  • AZERBAIJAN: ‘Operating on the ground has become increasingly difficult due to security concerns’

    KateWattersCIVICUS speaks about the links between the exploitation of fossil fuels and human rights violations in Azerbaijan with Kate Watters, Executive Director of Crude Accountability.

    Founded in 2003, Crude Accountability is a civil society organisation that works to protect the environmental and human rights of people in the Caspian and Black Sea regions and in areas of Eurasia affected by oil and gas development.

    How do extractive industries fuel human rights violations in Azerbaijan?

    The key problem is corruption, which results from the close relationship between the executive branch of government and the oil industry. The use of the state oil company by the regime led by president Ilham Aliyev is a key feature of Azerbaijan’s kleptocracy.

    Corporations operating in Azerbaijan handle vast sums of money and oversee massive projects. For example, British Petroleum (BP), the largest foreign investor, is involved in many of the key fossil fuel projects and is the majority shareholder and operator of the Baku-Tbilisi-Ceyhan pipeline, through which around 80 per cent of Azerbaijan’s oil is exported. BP has a monopoly in the industry that dominates the national economy, with oil and gas accounting for 95 per cent of all exports, 75 per cent of government revenue and 42 per cent of national GDP.

    Those in charge of the oil and gas sector control the financial and economic dynamics of the whole country. The vast revenues generated by the hydrocarbon industry make it difficult for smaller environmentally sustainable alternatives to gain traction and create fertile ground for corruption and secrecy. International mechanisms that promote transparency in the industry rely on a level of adherence to the rule of law that Azerbaijan lacks.

    That’s why Crude Accountability’s advocacy efforts focus on advancing transparency and accountability. We aim for the adoption of cleaner technologies that ensure the wellbeing of local communities and call for international financial institutions to cease financing fossil fuels and redirect their investments toward sustainable green energy projects. We urge companies to be transparent about the social and environmental impacts of their operations and strive for continuous improvement.

    What work do you do in Azerbaijan?

    Crude Accountability’s involvement in Azerbaijan dates back to the early 2000s. We work with communities, organisations and people affected by oil and gas developments. Our efforts encompass extensive research, educational and advocacy activities that address the specific impacts of the hydrocarbon industry, such as gas flaring from the BP’s Sangachal Terminal, which is causing villagers health problems and sleep disruption, along with  the broader impacts of onshore and offshore oil and gas development in Azerbaijan.

    As an organisation, we’ve shed light on previously undisclosed areas. One of our achievements is the collaborative report ‘Flames of Toxicity‘, produced in partnership with Omanos Analytics. Using satellite imagery and other technologies, we proved that oil spills and flaring were happening during extraction and refining processes in several locations. By doing this we reminded industry stakeholders that, even when it’s unsafe for activists to conduct extensive on-site verification, there are technologies we can use to gain insight into environmental and human rights violations.

    For the past few years, operating on the ground in Azerbaijan has become increasingly difficult due to security concerns for our partners. Since mid-2023, our primary focus in Azerbaijan has shifted to advocating for the release of Gubad Ibadoghlu, a prominent economist and anti-corruption activist. He was arbitrarily detained in July 2023 and is currently held in miserable conditions in a pretrial detention centre outside the capital, Baku, facing mistreatment and denial of medical attention. During his arrest, both he and his wife were severely beaten after the car they were driving was surrounded and forced to stop. The physical violence perpetrated against Ibadoghlu and his wife during arrest is extremely concerning.

    We are part of an international coalition of activists, academics, policymakers and journalists that works for the release of Gubad Ibadoghlu and other Azerbaijani political prisoners, including independent journalists affected by the recent crackdown on civil society.

    Is the level of repression in Azerbaijan increasing?

    Repression has intensified over the last five years, and particularly in the past couple of years, as President Ilham Aliyev and the presidential apparatus have sought to solidify their position and power. Following Russia’s full-scale invasion of Ukraine, authoritarianism and the repression of civil society have escalated across Eurasia. This is certainly the case in Azerbaijan.

    Azerbaijani people are afraid to speak out about the Azerbaijani offensive against Nagorno-Karabakh. Even those who refrain from criticising the offensive and work to address other related issues risk being labelled as ‘pro-Armenian’, a smear used by authorities against activists and dissenters.

    The snap presidential election scheduled for 7 February will serve to further consolidate Aliyev’s rule amidst regional turmoil. In this context, independent journalists face a heightened risk of repression. In June 2023, protests erupted in the village of Soyudlu, already threatened by environmental degradation, against the construction of an artificial lake to contain waste from the nearby Gadabay goldmine. Police severely beat community activists and journalists who came to cover the story. The village remains under lockdown, and although it appears that the goldmine’s activity has been limited or halted, it remains a challenge to obtain verified information. The community has been under stress since the incident.

    Environmental activists are also at risk. People with information about issues such as flaring or emissions are often afraid to speak out. Sometimes they have family members employed by the oil company or refinery and fear that they may lose their jobs, jeopardising the family’s livelihood. Fear of repercussions silences environmental activists and others who are aware of environmental violations. Still, some environmental and human rights defenders continue to operate discreetly in Azerbaijan.

    What forms of international support does Azerbaijani civil society currently need?

    Azerbaijan’s selection as the host for this year’s United Nations climate change conference, COP29, poses significant challenges from both a human rights and an environmental perspective. Azerbaijan has fallen short of its climate commitments. It hasn’t signed the Global Methane Pledge, a step taken even by countries like Turkmenistan. There are also serious concerns about civil society’s ability to participate in COP29 due to ongoing repression and severe human rights violations taking place in the host country. The imprisonment of a prominent Azerbaijani economist investigating corruption in the oil and gas sector raises further concerns.

    The international community should demand transparency and accountability from the Azerbaijani authorities in the run-up to COP29 and throughout the conference. A legitimate discussion on climate change in the framework of sustainability and human rights can only occur with the active participation of civil society.

    It is also very important to building international coalitions to confront authoritarianism, repression and closed civic space. Autocratic governance seeks to make people feel isolated and disunited, so collaborative efforts are vital. By working together, sharing resources and leveraging each organisation’s expertise for knowledge exchange, we can enhance our impact.

    Azerbaijani civil society requires financial resources, solidarity and support from the international community. The more we can offer to activists on the ground, the more successful our collective efforts will be.

  • BANGLADESH: ‘Civil society made a lot of efforts to stop Japan financing the Matarbari project’

    SharifJamilCIVICUS speaks about the cancellation of the Matarbari 2 coal-fired power plant project in Bangladesh with Sharif Jamil, General Secretary of Bangladesh Paribesh Andolon (BAPA), a platform that organises civil society movements against environmental degradation. Since 2009 Sharif has been involved with the Waterkeeper Alliance, a global network aimed at ensuring every community’s right to clean water. He is currently the Coordinator of Waterkeepers Bangladesh and Council Member of Waterkeeper Alliance.

    What is the significance of the cancellation of the Matarbari 2 project in Bangladesh?

    The cancellation of the Matarbari 2 coal plant project is very significant because it shows global leaders living up to their commitment to fight climate change. Last year G7 countries reached an agreement to stop building coal plants and funding coal-related projects. If Japan continued to support this coal project, it would have undermined the global effort being made to tackle climate change.

    We were happy to see a few contractors also pulling out of the project. Sumitomo Corporation, one of the biggest ones, decided to back out of the project on the basis that it contradicts their new climate policy. The Japanese-owned company decided to stop building and supporting coal plants. We believe this was a major step towards the cancellation of the project.

    People living in the area where Matarbari 1 and 2 were implemented were affected by pollution caused by the projects. If it continued, people living near the coal plant would have been affected by air pollution. The coal plant also threatened to pollute water in surrounding areas, which would have also put people in danger.

    How has civil society been involved?

    Civil society made a lot of efforts to stop Japan financing the Matarbari coal project, and hard advocacy work finally paid off. We made sure to talk to community members in surrounding areas to get their views on the project. Because we listened to their concerns about the health issues the project might cause it was easier to carry out advocacy work in the communities. Environmental civil society organisations (CSOs) were able to put pressure on key stakeholders with the help of research institutions that studied and tracked global finance and investments.

    It is encouraging to see G7 countries living up to their commitments. Japan taking a position against coal financing is a huge step towards protecting the environment in Bangladesh and the rest of world. Coal-fired power plants are the biggest contributors of carbon emissions and therefore one of the biggest obstacles to climate change mitigation efforts. As civil society we are happy to see that it is possible to hold governments and multinational corporations accountable.

    However, while it is good news to see Japan backing away from coal plant projects in Bangladesh, it is also quite frustrating to see it headed towards liquefied natural gas, which is also a fossil fuel. It would be good if Japan could help Bangladesh move towards clean and renewable energies. They have the necessary technology to do so and sharing it with us would help us overcome the climate crisis we are all going through.

    What role did your organisation play?

    As an organisation we found it important to talk to scientists to understand the scientific impacts this project would have had on our environment. We also analysed the environmental impact assessment study provided by organisations that were monitoring the project. We communicated with the plant company and the government to understand their position on the fight against climate change and environmental issues in Bangladesh. Fortunately, they were willing to listen to our concerns and even invited us to their stakeholder meetings.

    The problem we noticed with this project is that the parties involved did not consider the data provided by environmental organisations. It was understood that power plants would boost industrial activity, but our argument was that these projects had to be sustainable. Doing an environmental impact assessment was therefore key. Any project that is implemented should be carried out comprehensively, inclusively and on the basis of science so that it does not harm our environment. It was frustrating that the environmental impact assessment of Matarbari 1 did not do any modelling for harmful pollutants such as fine particles (PM 2.5) or mercury, letting the plant continue functioning subjecting it to scientific scrutiny.

    In advocating against the Matarbari project we tried to let people be part of the development activities happening around them. It was important to make them understand that every development project happening in their communities had to be sustainable and promote their wellbeing, which was not the case with Matarbari 1 and 2.

    What other actions are needed to combat climate change and environmental degradation?

    Japan is a trusted partner of Bangladesh. Bangladesh has long received Japanese investment and development collaboration. We have worked for a long time with the Japanese International Cooperation Agency, which has done a lot of good. We would like to see collaboration for development continue, but it should be of the sustainable and green kind.

    The Matarbari plant project was detrimental to our environment and its activities would have polluted both our water and air. This caused unrest and protests. We want multinational corporations and governments to consider the environmental impacts of any project they intend to introduce. They should consider the long-term effects of every project as well as the country’s energy security.

    Did you receive any support from international CSOs and activists?

    Several environmental organisations in Japan and other countries helped us raise awareness about the negative impacts of the Matarbari project. Some of these organisations conducted studies and came up with recommendations on how projects could be made green and sustainable.

