changes are required. First is a change in attitude. Iranian activists need to think positively and constructively instead of negatively and destructively. Second is a change in behaviour. We will only achieve democracy if we also act democratically and use democratic tools. This means avoiding any form of violence and understanding that democracy does not rise from bloodshed and fire. Third is a change in context. It is key to empower society to say no and resist the regime.

    The international community could support change by helping to increase the resilience of the social movement and its activists, both online and offline. The pursuit of meaningful and sustainable change is a marathon and it’s instrumental to echo the voices of activists and provide sustainable support. A coalition of international civil society organisations could help by providing strategic support to Iranian activists.

  • IRAQ: ‘Tolerance for abuses against LGBTQI+ people has now been made explicit through legislation’

    Sarah SanbarCIVICUS discusses the criminalisation of same-sex relations in Iraq with Sarah Sanbar, researcher at Human Rights Watch’s Middle East and North Africa division.

    The Iraqi parliament recently passed a law criminalising LGBTQI+ people, punishing same-sex relations with between 10 and 15 years in prison and transgender identities with sentences of one to three years. The original proposal included even harsher penalties, but lawmakers introduced amendments in response to strong criticism. Supporters claim the law upholds deeply held religious values, while critics condemn it for institutionalising discrimination and enabling serious human rights abuses.

    What led to recent legislative changes criminalising LGBTQI+ people?

    On 27 April 2024, the Iraqi parliament passed an amendment to the country’s 1988 anti-prostitution law, effectively criminalising same-sex relations and transgender identities. The amendment states that same-sex relations are punishable with between 10 and 15 years in prison, and provides for one to three years’ imprisonment for those who undergo or perform gender-affirming medical procedures.

    The law also punishes those who ‘imitate women’ with a seven-year prison sentence and a fine of between 10 and 15 million Iraqi dinars (approx. US$7,700 to US$11,500) and criminalises the ‘promotion of homosexuality’, a vague and undefined expression.

    The passing of this law follows years of steadily increasing hostile rhetoric against LGBTQI+ people. Prominent politicians and media personalities have consistently spread harmful stereotypes, tropes and disinformation. They often claim homosexuality is a western import that goes against traditional Iraqi values.

    This rhetoric has increasingly translated into government action. For example, on 8 August 2023, the Communications and Media Commission issued a directive ordering all media outlets to replace the term ‘homosexuality’ with ‘sexual deviance’ in all published and broadcast language. The directive also banned the use of the word ‘gender’, which shows how the crackdown on LGBTQI+ rights is intertwined with broader issues, and is also used to target and silence women’s rights organisations working on gender-based violence.

    Sadly, as in many other countries, LGBTQI+ people in Iraq are being used as political pawns and scapegoats to distract from the government’s failure to provide for its people. Tensions are growing between the more conservative and religious groups in society and government and those that take a more secular approach to governance. The fact that conservatives have gained increasing support in successive elections allows laws like this to be passed. Such a law probably wouldn’t have been passed even a few years ago.

    What’s the situation of LGBTQI+ people in Iraq, and how do you expect it to change?

    The situation of LGBTQI+ people is extremely unsafe. Threats to their physical safety, including harassment, assault, arbitrary detention, kidnappings and killings, come from society at large – including family and community members as well as strangers – and from armed groups and state personnel. Human Rights Watch has documented cases of abductions, rape, torture and killings by armed groups. Impunity is widespread, and the government’s failure to hold perpetrators accountable sends the message that this violence is acceptable.

    With the passage of the new law, the already dire situation is expected to worsen. Tolerance for abuses has now been made explicit through legislation. As a result, an increase in violence is to be expected, along with an increase in the number of LGBTQI+ Iraqis fleeing the country to seek safety elsewhere. Unfortunately, it is becoming even harder for LGBTQI+ Iraqis to ensure their physical safety in the country, let alone lead fulfilling lives, find love, make friends and build links with others in their community.

    What are the challenges facing Iraqi LGBTQI+ rights organisations?

    The space for LGBTQI+ organisations in Iraq has long been extremely limited. For example, in May 2023, a court in the Kurdistan Region ordered the closure of Rasan, one of the few groups willing to publicly advocate for LGBTQI+ rights in the region. The reason the court gave for its closure was its activities ‘in the field of homosexuality’, and one piece of evidence cited was its use of rainbow colours in its logo.

    Organisations such as Rasan have previously been targeted under vaguely worded morality and public indecency laws that restrict freedom of expression. By criminalising the ‘promotion of homosexuality’, the new law makes the work of LGBTQI+ organisations even more dangerous. Any action in support of LGBTQI+ rights could be perceived as ‘promoting homosexuality’, which could lead to activities being banned or organisations being shut down. It will be almost impossible for LGBTQI+ rights organisations to operate openly.

    In addition, all civil society organisations in Iraq must register with the Directorate of NGOs, a process that includes submitting bylaws, lists of activities and sources of funding. But now, it is essentially impossible for LGBTQI+ organisations to operate transparently, because they can’t openly state their intention to support LGBTQI+ people without risking closure or prosecution. This leaves two options: stop working, or operate clandestinely with the risk of arrest hanging over them.

    Given the restrictive legal and social environment, many organisations operate from abroad. IraQueer, one of the most prominent LGBTQI+ advocacy groups, is based in Sweden.

    But despite the challenges, LGBTQI+ organisations continue to advocate for LGBTQI+ rights, help people fleeing persecution and work with foreign governments to put pressure on Iraq to roll back discriminatory policies. And they have made significant achievements, facilitating the safe passage of people fleeing persecution and broadening coalitions to advocate for LGBTQI+ rights internationally. Their perseverance in the face of adversity is inspiring.

    What international support do local LGBTQI+ groups need?

    Global organisations should use their capacity to sound the alarm and advocate for the repeal of the new law and the reversal of other discriminatory measures, and for impunity for violence against LGBTQI+ people in Iraq to be addressed.

    An effective strategy could be to focus on human rights violations. Equal protection from violence and equal access to justice are required under international law, including the International Covenant on Civil and Political Rights and the Arab Charter on Human Rights, both of which Iraq has signed. Advocacy for LGBTQI+ rights as human rights can put greater pressure on the Iraqi government to fulfil its obligations.

    It’s also essential to provide resources and support to local organisations in Iraq and in host countries where LGBTQI+ Iraqis seek refuge, to ensure people have access to basic needs and community support, and can live full lives without fear.

  • KENYA: ‘Protests against femicides encouraged survivors to seek justice’

    Wangechi_Wachira.pngCIVICUS speaks with Wangechi Wachira, Executive Director of the Centre for Rights, Education and Awareness (CREAW), about recent protests demanding justice for femicide victims and policy changes to combat gender-based violence (GBV) in Kenya.

