  • Pakistan: Three years on, Prime Minister Imran Khan has overseen an assault on civic freedoms

    Three years after Imran Khan took office as Pakistan’s Prime Minister in August 2018, global civil society alliance CIVICUS has documented an ongoing assault on civic freedoms. Human rights defenders and critics have been harassed, criminalised and forcibly disappeared. There have been ongoing efforts to censor the media and to target journalists, and the crackdown on the Pashtun movement including enforced disappearances of activists has persisted. The culture of impunity in the country has meant that perpetrators of these abuses have not been held accountable.

    As a current member of the Human Rights Council, Pakistan has a duty to uphold the highest human rights standards. However, the documented violations are inconsistent with Pakistan’s international obligations to respect and protect civil society’s fundamental rights to the freedoms of association, peaceful assembly and expression, including those under the International Covenant on Civil and Political Rights (ICCPR). These fundamental freedoms are also guaranteed in Pakistan’s Constitution.

    Human rights defenders at risk

    The Pakistani authorities have harassed, and at times, prosecuted activists for criticising government policies. Among those targeted since Imran Khan came to power include human rights defender Idris Khattak who was forcibly disappeared from Khyber Pakhtunkhwa province in November 2019 for seven months. Nearly seven months later, in June 2020, the Ministry of Defence finally admitted that human rights defender Khattak was being held in state custody. He is now facing prosecution in a military court. Women human rights defender Gulalai Ismail was forced to leave the country in September 2019. She and both her parents, activist Professor Mohammed Ismail and his wife Uzlifat Ismail, have been facing harassment for the last two years and are also facing trumped up terrorism charges.

    The UN Committee on the Elimination of Discrimination Against Women has raised concerns that women human rights defenders are frequently subjected to reprisals, harassment and threats. One stark example of this has been the response to the ‘Aurat March’, a march held yearly in towns and cities across Pakistan to mark International Women’s Day and for women to reclaim their space, speak up for their rights and demand justice. Women rights activists involved in the march have routinely been subjected to intimidation and threats. The Imran Khan administration has systematically failed to speak out or take action against the perpetrators. On the contrary, in March 2021, a court in Peshawar ordered the registration of a first information report (FIR) against the organisers of the march in Islamabad.

    NGOs shut down or expelled

    The government has shut down numerous civil society organizations over the last three years under the guise of combating terrorism, money laundering or for promotion of an ‘anti-state’ agenda. In December 2018, not long after the Prime Minister assumed power, Pakistan expelled 18 international NGOs from the country when their renewal of registration was rejected arbitrarily without reason. Local NGOs have had their funds frozen. The procedures for NGOs to obtain foreign funding lacks transparency, remains cumbersome and applied in a discriminatory manner.

    Assault on press freedom

    Press freedom in Pakistan has also continued to deteriorate under Imran Khan’s leadership. The military has set restrictions on reporting, including barring access to regions, encouraging self-censorship through direct and indirect methods of intimidation against both reporters and editors, and even allegedly instigating violence against reporters.

    In 2019, several journalists were placed on a “watch list” by the Pakistan Federal Investigation Agency’s (FIA) Cybercrime Wing over criticism of Saudi Crown Prince Mohammed Bin Salman during his visit to Pakistan. In October 2019, the head of the Committee to Protect Journalists' (CPJ) Asia programme, Steven Butler, was denied entry into Pakistan and deported because his name was on a “stop list of the Interior Ministry”. In 2020, government officials and supporters mobilised a cyber-harassment campaign against women journalists and commentators whose views and reporting have been critical of the government and more specifically its handling of the coronavirus pandemic.

    Journalists have been criminalized and even abducted. Rizwan Razi was arrested in February 2019 in Lahore over a series of social media posts allegedly critical of the judiciary, government and intelligence services. In July 2020, Matiullah Jan was abducted by unidentified armed men from a busy street in Islamabad and released 12 hours later. Jan is known for his criticism of the country’s powerful institutions, including its military, and has been labelled “anti-state”. In May 2021, journalist Asad Ali Toor was assaulted by three unidentified men, believed to be agents of Pakistan’s Inter-Services Intelligence (ISI) agency who forcibly entered his apartment in Islamabad. They interrogated, gagged and beat him.

    Crackdown on the PTM movement

    There has been a systematic crackdown against the Pashtun Tahafuz Movement (PTM). The PTM have mobilised nationwide against human rights violations against Pashtun people. They have demanded the establishment of a truth and reconciliation commission to examine human rights violations committed by the state and non-state actors in Pashtun areas, including enforced disappearances allegedly perpetrated by the Pakistan army, and extrajudicial killings. Protesters also continue to call for equal rights for Pashtun people, as guaranteed by the constitution, and the restoration of peace in Pashtun areas and the region in general.