    But we still need support to ensure that upcoming projects aim to promote the use of clean energy and live up to environmental standards. Our country also needs resources to help it transition to clean energies. Therefore, there is further need for collaboration with governments that can help us move in that direction.

  • BOLIVIA: ‘To exercise our rights, Indigenous peoples don’t need anyone’s permission’

    CIVICUS speaks about the struggles of Indigenous peoples in Bolivia with Ruth Alipaz Cuqui, an Indigenous leader from the Bolivian Amazon and general coordinator of the National Coordination for the Defence of Indigenous Peasant Territories and Protected Areas (CONTIOCAP).

    CONTIOCAP was founded in late 2018 out of the convergence of several movements of resistance against the destruction of Indigenous territories and protected areas by extractive projects and the co-optation of traditional organisations representing Indigenous peoples. Initially composed of 12 movements, it now includes 35 from all over Bolivia.

    What challenges do Bolivia’s Indigenous peoples face in their struggles for land rights?

    The biggest challenge for Indigenous peoples is the Bolivian government itself, which has become the main agent and source of rights violations, as it does not guarantee compliance with the constitution or protect the rights of its citizens, and particularly those of Indigenous peoples. We are third-class human beings, without rights, and are sacrificed.

    The organisations that used to represent us have been politically subjugated and turned into accomplices and operational arms of the violation of the rights of Indigenous and peasant peoples and nations. The state apparatus is imposing all forms of extractivism on our territories and protected areas: mining, agribusiness and hydrocarbon exploration and exploitation.

    The right to free, prior and informed consultation is being manipulated and turned into a simple administrative process that consists in drawing up minutes and signing forms and allows the participation of groups close to the government, which the government identifies as valid interlocutors even though they are not the real people affected by the projects in question.

    Another challenge we Indigenous peoples face is that of understanding that we have been mentally colonised with offers of great wealth that never materialise. We must understand that the wealth that is generated in our territories is taken by outsiders and their corrupt environments. Behind the facade of interculturalism, the government divides us in order to discipline us and put us at the service of its political interests.

    Once we understand this, the main challenge will be to restore the unity of Indigenous peoples, recover our ancestral memory of freedom, undertake the required self-criticism and dedicate ourselves to planning and building the country we want, exercising the rights that are already recognised in the constitution.

    The Bolivian constitution and international conventions and declarations so far represent progress on paper only. The way in which they are implemented by the Bolivian state turns them into abysmal setbacks, gaps, walls and barriers. Thirteen years after its promulgation on 7 February 2009, the Political Constitution of the Plurinational State of Bolivia is still tucked away in a desk drawer. In the last decade and a half, a monocultural, centralist, authoritarian, patriarchal, elitist and classist state that imposes a radically extractivist and capitalist economic policy has become the most lethal weapon against economic, cultural, social and justice pluralism.

    Violations of land rights include intimidation, harassment, discrediting, disqualification, criminalisation and legal procedures to silence land rights defenders. Such acts are carried out by oil and mining companies, the security forces, the judiciary – which is dominated by the government – and even by Indigenous organisations that support the government, which issue public resolutions to ignore us and restrict our right to defend our rights.

    What are your mobilisation strategies?

    Our strategy is to always maintain our integrity and dignity and to insist on exercising the rights protected by the Bolivian constitution and international conventions. To exercise our rights we don’t need anyone’s permission or approval, we just need to recognise ourselves as free and independent beings with full rights. This is what CONTIOCAP has been doing. If the government does not do its job, we must remind it that the state belongs to everyone and that we all have a moral obligation to question the bad practices of governments, to debate what kind of country we want and to seek ways for all of us to have the opportunity to grow as human beings.

    Historically, we have resorted to long marches as an extreme form of mobilisation to draw attention and seek justice. First, we marched for a constitution that recognised our rights as Indigenous peoples. And for the past 13 years, we have marched to demand that those rights be realised in practice.

    Our marches have been ignored, made invisible, isolated, harassed, and repressed. They have been accused of responding to opportunistic interests and discredited by powerful economic, political, and governmental forces.

    The 37-day march initiated by the lowland brothers and sisters in September 2021 was no exception in this regard. After so much sacrifice, after abandoning their villages, their homes, their families, their animals, the response they got from the government was insulting. While they waited for a signal from the government, the government met not with them but with organisations subservient to its interests. It was a clear message that it is the government who decides whether we are first, second or third-class citizens.

    What legislative changes do you demand?

    Among the laws that go against Indigenous peoples is Law 535 on Mining and Metallurgy of 2014, which violates fundamental principles and guarantees of the rule of law. It grants privileges to mining operators that are placed above the principle of citizens’ equality. It grants them rights of access to water that supersede those of local communities. It violates fundamental rights of Indigenous peoples such as prior consultation, which is reduced to an administrative process with deadlines and procedures that undermine consultation as a right.

    We also demand the repeal of Law 969 of 2017, which violates the right to self-determination of the Indigenous peoples of the Isiboro-Sécure Indigenous Territory and National Park, of Supreme Decree 2298 of 2015, which violates our right to free, prior and informed consultation in the hydrocarbon sector, and of Supreme Decree 2366 of 2015, which allows oil exploration in protected areas.

    There are many laws that we would like to see passed, but in the current context of total control of all powers by the government of the Movement for Socialism, it is dangerous to push a legislative agenda. In the best case scenario, the government could use it to whitewash its image, and in the worst case scenario, to promote its own interests. They would use us to validate norms that could even turn against us.

    But we do demand legislation to guarantee the economic inclusion of productive community organisations and producer families, the approval of the Bill on the Restitution of Ancestral Territories, which was introduced in 2019, and the reform of article 10 of Law 073 on jurisdictional demarcation. We demand that priority be given to effective compliance with the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement) and other international agreements, conventions, pacts and covenants.

    Do you see your struggles as part of a broader regional movement?

    The struggle to protect land and the environment is not the struggle of a single movement but a global struggle for the defence of life through the protection of our land. Nor is it the product of a sudden inspiration, but of an awareness of our right and the right of all forms of life to exist in this world. We seek respect as human beings who have taken care of the planet for all of us, even for those who are now destroying it.

    In that sense, our struggles are the same as those of Indigenous peoples around the world. We are somehow connected and linked at regional and global levels, although over the past two years the COVID-19 pandemic has prevented us from having face-to-face exchanges, while virtual exchanges have been hindered by the limitations of access to communications in Indigenous territories. However, we are now resuming the exchange of experiences and coordination.

    What support do groups defending land rights in Bolivia need from international civil society?

    They can help us by making our struggles visible, making them known so we can connect with other struggles of Indigenous brothers and sisters around the world. We want them to know that we defend our territories in precarious conditions and with our own resources and sacrificing the economy of our families, even more so after the pandemic. And we do this not only for ourselves but for all beings that require oxygen and water to live. We need direct support with small funds for legal and other emergency actions.

    We hope that they will help us unmask the double discourse of the Bolivian governments of the past 16 years, which in international spaces have presented themselves as saviours of Indigenous peoples and defenders of Mother Earth. This is far from the truth; these are just speeches that sound good from the outside and that international organisations like.

    We must unmask the international propaganda about left-wing governments. For us Indigenous peoples, all the governments of Bolivia – whatever their political colour – have had the same plans against Indigenous peoples. They seek to relegate us, put us off, divide us and pit us against each other to perpetuate themselves in power.

  • BRAZIL: ‘If Bolsonaro continues as president, it is a threat to the Amazon and therefore to humanity’

    CIVICUS discusses the state of environmental activism in Brazil with Daniela Silva, a socio-environmental educator and co-founder of the Aldeias Project, an education, art, culture and environment project for children and young people in the municipality of Altamira, in the Brazilian state of Pará.

    What inspired you to become an environmental activist?

    I live in a territory that has suffered great social and environmental impacts following the establishment of the Belo Monte hydroelectric plant on the Xingu River. And like thousands of people, including riverbank dwellers, fishers, Indigenous people, farmers, boat people, women and young people, my family and I also had our lives strongly impacted on by the project.

    We lived in a neighbourhood called Aparecida, in a community where neighbours supported each other and children and young people played in the streets without fear. When a mother went out, she would leave her children in the custody of her neighbour. One of my best memories is our backyard. It looked like a farm: we had many fruit trees. We didn’t need to spend money to eat fruit. Solidarity was strengthened by a sense of community, which I think was intrinsically linked to the sense of belonging to a territory. All this was destroyed by a ‘development’ approach that disregards the subjectivity of peoples and populations.

    The displacement caused by the construction of the Belo Monte hydroelectric plant pushed families far away from the Xingu River and separated communities that had lived together for decades. It fragmented community ties. A negative consequence of these impacts on the territory and people’s sense of self was their disconnection from nature and the loss of the Amazonian sense of belonging. Not feeling part of the Amazon is dangerous, because generally speaking, people only defend what they love, what they know and what they feel a part of.

    Before the construction of the dam, my father worked as a potter. Together with my mother, who worked as a civil servant, they raised eight children. This was all over when the dam was built. My father became unemployed and so did my brothers. My father began to fight for the right to a ridiculously small pension. My brothers were forced to look for odd jobs around town. It was a difficult time! I realised that adapting to an imposed reality is one of the worst forms of violence against human dignity.

    I am an activist for socio-environmental rights and against racism. Since adolescence I haven’t had much choice but to fight. We are one with nature, so we need to fight for nature to ensure a better present and future for ourselves and our children.

    How is Brazilian civil society mobilising on behalf of the environment and what challenges does it face?

    There are many environmental movements in the Amazon mobilising to denounce the environmental crimes of the government of President Jair Bolsonaro, but unfortunately our country’s judicial institutions have not been functioning according to the law, and have left us in a vulnerable position.

    There are many civil society organisations that have been working for a long time in the Amazon and other areas that face great challenges to sustain themselves since there is little availability of financial resources. Most of those that manage to survive do so with international funding, since there is little incentive in Brazil to mobilise resources for civil society. Financial suffocation is one of the tactics used by the current government. In addition, we live in a very unstable and negative economic context, with high inflation and a fall in real wages. The fact that Brazil is a country lacking a culture of giving makes it even more complicated. It all results in a shortage of resources for the sustainability of organisations and the security of environmental defenders.

    Even so, new groups and collectives – including the one I lead, Aldeias Project – continue emerging to defend the Amazon. There are many young people in leadership positions in the movements to defend their territories.

    Our challenge is to create a safe space, since we are under constant threat. To be able to carry out our work, we have established partnerships with more experienced organisations that are able to advise us on best practices for taking care of our staff, partners and the communities we serve. Networking helps us see the big picture and build powerful links.