    Founded in 1999, CREAW is a national feminist women’s rights civil society organisation (CSO) dedicated to protecting and promoting women’s and girls’ rights and addressing systemic gender inequalities, oppression, exploitation and discrimination.

    Why did protest recently erupt in Kenya?

    On 27 January, thousands of women and men took the streets to protest against femicides. The protests were triggered by 14 cases in January alone, and their primary objective was to demand accountability from state agencies, particularly law enforcement and the judiciary, in prosecuting perpetrators of femicide and ensuring justice for the victims. The case of John Matara, accused of killing Starlet Wahu, highlighted the failures of the legal and judicial systems, because he had been previously reported for GBV multiple times but had remained free.

    Femicide Count reported 48 cases in January and February 2024, compared to 152 cases during 2023, which itself was the highest number in the past five years. Data from Africa Data Hub indicates that over 500 women were killed in acts of femicide from January 2016 to December 2023. It also acknowledges the number is likely much higher, with many killings of women not properly categorised as femicide.

    The protest also aimed to raise awareness about the issue, as many people, including those in public office, do not fully understand the severity of femicide as the most extreme form of GBV. A 2021 report by the United Nations (UN) Office on Drugs and Crime revealed that 56 per cent of all female homicides globally are committed by intimate partners or family members.

    Protesters sought to educate the public on victim-blaming, which empowers perpetrators and deters survivors from reporting abuse. By addressing the victim-blaming and shaming associated with GBV, the protests challenged societal norms and encouraged survivors to seek support and justice.

    What were protesters’ demands to the government?

    We urged the president to issue a declaration recognising GBV and femicides as a national crisis requiring an emergency response. Such a declaration must be accompanied by annual reports provided during the State of the Nation address, outlining measures taken to combat the problem.

    We also urge the government to establish a national public inquiry and official review of events or actions ordered by a government body for all femicide cases to track and ensure accountability.

    Given the lack of integrated official data, we also demand the government improves data collection on femicides and GBV, aligning it with international frameworks. This data is crucial for evidence-based policymaking and effective criminal justice responses.

    Additionally, we call for increased funding for GBV prevention programmes and demand an inclusive appointment process for all public positions, ensuring representation from grassroots feminist organisations and youth groups.

    How big a problem is GBV in Kenya, and what are its root causes?

    GBV is pervasive in Kenya, mirroring global trends. It exists in several forms, including physical, sexual, verbal, emotional and economic abuse. According to the 2022 Kenya Demographic and Health Survey, over 40 per cent of women have experienced physical or sexual violence from an intimate partner at some point in their lives. GBV also manifests in harmful practices such as female genital mutilation and child marriages. Femicides are a frequent occurrence and appear to be on the rise.

    The roots of GBV are found in patriarchal underpinnings of our society, which promote harmful social and cultural practices often reinforced by religious beliefs. Power is concentrated in men’s hands and women have little to none. Such unequal dynamics cannot but foster violence.

    Economic factors such as poverty help perpetuate GBV by pushing women to stay in abusive relationships due to lack of financial independence. They also push families in famine-hit areas to marry off young girls for economic gain, and specifically to be able to acquire livestock in return.

    Conflict, crises and displacement leave women and girls especially vulnerable to violence. A recent example is the COVID-19 pandemic, which saw an 80 per cent increase in intimate partner violence in 2020.

    How does civil society work to address GBV in Kenya?

    Civil society plays key roles in addressing GBV. CREAW specifically has a workstream focused on ending violence against women and girls. Over the years, we have provided free legal aid and psychosocial support to over 20,857 GBV survivors. We are among the few CSOs that offer these services. We collaborate closely with state-sponsored legal aid programmes, such as the National Legal Aid Service, to ensure integrated, efficient and timely GBV service delivery. Our work is enhanced by strategic partnerships with various GBV working groups, Court User Committees, relevant health institutions, parts of criminal justice system and community dispute resolution mechanisms.

    CREAW actively engages with legislators and policymakers at both national and county levels to advocate for the development and implementation of regulatory frameworks on GBV. Our advocacy contributed to the passage of the 2006 Sexual Offences Act, 2013 Matrimonial Property Act, 2014 Marriage Act and the 2015 Protection Against Domestic Violence Act.

    The aim of the Sexual Offences Act is to set out what constitute sexual offences, provide ways to prevent illegal sexual acts and protect all people from them. The Matrimonial Property Act sought to provide clear rules for what belongs in a marriage’s matrimonial estate and provide a legal framework for the ownership, management and distribution of matrimonial property that would apply to all types of unions. This was a monumental achievement because it recognised rights women didn’t previously have, such as owning and buying land.

    The Marriage Act consolidated various laws on marriage, provided procedures for separation and divorce and regulated the custody and maintenance of children in the event of separation or divorce. The Protection Against Domestic Violence Act provides avenues for victims and survivors of violence to report their circumstances to relevant authorities, seek legal redress and receive justice.

    CREAW also supports the county governments of Kilifi and Meru, the Kenya Police Service and the Kenyan judiciary in strengthening their mechanisms for implementing existing GBV laws and policies.

    CREAW’s commitment to supporting survivors extends to financial inclusion. Since 2020, we have implemented a programme, the Jasiri Fund (‘bold’ in Swahili) that provides GBV survivors with quality financial services to mitigate the effects of GBV and enable economic empowerment. To date, the project has supported around 1,000 survivors with a total of US$400,000, leading to the establishment of at least 878 women-owned enterprises. The Jasiri Fund offers complementary support, including access to justice, psychosocial support, shelters, business grants and case management grants, accompanied by financial training and business development support. Its success led to its scaling up to cover more counties and support more survivors.

    We are also part of the National Gender Based Violence working group, coordinated by the National Gender and Equality Commission and the National Women’s Steering Committee, and of the National Council on the Administration of Justice Working Committee on GBV.

    CREAW served as a co-convener of the Kenya Chapter of the Africa Unite campaign against GBV. We are also members of the Solidarity for African Women’s Rights and the Sustainable Development Goals Group. We contribute to various campaigns such as Gender is My Agenda and globally contribute to the Generation Equality Forum commitments.

  • KOSOVO: ‘Civil society has done most of the effort when it comes to dealing with our recent history’

    What’s the current security and human rights situation in Kosovo?

    The security and human rights situation in Kosovo is complex and multi-faceted. While Kosovo’s Constitution ensures robust human rights protection and incorporates several international human rights mechanisms into its legal framework, inconsistent law implementation creates a fertile ground for rights violations to flourish. Unfortunately, violations persist across many domains, with discrimination and violence against women, LGBTQI+ people, children and non-majority communities being prevalent issues.

