AUSTRALIA: ‘Repressive laws have been introduced to limit people’s ability to protest against climate injustice’

BIODIVERSITY: ‘Governments will not show political will unless people on the ground put enough pressure’
CIVICUS speaks with Gadir Lavadenz, global coordinator of the Convention on Biological Diversity Alliance (CBD Alliance), about the ongoing process to draft a post-2020 Global Biodiversity Framework with the full participation of affected communities and wider civil society.
The CBD Alliance is a network of civil society organisations (CSOs) with a common interest in the Convention on Biological Diversity. It works to increase public understanding of relevant issues, enhance cooperation among organisations wishing to have a positive influence in the CBD and bridge the gap between those who participate in CBD sessions and those involved in biodiversity-related work on the ground, while respecting the independence and autonomy of Indigenous peoples, a key stakeholder.
What is the CBD Alliance, what does it do and how did it develop?
The origins of the CBD Alliance, about two decades ago, were organic – it came naturally as those participating in the CBD process saw the need to act together and amplify the voices of civil society in the negotiations. Since the beginning, the CBD Alliance’s role was not to speak on behalf of people, but rather to support all advocacy efforts being undertaken autonomously in the best way possible.
Despite our limitations, it is very clear to us that the less privileged groups require specific support. Also, while our network is diverse, we respect the role and have fluent coordination with the other major groups involved in the process, particularly the International Indigenous Forum on Biodiversity (IIFB), the Global Youth Biodiversity Network and the Women Caucus.
The CBD Alliance is a broad community: in includes both Indigenous peoples and local communities (IPLCs) and CSOs that support them closely. We fully respect each of these groups’ governance structures and decision-making processes and decisions. We maintain fluent communications and coordination with the IIFB, which represents the biggest group of IPLCs engaged with the CBD. We support their statements during official meetings, we support the participation of IPLCs at international meetings whenever possible and we amplify all their publications and campaigns.
Why is there a need for a new Global Biodiversity Framework?
Historically, the implementation of the CBD focused around its first objective, the conservation of biological diversity, and comparatively little attention was put on its second and third objectives, which are the sustainable use of the components of biological diversity, and the fair and equitable sharing of the benefits arising out of the use of genetic resources. This is one of the reasons why the CBD has not been able to deliver the results required. The past decade saw lack of political will from parties to the CBD leading to failure in achieving the Aichi targets, and there is abundant literature demonstrating how the destruction of biodiversity continues rampant.
A new framework should be a unique opportunity to correct past mistakes. The CBD covers a broad range of issues but has failed to address the root causes of biodiversity loss, and its hyper attention to targets such as the one on protected areas, focusing on quantity rather than quality, has hidden huge inconsistencies in our approach to biodiversity loss.
For instance, the Forest Peoples Programme, a member of the CBD Alliance, reported that global funding of biodiversity has grown significantly over the past decade, and is now estimated at between US$78 billion and US$147 billion per year. However, it is greatly outweighed by public subsidies and broader financial flows that drive biodiversity loss, which are estimated at between US$500 billion and several trillion dollars per year.
Furthermore, while the contributions of Indigenous peoples and local communities are widely recognised as critically important for protecting biodiversity, they are often negatively impacted on by biodiversity finance, and receive little direct support for their efforts.
Another CBD Alliance member, the Third World Network, reported that in 2019, 50 of the world’s largest banks underwrote more than US$2.6 trillion in industries known to be the drivers of biodiversity loss. A recent study concluded that ‘the financial sector is bankrolling the mass extinction crisis, while undermining human rights and indigenous sovereignty’.
According to the Global Forest Coalition, also a member of the CBD Alliance, climate finance and subsidised renewable energy generation are a form of direct subsidy that often harms forests while failing to reduce emissions. The most prominent example of this is the Drax power station in the UK, which receives UK£2 million (approx. US$2.8 million) per day to produce highly polluting electricity from wood clear-felled from highly biodiverse wetland forests in the south-eastern USA, among other places. Other examples include the Global Environment Facility’s subsidy to iron and steel companies to produce charcoal from eucalyptus plantations in Brazil, and numerous national and European Union-level subsidies available to the pulp and paper industry in Portugal.
Recently, in an event organised by the CBD Secretariat, several so-called world leaders pledged great amounts of money for biodiversity. However, countries from the global north have failed to fulfil their international commitments in relation to new and additional funds. What they pledge for nature is mixed with all sorts of schemes that do not address the real causes of biodiversity loss. And the amounts pledged to protect biodiversity are clearly outweighed by all the money invested in destroying biodiversity.
In addition to these troubling contradictions and inconsistencies, powerful groups and developed nations constantly try to avoid their responsibilities by all means. We see the push to incorporate terms such as nature-based solutions in the CBD simply as another trick from big polluters to offset their obligations and a new form of corporate land-grabbing and greenwashing.