    What do you think about the recent verdict by the Brazilian Supreme Court to recognise the Paris Agreement as a human rights treaty?

    The Paris Agreement is undoubtedly an important legal instrument, and it is good that, as a human rights treaty signed by the Brazilian state, it has acquired constitutional status. But like all of Brazil’s legal documents, including the Federal Constitution, it must be fully implemented, especially by public managers who keep on violating human and environmental rights regardless of what is stated in the Brazilian Constitution.

    For the Paris Agreement to be implemented and make an impact on the daily life of Brazilians, it must be disseminated among the people who suffer the climate crisis the most: Indigenous populations, riverside dwellers and Black communities in city outskirts. It is also important for the international community to take decisive action and put pressure on the Brazilian government for it actually to fulfil the agreement.

    Will the result of the upcoming election make any difference to your struggles?

    The October elections are perhaps one of the most important in Brazil's history. There is a lot at stake when it comes to the Amazon region. Bolsonaro, the incumbent, has unleashed uncontrolled deforestation, land grabs and illegal mining on Indigenous lands. He is also encouraging violence against human and environmental rights defenders in the Amazon.

    With Bolsonaro there is no possibility of dialogue or engagement of organised civil society in decision-making on environmental matters. If Bolsonaro continues as president of Brazil, it is a threat to the Amazon and its peoples, and therefore to humanity. We are experiencing a global climate crisis and we need world leaders focusing on working alongside civil society, scientists and the international community to put together short, medium and long-term solutions to tackle it.

    The advances of deforestation in the Amazon should be a key factor driving a Bolsonaro defeat in this election, but unfortunately it is not. Brazilian society remains very oblivious to the reality of the Amazon. Brazil’s large urban centres do not recognise the everyday reality of the forest and its peoples. The consequence of their ignorance is their lack of active concern about the current ecocide being committed by the Bolsonaro government. Fortunately, many Amazonian environmental movements are trying hard to pierce their bubble so Brazilian society gets to know what is happening and takes a stand.

    Now, while acknowledging the utmost importance of defeating Bolsonaro in the upcoming election, we also have strong criticism of his main rival, the Workers’ Party (PT). Like right-wing governments, PT governments, led by the current PT candidate, Lula da Silva, and his successor as president, Dilma Rousseff, also pushed initiatives that were environmentally destructive: the Belo Monte project was built under PT administrations, without any respect for the law and international agreements on human and environmental rights.

    However, we believe that with Lula we would be able to have a dialogue and there could be more space for civil society engagement in environmental decision making.

    What do you think should happen at the forthcoming COP27 climate summit, and what do you think will happen?

    Firstly, I think it is very important that COP27 is taking place in Africa, because African nations are among those that are suffering the most due to a climate crisis that has been caused by a small powerful group of white millionaires. They now have the opportunity to have a greater involvement at COP27 and demand more assistance from the richer nations that have caused the climate crisis. I hope that this edition of COP27 will enable the implementation of the promises and targets already agreed upon. And that women, children and adolescents will play an active role in this struggle for social and environmental justice.

    Although that is what I hope for, we all know that COPs are a space where difficult conversations must take place and the governments of big nations lack the will to face the reality of climate change, especially when it comes to financial investments and taking it upon themselves to counter the damage their developmentalist approach continues to cause. So we will be closely watching the negotiations and agreements. We are at a critical point regarding climate, and there is no time to lose.

    What kind of support do Brazilian environmental activists need from the international community?

    The international community is our ally in our struggle for climate, social and racial justice. One way to help is by shedding light on activists’ work and directly and indirectly supporting their struggles. Another is to put pressure on genocidal and ecocidal governments such as Bolsonaro’s so that they respect human and environmental rights. Be aware of our struggles and listen to the voices of those on the ground in the countryside, on the peripheries of cities and on the forefront of this war we wage on a daily basis.

  • CAMEROON: ‘Communities must benefit from what comes from their land’

    EstelleEwouleLobeCIVICUS discusses the aspirations and roles of civil society at the forthcoming COP28 climate summit with Estelle Ewoule Lobé,co-founder of the Cameroonian civil society organisation (CSO) Action for the protection of environmental refugees and internally displaced people in Africa (APADIME).

    What environmental issues do you work on?

    Our organisation, APADIME, works on several interconnected human rights and environmental issues. We work on the protection of the rights of Indigenous peoples and local communities, with a particular focus on Indigenous women and environmentally displaced people. We contribute to the fight against transnational environmental crimes such as the illegal exploitation of forest resources and illegal trafficking of protected species. We work to strengthen the resilience of Indigenous peoples and local communities and to raise public awareness of the need to protect forests. Finally, we implement income-generating activities for Indigenous peoples and local communities.

    When we work on organised crime, we don’t leave out the defence of people’s fundamental rights. Our area of work is the Congo Basin, with a base in Cameroon. Central Africa is home to one of the world’s largest tropical rainforests. It contains enormous resources on which millions of people depend for their livelihoods, including Indigenous peoples and local communities. The forest also provides a habitat for countless animal species and is of crucial importance for the global climate.

    Despite all the legal measures in place to protect Cameroon’s forests, forest exploitation, often carried out in partnership with private companies, gives rise to numerous abuses, resulting in serious human rights violations fuelled by well-organised criminal networks, and generally leading to the dispossession of the lands of these peoples and communities. This is where our association comes in.

    First, our work has a research component that is focused on both the legal and institutional framework to support our advocacy work at the national and international levels, and on carrying out studies and publishing articles and books, the latest of which is In Search of a Status for the Environmentally Displaced.

    Second, there is a field component in which we meet communities and organise consultation events, focus groups, surveys and observations to gather data about the difficulties people face and the needs they have.

    The third strand of the association’s work is education, through which we build the resilience of Indigenous peoples and local communities and awareness about their intrinsic rights, procedural rights, sustainable land management, the preservation of protected species and current forestry legislation. We also organise awareness campaigns to help educate communities.

    The fourth component is access to rights. We help organise communities by setting up networks of institutional and local players to facilitate access for communities whose human and land rights are constantly violated.

    The last component concerns economic recovery through the implementation of income-generating activities, particularly through community fields.

    Have you experienced any restriction or reprisal because of your work?

    We are human rights defenders working in an environment that is not always receptive to the type of work we do. We are confronted with powerful interests such as those of forestry companies that often exploit forests abusively. Our presence often makes an impression and we are subject to threats that force us to limit our scope of action to prevent the situation from degenerating and becoming too risky.

    At an administrative level, the main obstacle is the lack of a positive response or collaboration from officials. Some refuse to take part in our projects, contenting themselves with one general discussion session with us. Others refuse to make their contact information public.

    How do you connect with the global climate movement?

    APADIME collaborates with several of the world’s leading international organisations, including the International Centre of Comparative Environmental Law, an international scientific CSO based in France, which works on environmental protection through the promotion of international legal instruments. We also work with the Global Initiative against Transnational Organised Crime (GI-TOC).

    With the support and guidance of GI-TOC, we are currently working with a network of stakeholders in the Republic of the Congo and Gabon to combat organised environmental crime in the Congo Basin and protect the rights of Indigenous peoples to achieve climate justice centred on human rights.

    We are involved with international players in developing the People’s Summit for social and environmental justice, against the commodification of life and nature, and in defence of the commons. Our association is also actively involved as a speaker and observer at major international meetings, the most recent of which was the 11th Conference of the Parties to the United Nations Convention against Transnational Organised Crime (UNTOC), held in Vienna, Austria in October 2022, which produced a call for action by civil society.

    What priority issues should be addressed at COP28?

    COP28’s priority issues are the same as those we have been defending for a long time: support for Indigenous peoples and local communities to ensure their rights are protected, in particular through the funding of conservation activities and income-generating activities to raise their standard of living, and the equitable sharing of the benefits of nature as defined by the Kunming-Montreal Global Biodiversity Framework, which recognises that in addition to the urgent need to use nature sustainably, communities must benefit from what comes from their land.

    In particular, this involves examining how marginalised communities, including Indigenous peoples, can benefit from the often lucrative therapeutic and cosmetic products derived from the resources of their lands.

    Do you think that COP28 will provide sufficient space for civil society? What are your expectations regarding its outcomes?

    The participation of civil society in climate negotiations is extremely important because we are active stakeholders and, when we are able to influence the negotiations, we are a key factor in progress towards sustainable development. Our actions are complementary to political dialogue, which is why it is necessary, even compulsory, for us to take part in these negotiations.

    As usual, COP28 will officially be open to civil society as participants and observers, but the difficulties of access will lie in financing travel to and stay in the United Arab Emirates, where this global event will be held.

    But we hope that despite all these difficulties, progress will be made on the issues that are at the heart of our work, namely direct funding for communities to guarantee adaptation actions and strengthen their resilience.

  • COP27: ‘Climate justice requires debt cancellation, reparations and non-debt climate finance for small island developing states’

    Tariq Al OlaimyCIVICUS speaks with Bahraini social entrepreneur Tariq Al-Olaimy about the upcoming COP27 summit on climate change.

    Tariq is Managing Director of 3BL Associates, an ecosystem of social and planetary enterprises working towards regenerative, inclusive and wellbeing-centred economies.

    What was the purpose of the Greenpeace United for Climate Justice ship tour you recently took part in?

    Greenpeace is sailing throughout Egypt together with climate leaders from the Middle East and North Africa to put climate justice high on the agenda in the lead-up to COP27, which will take place in Sharm el-Sheikh, Egypt. The ship tour is a platform for climate leaders living in some of the world’s most affected regions to promote systemic change around climate adaptation, justice, access to energy and response to the loss and damage associated with the disproportionate impacts of the climate crisis. They are representing the voices of people from across the region, focusing on both climate impacts and the many solutions already at hand.

    It's important to spread these leaders’ messages around the world and to make sure their voices are not forgotten during COP27, especially in highlighting the need for climate justice for the global south. For these leaders, this is a collective fight for justice for their countries and communities.

    Young people from the across the global south in particular are among the most affected and most marginalised, but also among the most powerful voices. They are not victims, but collectives of solidarity and hope working for a brighter future for all.

    What issues should be prioritised at COP27? 

    COP27 must raise the call of climate justice for the most vulnerable, and also the least responsible for climate change: the people in Africa, in the South-west Asia and North Africa region, and on small islands, among others.

    I am from Bahrain, which makes me one of 65 million people who live in small island developing states, representing roughly one per cent of the world’s population. Climate justice, mitigation, adaptation and loss and damage strategies require consistent and regular resources. Small islands typically lack those resources and, being particularly vulnerable to extreme climate events, often face reconstruction costs that lead to more borrowing and debt, which in turn increases their vulnerability.