    Instead of addressing these concerns, the Imran Khan administration has arbitrarily arrested, detained and prosecuted on spurious charges scores of PTM activists since the beginning of the protests. These activists have been accused of sedition and other crimes under Pakistan’s Penal Code, and of terrorism charges.

    Some PTM activists have been killed. In February 2019, PTM leader Arman Loni died in police custody Loralai in Baluchistan. He had suffered blows to the head and neck when police officers physically assaulted him with rifle butts. Arman’s death was not registered by the police for another two months. In May 2020, Arif Wazir, a PTM leader, died in Islamabad following an attack by unidentified assailants outside his home in Wana, South Waziristan. He had been detained and charged for his activism, and had previously been considered ‘anti-national’ by authorities. No one has been brought to justice for these killings.

    Authorities have attempted to suppress the PTM by silencing media coverage of the movement. In December 2018, internet service providers blocked the website of Voice of America's (VOA) Urdu language service. An article by Manzoor Pashteen published in the New York Times in February 2019 was censored by its local publisher. Journalists covering protests have been targeted in a similar manner to participants.

    Enforced disappearances

    Enforced disappearances targeting human rights defenders, political activists, students, journalists and others have continued relentlessly under the Imran Khan administration. The UN Working Group on Enforced or Involuntary Disappearance has received 1144 cases of allegations of enforced disappearances from Pakistan between 1980 and 2019 with more than 731 cases pending at the end of 2019. According to human rights groups, in some instances, people are openly taken into custody by the police or intelligence agencies, and often authorities deny information to families about where their loved ones are being held. Many of those forcibly disappeared have been subjected to torture and death during detention.

    The government had committed to criminalising enforced disappearances when it came to power in 2018. However, the bill to do so languished at the draft stage for more than two years before it was finally introduced to the National Assembly in June 2021.

    Recommendations

    After three years in power, the current administration continues to fall far short of its human rights obligations.

    We urge the government of Pakistan to undertake the following as a matter of urgency:

    • Take steps to ensure that all human rights defenders in Pakistan are able to carry out their legitimate activities without any hindrance and fear of reprisals in all circumstances and conform to the provisions of the UN Declaration on Human Rights Defenders.
    • Drop all charges against human rights defender Idris Khattak and release him immediate and unconditionally. End all acts of harassment - including at the judicial level and restrictions on freedom of movement - against Muhammad Ismail, his wife Uzlifat Ismail and Gulalai Ismail.
    • Take measures to foster a safe and enabling environment for civil society, including by removing legal and policy measures that unwarrantedly limit the freedom of association. This includes removing all undue restrictions on the ability of CSOs to receive international and domestic funding, in line with international law and standards; refrain from acts leading to the closure of CSOs or the suspension of their peaceful activities and consult meaningfully with civil society in any review of these laws and regulations.
    • Ensure freedom of expression and media freedom, both online and offline, by bringing all national legislation into line with international law and standards and ensuring that journalists are able to work freely and without fear of retribution for expressing critical opinions or covering topics that the government may find sensitive. Any forms of harassment and attacks against journalists must be promptly and impartially investigated immediately and perpetrators brought to justice;
    • Put an end the harassment, stigmatisation, intimidation, unlawful surveillance, travel restrictions and arrest of peaceful PTM activists and ensure that they can freely express their opinions and dissent without fear of reprisals. Conduct a swift, thorough, independent and impartial investigation into the killing of PTM leaders and activists Arman Loni and Arif Wazir, and ensure that those responsible for his death are brought to justice;
    • Ensure efforts to criminalise enforced disappearance as an autonomous crime move swiftly and that the law in in line with international law and standards. The government must also ensure that all allegations of such acts are thoroughly investigated and those responsible brought to justice.

  • Palestine: New Research brief documents escalation of attacks on civic freedoms

    Civic freedoms in Palestine continue to deteriorate with an escalation of attacks on civil society organisations, journalists and Human Rights Defenders (HRDs) by the Israeli Occupying Forces (IOF).

    Ahead of the United Nations Human Rights Council debate on Item 7, “Human rights situation in Palestine and other occupied Arab territories, a new research brief by CIVICUS provides an overview of recent civic space restrictions in the Occupied Palestinian Territory (OPT) perpetrated by both IOF and OPT authorities.

    PalestineCountryBrief.September2022.en Page 01Violations documented as a result of Israel’s institutionalised regime of apartheid include the harassment and killing of journalists, protesters and HRDs, censoring Palestinian voices online and offline, and the forcible closure of civil society organisations (CSOs).

    Israel’s targeting of CSOs escalated in 2021 after six leading Palestinian human rights organisations were designated as “terrorist organisations” under the Counter-Terrorism Law. On 18 August 2022, the IOF forcefully entered, raided, and sealed the entries to the offices of seven CSOs[1], confiscating and damaging property in some of the offices. Following the raid, the director of Al-Haq, one of the organisations targeted, was intimidated and threatened that he would pay a ‘personal price’ if Al-Haq continued its work.