    In recent years, ethnic violence has increased in north Kosovo, triggered by the implementation of ID and licence plate regulations in 2022. These policies increased tension and ultimately led to Kosovo-Serbs resigning from public institutions and boycotting local elections. Violent clashes were reported in north Kosovo between Kosovo-Albanian police factions and peacekeeping soldiers on one side and Kosovar Serbs on the other. On 24 September, an attack unfolded at Banjska Monastery involving around 30 armed people from Serbia and the Kosovo-Serb community. The incident resulted in a fatal shootout that killed one Kosovar police officer and three attackers. This has heightened tensions further and created a fragile political and diplomatic situation between Kosovo and Serbia.

    Political leaders, driven by nationalist propaganda, foster social divisions between two ethnic groups. The risk of secession in north Kosovo, if not properly addressed, would pose a precedent for other separatist conflicts and cause destabilisation in the whole Balkan region. Russia’s war against Ukraine has changed the geopolitical landscape and the stability paradigm in Europe. This created an even greater need to extinguish local conflicts and prevent their recurrence, particularly between Kosovo and Serbia.

    What should be done to normalise relations between Kosovo and Serbia?

    Serbia’s non-recognition of Kosovo’s independence since 2008 has created obstacles against normalising relations between the two states and induced an economic blockade as well as presenting international diplomatic challenges. The normalisation of relations requires a process of social change alongside the implementation of agreements and resolution of underlying problems, such as the establishment of an association of Serb-majority municipalities and the enhancement of institutional functionality in north Kosovo as well as the recognition of Kosovo’s sovereignty by Serbia.

    Civil society on both sides constantly works to improve the situation through a range of initiatives, including continuous support in the negotiation process. However, deteriorating political relations are exacerbating public tensions. As a result, CSOs in Kosovo have difficulties in engaging with communities that are predominantly Kosovo-Serbian.

    What are relations between the Kosovo-Albanian and Kosovo-Serbian communities like?

    The war in Kosovo claimed thousands of lives and destroyed the social fabric, replacing it with hatred and isolation. The rupture in communication between most Kosovo-Albanians and Kosovo-Serbs has made the two communities closed and isolated, seeing each other as enemies. Children are often brought up in fear and unaware of the wider context and problems shared by all communities in Kosovo. The influence of media, nationalist organisations and an aggressive environment pressure young people to take sides and view ‘the other’ as the cause of all problems. Ignorance about each other is the source of the prejudices and hostility that persist to this day.

    An important factor lies with the education system. Various nationalist narratives are perpetuated through history books, as evidenced by an analysis we conducted in 2017. Kosovo-Serb young people learn from history books produced by the Serbian government, which barely mention the Kosovo             War and portray Serbian people as the main victims. Xenophobic language has created isolation, prejudice, lack of trust and a feeling of insecurity in both communities.

    How is YIHR-KS working toward reconciliation and peacebuilding in Kosovo?

    Compared to political institutions, Kosovar CSOs have done most of the effort when it comes to dealing with our recent history. Over the years, the Kosovo government initiated efforts related to transitional justice, including the establishment of an inter-ministerial working group to develop a national strategy on transitional justice, a preparatory team for a Truth and Reconciliation Commission and a War Crimes Institute. Unfortunately, these initiatives became politicised and to this day Kosovo hasn’t been able to implement a comprehensive transitional justice strategy.

    To address the current polarised situation, YIHR-KS launched the ‘Dealing with the Past’ programme, aimed at building a collective memory and lasting peace in Kosovo and the Balkan region. We conduct workshops and memory initiatives aimed at educating young people about the Kosovo War and providing them with opportunities to connect with peers from ‘the other side’.

    One notable initiative is the Virtual Museum of Refugees, a digital archive featuring stories of forcibly displaced people. By collecting and sharing refugee interviews, this archive helps preserve memory and provides a basis for the understanding of Kosovo’s past through personal stories. It’s also a platform for refugees to connect with others who may have undergone similar experiences and thus foster a better understanding among survivors of what happened in the war. The museum challenges ethno-nationalistic narratives and builds a shared vision for reconciliation.

    We facilitate residential and regional exchanges for young people from Kosovo-Albanian and Kosovo-Serbian communities so they can share experiences, ideas and opinions and learn about transitional justice, intercultural dialogue and negotiation skills. We also organise visits to sites where war crimes occurred against both Kosovo-Albanians and Kosovo-Serbs for them to hear stories from victims’ family members. This experience is transformative because it bridges gaps created by propaganda, which is based on concealing crimes committed against the ‘other’ group.

    Every year we conduct street actions to commemorate the International Day of the Victims of Enforced Disappearances and the National Day of Missing People. We use these to demand greater commitment and engagement from the government of Kosovo to seek truth and establish justice for over 1,600 missing people of all ethnicities.

    We closely cooperate with all YIHR offices in the region, and particularly with Serbia’s due to our shared and troubled past. Together with YIHR Serbia, we issue joint statements and are vocal about the human rights violations committed in the 1990s Balkan wars and the present political and social tensions.

    What further international support does Kosovar civil society need?

    Civil society activities in Kosovo have significantly expanded over recent years, creating space for policy advocacy and the promotion of transparency and democratic ideals. However, despite the large number of CSOs addressing pressing issues, there is a lack of funding for activities.

    We need further support in facilitating the European Union (EU) integration agenda, aligning Kosovo’s legal system with the Community acquis – the accumulated legislation, legal acts and court decisions issued since 1993 that make up EU law, strengthening democratic values and promoting a safe and equal environment for everyone living in Kosovo.

    Kosovo would also significantly benefit from joining the Council of Europe. This would enable access to expertise and resources to advance the transitional justice agenda and encourage a victim-led approach.

  • KOSOVO: ‘Civil society plays a crucial role in maintaining communication in difficult times’

    MilicaAndricRakicCIVICUS speaks with Milica Andric Rakic, project manager at New Social Initiative (NSI), about intensifying inter-ethnic violence and deteriorating civic space in Kosovo.

    NSI is a civil society organisation (CSO) that seeks to empower non-majority communities to participate in Kosovo’s social and institutional life and increase trust among communities by helping people to deal with past events and promoting the normalisation of relations between Kosovo and Serbia.

    What’s the current human rights and security situation in Kosovo?

    The situation in Kosovo is highly volatile. Kosovo declared independence from Serbia in 2008, but to this day Serbia doesn’t recognise Kosovo as an independent state and continues to claim it as an autonomous province of Serbia. The longstanding impasse in negotiations is straining inter-ethnic relations within Kosovo, between Kosovar Serbian and Albanian communities. Unlike past tensions that eventually subsided, the security situation has steadily worsened over the past two years.

    Human rights are generally upheld in Kosovo, although rather selectively. For example, successive governments have refused to implement constitutional court decisions regarding the ownership of an Orthodox monastery’s extensive land and the establishment of an association of Serbian-majority municipalities, two longstanding demands of the Kosovo Serb community. There have been break-ins at Orthodox churches and police arrests of Kosovar Serbs without a prosecutor’s order. While the overall human rights situation isn’t bad, there are specific areas where the government fails to respect the law and court orders.