    All small island states together only received US$1.5 billion in climate finance between 2016 and 2020. In the same period, 22 small island developing states paid more than US$26 billion to their external creditors – almost 18 times as much. Climate justice requires debt cancellation, reparations and non-debt climate finance for small island developing states.

    COP 27 is framed as an ‘implementation COP’, and the climate finance gap and unequal distribution of finance between countries are critical barriers to implementation.

    Are you hopeful meaningful commitments will be made at COP27?

    The window of opportunity to act is closing. The United Nations Intergovernmental Panel on Climate Change’s6th Assessment Report offers an even clearer picture of the remaining carbon budget available to stay within a 1.5°C temperature rise and therefore avoid the worst impacts of climate change. While enhanced mitigation ambition is critical, the urgency of implementation is a key concern. Taking into account the pledges fully implemented as of 31 December 2021, total greenhouse gas emission levels are still projected to be 10 per cent higher than 2012 levels.

    To truly scale mitigation ambition, it is important that governments don’t just negotiate the text and numbers of pledges but negotiate the very system within which we implement climate action. We need degrowth of the most ecologically harmful sectors of our economy, a global and just transition and transformation towards a post-growth economy.

    In a context characterised by short-term political calculations we are completely missing the need for urgent and radical change. I do not expect COP27 to address all this. But there are still some issues that could be meaningfully advanced – in particular, the establishment of the basis for the operationalisation of a Loss and Damage Finance Facility, the details of which could be finalised at COP28 next year.

    This is an issue of climate justice towards the many countries in the global south that are particularly vulnerable to the impacts of climate change yet have done little to contribute to the crisis. At the same time, these countries do not have the financial or technological capacity to address these impacts, adapt and pursue a post-extractivist and low-carbon transition. Loss and damage financing can force a rethink around financial commitments and contributions, and pressure for both debt and tax reform as well as renewed financial commitments for mitigation and adaptation.

    How concerned are you about the conditions for civil society participation at a COP held in a country with highly restricted civil space?

    Civil society participation is always a critical concern at COPs. It’s clear that we can’t have a green and peaceful future without justice, equity, civil rights and empowered communities. That includes the full inclusion of independent civil society as a key stakeholder in climate negotiations. This is why business and civil society organisations have stressed the crucial importance of a rights-based approach to climate action.

    As the world transitions toward net zero, protecting the human rights of civil society, workers and communities is key to achieving a just transition. There is significant danger of pledges being made to close the emissions gap while irresponsible implementation strips the rights of civil society. Green transitions in rich countries and ‘green growth’ require significant mineral resources, supplied from the global south, so there is a risk of a neo-colonial mineral rush and a regression of labour rights. It is essential to develop norms, standards and safeguards so that the transition strategies implemented by governments and businesses comply with international human rights and labour standards.

    In the context of the COP, this starts with the United Nations taking a much stronger stance regarding the enabling of safe, inclusive and meaningful civil society participation throughout the negotiation process. The COP agenda is largely dominated by global north governments and interests, and civil society perspectives, especially those from the global south, need to find their way into the mix, bringing forward alternative pathways, experience and knowledge.

  • COP27: ‘The participation of civil society is important because it represents the voices of communities’

    Chibeze EzekielCIVICUS speaks about civil society’s aspirations and roles in the upcoming COP27 climate change summit with Chibeze Ezekiel, coordinator of the Strategic Youth Network for Development (SYND).

    SYND is a civil society organisation (CSO) that promotes youth participation and advocacy for environmental sustainability in Ghana.

    What are the environmental issues that you work on?

    SYND works for environmental sustainability by promoting youth participation in policymaking and project implementation. We focus on four thematic areas: climate change, biodiversity, forests and energy. In May 2019, with support from the World Bank and United Nations Development Programme, we established the Youth in Natural Resources and Environmental Governance platform. It is a platform for young people to share and exchange learning on their respective actions and help them embark on joint, coordinated campaigns.

    To help build capacity so that young people can better advocate for environmental sustainability and help the government fulfil its climate obligations, we have also developedcapacity building projects. As part of our efforts to empower students to become climate activists and environmentalists, we have also worked with schools. For instance, through our Children for Climate (#C4C) Action campaign we are empowering children to become climate champions. And we publishreports that highlight our activities and their impacts in the communities we work in.

    Have you faced any restrictions when conducting your work?

    Fortunately, we have not faced any restrictions working in Ghana. We believe that this might be because of our approach. We confront the government and question public officials on their policies, but we do it in a manner that will not jeopardise the work relationship we have built or put ourselves in harm’s way. This has worked for us, because our work relationship not only with the government but also the private sector has strengthened over the years, which has helped us continue doing our work.

    How do you connect with the global climate movement?

    We work in connection with similar organisations in other African countries as well as with international organisations advocating for environmental rights. In the African region, some of the organisations we work with include theAfrican Youth Initiative on Climate Change,350 Africa,African Climate Reality Project and thePan African Climate Justice Alliance. We are also the West Africa Regional Node forACCESS Coalition, a global network with about 70 members advocating for people living in poverty to have access to safe, reliable and affordable energy, and for environmentally sustainable and efficient energy systems globally.

    Working with all these organisations has allowed us to transcend the local level and connect to the global. To contribute to this global work, we produce position papers and give input on policies, among other things.

    What issues would you like to see addressed at COP27?

    Over the years global leaders have made pledges and promises but they have not fulfilled them. We hope at this year’s COP more serious commitments will be brought forward. Global leaders shouldn’t be making promises they won’t keep and should instead get to work.

    Climate finance is still an outstanding issue. There should be a clear understanding of how the mitigation and adaptation measures to climate change will be rolled out. Global leaders must provide communities with resources to adapt to climate change and assist them with mitigation plans. All of this will only be possible if adequate climate finance is provided.

    Another priority is loss and damage. We are aware that vulnerable people and those living in underdeveloped communities are the ones suffering the most as a result of climate change. Many people have lost their homes, land and source of livelihood, and it is only fair they are compensated for the irreparable damage caused to them.

    A few weeks back we travelled around Ghana to analyse how climate change has affected communities and what demands people had for the government. We conducted interviews and asked people about the situations they are going through and the solutions they would like to see implemented. We plan to present our video documentary at COP27 to show world leaders the real situation on the ground. This will give a clearer picture of what we mean by loss and damage, and hopefully put pressure for urgent action.

    Energy transition, away from fossil fuels and towards renewable energies, is also an issue we expect to see discussed. Especially since there are industrialising ambitions in Africa, it will be interesting to see how leaders plan to make energy available and affordable during this transition. Africa has plenty of resources such as wind, solar and hydro, but its progress towards renewable energies has been very slow. According to theInternational Renewable Energy Agency, only two per cent of global investment in renewable energies is invested in Africa, and only three per cent of jobs in the continent are in the sector. We want to know how global leaders plan to use their resources to help Africa with its energy transition.

    Why is civil society participation in climate talks important?

    The participation of civil society in COPs is important because it represents the voices of communities and is best placed to articulate people’s concerns and propose polices that will improve the lives of citizens. CSOs are also accountable to their communities, so when we attend global conferences such as COPs, we all go back to our respective countries to provide feedback and confront decisions made at the global level with the realities that people continue to live in. This pushes us to continue with our advocacy work. We continue carrying out engagement activities at the local, regional and international levels, holding our leaders accountable to their commitments and supporting their work to implement the policies agreed in global forums.

    Do you think COP27 will offer enough space for civil society participation?

    Because of the role we play, there is a space for CSOs to participate in COPs, although improvements in access could certainly be made. It is, however, unfortunate that CSOs only have observer status and cannot take part in negotiations. If they were offered an opportunity to interact with negotiators, they would get a better chance to convey their priorities and share their ideas.

    COP27 in particular is tricky because it’s taking place in a closed civic space environment. But that is what the situation is in Egypt. More could have been done to offer a conducive environment for civil society, but we will have to work with what we are presented with. I believe there is still some room to have a discussion with the Egyptian authorities so they allow some form of demonstration and civil society can make the voices of people heard. The government should allow its citizens to participate without any restriction because their views are also important.

  • COP27: ‘We doubt that we will be able to mobilise as we did around COP26’

    CIVICUS speaks with Sohanur Rahman, Executive Coordinator of YouthNet for Climate Justice, about civil society’s aspirations and roles in the upcoming COP27 summit on climate change. YouthNet for Climate Justice is a global platform of youth-led organisations of the global south that aims to promote climate action among young people.

    What environmental issues do you work on?

    YouthNet focuses on climate justice, the new human rights frontier. We want to hold global leaders accountable for the climate crisis we are currently in. We work on climate justice because we understand that young people, people from the global south and Indigenous people are bearing a disproportionate share of the consequences of the climate crisis, while not being responsible for what is going on.

    Climate change must be addressed through an intersectional and intergenerational lens because vulnerable groups are the ones experiencing its worst consequences. The climate crisis is rooted in capitalism, colonialism and patriarchy. This makes the struggle for climate justice inseparable from the struggle for human rights.

    We are now specifically working on the issue of loss and damage. We want world leaders to support adaptation and financing for loss and damage and provide funding facilities to help developing countries deal with the climate crisis.

    What issues would you like to see addressed at COP27?

    COP26 failed young people and vulnerable communities. It made clear to us that global leaders are not treating climate change as the global emergency it is. But sadly, we are currently facing one environmental catastrophe after the other. Most recently, there were massive floods in Pakistan and floods and a cyclone in Bangladesh. What else needs to happen so leaders realise we need urgent solutions to these problems?

    The COP26 presidency asked state parties to submit new climate plans and nationally determined contributions (NDCs), because the previously submitted ones were not ambitious enough, and would not reduce emissions to the extent needed to stay within the 1.5°C targets. However, Only 23 of the nearly 200 countries that signed the Glasgow Climate Pact have submitted enhanced NDCs. Rather than strengthening headline targets, most of these offered more policy detail. We need commitment from all parties involved to ensure that the climate crisis is addressed effectively.

    We can see the progress achieved in previous COPs is very limited. In the run-up to COP27, our major priority is loss and damage financing. Before we can pursue adaptation, we have to support communities with loss and damage. We are not asking developed countries for charity or debt, but for reparations for their historical responsibility in this climate crisis.

    In 2019, developed countries pledged US$100 billion towards adaptation and mitigation but they are not disbursing this. Everything at this point is theoretical – no practical mechanism has been put in place to ensure the money is paid up. And when the funds finally come, we would like to see a 50/50 split between adaptation and mitigation, because both require equal efforts. Finally, we would like to see the financing of locally led adaptation addressed at COP27. Communities should be given a platform to develop and implement solutions that will work for them, rather than implementing universal strategies that don’t fit everybody.

    This COP should be one where the focus shifts to implementation. We no longer want to hear promises that will remain unfulfilled. We want action towards solving our problems.