    To date, there has been no accountability for the killing of Palestinian-US Al-Jazeera journalist Shireen Abu Akleh, who was killed over four months ago, in May 2022, while reporting on an Israeli raid in the occupied West Bank city of Jenin, despite wearing a helmet and flak jacket marked “PRESS”.

    Violations of Palestinians' digital rights are commonplace, with major social media platforms such as Facebook, WhatsApp, Instagram, and Tik Tok complicit in silencing Palestinian voices. For example, during the Sheikh Jarrah protests, where families faced forced eviction and imminent threat by Israeli settler organisations, social media was one of the most important vehicles to share evidence of human rights violations. However, users were systematically silenced on an egregious scale, including by deletion of content, blocking or closing of accounts, hiding hashtags, and reducing content reach. Offline, Palestinians who continue to express their discontent by staging protests are often met with violence from the IOF and settlers.

    In addition, violations of civic space and Palestinian human rights are committed by Palestinian authorities. Both Hamas in Gaza and the Palestinian Authority (PA) in the West Bank are responsible for harassing, detaining and attacking activists, journalists and protesters.

    “The deterioration of civic freedoms in Palestine due to increasing attacks by Israeli Occupying Forces can no longer be ignored. It's time for democratic governments to break their silence and condemn Israel's apartheid regime of systematic racial domination and oppression over the Palestinian people as a whole and to impose economic and diplomatic sanctions on Israel,” said Aarti Narsee, Civic Space Research Officer.

  • Philippines: Lack of action by the UN Human Rights Council risks abandoning victims of human rights abuses

    Without a resolution at the upcoming 51st session of the UN Human Rights Council (HRC), the Office of the High Commissioner for Human Rights’ (OHCHR) mandate to report on the Philippines will expire.

    In this joint letter, CIVICUS and other non-governmental organisations call for members and observer states at the HRC to adopt a resolution on the Philippines that continues and strengthens its reporting mandate. In the absence of secure and effective spaces for deliberations at the domestic level, OHCHR’s reporting and the debate that follows it at the HRC are key for victims who continue to seek justice and accountability for human rights violations, including those committed in the context of the so-called “war on drugs.”

    We, the undersigned human rights organisations, are writing to raise urgent concerns about Bahraini human rights defender Dr Abduljalil AlSingace, who has been on hunger strike since 8 July 2021, to protest the confiscation of his academic research on Bahraini culture. He turns 60 on 15 January 2022. He has been in prison for over a decade in violation of his freedom of expression and assembly rights.

    What is the Rohingya Students Network and what does it do?

    The Rohingya Students Network is a global interconnected network of Rohingya students and young people. I founded it in December 2019 and it now has members in all 33 camps in Cox’s Bazar. We operate through WhatsApp and we arrange weekly meetings with all members to work towards our objective, which is to ensure the life, liberty and security of the Rohingya people.

    We do two kinds of work. We work on community development by organising activities such as skills training and youth workshops. And we advocate for our people by talking to international media and working alongside the International Court of Justice (ICJ). As bringing justice to our people is very important for us, we help by collecting materials such as victims’ testimonies. We also oversee the overall situation of our people and collect data to share with our members.

    We are bringing a case against Facebook because we believe Facebook used the genocide in Myanmar for business. We would normally send a letter to Facebook and ask them for help to fund Rohingya education camps. But they refuse to compensate for what they did, and so we had to take the legal way. Facebook is responsible for many human rights violations in Myanmar, so now we are legally pursuing the matter. We are getting help from Victim Advocates International, an organisation of lawyers.

    What is the education situation in refugee camps?

    The situation is bad. There are several schools in the camps but they all have a very dated system. One of them is the Rohingya Learning Centre. But all they do is give Rohingya students biscuits! Kids tell us, ‘We go to the Learning Centre to get biscuits, not to get education’.

    There’s a lack of learning centres and qualified teachers inside the camps, even though we’ve been living here for five years. Teachers just teach basic things such as A is for apple, B is for ball. Our kids aren´t getting the quality education they deserve.

    Have there been any changes in the situation of Rohingya people?

    I would say there hasn’t been any change to our situation since 2017. It’s true there have been meetings about the Rohingya and many organisations and groups have issued statements regarding our situation. However, all these meetings and statements have brought no positive outcome. The solutions offered to end the conflict still equal zero.

    There have been some minor improvements though. For instance, the USA has declared the Rohingya situation as genocide. The case has made some progress in the ICJ and the International Criminal Court. But still, solutions haven’t gone past an initial stage. Our crisis is a complicated one. 

    The long-term scenario is complex. We left our country, Myanmar, in 2017 and are still facing systematic violence there. We were a minority and had to leave because of the violence towards us. We are now living in Bangladesh but continue to fight in various arenas to get the justice our people deserve.