    What was the significance ofviolence in Banjska on 24 September?

    The attack occurred in the context of increased tensions in north Kosovo, which included the resignations of thousands of Kosovar Serbs working in the public sector, including the mayors of four municipalities. On 24 September 2023, Serb militants carried out an attack against the Kosovo police in the village of Banjska, in north Kosovo.

    North Kosovo’s population is 90 per cent Serbian but its police force is mainly Albanian, which leads to a level of mistrust and tensions that pose a threat of violence. Those involved in the attack had a secessionist political agenda. While secession isn’t an imminent threat, it’s definitely a motivating factor, and many on-the-ground processes have had a disintegrative effect.

    What role is civil society playing in normalising relations between Serbia and Kosovo?

    It seems that civil society has been the only healthy player in Serbian-Albanian relations. It has played a crucial role in maintaining communication in difficult times. We’ve acted as mediators between the international community and Kosovar and Serbian governments, trying to understand the perspectives of all sides.

    From 2011 to 2017, effective dialogue and integrative processes were underway, albeit with slow implementation and numerous challenges. The European Union (EU) played a special facilitating role in the negotiations, motivating both sides through the promise of potential EU membership.

    But now the only trend we are witnessing is towards disintegration. The lack of proper dialogue over the past two years indicates a need for a political change on at least one side to move the process forward.

    How is NSI working towards peacebuilding in Kosovo?

    As an umbrella organisation, we engage Kosovars in inter-community dialogue through various projects. One initiative promotes reconciliation by creating connections and fostering cooperation among young Kosovar Serbs and Albanians. As there are limited organic opportunities for them to meet, the responsibility for creating personal inter-ethnic ties lies largely on the shoulders of local CSOs. If a Kosovar Serbian and an Albanian know each other, there’s an 80 per cent probability that they’ve met at a civil society activity.

    Another programme focuses on multiculturalism and bilingualism. Albanian and Serbian are both official languages in Kosovo, and our goal is to increase social acceptance and promote the learning of both. For almost 40 years we haven’t been taught each other’s language in school, which has led to a significant linguistic gap. It should be noted that Albanian and Serbian are very different languages and can both be challenging to learn.

    We have a transitional justice programme, where we collaborate with associations that represent various categories of war victims, including families of missing people and internally displaced people. This regional project involves Kosovo, North Macedonia and Serbia. We support these associations to expand their work from truth-seeking to regional reconciliation, simultaneously enhancing their financial sustainability by securing funding for new projects. We have also participated and proposed policies in the Ministry of Justice’s working group to draft a national strategy for transitional justice.

    Moreover, we’ve organised diverse artistic activities, including a joint photo exhibition, ‘All Our Tears’, in which photographers captured images of war victims in Kosovo, North Macedonia and Serbia. The exhibition was showcased in cities including Kosovo’s capital Prishtina, Serbia’s capital Belgrade and at the Council of Europe in Strasbourg. Additionally, we have supported regional theatre projects that raise transitional justice issues through performance.

    What challenges do you face in doing your work, and what further support do you need?

    There has been a significant narrowing of civic space in Kosovo, marked by delegitimising campaigns targeting CSOs, political opponents and critics of the government, mainly through online harassment. Our organisation, along with some staff, has faced such attacks.

    Engaging with the government on policy matters has been challenging, as our recommendations regarding the Kosovar Serb community are often ignored or poorly implemented. It’s evident that the government’s outreach to the Kosovar Serb community is influenced more by international pressure than a genuine willingness to engage. The contacts we maintain with government representatives are often facilitated by outside parties, either from embassies or European think tanks that hold roundtable discussions where we can directly discuss issues of the local Serb community with the government.

    Kosovar civil society has sufficient funding opportunities. What we really need is support to maintain our relevance, especially when governments attempt to exclude CSOs from political decision-making processes. Whenever there’s an attempt to narrow civic space, the international community should demonstrate that it’s willing to support local CSOs, signalling their importance and thereby putting pressure on the government to take them into consideration.

  • MEXICO: ‘The problem of insecurity is paramount, but it cannot be solved with militarisation’

    CIVICUS speaks about the militarisation of security in Mexico and its implications for civil society with Sofía de Robina, a lawyer with Centro de Derechos Humanos Miguel Agustín pro Juárez-Centro Prodh.

    Centro Prodh is a Mexican civil society organisation (CSO) founded in 1988 by the Society of Jesus with the aim of defending victims of serious human rights violations and promoting structural changes to allow all people in Mexico to enjoy and exercise the full range of their human rights equally. Its work focuses specifically on Indigenous peoples and groups, women, migrants and victims of repression.

    What trends do you see in the militarisation of public security in Mexico?

    At Centro Prodh we have seen that starting in 2006, with the deployment of the armed forces in the fight against drug trafficking, there has been an increased focus on the use of force by elements of the military sector instead of on strengthening the civilian police with a focus on prevention and prioritising access to justice and the fight against the corruption of authorities linked to organised crime. Consequently, rather than decreasing, violence increased, as did human rights violations.

    The presence of the army and its responsibility for human rights violations dates a long way back – it was involved in the so-called ‘dirty war’ of the 1960s and 1970s. However, this trend deepened under the administration of President Felipe Calderón of the National Action Party, continued under President Enrique Peña Nieto of the Institutional Revolutionary Party and further intensified under the current government of MORENA’s President Andrés Manuel López Obrador.

    Over 80 per cent of the current members of the National Guard – created in 2019 through a constitutional reform and initially under the civilian command of the Ministry of Public Security – come from the military. According to the National Guard Law, the institution performs tasks of migration review and supervision, surveillance and investigation. This is extremely worrying as it is becoming a military body. Practically all of its commanders, both administrative and operational, come from the Ministry of National Defence (SEDENA), which means the National Guard is increasingly subordinate to the army.

    Congress recently approved an executive initiative to reform the National Guard Law, transferring its operational and territorial command to SEDENA. This is contrary to the constitution, which establishes that public security should be the responsibility of civilian institutions, as ratified by the Supreme Court.

    In addition, in 2020 it was established that the armed forces could continue to carry out tasks related to public security, without making clear how they would comply with the principles of exceptional, extraordinary, subsidiary, complementary and supervised intervention. Initially it was agreed that they would do so until 2024, but Congress has just approved a reform to extend the deadline until 2028, without providing any justification.

    All these decisions are evidence of the government’s commitment to militarised security instead of strengthening civilian police forces and state and federal prosecutors’ offices, which we believe would be more appropriate if the objective is to investigate crimes and human rights violations.