    Why is civil society participation in climate talks so important?

    Civil society participation in COPs, and specifically the participation of young people, is important because they are there to hold leaders accountable. The global community is making empty promises and commitments and not taking action. Civil society’s mission is to hold governments and companies accountable, including by making polluters pay for the loss and damage they are causing to people and the environment.

    Because the current systems are failing, civil society must advocate for systemic change. To achieve such transformative change, we must be united. Those joining COP27 should use the platform to advocate for change; those observing from home countries should mobilise in their own countries to highlight the crisis we are in. We must all put pressure on decision-makers to deliver on their promises. COP27 will only bring a breakthrough if civil society is allowed to participate without any restrictions and a decision is made to start paying out climate reparations.

    Do you think COP27 will offer enough space for civil society participation?

    We are very frightened about the situation in Egypt. The government of Egypt should release all arrested activists before COP27 takes place. Without our participation, it will be just more greenwash. And we cannot archive climate justice if human rights are ignored. The global community should stand up and speak against what Egyptian environmental activists are going through.

    COP26 was labelled as ‘inclusive’, but it was very exclusive. The pandemic came on top of persistent systemic barriers, notably the lack of resources that excludes many young people. World leaders negotiated on issues affecting us, but they did not include us at discussion tables. Unfortunately, the situation for civil society participation at COP27 will be even worse.

    The government of Egypt does not respect or support human rights defenders. This was clear in the multiple arrests of activists that have taken place over the past few months. Civil society can expect to experience several barriers during the conference, and LGBTQI+ activists have expressed their concerns regarding their safety while in the country. We fear that our presence, digital footprint and communications will be monitored. We doubt that we will be able to mobilise as we did around COP26 in Glasgow where we held a climate strike.

    Even though labelled ‘the African COP’, COP27 doesn’t truly represent African people. Many young African activists are still struggling to get accreditation and sponsorship. Rising hotel prices will affect the participation of people from less developed countries. There will be limited participation of young activists, Indigenous people and organisations from the global south. This event was never meant to be inclusive at all. The most affected people will be excluded. This raises the alarm that, instead of addressing the real issues people are dealing with, it may turn into a greenwashing event.

  • COP27: ‘We shouldn’t even be discussing why civil society needs to have a seat in climate talks’

    Ayisha SCIVICUS speaks about civil society’s aspirations and roles in the upcoming COP27 summit with Polluters Out co-founder Ayisha Siddiqa.

    Polluters Out is a global coalition founded in 2020 in reaction to the negative experience of COP25, when young and Indigenous activists were removed from the venue. Its aim is to put pressure on world leaders to adopt policies to fight climate injustice and hold them accountable.

    What key environmental issues should be addressed by the upcoming COP27 summit on climate change?

    A key issue is loss and damage finance. I would like to see COP27 mobilising theSantiago Network on Loss and Damage, a multi-stakeholder coalition of civil society organisations (CSOs) and governments launched at COP25 in 2019 to facilitate and support the efforts of global south countries to address loss and damages associated with the adverse impacts of climate change.

    A large number of those are affected by climate change are Indigenous people and people in the global south, who contribute proportionally little to environmental problems. Global north countries should use their resources to help those that have been put in these unfortunate circumstances. They should pay up the US$100 billion they committed to at COP26 so global south countries can develop and implement mitigation and adaptation strategies, as well as early warning mechanisms to help people get life-saving information in time.

    We also need to start thinking about taxing the money corporations make by exploiting emergency situations such as wars, natural disasters and economic fluctuations and channel those funds towards climate financing.

    My work currently focuses on raising awareness about the issue of tax havens. Governments have pledged a lot of climate financing but most of that money comes from taxes. Estimates show that every year around US$600 billion – six times the current climate finance target – are lost because corporations and high-net-worth individuals are using tax havens to escape their responsibilities to give back to the communities that make their profits possible. They should instead be made pay their share, and the additional funds should be used to help communities affected by changing climatic conditions.

    Have you faced any restrictions as a result of your work?

    Prior to working on climate finance, I worked on fossil fuel de-proliferation. According to a report by the United Nations (UN) Intergovernmental Panel on Climate Change, coal, oil and gas account for 86 per cent of carbon dioxide emissions. This means governments should adopt strategies to phase out fossil fuels and adopt clean energies. But this would affect very powerful interests. Due to my work on this issue, I have faced challenges both in my home country, Pakistan, and abroad.

    I also advocate for a UN conflict-of-interest policy so that COP hosts cannot take money from the fossil fuel industry when organising the summit and lobbyists cannot influence COP outcomes. So far, every single COP has been sponsored by the very same people causing the climate crisis. As a result, the outcomes of these events have been diluted and have failed to address the key issues.

    For this work I have faced multiple restrictions traveling. Iam from a tribal community in northern Pakistan where fighting against dams and coal and pipelines puts people’s lives in danger.

    Why is civil society participation in climate talks important?

    Having people from the global south and members of Indigenous communities participate in climate talks is very important not just because they are the most affected by climate change but also because they are the main drivers of ambition for climate commitments.

    As civil society, our aim is to advocate for the good of people and the environment and hold those in power accountable. Civil society doesn’t only offer diversity – it also offers the tools, the language and the practical lens to push all of this forward. At the end of the day, every decision made in COPs affects everyone. Our lives are on the line so we should have a say. It is not only our right but also our duty to protect the earth. Quite frankly, we shouldn’t even be discussing why civil society needs to have a seat in climate talks.

    Do you think COP27 will offer enough space for civil society participation?

    I don’t. COP27 has been labelled as the ‘African COP’ and one would think that African environmental organisations and activists would be given a platform to participate freely and make their voices heard. This was anopportunity for the global south to speak for itself and it would be a shame if that was limited. Many young people have been unable to get accreditation while others don’t have the funding to attend.

    Holding a COP in a country with closed civic space such as Egypt is problematic, and the reality of a restricted civil society cannot be ignored.

    Climate change is an urgent matter that must be addressed with the participation of all relevant stakeholders, who should be able to play their part without any restriction on free speech or the freedom of assembly, among many other indispensable freedoms. But many restrictions have been placed on Egyptian CSOs and activists – even on organisations outside of the country. As a result, there will most likely not be meaningful civil society participation at COP27.

    The situation we are now in is the responsibility of both the UN and the African governments that nominated Egypt to host COP27. They have let COP become an obstacle to climate justice so states who bid to host the COP make money from tourism and get media attention without caring the least about the crisis at hand and the policies needed to tackle it.

    The process leading to COPs is very opaque: for instance, we don’t know who the official sponsors are until the COP president announces them. And when civil society shows up with all of the hard work it has done, it can easily be erased with one vote from one state party.

  • COP28: ‘Political momentum should translate into adequately funded collective action’

    CarolineOwashabaCIVICUS discusses the hopes and roles of civil society at the forthcoming COP28 climate summit with Caroline Owashaba, an eco-feminist and gender inclusion specialist and Executive Director of Action for Youth Development Uganda (ACOYDE).

    Founded in 2014 and fully operational since 2014, ACOYDE is a community-based civil society organisation (CSO) working with adolescents and young people to set the agenda and influence policymaking to tackle young people’s challenges at the local, national and international levels. Its head offices are in Mbarara District, southwestern Uganda.

    What environmental issues does your organisation work on?

    ACOYDE works on a variety of environmental issues. In August 2022 we officially launched Climate Justice Clubs in Schools, aimed at helping teachers and students learn more about climate issues, bring this information into their families and the wider community, advocate for climate justice in their localities and create their own sustainable solutions. Schools are in a good position to start up sustainable solutions – for instance, some schools have agreed not use polythene bags as packages for the food consumed at break times.

    We also run a social enterprise that uses banana fibre to produce a variety of useful items. In this way, we contribute to the green economy by producing eco-friendly products that are biodegradable and support community livelihoods, especially for women and young people. This adds value to available community resources by training women to learn new skills to enhance their livelihoods.

    We have recently launched a climate justice club for adolescents and young women in Mbarara, which works as a peer learning and knowledge exchange platform focused on learning new skills. We also aim to build the resilience of rural women and raise the voices of women environmental human rights defenders. Women make up a large portion of the agricultural workforce in Uganda, but their importance is largely unacknowledged: their voices and concerns are rarely heard at the national and global levels and they are largely absent from decision-making roles. Our work has focused on training young women environmental defenders to be better able to tackle the challenges they face, including threats, intimidation, harassment and evictions, amplifying their voices, sharing their best practices and providing the conditions so they can learn from one another.

    Over time, we’ve seen growing collaboration between environmental activists and organisations working to protect biodiversity and those working for the rights of Indigenous peoples.

    Why is civil society participation in climate talks so important?

    Civil society plays critical roles in pushing for new laws, programmes, policies and strategies on climate change, holding governments accountable for their commitments, identifying the lack of coordinated government responses to climate change and ensuring that national policymaking does not forget the poor.

    CSO networks also collaborate to engage the media in order to reach the public and important decision-makers to impact on policies at the planning levels.

    What are your expectations concerning the outcomes of COP28?

    We expect to see a clearly defined agenda take shape to implement the loss and damage strategy agreed at COP27. Political momentum should translate into adequately funded collective action.

    The loss and damage fund launched at COP27 lacked a clear action plan, so we now expect to see a strategy to make it operational. Loss and damage funds are supposed to be aimed at assisting global south countries that are most vulnerable and have experienced the worst impacts of climate change. This is meant to cover the costs of natural disasters caused by global warming, such as wildfires, rising sea levels, heat waves, droughts and crop failure. Affluent countries must be the main source of funding for loss and damage, because forcing poor countries to borrow money to mitigate the effects of extreme weather and climate disasters would create more problems than it would solve.

    We would like to see more heads of states present at COP28, especially from the worst polluters and largest geopolitical powers, and held accountable for their countries’ emissions.

    We would like to see progress towards a just economic transition across key climate policy sectors. Meaningful partnerships are needed to link the climate agenda with broader issues of gender, food systems and ecosystem restoration. A fund should be set up for women farmers because in terms of climate resilience, grassroots and rural women are the most unsung change-makers of all time. They provide food, decent jobs and income to a large number of people. Consider how many households would be positively affected if they are adequately funded.

    That’s why I take part in the COP’s national gender and climate change working group, which has a chair reporting to the global chair. This is how we connect with the global climate movement and engage in conversations to influence climate policy.

    Do you anticipate any obstacles in engaging with COP28?

    Gender underrepresentation is likely to persist. Women have historically been underrepresented at COPs, for a variety of reasons including lack of funding to cover airfares, accommodation and living expenses. For example, when two young women from our organisation arrived in Egypt last year, they had trouble with their accommodation reservations. They had an incredibly hard time because hotels kept increasing their rates, and the hassle hindered their involvement in the event. We were very dissatisfied with the COP’s organisational planning.