    There are many factors we need to consider to get our rights back. We can say there’s a civil war happening in Myanmar. There are two parallel governments competing to rule the country: the military government and the National Unity Government.

    In Rakhine State – where Rohingya people are from – there are powerful groups such as the Arkan Army, which are also a challenge because they prevent people from getting back to their homes. These are challenges we need to address. And who knows, maybe someday we can get back home.

    What challenges do you face when doing your work?

    The threats and dangers are constant. For every single activity we want to do, there is some kind of opposition. A big part of society is opposed to the kind of work we do. We are respected by the government of Bangladesh and allowed to do our work freely, although I think they are now changing their minds. I think our Going Home Campaign, which we launched a few weeks ago, will make our relationship a bit harder.

    There is also the fact that we continue to demand our rights, and many people speak up online and advocate for our rights, but the audience that we really need to listen to us, those responsible for the persecution we suffer, and those we need to sort out our situation, are sitting in government chairs in Myanmar and won’t address our demands because they simply don’t want us.

    What international help do Rohingya people need?

    We need as much international help as we can get. We need the international community to pressure the government of Myanmar so that they accept all of our demands for basic needs and rights. We need them to accept Rohingya people in Myanmar.

    What we expect from the world is to help us create the right conditions to put pressure on Myanmar’s power holders, the main stakeholders to solve this crisis. There are many ways they can help us. For instance, as the USA helped us by declaring our situation as genocide; other big powers should do the same. We need the world to speak out and stand together with us. We want to go back home in peace!

  • Silence Does Not Mean Consent: The Dire State of Human Rights in Equatorial Guinea

    Located in the west of Central Africa between Cameroon and Gabon, and with a population of less than a million people, Equatorial Guinea is often described as one of the most censored countries in the world. The space for civil society - civic space - is closed, and consequently, independent journalists and human rights defenders (HRDs) are vulnerable to judicial persecution, threats and attacks from the state. Recent acts of intimidation, arbitrary arrest, detention and harassment of HRD Alfredo Okenve on the day he was supposed to receive a human rights award from the French Embassy in the capital city of Malabo exemplify the risks faced by HRDs.

    President Teodoro Obiang Nguema Mbasogo is Africa’s longest-serving head of state and the world’s longest-serving non-royal leader, having seized power from his uncle Francisco Macías Nguema through a coup d’état in 1979. Equatorial Guinea remained isolated until oil was discovered in the early 1990s and the country opened up to more foreign investment. However, despite the vast amounts of funds secured from the sale of oil, Equatorial Guinea’s human development indicators remain extremely low. Much of the wealth is controlled by President Obiang’s family and close associates while a majority of citizens lack basic services and live in poverty. President Obiang and his ruling Democratic Party of Equatorial Guinea (PDGE) have used violence, repression, intimidation and harassment to maintain control of all state institutions and military forces for four decades. Groups or political parties and activists that are perceived by government officials to threaten the power base of the PDGE are either co-opted, harassed, intimidated, or forced to self-censor.  

    This policy brief sheds light on some recent human rights violations committed by the regime and restrictions placed on citizens. Since assuming power four decades ago, President Obiang has refused to implement any verifiable and irreversible democratic or political reform. The ruling PDGE party, maintaining stringent control over all aspects of governance, has completely closed spaces for civil society reforms. Given this, Equatorial Guinea’s UPR hearing offers a rare opportunity to hold the government responsible for human rights violations. The African Union (AU), donors, multilateral organisations and global civil society have a responsibility to exert pressure on the government to implement much-needed reforms.

  • Singapore: Joint Statement on the Sentencing of Human Rights Defender Jolovan Wham

    We, the undersigned human rights organisations, strongly condemn the politically-motivated prosecution of Singaporean human rights defender Jolovan Wham. After convicting Wham in January 2019 of ‘organising a public assembly without a permit,’ the State Court sentenced him, on 21 February, to a fine of S$3,200 (US$2,367), or by default, 16 days in prison.

    The sentencing of Singaporean activist Jolovan Wham highlights the increasingly repressive space for activists and human rights defenders in Singapore, said the Asian Forum for Human Rights and Development (FORUM-ASIA), CIVICUS: World Alliance for Citizen Participation, and Think Centre in a joint statement today.

  • Singapore: Withdraw Foreign Interference (Countermeasures) Bill

    Today, eleven undersigned organizations called on the Government of Singapore to withdraw the Foreign Interference (Countermeasures) Bill (‘FICA’). FICA’s provisions contravene international legal and human rights principles – including the rights to freedom of expression, association, participation in public affairs, and privacy – and will further curtail civic space, both online and offline.

    On October 4, 2021, the Parliament of Singapore passed FICA, three weeks after it was tabled on September 13 by the Ministry of Home Affairs purportedly to “prevent, detect and disrupt foreign interference in (...) domestic politics”. This was despite serious concerns that the law could undermine civic freedoms – raised by members of the public, civil society, legal fraternity, independent media, political opposition, academia and industry in Singapore. The bill went through both its second and third readings in one parliament sitting and FICA was passed without significant amendments to address key concerns.