Why isn’t this all over the mainstream media? This is what happens when ‘big’ players focus all their attention on certain policies and activities, such as the increase in protected areas. Protected areas are not bad, but they are far from being a real solution to the much-needed change in our production and consumption patterns. The narrative around the CBD must shift towards the root causes of biodiversity loss, which are more structural and related to justice and equity. Just like climate change is no longer a purely environmental problem, we need to see the big picture of the destruction of biodiversity that relates to the rights of IPLCs, peasants, women, future generations and nature herself. We need to put an end to the commodification of nature, since nature does not belong to us, or to those few privileged among us. Nature does not need fancy schemes and lots of money to thrive, it needs us to stop destroying it. This narrative should make us all desire and truly work for profound individual and collective change.
What change should the post-2020 Global Biodiversity Framework bring?
The CBD is a legally binding agreement and, if fully implemented, has great potential. The post-2020 Global Biodiversity Framework should be the instrument to implement the legal obligations of the parties to the CBD through accountability mechanisms that sanction any lack of action. It is also an opportunity to adopt a rights-based approach that puts the rights of IPLCs, women and peasants, and the rights of nature, at the centre of the debate, connecting the CBD to the international human rights architecture.
Several reports have shown that violations of human rights have been committed for the sake of protected areas. While tackling the biodiversity and climate change crisis is both possible and unavoidable, various interests are pushing for this connection to be centred around ‘nature-based solutions’, a cover for schemes such as offsets, which do not benefit nature but the status quo and do not bring real solutions to our structural problems.
Another great challenge is the fact that the implementation of environmental norms is usually in the hands of environmental ministries, which tend to be completely powerless in comparison to others that are the actual drivers of biodiversity loss. This needs to change in relation to the new Global Biodiversity Framework.
The UN Biodiversity Conference has been twice postponed due to the COVID-19 pandemic. What challenges has this created?
The first challenge we faced was that global north countries pushed strongly to continue with the negotiations through virtual means without any consideration of the variety of difficulties experienced not only by their counterparts in the global south but also by civil society. The CBD Alliance expressed concerns around the inequalities and inequities of virtual negotiations on several occasions and supported the proposal by global south parties to postpone the negotiations. It was only when African and some Latin American parties expressed deep concerns about this situation that rich nations backed down and online meetings were maintained so the conversations could continue, but it was established that decisions would only be adopted in face-to-face meetings.
How can international civil society best support the work you are doing around the post-2000 Global Biodiversity Framework?
Some of our goals are to ensure that the post-2020 Global Diversity Framework centres around a strong statement of principles, such as equity and common but differentiated responsibilities (CBDR); a mechanism for dealing with noncompliance, including penalties, which should be well embedded under the principle of CBDR; a target focused on human rights and environmental defenders and on women, as they are the ones who are defending biodiversity in the real world; and a target on outlawing major disturbances of nature.
Once the Framework is approved, our mission will be to coordinate with regions, networks and organisations that have a direct connection with those working on the ground and on the frontlines. This coordination should include massive and intense dissemination of the Framework, but with a focus on how it can empower people in their resistance, struggles and projects.
Even if faced with legally binding obligations, governments will not show political will unless people on the ground put enough pressure on them. Such pressure cannot happen without meaningful empowerment and information of the decisions adopted at the international level.

COP27: ‘Climate justice requires debt cancellation, reparations and non-debt climate finance for small island developing states’
CIVICUS speaks with Bahraini social entrepreneur Tariq Al-Olaimy about the upcoming COP27 summit on climate change.
Tariq is Managing Director of 3BL Associates, an ecosystem of social and planetary enterprises working towards regenerative, inclusive and wellbeing-centred economies.
What was the purpose of the Greenpeace United for Climate Justice ship tour you recently took part in?
Greenpeace is sailing throughout Egypt together with climate leaders from the Middle East and North Africa to put climate justice high on the agenda in the lead-up to COP27, which will take place in Sharm el-Sheikh, Egypt. The ship tour is a platform for climate leaders living in some of the world’s most affected regions to promote systemic change around climate adaptation, justice, access to energy and response to the loss and damage associated with the disproportionate impacts of the climate crisis. They are representing the voices of people from across the region, focusing on both climate impacts and the many solutions already at hand.
It's important to spread these leaders’ messages around the world and to make sure their voices are not forgotten during COP27, especially in highlighting the need for climate justice for the global south. For these leaders, this is a collective fight for justice for their countries and communities.
Young people from the across the global south in particular are among the most affected and most marginalised, but also among the most powerful voices. They are not victims, but collectives of solidarity and hope working for a brighter future for all.
What issues should be prioritised at COP27?
COP27 must raise the call of climate justice for the most vulnerable, and also the least responsible for climate change: the people in Africa, in the South-west Asia and North Africa region, and on small islands, among others.
I am from Bahrain, which makes me one of 65 million people who live in small island developing states, representing roughly one per cent of the world’s population. Climate justice, mitigation, adaptation and loss and damage strategies require consistent and regular resources. Small islands typically lack those resources and, being particularly vulnerable to extreme climate events, often face reconstruction costs that lead to more borrowing and debt, which in turn increases their vulnerability.