    We have also witnessed accreditation procedures limiting women and girls’ involvement in COPs. The number of accreditations given is always limited, and a low share is granted to women, limiting their voices in decision-making spaces. In 2011 states agreed to boost female participation at COP, but their numbers have continued to significantly decrease. This happens at every level: for instance, a photo that was widely circulated at the start of COP27 showed only seven women among 110 leading negotiators.

    If we educate women and girls but do not provide them the opportunity to participate in international conferences, we are wasting their education, time and brains. Among participants at COP27 in Egypt, only 34 per cent were women. We don’t want this to happen at COP28 in the United Arab Emirates. We want to see educated, learned women and girls representing us at COP28. More inclusiveness is needed, including of women and girls with disabilities, from Indigenous and grassroots communities, rural and peri-urban communities, and especially those working in agriculture.

    What measures should be taken to make it happen?

    States should invest in funding more women and young people to take part in COP28 negotiations to ensure their issues are addressed and their voices are heard. Governments should invest more in women to drastically increase the current rates of female representation, which for some countries is as low as 10 per cent.

    As a result of their bigger burden of unpaid care work and more limited access to resources, women are more affected by climate change and suffer its economic impacts more. In some contexts, women are forced to drop out of school or marry to alleviate financial stress. If women and girls are given more space in negotiations, it will be more likely that these issues are addressed.

    We acknowledge that COP27 had the first-ever children and youth pavilion, where young people were able to participate effectively in the process; however, there is a need for higher numbers in subsequent sessions.

    The United Nations Secretary General’s Youth Advisory Group on Climate Change made a credible attempt to involve and engage young people at COP27. But there are ongoing barriers to youth participation in high-level events, including lack of commitment from older people and lack of funding, which must be addressed.

  • COP28: ‘We are worried that the host country, the United Arab Emirates, restricts civil society’

    GideonSanagoCIVICUS discusses the hopes and roles of civil society at the forthcoming COP28 climate summit with Gideon Abraham Sanago, Climate Coordinator with the Pastoralists Indigenous Non-Governmental Organizations’ Forum (PINGOs Forum).

    Established in 1994, PINGOs Forum is an advocacy coalition of 53 Indigenous peoples’ organisations working for the rights of marginalised Indigenous pastoralists and hunter-gatherer communities in Tanzania. It was founded by six pastoralists and hunter-gatherers’ organisations promoting a land rights and development agenda.

    What environmental issues do you work on?

    PINGOs Forum works with Indigenous peoples’ communities across Tanzania to address the impacts the environmental and climate crisis is having on them.

    Although it is a global phenomenon, climate change affects communities in different ways and presents a variety of challenges. These include prolonged and severe droughts, floods, biodiversity loss, land conflicts and displacement, and the loss of livestock that communities depend on for their livelihoods. This also leads to the loss of culture and identity as young men migrate towards towns looking for an income-producing job, leaving women, children and older people abandoned at home.

    To respond to these challenges, PINGOs Forum supports community initiatives for land conflict resolution, the development of land use plans and the recognition of land rights for Indigenous peoples, as well as for water provision and restocking of agricultural supplies for destitute families. We also build capacity to tackle climate issues and support Indigenous peoples’ participation in national, regional and global climate forums to ensure their voices are heard and the resulting policies respond to their needs.

    PINGOs Forum is a member of the Climate Action Network (Tanzania Chapter), the CIVICUS alliance, the International Indigenous Peoples Forum on Climate Change and other bodies engaging with the United Nations (UN) Framework Convention on Climate Change. We use these platforms for advocacy and campaigning. They have been instrumental for us in being able to voice our concerns and engage in productive dialogue and exchanges.

    Have you faced any restrictions or reprisals for the work you do?

    Human rights defenders face threats and intimidation when advocating for the rights of Indigenous peoples to land and resources and organising to respond to their violations.

    The state of Tanzania does not recognise the existence of Indigenous peoples in the country. Instead, it always refers to them as marginalised groups, forest-dependent communities, forest dwellers and other such terms. This limits the ability of Indigenous peoples to exercise their rights as enshrined in the UN Declaration on the Rights of Indigenous Peoples, of which Tanzania is a signatory but clearly does not respect.

    The UN declaration includes the key right of Indigenous peoples to give free prior and informed consent, which of course the Indigenous peoples of Tanzania have never exercised. Their rights to ownership of land and resources have been repeatedly violated through forceful evictions from their ancestral lands. We have seen examples of this in Loliondo/Ngorongoro and Kimotorok in Simanjiro District.

    Another major challenge is access to the media. We believe in the power of media and recognise the pivotal role it plays in addressing the challenges faced by Tanzanian Indigenous peoples. But the media is restricted when it comes to publishing any information coming from Indigenous people’s organisations regarding issues such as land crises, as happened in the case of Loliondo. All media outlets were warned not to publish any information about it.

    What priority issues do you expect to see addressed at COP28?

    There are several key priorities for Tanzanian Indigenous peoples on the frontline of climate challenges, the first one being funding of loss and damage. One of the key decisions from COP27 was to establish a loss and damage funding mechanism. We would like to see this funding mechanism operationalised with sufficient resources to urgently respond to the challenges faced by Indigenous peoples. We are eager to understand how this mechanism will address economic and non-economic losses and provide compensation for what we have already lost.

    More broadly, Indigenous peoples are in dire need of direct access to reliable and flexible funding, including for adaptation measures and to build resilience in the face of the impacts of climate change.

    Regarding the carbon market, Indigenous peoples would need to be engaged and the technicalities and political issues around these investment approaches should be clarified. Indigenous peoples should be able to exercise their right to free, prior and informed consent when it comes to carbon credits in their ancestral lands and forests to avoid any rights violations resulting from climate interventions.

    All this would require a recognition of the rights and knowledge of Indigenous peoples and their full and effective participation in climate forums at all levels to inform better policy formulation and decision-making processes.

    Do you think COP28 will provide enough space for civil society?

    We are particularly worried about the fact that COP28’s host country, the United Arab Emirates, restricts civil society movements and campaigns. It is key for civil society and Indigenous peoples’ organisations to be able to exercise their rights to express their views and peacefully demonstrate at any time during the negotiations. Otherwise their perspectives will not be reflected in the outcomes and their concerns will not be addressed.

    Civil society and Indigenous peoples’ organisations play a pivotal role as observers at COPs. They hold negotiating parties accountable and make a difference when they are reluctant to take important decisions during the negotiations. During COPs, civil society campaigns, mobilises, develops position papers and issues joint statements to push parties to take urgent actions on agreed points.

    What are your expectations concerning its outcomes?

    Our main expectation is to have an ambitious COP28 addressing key points of climate change action. We expect the loss and damage financial mechanism to be operationalised in ways that take into consideration the rights of Indigenous peoples and address both the economic and non-economic losses they are experiencing. We expect direct and flexible funding to become accessible to Indigenous peoples, as well as capacity building and the transfer of the required technologies.

    We also would like to see a clear definition of adaptation actions and serious emission reduction commitments by developed countries. But above all, we want this to be a COP of actions and not of empty promises – we want to see developed states live up to their commitments, giving vulnerable communities reasons for hope that they will be able to face and survive the impacts of climate change.

  • EUROPE: ‘The Energy Charter Treaty is having a chilling effect on climate legislation’

    Paul de ClerckCIVICUS speaks with Paul de Clerck,Economic Justice Coordinator at Friends of the Earth Europe, about the implications for climate action of the Energy Charter Treaty.

    Friends of the Earth International was founded in 1971 by four civil society organisations (CSOs) from France, Sweden, the UK and the USA to campaign together on key issues such as nuclear energy and whaling. Over time it grew to become a federation of 73 groups across the world. Its European arm, Friends of the Earth Europe, is the continent’s largest grassroots environmental network, bringing together more than 30 national CSOs with thousands of local groups. In coordinationwith other European CSOs, it currently advocates for European Union states to withdraw from the Energy Charter Treaty, which is preventing them from adopting and implementing effective policies to address climate change.

    What is the Energy Charter Treaty (ECT)?

    The ECT is a trade agreement that was established in 1994, after the disintegration of the Soviet Union. A large part of the 15 former Soviet countries had huge oil and gas reserves and western oil and gas companies wanted to ensure for themselves unrestricted access to invest in and extract those resources. So they agreed that the European Union (EU) and all its member states would grant these companies an investor-state dispute settlement system: a mechanism that allows companies to sue governments when they adopt new policies or laws that affect their financial interests. 

    For example, if a state introduces a new environmental or labour law that could jeopardise current or future profits, a company can file a lawsuit. This is especially relevant when it comes to oil and gas projects because oil-extraction facilities are usually operational for about 40 to 50 years, and the expected profit over such a long time can be enormous. 

    Such lawsuits are presented before investment tribunals, which are completely industry-biased as they don’t take human rights, labour rights, environmental rights or other public interest issues into consideration. As lawsuit processes are usually negotiated in secrecy, there is very little information available regarding the amounts of the settlements. 

    These lawsuits have become increasingly frequent in Europe as states have adopted climate transition policies. Companies are resorting to the ECT to claim massive compensation, ranging from hundreds of million to billions of euros. This mechanism not only forces governments to pay for compensation, but also stops them introducing new sustainable energy policies. That is what we call the ‘chilling effect’: governments anticipate they will be sued so they either weaken their legislative proposals, delay them or discard them altogether.

    The ECT is an old treaty that is out of line. Its main purpose is to protect fossil fuel companies, and it’s completely at odds with the Paris Agreement on climate change and the EU’s climate and sustainability agenda.

    Several EU states have recently announced they will withdraw. What happens after a state quits the ECT?

    France, Spain and the Netherlands have recently made such announcements, but the only state that has withdrawn so far has been Italy. Following the announcement, it takes one year for withdrawal to become effective. However, the treaty’s so-called ‘sunset clause’ states that if a country leaves the ECT, investors can continue to sue it for another 20 years. This gives an almost unlimited right to companies and investors and is one of the reasons why we are urging EU states to leave the treaty all together, in a coordinated way. If they did so, they could agree on passing EU-level legislation preventing further investor-state dispute settlement cases. About 90 per cent of current cases involve EU states, so they would gain much better protection this way.

    Over the past two and a half years the ECT has been renegotiated, and in June 2022 member states reached an agreement to reform it. But from the civil society perspective, this is not good enough. First, because it extends protection for fossil fuels for another 10 years. And second, because it would extend its reach to other energy sources such as hydrogen production from biomass with carbon capture and storage, which would result in increasing rather than decreasing risk.