    While the protection of national security may be a legitimate aim, FICA contravenes the rule of law and the principles of legality, necessity and proportionality under international human rights law. Overbroad and ambiguous provisions draw within its scope a wide range of conduct, activities and communications “directed towards a political end in Singapore”. As a result, almost any form of expression and association relating to politics, social justice or other matters of public interest in Singapore may be ensnarled within the ambit of the legislation – making it difficult, in turn, for the average individual to reasonably predict with precision what conduct may fall foul of the law. Vague provisions also allow for unfettered executive discretion in interpretation and implementation of the law. Unlimited executive discretion – together with severe penalties under the law – can result in executive overreach into what it deems permissible as civic discussion and public debate. FICA also provides no mechanism for independent judicial oversight or provision of remedy where human rights violations occur as a result of the enforcement of its provisions. The law thus fails to provide for the least intrusive mechanisms to achieve its stated aim of protecting national security while greatly enhancing the risk of executive abuse.

    FICA empowers the Minister for Home Affairs to order the removal or disabling of online content – undermining the right to freedom of expression. The Minister is, for example, empowered to order publication of mandatory messages drafted by the authorities, ban apps from being downloadable in Singapore, and order disclosure of private communications and information, when the Minister “suspects or believes” that someone is undertaking or planning to undertake online communications activity “on behalf of a foreign principal”, and that it is in the “public interest” to act. The law makes it a criminal offence to undertake “clandestine” electronic communications on behalf of a foreign principal under certain circumstances, including when that activity “diminishes or is likely to diminish public confidence in (...) the Government or a public authority” or “is likely to be directed towards a political end in Singapore”. Activity “directed towards a public end” includes conduct influencing or seeking to influence government decisions or public opinion on matters of “public controversy” or “political debate” in Singapore. The government can also designate individuals as “politically significant persons” after which they can be required to follow strict limits on sources of funding and disclose all links with foreigners or foreign entities.

    FICA’s provisions can also facilitate violations of the rights to freedom of association and participation in public affairs. “Conduct” committed in connection with a “foreign principal” and “directed towards a political end in Singapore” is criminalized where this involves “covert” communication or “deception” – which is defined as including any “deliberate” use of “encrypted communication platforms”. The expansive and vaguely worded definition of activities “directed towards a political end” can cover a broad range of activities – including social justice advocacy, artistic commentary, academic research, social enterprise or journalistic reporting – carried out by, among others, members of civil society, academia, media, the arts and industry. Meanwhile, the overbroad configuration of connection with a “foreign principal” as “arrangements” with any “foreigner” or “non-Singapore registered entity” that can be “written or unwritten” brings within the law’s remit nearly all forms of cross-border collaboration or engagement. Use of “encrypted platforms” as a reflection of “covert” communications also allows for criminal intent to be inferred from a wide range of modes of communications via modern electronic devices and platforms – including through encrypted messaging and email services; and the use of online platforms through secure connection services, such as virtual private networks (VPNs).

    FICA will disproportionately impact members of civil society, independent journalists, academics, researchers, artists, writers and other individuals who express opinions, share information and collaborate to advocate on socio-political issues and matters of public interest. As their work can involve critical opinions and is often underpinned and supported by cross-border collaboration, research and funding, they are exposed to increased scrutiny and sanctions under FICA. The issues on which they work will also come under increased State oversight and control. Executive oversight and control can, in turn, infringe not only their rights to freedom of expression and association but the rights of other individuals in Singapore who rely on their work to participate in public affairs, which includes conduct of citizens to “exert influence through public debate and dialogue with their representatives or through their capacity to organize”.

    Severe penalties under FICA are disproportionate. In addition, many of those penalties may be imposed without adequate independent oversight or remedy in case of human rights violations, which can result in a chilling effect on civic space and discussion. Directions can be issued by the authorities to censor, restrict or block access to online content, accounts, services, apps or locations deemed to violate the law. The law also allows for the authorities to designate “politically significant” individuals and entities and order them to “disclose foreign affiliations” and “arrangements” or to end “reportable arrangements”. However, there is a lack of independent oversight over these restrictions and designations. These directions may only be appealed to a Reviewing Tribunal appointed by the President on advice of the Cabinet, and decisions made by this Tribunal cannot be appealed to the High Court except for non-compliance with procedural requirements. Further, individuals can face criminal sanctions under the law for “clandestine foreign interference by electronic communications activity” and non-compliance with directions, which may result in steep fines and imprisonment terms. These criminal offences are arrestable and non-bailable.