    Moreover, military presence has been strengthened not only in the area of public security, but also in other areas of public administration, such as customs and ports, as well as in the construction of public works. The armed forces have one of the largest budgets in the public administration and are not subject to adequate controls, even though they have historically been characterised by a lack of transparency and accountability.

    The National Human Rights Commission has shown no signs of true autonomy when it comes to military oversight. This is evidenced by the small number of recommendations it has issued despite the abundance of complaints involving the National Guard, as well as its refusal to challenge the unconstitutional legal changes.

    The attorney general’s office has also failed to carry out relevant investigations into the matter, perpetuating impunity. Oversight bodies are clearly not a sufficient counterweight to SEDENA’s growing power.

    Why has this trend developed?

    It is undeniable that the current context is one of unprecedented violence and that organised crime carries great weight in Mexico. It is responsible for many human rights violations, often in collusion or at least with the acquiescence of authorities at all levels. In some places, removing the armed forces overnight would not be the most appropriate measure to take.

    It is understandable that both the government and society are concerned about security: it is one of the problems that most affects Mexicans. However, the government has opted for militarisation, indicating that there are no other options available. Meanwhile, it has not taken any steps to strengthen adequate investigations to dismantle corruption and organised crime networks.

    The militarisation of security has not yielded good results. It has failed to reduce violence and has perpetuated human rights violations. For this reason, international organisations promote a ‘programmatic’ or gradual withdrawal of armed forces, while civilian forces and access to justice are strengthened. However, these recommendations are not being heeded and the role of the armed forces continues to be increased.

    We can’t emphasise enough that action must be taken to tackle insecurity. But it is important to discuss what measures should be employed. We believe it should be done by strengthening the civilian police and improving access to justice, and not by means of militarisation.

    How is Centro Prodh working on the impacts of militarisation?

    Centro Prodh defends and supports people who have been victims of serious human rights violations, mostly enforced disappearances, torture and extrajudicial executions. We work from a comprehensive defence perspective that includes legal defence, organisational and educational support for communities and organisations, international litigation, campaigns and public policy advocacy.

    Militarisation is one of the main focuses of our work because it has a great impact on human rights, especially for people in vulnerable situations and historically excluded people who are at the centre of our attention: poor people, migrants, Indigenous people and women.

    Although militarisation has deepened in recent years, Centro Prodh has long worked on cases of serious rights violations due to military involvement in public security. These types of abuses have always occurred, and we do not foresee them stopping any time soon.

    It is common that, as in the Tlatlaya case – where it’s alleged senior army officers ordered soldiers to kill suspected members of criminal gangs and survivors were tortured, and which remains unpunished – the armed forces carry out detentions making a disproportionate use of force and resort to torture to fabricate evidence, without being held accountable for it.

    We have worked on cases that have reached the Inter-American Court of Human Rights (IACtHR), such as the case of the Campesinos Ecologistas (‘environmental peasants’), two peasants who were defending their land and were arbitrarily detained and tortured by military forces. In 2010, the IACtHR ordered the Mexican state to redress the violations suffered by the two activists and implement structural changes to eradicate the causes of the abuses: to maintain an updated register of detainees with accessible information and control mechanisms, investigate allegations of torture and reform the Code of Military Justice to ensure that military jurisdiction does not apply to cases of human rights violations.

    We have also worked domestically on case of torture committed the armed forces – and specifically by SEDENA and the navy – which have often included sexual violence against women, including cases brought by Claudia Medina and Korina Utrera, Denis Blanco and Charly Hernández.

    In working with the families of the 43 students who were disappeared in Ayotzinapa in 2014, we have also observed the resistance of the armed forces to hand over information and be held accountable.

    In short, our concern about the militarisation of public security stems from our work to document and support action on cases of serious human rights violations committed by the armed forces.

    How is civil society responding to militarisation?

    Civil society has mobilised against militarisation for many years, and not just under the current government. This has been a longstanding and ongoing concern.

    Organisations working on the ground throughout Mexico have documented the impacts of militarisation. The Women’s Human Rights Centre in Chihuahua has done crucial work documenting violations, particularly disappearances perpetrated by the armed forces, and obtained a recent IACtHR ruling in the case of Alvarado v. Mexico, which established that ‘the intervention of the armed forces in public security activities must be based on criteria of strict proportionality, exceptionality and due diligence to safeguard the guarantees established in the Convention, because the fundamental role of the military forces cannot be conciliated with the essential functions of the civil authorities’.

    Organisations such as Tlachinollan have highlighted the repercussions of the presence of the armed forces in Indigenous and poor territories. They have worked on cases such as that of Inés Fernández and Valentina Rosendo, two Indigenous women who survived sexual torture by the armed forces, which led to a ruling by the IACtHR.

    Many local organisations, such as Fray Matías de Córdova Human Rights Centre in the south of Mexico and Casa del Migrante de Saltillo in the north, have expressed concern about the militarisation of the borders and the National Guard’s conduct in migration-related tasks .

    International human rights organisations have expressed similar concerns. The Inter-American Commission on Human Rights has been vocal on the issue since its first visit to Mexico in 1996. It has issued constant recommendations to successive governments ever since.

    So have various United Nations’ (UN) human right experts, such as the Working Group on Arbitrary Detention, the Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment and the Special Rapporteur on extrajudicial, summary or arbitrary executions. The Committee on Enforced Disappearances recently visited Mexico and referred to militarisation as one of the main reasons why we currently have more than 105,000 disappeared people.

    The Office of the UN High Commissioner for Human Rights has also consistently and emphatically expressed its concern about the military presence and resulting human rights violations.

    What alternatives is civil society proposing?

    Civil society stands in line with the recommendations made by international organisations, which are very clear: a programmatic withdrawal of the armed forces should be undertaken and civilian institutions should be strengthened – by means of training, funding and a public security strategy that addresses the root causes of the problem – alongside investigative institutions to ensure access to justice.

    Unfortunately, instead of following these recommendations, the government has deepened militarisation not only de facto but also de jure, through the creation of a dense legal and institutional framework. This indicates that the trend will be difficult to reverse and will have long-term consequences. SEDENA has always resisted controls and will not voluntarily give back the power it has gained, and it will not be easy for future governments to take it away from it. The possible erosion of the military’s subordination to civilian power opens up a question mark over the future of democracy.

    What kind of support could the international community provide?

    It is very important for the international community to keep an eye on what is happening in Mexico, monitor the decisions being made, defend civil society in the face of a government that has repeatedly restricted its work and that of independent journalists, and offer support to victims. We need their help so that human rights are placed at the centre of our politicians’ decisions.

    Our criticisms are not personal or partisan attacks. Over the years we have looked at the faces of people who have suffered the consequences of militarisation first-hand. The work we do is indispensable in any democracy.