    This is going to be decided within the next month, first by EU member states, and then by all ECT member states. The European Commission, the EU’s executive body, wants EU states to remain parties to the ECT, and it is pushing for the EU as a whole to adopt the modernised agreement. Several states are in favour of adopting the reform as they assess this new treaty as a better protection than the old. Of course, these are states that have been less exposed to the legal risks posed by international investors. On the other hand, there are the states that have been sued, such as France, Italy, Poland and Spain. Earlier this year, Italy lost a case against an English oil company that cost it several hundreds of million euros. 

    Has the war in Ukraine and Europe’s current energy crisis affected the negotiation process?

    Even though Russia is not an ECT state party, there are possible implications to the fact that the EU has taken several measures to restrict the operations of Russian companies. These are partly based in other European countries, which means they could sue European states.

    There could also be other impacts. Most European countries are persistently trying to find new sources of gas and hydrogen and are looking at African markets. Several African countries such as Nigeria are in the process of becoming ECT members, and it is suddenly in the interest of European states to bring them on board. This is having an impact on the negotiation process, although I am not sure it is a decisive one.

    What should we expect to happen now?

    The European Council, which brings together the heads of the 27 EU member states, needs to decide whether the reform will be adopted. It was supposed to decide by 25 October, but because of all the withdrawal announcements it has been unable to do so. Now a decision is expected by mid-November. If the European Council approves the reform, then the European Commission and its members will go to the annual ECT meeting, which will be held in Mongolia on 27 November. That meeting is the second step to move forward on the reform’s approval. The third and final step will be a vote by the European Parliament.

    We are campaigning for the EU and its member states to reject the reform. If we lose, then we will shift our focus towards the European Parliament. For the past two years, its representatives have been completely left out of negotiations and several parliamentary blocs have been very critical about the treaty. So we are still hoping we will be able to stop the agreement in the European Parliament.

    Along with other European CSOs, we have been doing a lot of joint advocacy with European institutions and coordinating actions, messages and strategies across Europe. We must put pressure on governments. The next few weeks will probably be decisive.

  • HONDURAS: ‘We demand environmental justice in the face of corrupt interests insensitive to local needs’

    Juana EsquivelCIVICUS discusses community resistance to mining mega-projects in Honduras with Juana Esquivel, representative of the Municipal Committee for the Defence of Common and Public Goods of Tocoa. The committee is made up of local organisations and communities that oppose extractive projects that threaten the environment and common and public goods.

    On 13 June, an open council meeting convened by the Tocoa mayor’s office approved a petroleum coke thermoelectric plant, despite a legal appeal by the local community. It is feared the project will cause deforestation, sedimentation and pollution of the Guapinol River. A similar conflict took place in 2014 when, without consulting communities, the authorities granted permits for a mine in a protected national park affecting the Guapinol and San Pedro rivers. In response to their peaceful protests against the project, many activists were criminalised and eight were imprisoned for long periods.

    Why do you oppose the Tocoa thermoelectric plant project?

    We oppose the thermoelectric plant because its impact on human health and the environment would be devastating. The fact that it is less than 150 metres from some communities significantly increases the risks. But these are not reflected in the environmental impact studies the company presented, which contain deliberate errors that minimise the project’s real damage.

    The plant would use pet coke, a substance derived from coal and oil that is not regulated for energy production in Honduras. It would require huge amounts of water to operate, threatening the drinking water supply of local communities. Waste would be discharged into the Guapinol River, seriously affecting aquatic life and the ecosystem. The company’s studies absurdly claim that the fish in the river will adapt to the warm water coming from the plant.

    Our demands are clear: the project must not go ahead because of its serious environmental and health impacts. We demand that our rights be respected and our environment protected.

    Why did you object to the calling of a public town hall meeting on 13 June?

    Civil society objected to the meeting because of the history of manipulation and lack of transparency in the implementation of mega-projects in the area. The thermoelectric plant is part of a mega-project known as Los Pinares/Ecotek, owned by the Emco Holdings group, which has six other components: two mining concessions in the core zone of the Carlos Escalera National Park, an iron oxide processing plant and three water concessions on the Guapinol, Quebrada de Ceibita and San Pedro rivers.

    The municipality issued a falsified document stating it had carried out a community consultation to validate the project. The project is being presented to the community as a solution to its energy problems, when in fact it is designed to supply energy to the iron oxide processing plant, not the community.

    In December 2023, we attended a public town hall meeting where between 2,500 and 3,000 people expressed their opposition to the project. Faced with this massive opposition, the mayor suspended the event, citing security reasons, and in January he unilaterally called another town hall meeting, without the support of municipal institutions, which was suspended following a legal appeal we filed. Finally, in the town hall meeting of 13 June, the mayor manipulated the situation, holding the open town hall meeting against the will of the community and listening only to those who support the project, who are representatives of boards of trustees controlled by the mining company.

    How has the community organised against this mega-project, and what reprisals have people faced?

    We have been fighting against the Los Pinares/Ecotek mega-project since 2014. We have carried out numerous protests, including holding permanent popular assemblies in front of municipal offices and mass protests. Thanks to these we managed to have Tocoa declared a mining-free municipality and the core zone of the Carlos Escaleras National Park restored.

    In 2018, we set up a camp under the banner ‘For Water and Life’, which lasted 88 days. This direct action triggered a wave of criminalisation and persecution. Repression against environmental activism has been fierce, with 32 prosecutions and eight comrades imprisoned for almost three years.

    Activists have been murdered and there’s a climate of constant threats and harassment. Hundreds of families have been displaced by threats and the use of excessive force by the authorities and armed groups hired by the company.

    Despite these challenges, we continue to fight against the corruption and state and corporate violence that has affected our communities for more than a decade.

    Has thegovernment of President Xiomara Castro fulfilled its promises regarding Guapinol?

    The government’s actions on this issue have been negligent and have exacerbated polarisation and conflict. Although the government has made Guapinol a central issue on its political agenda, the release of imprisoned environmental defenders has been the result of years of community mobilisation and resistance rather than direct intervention by central authorities.

    A significant government debt to Tocoa and Guapinol remains: the complete cancellation of the Los Pinares/Ecotek megaproject. A decree was issued in February 2024 to protect areas of the Carlos Escalera National Park, but it is crucial to ensure its effective implementation and the repair of the environmental damage already caused.

    The community remains vigilant and active, demanding environmental justice and the preservation of its natural resources in the face of corrupt economic and political interests insensitive to local needs.

  • MEXICO: ‘When climate activism threatens powerful interests, it is labelled on the same level as terrorists and drug traffickers’

    MariaReyes CIVICUS speaks about the role of civil society and its expectations for the upcoming COP28 climate summit with María Reyes, a young human rights and environmental activist from the Mexican state of Puebla.

    María is part of the Indigenous Figures (Futuros Indígenas) collective, made up of peoples, including young people, from Mexico and Central America. She participates in the global south division of Fridays for Future (FFF), an organisation that fights for environmental justice and advocates for action in the face of the climate emergency.

    What are Mexico’s main environmental problems?

    Generally speaking, Mexico is very vulnerable to the climate crisis. Water scarcity is a central issue, partly caused by droughts, but also by infrastructure problems, as many people do not have access to piped drinking water, and by very poor distribution and overexploitation of aquifers by private companies. If we add to the existing drought the fact that in many communities there are companies that obtain concessions through non-legal and non-transparent means and appropriate the little water that is left, the situation for people becomes unbearable.

    Mexico is one of the most dangerous countries to be an activist and environmental defender. In the southeast of Mexico there is a series of transnational extractive megaprojects, such as the Interoceanic Corridor and the ‘Mayan Train’, which threaten the environment through logging and water extraction, and displace wildlife, expropriate territories and resources, harm people and commit human rights violations. Local communities, particularly Indigenous communities, are criminalised when they oppose these megaprojects that are imposed on their territories without any consultation and without their consent or through the staging of rigged consultations.

    CIVICUS and over 120 civil society organisations have signed a joint letter to urge the authorities in Mongolia to stop reprisals against human rights defender Sukhgerel Dugersuren and to ensure that environmental defenders, and communities impacted by development projects, can freely and safely defend human rights and protect the environment without fearing reprisals.

  • PARAGUAY: ‘As long as land remains in private hands, conflict will continue '

    CIVICUS speaks with Alicia Amarilla, national coordinator of the Organisation of Peasant and Indigenous Women (CONAMURI) in Paraguay about conflicts over land rights between the state, the private sector and Indigenous communities.   • PERU: ‘Environmental regulations were relaxed, when they should have been strengthened’

    Juan Carlos SueiroCIVICUS discusses the recent oil spill off the coast of Lima, Peru, with Juan Carlos Sueiro, Director of Fisheries at Oceana, the world’s largest international organisation dedicated to protecting and restoring the world’s oceans. Founded in 2001, Oceana focuses its work on restoring fisheries, promoting clean energy and establishing protected marine areas.

    Has anyone been held responsible for the oil spill off the coast of Lima?

    The oil spill, caused by the Spanish oil company Repsol, happened on 15 January 2022. Due to its magnitude and visibility, it was the worst ecological disaster in Peru’s recent history. It occurred in an artisanal fishing zone, with protected areas and important seasonal economic activity. It is the largest spill we have ever had.

    The spill happened because of the high tides caused by the eruption of the Tonga submarine volcano, which affected the process of unloading oil from a Repsol oil tanker to the La Pampilla refinery. The question is: how is it possible that the company only became aware of the magnitude of the spill the next day? The company’s negligence magnified the consequences of this spill.

    Unfortunately, we have seen little progress in terms of Repsol taking responsibility for recovering the ecosystem. Even the exact volume of oil spilled is not known with any certainty. The company’s reaction was very slow, which is worrying because the first 24 hours following this kind of accident are key, as the oil film becomes very thin and expands a lot. It was only almost 20 days later that more sophisticated equipment was brought in to address the problem.

    Overall there is not enough transparency. In this case, the contingency plan was not implemented. The activities currently underway are supposed to be the product of a plan, but neither the company’s commitments nor the contents of that plan have been made public. The area between Ancón and Chancay was heavily impacted on by the spill, and there is no bay there, only cliffs and water. It is visible how little has been done in the way of recovery.

    There is also little transparency in the investigation. It is still not clear whether Repsol has handed over the equipment that was underwater in order to investigate and determine what happened on the day of the spill.

    This lack of transparency is symptomatic of the way the Peruvian state operates. This is similar to what happened when the pandemic broke out and we ‘discovered’ that we had an absolutely precarious health system, which was clearly not up to the task. In this case, we have environmental structures, legislation and procedures on paper, but not in reality. The opacity of information is intended to hide this discrepancy.