    These penalties and restrictions not only risk undermining the right to privacy, but increase the risk of individuals self-censoring and deliberately deciding not to participate in or engage with cross-border networks to avoid potentially falling foul of the law. Their negative impacts can be particularly severe on independent online platforms, which can be banned from receiving funding or other financial support from foreign individuals or entities, and on journalists, political commentators, civil society members and community researchers who often nurture public opinion and debate through information, opinions and advocacy shared online.

    In light of these significant concerns, we request that the Government of Singapore withdraw FICA. The law risks imminently and substantially narrowing already limited civic space in the country – particularly where this space is significantly restricted through abuse of other existing laws such as defamation and contempt of court provisions; the Protection Against Online Falsehoods and Manipulation Act (POFMA), the Public Order Act and the Administration of Justice (Protection) Act. The imminent enactment and future enforcement of FICA will significantly undermine the Government of Singapore’s obligations under international law to protect, promote and fulfil human rights – instead allowing for the State to expand curtailment of civic freedoms to the detriment of its people.

    Summary Legal Analysis

    International legal principles are clear that even as the protection of national security is a legitimate purpose for the restriction of certain rights, restrictions must be narrowly defined, strictly necessary and proportionate to this aim. The UN Human Rights Committee has clarified that this three-part test of legality, necessity and proportionality applies to freedom of expression. Limitations on this right must “conform to the strict tests of necessity and proportionality” and be “directly related to the specific need on which they are predicated”. Restrictions on the right to freedom of expression also negatively impact upon the rights to association and participation in public affairs as freedom of expression underpins the “free communication of information and ideas about public and political issues between citizens, candidates and elected representatives”. Meanwhile, the UN High Commissioner for Human Rights has noted that the three-part test also applies to the right to privacy in the digital age – noting that any interference with privacy must be “necessary and in proportion to” a legitimate aim, “be the least intrusive option available,” and “not render the essence of the right meaningless”.

    Overbroad and ambiguous provisions

    FICA’s overbroad and ambiguous provisions allow for abusive interpretation and implementation by the authorities, while failing to provide clarity to the public on what conduct would fall foul of the legislation. Its potential to encompass a wide range of conduct fails to ensure compliance with the principle of legality and confers overbroad discretion in interpretation and implementation upon those charged with enforcement of the law.

    FICA applies to “conduct” engaged on behalf of a “foreign principal” directed “towards a political end in Singapore”. (ss 4; 8) This includes “arrangements” with any “foreigner” or “non-Singapore registered entity” that can be “written or unwritten” to “influence or seek to influence” “public opinion” on matters of “public controversy” or “to promote or oppose political views, or public conduct relating to activities that have become the subject of a political debate”. (ss 4; 5; 8(f); 8(g))

    Criminal penalties apply where a person “undertakes electronic communications activity on behalf of a foreign principal” in a “covert” or other manner that “involves deception” which results in the publication in Singapore of “information or material” which “is likely to be prejudicial” to “public tranquillity” or “public order”; “likely to diminish public confidence in the Government” or is “likely to be directed towards a political end.” (ss 17-19)

    The expansive and vaguely worded definition of activities “directed towards a political end” encompasses a broad range of activities – including social justice advocacy, artistic commentary, academic research, social enterprise or journalistic reporting relating to a “political” issue – of civil society, academia, media, the arts and industry, amongst others. Individuals and organizations are therefore unable to accurately define what conduct can risk violating the law. Engagement “on behalf of a foreign principal”, for example, can also cover collaboration with foreign actors to conduct and share research; receive funding to hold events or implement projects; and cross-border training and education.

    Matters of “public controversy” and “political debate” can also overbroadly apply to pertinent issues of public interest on which individuals engage – potentially limiting their rights to freedom of expression, association and participation in public affairs. This risks impacting particularly on civil society engaging in research and advocacy – whose purpose is specifically to nurture and direct “political debate” on matters of public interest, including “controversy”, and to oversee and check powers of the executive. There is a risk that the authorities may bring within FICA’s remit civil society’s cross-border engagement and information-sharing, both of which are fundamental to policy and advocacy work, thereby negatively affecting collaboration among civil society actors in Singapore and organizations based outside the country, such as the organizations that are signatories to this statement.

    “Public tranquillity” and matters which “likely diminish public confidence in the Government”also allow for an overly broad interpretation to target critical commentary on government policy even in the absence of any legitimate reason to limit freedom of expression. “Covert” conduct includes “deliberately moving onto encrypted communication platforms” (p. 205), which can apply to the use of most modern electronic devices and be relied on to infer criminal intent from a broad range of potential communications – including through encrypted messaging and email services; and the use of online platforms through secure connection services, such as virtual private networks (VPNs).

    Unfettered executive discretion

    FICA allows for unfettered executive discretion to censure expression and association deemed impermissible by the State. In fact, it provides for wide potential for the authorities to encroach on the rights to free expression, association, participation in public affairs, and privacy, even in circumstances when such encroachment is not strictly necessary to achieve the purported aim of protecting national security.