  • NETHERLANDS: ‘No government should allow transfers of weapons to a state committing war crimes’

    Frank SlijperCIVICUS speaks with Frank Slijper, Arms Trade project lead at PAX, about a recent court victory in a case brought jointly with Oxfam Novib and the Rights Forum against the Dutch government for exporting arms to Israel that are being used in the assault on Gaza.

    PAX is the largest peace organisation in the Netherlands. It works to protect civilians against acts of war, end armed violence and build inclusive peace.

    Why did you bring a lawsuit against the Dutch government?

    We brought this lawsuit to stop our government exporting military equipment to Israel. PAX does research into the arms trade in countries that violate human rights and approaches those who finance it by appealing to their social responsibility. Oxfam and the Rights Forum share our values, so we decided to sue the government together. We had previously called on it to stop giving Israel free rein in Gaza but the government had not acted on our calls, choosing instead to continue supplying Israel with F-35 fighter jet parts despite the rapidly deteriorating situation.

    No government should allow transfers of weapons to a state committing war crimes. If there was ever a clear case of why this is so, this is it.

    Given the urgency of the situation we had to act quickly, and so we did, Merely four weeks after we learned about these exports to Israel, through a government leak posted by the NRC newspaper, we were in court making our case.

    What did the court decide?

    On 12 February, the Court of Appeal in The Hague ordered the Dutch government to stop all transfers of F-35 fighter jet parts to Israel within seven days, given the clear risk of violations of international humanitarian law by Israel. The court ruled that after 7 October 2023 the minister of Foreign Affairs was obliged to reassess the licence for the export and transit of F-35 parts to Israel and that this assessment should conclude that further export and transit must no longer be permitted. In addition, the court stated that such an assessment cannot be ‘weighed’ against other interests such as potential damage to diplomatic relations or economic interests. It also made clear that any ‘general’ arms transfer licence for an indefinite period must include a reassessment trigger in case the situation changes drastically, because otherwise the very idea of arms export controls would be undermined.

    The court also made clear that violations of international humanitarian law don’t need to be proved and that a ‘clear risk’ of such violations suffices. It found it ‘sufficiently plausible’ that F-35 fighter jets were involved in violations of international humanitarian law while also pointing out that there’s no requirement to prove a direct link between a specific weapons transfer and the alleged violations of international humanitarian law.

    Importantly, the court rejected claims by the government that information provided by human rights organisations such as Amnesty International and by United Nations (UN) special rapporteurs could not be credibly verified. Instead, it said that such sources must be taken ‘extremely seriously’.

    It also reaffirmed the very important role of civil society organisations in monitoring and ensuring the implementation of state obligations under the Arms Trade Treaty (ATT).

    The government had a week to comply with the court ruling and said it would do so. Sadly, however, it didn’t agree with the Appeals Court verdict and announced it would take the case to the Supreme Court for a final decision.

    Are you taking any further steps in relation with the Dutch government’s approach to the Israel-Palestine conflict?

    The Dutch government claims it is taking a balanced approach, speaking to both sides, when in fact it has refused to clearly condemn Israel, voted alongside the USA against UN resolutions that condemn Israel and demand an immediate ceasefire, and has refused to stop supplying weapons to Israel. Yes, it has enabled airdrops of medical supplies, but that is nothing more than a basic humanitarian obligation.

    In all the years our government has taken this supposedly balanced approach, not much has been achieved and a solution has not come any closer. More Palestinians have been forcibly displaced and illegal Israeli settlements have grown. We keep advocating for practical steps and measures to stop these violations and for an end to military cooperation between the Netherlands and Israel.

    For now, we are awaiting the last part of the legal process, and we have no choice other than keep defending our case, as we have successfully done so far.

    Do you expect this court ruling to have any international repercussions?

    The Appeals Court’s broad analysis of states’ obligations under the ATT and the European Union Common Position on Arms Exports makes this ruling an important source for any other organisation considering litigation. This case has been incredibly important for the future of arms export control, because it is the first time Dutch judges have set out so clearly and in such detail the government’s obligations to implement export controls. Governments that export arms must ensure that their exports comply with obligations under the ATT.

  • NEW CALEDONIA: ‘The French parliamentary elections will have an impact on our future’

    In May 2024, protests broke out in New Caledonia after the French parliament passed a law that would have allowed more non-Indigenous people to vote. The French government presented the measure as a democratic reform, but many Indigenous Kanaks, who make up around 40 per cent of the population, saw the prospects of independence receding. When clashes between pro-independence protesters and police led to riots, the French authorities declared a state of emergency, deployed troops and banned TikTok. The French government suspended the electoral changes, but has recently detained some pro-independence leaders, and the situation remains tense.

    What is New Caledonia’s political status and what how does this mean for its governance?

    The 1988 Matignon-Oudinot Accords, the 1998 Nouméa Accords and the 1999 Organic Law gave New Caledonia special status within the French Republic, transferring many powers other than those of sovereignty – the army, the police, the judiciary and the currency – as part of a scheme of ‘shared sovereignty’. A title on ‘transitional provisions for New Caledonia’ was added to the French Constitution.

    This title provided for the freezing of the electorate for three planned referendums on self-determination and provincial elections, which determine the composition of the Congress that elects the government of New Caledonia. To vote in provincial elections, you have to be born before 1998 and have lived in New Caledonia for 10 years. Other elections follow French national rules.

    What led to recent protests?

    The Nouméa Accord provided for a gradual transfer of sovereignty, with three referendums on self-determination to be held in 2018, 2020 and 2021. The pro-independence Kanak and Socialist National Liberation Front (FLNKS) had called for the third referendum but then rejected the proposed date because of the pandemic that hit New Caledonia late. In 2021, many families were in mourning and a campaign could not be properly conducted due to restrictions.

    The French government maintained the date of the referendum, and the FLNKS called for a boycott. This call was widely followed by Kanak people, resulting in a turnout of only 43.90 per cent, compared to 85.64 per cent for the second referendum in 2020. In the Loyalty Islands, 95.46 per cent of voters, mainly Kanak people, abstained, and in the Northern Province 83.38 per cent did so. Despite this, the French government recognised the results and declared the Nouméa Accord null and void, urging local politicians to reach a new agreement, specifically on the composition of the electoral body.

    In the absence of an agreement, the government decided to change the make-up of the electorate by amending the constitution, allowing anyone who has lived in New Caledonia for 10 years to vote in provincial elections. This caused tensions as Kanak people, already in a minority as a result of colonisation and the nickel boom of the 1970s, saw this as a threat to their representation in institutions and the conclusion of the decolonisation process.