    For us it is very clear: Repsol must publicly assume clearly defined responsibilities.

    What have been the environmental and economic impacts of the spill?

    There has been great environmental damage. The area affected by the spill includes several protected natural areas: the Ancón Reserved Zone, the Guaneras Islands and the Punta Salinas Reserved Zone. The spill has impacted on marine fauna, affecting animals such as sea lions, otters, penguins and birds. Many have been stained with oil and their lives are at risk. Oceana is currently surveying this damage, as well as the additional damage caused by the company’s delayed reaction.

    For communities in the area, the greatest concern is economic. These are mostly low-income people engaged in artisanal fishing. Beyond individual and immediate impacts – for example, for those who had invested in a seasonal business just before the spill – the consequences are collective and long-term. It is now impossible to fish in Ancón or Chancay, and it is difficult to know when it will be possible to do so, because oil has a much longer degradation time when it settles on the seabed. The fishermen and all the workers involved in processing and distribution logistics are also concerned about the variation in fish prices and the drop in demand.

    We have run a calculation of the economic worth of coastal fisheries in these places to give us an idea of the economic loss. We also believe that there is an important impact on tourist activity: for the nine million inhabitants of the capital, Lima, and the three million living a little further north, these beaches are the closest place to spend the summer, and the spill has cut short the summer season, which runs from January to April. We have already warned the local municipalities that they must estimate the damage caused to tourism.

    How has civil society responded?

    We have all reacted with concern and a great interest in helping others. We have seen many volunteers helping to clean up the beaches, as well as experts and academics contributing within their areas of expertise.

    However, volunteer work has limitations because in order to rescue marine wildlife from the damage caused by oil, certain procedures and products must be used to properly remove oil from an animal’s plumage or skin. Because of this, interest in helping usually does not translate into 100 per cent successful results.

    Moreover, as this is the first time we have faced a disaster of this magnitude, Peru does not have all the expertise it needs. There is post-disaster expertise and experience elsewhere; it is necessary to bring it in. It would also be important to deepen the discussion about the energy mix we have and how to change it by turning towards the renewable resources that are available to us.

    How can private companies be called to account and contribute to preventing future disasters?

    Lack of accountability is a longstanding concern for the communities in these areas, and the fact that their demands have been systematically ignored is a symptom of Peru’s strong centralism. Artisanal fishermen in the north have been warning about this situation for several years and there has been no meaningful response. Oil extraction in Peru dates back to the 19th century; Peru had the first oilwell in South America. In the 1950s and 1960s, offshore platforms were installed, which are at the root of the spills and leaks that fishers complain about. There are also complaints about what happens in the transportation process, which has much greater implications.

    This situation has encouraged civil society to prioritise the search for solutions. For almost a decade, environmental requirements have been reduced in Peru; it is necessary to walk back that path. Peru is engaged in fishing, mining and other activities for which regulations have been relaxed, when they should have been strengthened. The very low environmental capacity of the state and the poor response of companies to disasters clearly shows their inadequacy. Peru suffers from a major crisis of governance and respect for the rule of law. 

    The possibility of another spill is always present. It is necessary to minimise the likelihood of it happening, and to ensure that when it does, it has the least possible impact in terms of magnitude, frequency and consequences. To do this we have to start by not losing sight of who is responsible for this disaster and the consequences of their irresponsible action.

  • SERBIA: ‘We are not just fighting locally; we are sending a message to the world’

    CIVICUS speaks about the recent protests against the exploration and licensing of lithium mining – for use in batteries, including electric vehicle batteries – in Serbia with Miroslav Mijatović, activist and president of the Podrinje Anti-Corruption Team (PAKT). Founded in 2014, PAKT is a civil society organisation (CSO) working on anti-corruption and the promotion and protection of human rights and freedoms.

    What is the ongoing civil society campaign against lithium mining in Serbia?

    There are currently 172 mining exploration permits in Serbia, and lithium is being explored at 10 locations. The project that has progressed the most so far is the one in the Jadar river valley. The company in charge, Rio Tinto, certified the balance reserves of lithium and boron in late 2020, accounting for 158,647,256 tonnes – 1.7 per cent lithium and almost 14 per cent boron.

    Initial investigations are also taking place in other places across Serbia, so people all over have joined our fight in fear of what awaits them.

    The Law on Mining and Geological Explorations (2011-2015) declared lithium and boron to be strategic minerals, and therefore in the public interest, allowing land expropriation to be carried out for those mining projects. As a result, people are afraid that the state will confiscate their property at a very low price.

    Rio Tinto has spread the rumour that it pays a much better price and this has played very well on the field, but it is simply not true. The company has so far managed to buy about 150 of the 350 hectares required to obtain a building permit and approval for exploitation, but I think it won’t be able to get much more. Now everyone expects a move by the state. It is not easy for the government to move on with expropriations before an election, but after these take place in April, the situation will get worse.

    For now, the fight against Rio Tinto is taking place in the justice system. We have not yet entered the field of environmental protection because it is not yet clear which technological process will be used to separate lithium and boron. We have been told Jadar Valley is going to be experimental project, but we don’t want to be treated as lab rats. According to reputable experts and academics we have consulted with, it is almost impossible to extract lithium and boron without a severe environmental impact. Available data shows that over the estimated 60 years of the mine’s lifetime about 90 million tonnes of tailings – mining waste – will be deposited in the Jadar Valley.

    Our efforts are currently focused on the multiple proven violations of Serbian legislation and regulations involved in the state’s dealings with Rio Tinto. As well as violations of national legislation, including of the Environmental Protection Law, the Law on Planning and Construction, the Law on Agricultural Land, the Forest Law and the Law on Environmental Impact Assessment, among several others, there have been repeated violations of the Aarhus Convention, which guarantees the right of people to access timely and accurate environmental information held by the authorities.

    All Rio Tinto contracts are labelled as ‘trade secrets’. The local community knew almost nothing about the project until a special-purpose area spatial plan for Jadar came to light. There are no real controls on what the company is doing because, believe it or not, Serbia only has three mining inspectors.

    What has PAKT done to try to stop the project?

    We helped the local community register their association, ‘We won’t give up Jadar’, and soon decided to start an online petition. We were aware of the fact that a petition does not have any legal power but seized the opportunity to create wider awareness of the issue.

    We requested the help of experts and academics and activated as many public figures, including athletes and actors, as possible.

    We also cooperated with an opposition member of parliament who was able to secure a meeting with the prime minister. We showed her the 300,000 electronic signatures we had collected and explained to her why we were against the mine, but her response was that we were against progress and that was the end of the dialogue.

    However, the media began had started to pay attention, and when foreign television channels began to arrive in the Jadar Valley, we knew that we were no longer alone.

    As for legal action, there are already three complaints filed against the company. The main one is related to large-scale environmental pollution.

    For months we toured the Rio Tinto wells in the Jadar Valley and found out that nothing grew around them, not even weeds. Inspection bodies did not react to our evidence, and then someone approached us with a compensation agreement drawn on behalf of Rio Tinto, in which the company recognised pollution from exploratory wells and offered to pay damages to the plot’s owner. We investigated and found five more such contracts, all classified as secret. There may be many more, because there are over 580 exploration wells in the Jadar Valley.

    We filed a complaint against the company with the Prosecutor’s Office in Loznica, attached the contracts, and requested an independent expert investigation to find out how many wells are leaking and what kind of pollution they produce.

    What did the campaign achieve?

    The campaign connected with the public, and in the second week of protests against the scandalous Expropriation Bill, which the government tried to push through the National Assembly by urgent procedure, there were over 120,000 people on the streets.

    In the face of many displeased people mobilised in an election year, the government reacted. It first withdrew the Expropriation Bill. Then it revoked the decree greenlighting Rio Tinto’s project and backtracked on the spatial plan for the special-purpose area designed for the project’s implementation, which had been illegally introduced.

    Since the beginning of the protests, PAKT has emphasised that these were citizen protests that did not involve the political opposition. This civil revolt achieved something that the weak opposition never achieved under nine years of rule – first as prime minister and now as president – by Aleksandar Vučić: the protests attracted a part of his electorate and gave him a signal to give in.

    It really was the fact that people mobilised in an election year that did the trick. In our last meeting, we asked the prime minister if she had withdrawn the decree on the spatial plan because of growing awareness of the environmental danger, and she replied that she did not yet have all the information on lithium exploitation. It became clear to us that they are afraid of people taking massively to the streets in an election year.

    This raises concerns that the government made what they view as a small temporary compromise to make demonstrators protesters happy but everything will return to normal after the April election.

    How has Rio Tinto reacted?

    We have not been in contact with Rio Tinto for over two years. We believe dialogue only benefits them because afterwards they claim they have engaged with civil society and have listened to our concerns. When we managed to convince other CSOs that this was the right approach, the company went on to found its own fake CSOs to go through the motions of civil society consultation.

    So far, we haven’t received any threats from the company. Threats typically come from domestic extremists who mostly support the Vučić government. We are annoying for many right-wing movements and associations, so they threaten and attack us. While so far we haven’t received serious threats, we have noticed an increased interest of security agencies in our work. But as we have been dealing with corruption for more than 10 years, we are used to this.

    What do you think will happen after the elections?

    It seems that President Vučić has emerged quite strongly from the protests. He seems to have galvanised his electorate, because the public appears to have been sold on his concessions, and now they wonder, what more do environmentalists want?

    In addition, some members of the opposition joined the protests in an attempt to score some political points, which only served to drive many people off the streets. As the opposition is divided, the majority will likely stick with Vučić for another term, and I am genuinely afraid that after the election we will see the real repressive face of this regime.

    Our main goal will be to achieve the adoption of a law banning lithium and boron research, the only thing that could reduce tensions to some extent. We have submitted a bill to that effect and even proposed to set up a working group with experts from government and civil society. We urged for this to happen before the election campaign is underway, because we do not believe the government’s intentions are sincere. It is highly unlikely it will agree to pass this law by urgent procedure before the elections, so protests will likely continue.

    What support could international civil society and the international community provide?

    Any help and support from international civil society will be welcome, particularly in terms of amplifying and internationalising environmental issues. We are not just fighting here locally to protect our environment; we are sending a message to the world about the dangers of extracting lithium from solid sediments, which are simply not acceptable anywhere in the world. We all need to be vigilant.

    As an organisation whose mission is to trace the flow of public resources and money, we have also made the connection between environmental and anti-corruption issues. This government is turning Serbia into a European landfill, and there are obvious reasons why it gives tacit approval for corporations to violate environmental standards to reduce production costs.

    European Union (EU) companies and civil society should deal with this issue, because the situation in Serbia will eventually affect the business of EU companies and distort competition, ultimately affecting the quality of life in the EU.