    FICA allows authorities to designate individuals and entities as “politically significant” if their activities are “directed in part towards a political end” and if “it is in the public interest”. (ss 47, 48) This can result in any individual being potentially targeted under the law for expression or advocacy on issues relating to politics or public interest in Singapore. It can also apply to any individual currently working on these issues for a foreign organization or in collaboration with foreign actors – either through academic, civil society or other modes of arrangement.

    Designated “politically significant” individuals and entities can be ordered to “disclose foreign affiliations” and “arrangements” through reports to the authorities on their activities, even where they are “not directed towards a political end in Singapore”. (ss 76, 78) The authorities can also direct these “reportable arrangements” to end. (s 84) This can result in infringements of the rights to privacy and association of designated individuals working on issues of social concern in Singapore – particularly journalists, academics and researchers who may be required to reveal information and communications with foreign actors in contravention of professional ethics. Designated “politically significant” journalists and independent media outlets can also be issued a “transparency directive” – requiring them to disclose any “political matter with a foreign link” published in Singapore and identify the author’s name and nationality and any links to a “foreign principal”. (s 81)

    FICA also prohibits “politically significant” individuals and entities from accepting “donations” from “impermissible donors” who are not Singaporean individuals or companies (ss 55, 56); caps anonymous donations at S$5,000 a year (ss 57, 58); and bans foreigners from provision of “voluntary labour” to such individuals and entities. (ss 55, 56) These provisions risk being abused to muzzle social justice initiatives, civil society organizations and independent media outlets that rely on independent funding and potential support of individuals who are not Singaporeans to volunteer work or research time.

    Notably, FICA empowers the authorities to order any person to “provide any document or any information or material” on activities “directed towards a political end in Singapore” where it is deemed “necessary” for the exercise of powers under FICA. (s 108) This potentially violates the rights to privacy and association of any individual in connection with any individual or entity in relation to any matter under FICA – with a penalty of a fine of up to S$5,000 (approx. US$3,685) and continuing fines of up to S$500 (approx. US$368) for “every day or part of a day” of non-compliance. (s 108)

    Severe penalties

    Severe penalties can result in a chilling effect on the free exercise of the rights to expression, association, and participation in public affairs. Directions can be issued by the authorities under Part 3 of the law to “stop”, “disable” or “block access to” online content; and “restrict accounts or services” and “remove apps” for apparent violations. An online location which is deemed a “proscribed online location” by the Minister (s 24) on a Part 3 direction can then be prohibited from “soliciting or procuring” “any expenditure to operate”or for “services” provided for the platform. (s 39) Non-compliance with these restrictions amounts to a criminal offence, which is arrestable and non-bailable. Individuals can be slapped with severe criminal sanctions for alleged “clandestine foreign interference by electronic communications activity” – they can be fined up to S$100,000 (approx. US$74,000) and/or imprisoned for up to fourteen years. (ss 17 – 19)

    The UN Human Rights Committee has noted that criminal sanctions constitute severe interference with the right to freedom of expression and are disproportionate responses in all but the most egregious cases. These severe penalties are likely to exert a chilling effect on everyone, and particularly on journalists, political commentators, civil society members, academics and community researchers, who often publish information and opinions online.

    Lack of independent judicial oversight

    FICA does not provide for any independent oversight or remedial mechanism to address potential human rights violations. Appeals against Part 3 directions and Part 4 designations are provided for under the law – however, they are to first be made to the Minister in charge of issuing the order in the first place (ss 92, 93) and/or to a “Reviewing Tribunal” chaired by a Supreme Court Judge but consisting of three individuals closely linked to the government, “each of whom is appointed by the President on the advice of the Cabinet”. (s 94) The rules for such Tribunal’s proceedings are to, in turn, be determined by the Minister for Home Affairs. (s 99)

    Independent judicial review is severely limited as any appeal decision made by the Reviewing Tribunal, Minister or other authorities is “final” and “not to be challenged, appealed against, reviewed, quashed or called in question in any court” – except where the requested review of the Tribunal’s or Minister’s decision refers to procedural requirements, that will not analyze substantive questions relating to executive implementation of the law. (s 104) This limitation on the judiciary’s review powers undermines the rule of law, which requires judicial oversight as a check and balance against the executive’s exercise of discretionary power. Lack of oversight accentuates risks of violations perpetuated by severe penalties and the law’s stipulation that non-compliance with any order is an offence with penalties incurred from the time of alleged offending, regardless of any appeal.

In recent months and weeks, state agents have forcibly entered the offices of civil society organizations; public threats have been made against defenders who have been engaging with human rights mechanisms, NGO bank accounts have been frozen and arrest warrants issued for aid workers.