    After the 2021 referendum, the Caledonian Union, a FLNKS member, set up a mobilisation group, the Field Action Coordinating Cell (CCAT), which has organised protests against the electoral change. The French government ignored our warnings about the dangers of forcefully passing the amendment, and protests degenerated into blockades and fires in and around the capital, Nouméa, leading to the imposition of a curfew, a state of emergency and the blocking of TikTok. The army was deployed. There are reports of police abuse and people forming anti-Kanak militias.

    How did Kanak leaders react?

    Kanak leaders called for calm but were not listened to, nor were traditional leaders or the president of the government.

    The FLNKS refused to talk to the three senior officials who accompanied French president Emmanuel Macron on a whirlwind visit and called for a political solution to the conflict.

    The president of the Southern Province and a former deputy made fiery statements on the question of links with France. Another current in the loyalist – anti-independence – camp, represented by another ex-deputy and the mayor of Nouméa, is in favour of dialogue and the search for a new institutional agreement. Some independence supporters back dialogue with this faction of the Loyalist Party. The Oceanian Awakening party, which represents people from the Wallis and Futuna islands, considers the 2021 referendum to be ‘political nonsense’ and could play a role in dialogue if the French government adopts a position of neutrality, as promised in the preamble to the Nouméa Agreement.

    How is civil society promoting peace in New Caledonia?

    The Human Rights League was instrumental in the signing of the Matignon Accords at a time when civil war had claimed over 90 lives. But recently the Minister of the Interior criticised us and ignored our warnings. We hope the next government will listen to voices for peace.

    The unrest has so far mostly been confined to Nouméa and the surrounding communes, leaving the islands and northern provinces largely untouched. This shows that the peace process has forged links between communities. In 2022, a statue symbolising the handshake between loyalist politician Jacques Lafleur and pro-independence leader Jean-Marie Tjibaou was unveiled in the Place de la Paix (Koo We Joka). Women called for a peace rally on that square.

    New Caledonian civil society, which is deeply attached to this country, can still work towards a common destiny if France respects its commitment to the decolonisation process as set out in the Nouméa Accord.

    France must carry out impartial investigations to restore peace through legal channels. Both pro-independence and loyalist politicians must commit themselves to rebuilding a common destiny and fighting the social inequalities at the root of the revolt of young Kanaks.

    Civil society must influence elected representatives to work towards this goal and demand impartial justice. The decision to transfer CCAT leaders to provisional detention in France, more than 17,000 km away, to the detriment of their private and family lives and their rights to defence, was followed by new riots, this time in the north and on one of the Loyalty Islands.

    The French parliamentary elections will have an impact on the future of New Caledonia, and it’s vital to encourage and seek dialogue and agreement on a common destiny.

  • NIGER: ‘France and the USA have displayed imperial attitudes towards poor countries in Africa’

    BoubacarNDiayeCIVICUS speaks about Niger’s recent decision to suspend military cooperation with the USA with Dr Boubacar N’Diaye, Emeritus Professor of Pan-African Studies and Political Science at the College of Wooster, international consultant on security sector governance and former chair of the African Security Sector Network, a pan-African think tank focused on security governance issues in the continent, and particularly in West Africa.

    How would you describe Niger’s security situation?

    Niger is located in a very strategic position in the continent – it’s at the heart of West Africa and the Sahel, and shares borders with Algeria, Benin, Burkina Faso, Chad, Libya, Mali and Nigeria. This makes it an ideal location for geopolitical powers to have a presence.

    Until recently, Niger was a key security partner of France and the USA. There were French troops in the country, and in 2012, the government signed an agreement with the USA to establish a drone base to conduct surveillance and military operations against terrorism. Between 1,000 to 1,500 US soldiers were deployed under this agreement.

    But despite promises to assist Niger in fighting terrorism, little was done in this regard. Instead, the USA utilised this alliance to carry out surveillance operations in the region in support of its global geopolitical strategy.

    On 26 July 2023, Niger experienced a military coup against President Mohamed Bazoum, with the junta claiming the president’s response to the dire security situation was inadequate. The country has confronted terrorist attacks on military and civilians for quite some time. Yet the crisis extends beyond security to encompass political and social dimensions.

    Following the coup, the junta demanded France and its soldiers leave the country. France and the Economic Community of West African States (ECOWAS) imposed sanctions on Niger, resulting in power cuts and border closures. No goods or medical supplies were allowed in or out across ECOWAS borders, while terrorist attacks persisted, claiming the lives of Nigerien military personnel. Sanctions were subsequently lifted, but the crisis persisted.

    Why did Niger suspend military cooperation with the USA?

    While France maintained a firm stance against military coups in the region, the USA took a more conciliatory approach. For that, one would have expected General Abdourahamane Tchiani, the junta’s leader, to be more accommodating with the USA.

    While the military leaders were quite grateful for this, they were also irked by the arrival of a US delegation of high-ranking State Department officials who, with a typical imperial attitude, lectured them on democracy and demanded they cut all links with the Russian government. They also accused them of having secret deals with Iran to sell uranium.

    The fact that the USA belittled and showed no respect to Niger led the military junta to revoke the 2012 agreement, which it highlighted was a secret document not endorsed by the public that granted the USA carte blanche to operate in Niger as they pleased.

    In requesting the USA lo leave the country, Niger asserted its rights as a free and sovereign nation. As such, Niger is free to make deals with whichever country it chooses, with neither the USA nor France having the authority to dictate any decision.

    This decision significantly affects the USA’s geostrategic position, as Niger is the only country in West Africa where it has a military presence. If compelled to withdraw entirely, the USA would lose its surveillance capabilities and ability to project power. If the USA wants to stay and seek a new agreement with the junta, it will need to tone down its demands. But if it keeps pressing Niger to cut ties with Russia, it is unlikely to be able to reach a deal.

    Do you see Niger’s decision as part of a broader regional trend?

    Over the past few years, people in other countries in the region, including Burkina Faso, Mali, Nigeria and Senegal, have shown a desire to reaffirm sovereignty and reject the influence of imperial powers.

    France, as the former colonial power and on behalf of the European Union (EU) and the west, has particularly had a lot of influence in the region. It has conducted military operations, done business and even imposed the CFA franc, the regional currency and a relic of French colonialism in Africa.

    France, and to a lesser extent the USA, have displayed imperial attitudes towards poor countries in Africa. They have completely disregarded their national sovereignty and ignored their need for dignity. They aim to dictate to their people the type of government they should have, the decisions they should make and who they should partner with. This imperial mentality must stop.

    The public, guided by a very active civil society, is happy to see France and the USA being told to leave. They are happy to see Niger behave as a sovereign country that rejects foreign influence, particularly when both countries have done little to nothing to help resolve the insecurity dilemma Niger has faced for a decade.

    How do you understand the growing power of Russia in this context?