    Dear Excellencies,

    We, the undersigned Sudanese, African and international organisations and individuals, write to you ahead of the 40th session of the UN Human Rights Council (“the Council”), which will take place from 25 February-22 March 2019, to express our concerns and urge you to address the Sudanese government’s crackdown on peaceful demonstrators and ongoing violations of human rights. Since 13 December 2018, tens of thousands of people have protested throughout Sudan and the authorities have responded by indiscriminately firing live ammunition and tear gas into crowds of peaceful protesters killing more than 50 civilians.

  • Sudan: Ensure continued public debates on the human rights situation

    Excellencies,

    Following the military coup of 25 October 2021,[1] the UN Human Rights Council took urgent action by holding a special session, on 5 November 2021, and adopting a resolution re­ques­ting the High Commis­sioner to designate an Expert on Human Rights in the Sudan.[2]

    As per resolution S-32/1, which was adopted by consensus with the support of the Group of African Sta­tes, the Expert’s mandate will be ongoing “until the restoration of [Sudan’s] civi­lian-led Govern­ment.” The Council made it clear that the term of office for the designated Expert will conclude “upon the restoration of [Sudan’s] civilian-led Government.”[3]

    Ahead of the Council’s 50th session (13 June-8 July 2022), we, the undersigned non-governmental organisations, are writing to urge your delegation to support the adoption of a resolution that ensures continued attention to Sudan’s human rights situation through enhanced interactive dia­logues at the Council’s 52nd and 53rd regular sessions.

    While the Expert’s mandate is ongoing, a resolution is required for the Council to hold public de­bates and continue to formally discuss the situation. A resolution at the Council’s 50th session would ope­ra­tio­nalise resolution S-32/1, which in its operative paragraph 19 called upon “the High Commis­sioner and the designated Expert to monitor human rights violations and abu­ses and to continue to bring information thereon to the attention of the Human Rights Council, and to advise on the further steps that may be needed if the situation continues to deteriorate.”

    As the de facto military authorities are consolidating their power[4] and human rights violations continue, including against peaceful protesters[5] and in Darfur and other conflict areas,[6] once-yearly reporting by the High Com­mis­sioner as part of her reports and updates under the Council’s agenda item 2, followed by a ge­neral debate, would be insufficient to maintain an adequate level of atten­tion to the country.

    The Council has a responsibility to follow up on its meaningful action on Sudan. It should ensure that the High Commissioner publicly and regularly reports on the human rights situation and that dedicated public debates continue to be held. The High Commissioner, with the assistance of the desi­gna­ted Expert on Human Rights in the Sudan, should be able to present updates and reports on the situ­ation of human rights in Sudan.

    Programme budget implications (PBIs) are required for the formal presentation of reports to the Council and holding of interactive dialogues and enhanced interactive dialogues. A resolution with the necessary PBIs could be approached from a technical perspective; it could be a procedural text that achieves just this: mobilising budget for reports and public debates on Sudan.

    We believe that interactive dialogues on Sudan’s hu­man rights situation should be held in an enhanced format, allowing for the participation of various stakeholders, including UN agency and civil society representatives. We also believe that the Council should discuss the human rights situation in Sudan at least twice a year. Furthermore, we believe that to avoid any risk of a public reporting gap, the Council should act at its 50th session – the last session during which presentation of a comprehensive written report is currently planned.

    Ahead of the Council’s 50th session, we therefore urge your delegation to support the adoption of a resolution that:

    • Recalls resolution S-32/1, including its request that the High Commis­sioner and the desi­gna­ted Expert continue to report on human rights violations and abu­ses com­mitted in Sudan and to advise on the further steps that may be needed;
    • Requests the High Commissioner, with the assistance of the designated Expert on Human Rights in the Sudan, to update the Council at its 52nd session, in an en­han­ced interactive dialogue, on the situation of human rights in Sudan; and
    • Further requests the High Commissioner, with the assistance of the designated Expert on Human Rights in the Sudan, to present to the Council, at its 53rd session, a comprehensive written report focusing on the situation of human rights in Sudan, to be followed by an enhanced interactive dialogue, and to continue to report on the situation of human rights in Sudan to the Council twice a year.

    While the government of Tanzania trumpets its Vision 2025 – a lofty plan to become a middle-income country within the next six years through sustainable development – it continues to thwart real development with its ongoing campaign to clampdown on fundamental freedoms in the country.

    Its latest attack on human rights comes in the form of sweeping new legislation, rushed through its parliament last week, that places new punitive restrictions on civil society organisations (CSOs) and tourism in Tanzania.

  • Thai government fails to accept recommendations to repeal restrictive laws at UN periodic review

    Human rights groups CIVICUS: World Alliance for Citizen Participation and the Asia Democracy Network (ADN) are disappointed by the Thai government’s failure to accept recommendations to repeal restrictive laws as recommended by members states of the UN Human Right Council, despite making commitments to civic freedoms. These actions highlight the inconsistent approach of the government to human rights that is undermining its credibility.