    Russia, and to a lesser extent China, are the default partners in the region. Despite their substantial presence and technological capabilities, France, the USA and even the United Nations have not achieved the same level of success as Russia in nations such as the Central African Republic (CAR) or Mali. Russia has been able to stabilise the security situation in the CAR, at least to some extent, and recapture major strategic cities in Mali that have been under rebel control for the last 10 years.

    Countries in the region see an alternative in Russia. This is not rooted in a Cold War mentality but rather in Russia’s longstanding presence in the region, its support for many nations during the early years of independence and its demonstrated effectiveness in combating terrorism.

    What international support does Niger’s civil society need?

    Nigerien civil society needs the solidarity of civil society across the world. Civil society organisations have suffered a lot. Niger is one of the poorest countries in the world and has faced months of a severe embargo, sanctions, electricity cuts and medicine shortages. While these measures have been lifted, so has financial assistance from the EU and France, which has exacerbated socioeconomic hardships and security issues.

    The country hasn’t collapsed – as some had hoped – but is undergoing serious socioeconomic hardship and security challenges. The military coup is not to be applauded – it’s a clear sign of political failure. But considering the context, it can be understood. People have accepted that the military are in charge, and now they need all the help and solidarity they can receive.

    The international community should adopt a more empathetic stance towards Niger, supporting the country and its authorities. They should avoid punitive measures such as sanctions, which only harm the public, and refrain from imposing decisions and norms upon the nation.

    Instead, the international community should find a formula to help Nigerien authorities navigate through this complicated context and transition back to a constitutional order, with the active involvement of local civil society.

  • NIGERIA: ‘Many families prefer to keep their daughters at home to ensure their safety’

    Jeff is spokesperson for #BringBackOurGirls, a diverse citizen group that advocates for the effective search and rescue of all abducted children and the containment and neutralisation of insurgency in Nigeria.

    What’s the security situation in Nigeria’s Kaduna state?

    The security situation in Kaduna state is alarming and continues to deteriorate. Kidnappings for ransom and other forms of violence are on the rise. Those primarily responsible for these criminal activities appear to be Fulani herders, organised in bandit groups that have reportedly become affiliated with the Boko Haram insurgency. They are creating widespread chaos and terror in northern Nigeria.

    The state’s inability to curb such criminal activity and protect its citizens was reflected in the recent abduction of 287 students. A whole decade after Boko Haram kidnapped 276 high school girls in Chibok, a town in northeast Nigeria, the security situation remains precarious and has even worsened.

    Kaduna’s state authorities have proven ineffective in addressing these challenges. Instead of taking decisive action to dismantle these groups, they have opted to pay off insurgents to temporarily halt the violence. This is ultimately counterproductive, as the government submits to blackmail by rebel groups, further undermining security and leaving people vulnerable.

    During the recent Eid al-Fitr festival, a video emerged of over 100 armed Fulani herders conducting prayers in Kaduna. Gatherings of such size cannot happen without security agents being aware, pointing to possible complicity by the authorities. This lack of reaction fosters an environment of fear and insecurity.

    The ongoing cycle of violence, displacement and ransom-taking disrupts the lives of local communities, contributing to food insecurity as farmers cannot safely work their lands. It is crucial for the government to take a more strategic and robust approach to restore order and protect people.

    How have kidnappings affected the situation of girls and women?

    Right after the abduction of the Chibok girls, efforts were made to develop strategies to improve security in schools and safeguard girls and women in society. A task force involving community members and government representatives, including the then Minister of Finance, initiated the Safe School Initiative.

    This programme proposed to enhance security in schools by installing CCTV cameras, bringing in security agents, putting up perimeter fences and providing secure transportation. However, it never materialised.

    Today, many families prefer to keep their daughters at home to ensure their safety rather than risk sending them to school. In northern Nigeria, over 13.8 million children aren’t attending school, and the number continues to increase. Lack of formal education only exacerbates existing inequalities that disproportionately affect women and girls. The situation demands urgent action, but unfortunately the government is not doing much.

    What’s the government’s approach to securing the safe return of abducted people?

    The government doesn’t have a specific approach. The fact that mass abductions have continued, including the kidnapping of 300 female students in Zamfara state in 2021 and 100 schoolchildren in Kebbi state a few months later, highlights the lack of a real strategy to address the issue. Between January and April 2024 alone, 599 people were kidnapped.

    The government is largely reactive rather than proactive, which is concerning. It has not clearly communicated any specific measures. This indicates a significant gap in leadership and a disconnect between its goals and people’s needs.

    Civil society, which often operates close to affected communities, is calling on the government to adopt more effective strategies. These include developing a comprehensive plan for the safe return of the remaining 91 Chibok girls and other abducted people. Civil society also proposes establishing a military situation room with civil society participation to enhance information sharing and collaboration in addressing security challenges.

    We also demand an end to political interference in security matters, as this has been a barrier to effective action in states like Kaduna. The Nigerian military and police have the capacity to tackle these challenges, yet there seems to be a lack of political will to take decisive action.

    There is a pressing need for the government to adopt a comprehensive, coordinated strategy to address the security crisis and protect the lives and properties of its citizens. This includes collaborating with civil society, improving information sharing and taking decisive military and law enforcement actions to dismantle insurgent groups.

    How is civil society working to address the problem, and what obstacles does it face?

    Civil society organisations are making significant efforts to raise awareness and urge government action, but progress has been slow. Overall, there have been 80 new attacks on schools since the Chibok girls were abducted, resulting in the kidnapping of 1,800 students and 64 teachers.

    Nigerian civil society faces significant challenges in doing this work. Freedom of speech is not fully guaranteed, and those who speak out often face threats or retaliation. For instance, members of Bring Back Our Girls, including myself, have faced arrests and harassment for advocating for justice and the safe return of abducted girls.

    Ethnicity and religion also divide Nigerian society, making it difficult for people to unite in pursuit of common goals. People tend to support leaders from their own ethnic or religious groups, even when they don’t act in the best interests of the country.

    Advocacy work isn’t just challenging due to these obstacles – it’s also costly. Organisations must carefully plan and execute their strategies with very limited resources. In the past, strong international partnerships helped support civil society efforts, but these relationships have weakened over time.

    Still, civil society continues pushing for change and striving to hold the government accountable.

    What forms of international support does Nigerian civil society need?

    In the early days of the Bring Back Our Girls movement, prominent figures such as then-President Barack Obama and First Lady Michelle Obama raised awareness by publicly supporting the cause. Hollywood celebrities, musicians and news networks also played a crucial role in amplifying the movement.

    We need to achieve a similar level of international support and visibility. The Nigerian government tends to be more responsive to international pressure, so we encourage world leaders and organisations to keep the conversation alive and help us hold the Nigerian government accountable. This includes asking about the whereabouts of the 91 remaining Chibok girls and demanding action from Nigerian officials.

    We urge people around the world to use their platforms to put the Nigerian government under the spotlight and keep these issues alive.