All small island states together only received US$1.5 billion in climate finance between 2016 and 2020. In the same period, 22 small island developing states paid more than US$26 billion to their external creditors – almost 18 times as much. Climate justice requires debt cancellation, reparations and non-debt climate finance for small island developing states.
COP 27 is framed as an ‘implementation COP’, and the climate finance gap and unequal distribution of finance between countries are critical barriers to implementation.
Are you hopeful meaningful commitments will be made at COP27?
The window of opportunity to act is closing. The United Nations Intergovernmental Panel on Climate Change’s6th Assessment Report offers an even clearer picture of the remaining carbon budget available to stay within a 1.5°C temperature rise and therefore avoid the worst impacts of climate change. While enhanced mitigation ambition is critical, the urgency of implementation is a key concern. Taking into account the pledges fully implemented as of 31 December 2021, total greenhouse gas emission levels are still projected to be 10 per cent higher than 2012 levels.
To truly scale mitigation ambition, it is important that governments don’t just negotiate the text and numbers of pledges but negotiate the very system within which we implement climate action. We need degrowth of the most ecologically harmful sectors of our economy, a global and just transition and transformation towards a post-growth economy.
In a context characterised by short-term political calculations we are completely missing the need for urgent and radical change. I do not expect COP27 to address all this. But there are still some issues that could be meaningfully advanced – in particular, the establishment of the basis for the operationalisation of a Loss and Damage Finance Facility, the details of which could be finalised at COP28 next year.
This is an issue of climate justice towards the many countries in the global south that are particularly vulnerable to the impacts of climate change yet have done little to contribute to the crisis. At the same time, these countries do not have the financial or technological capacity to address these impacts, adapt and pursue a post-extractivist and low-carbon transition. Loss and damage financing can force a rethink around financial commitments and contributions, and pressure for both debt and tax reform as well as renewed financial commitments for mitigation and adaptation.
How concerned are you about the conditions for civil society participation at a COP held in a country with highly restricted civil space?
Civil society participation is always a critical concern at COPs. It’s clear that we can’t have a green and peaceful future without justice, equity, civil rights and empowered communities. That includes the full inclusion of independent civil society as a key stakeholder in climate negotiations. This is why business and civil society organisations have stressed the crucial importance of a rights-based approach to climate action.
As the world transitions toward net zero, protecting the human rights of civil society, workers and communities is key to achieving a just transition. There is significant danger of pledges being made to close the emissions gap while irresponsible implementation strips the rights of civil society. Green transitions in rich countries and ‘green growth’ require significant mineral resources, supplied from the global south, so there is a risk of a neo-colonial mineral rush and a regression of labour rights. It is essential to develop norms, standards and safeguards so that the transition strategies implemented by governments and businesses comply with international human rights and labour standards.
In the context of the COP, this starts with the United Nations taking a much stronger stance regarding the enabling of safe, inclusive and meaningful civil society participation throughout the negotiation process. The COP agenda is largely dominated by global north governments and interests, and civil society perspectives, especially those from the global south, need to find their way into the mix, bringing forward alternative pathways, experience and knowledge.

COP27: ‘The participation of civil society is important because it represents the voices of communities’
CIVICUS speaks about civil society’s aspirations and roles in the upcoming COP27 climate change summit with Chibeze Ezekiel, coordinator of the Strategic Youth Network for Development (SYND).
SYND is a civil society organisation (CSO) that promotes youth participation and advocacy for environmental sustainability in Ghana.
What are the environmental issues that you work on?
SYND works for environmental sustainability by promoting youth participation in policymaking and project implementation. We focus on four thematic areas: climate change, biodiversity, forests and energy. In May 2019, with support from the World Bank and United Nations Development Programme, we established the Youth in Natural Resources and Environmental Governance platform. It is a platform for young people to share and exchange learning on their respective actions and help them embark on joint, coordinated campaigns.
To help build capacity so that young people can better advocate for environmental sustainability and help the government fulfil its climate obligations, we have also developedcapacity building projects. As part of our efforts to empower students to become climate activists and environmentalists, we have also worked with schools. For instance, through our Children for Climate (#C4C) Action campaign we are empowering children to become climate champions. And we publishreports that highlight our activities and their impacts in the communities we work in.
Have you faced any restrictions when conducting your work?
Fortunately, we have not faced any restrictions working in Ghana. We believe that this might be because of our approach. We confront the government and question public officials on their policies, but we do it in a manner that will not jeopardise the work relationship we have built or put ourselves in harm’s way. This has worked for us, because our work relationship not only with the government but also the private sector has strengthened over the years, which has helped us continue doing our work.
How do you connect with the global climate movement?
We work in connection with similar organisations in other African countries as well as with international organisations advocating for environmental rights. In the African region, some of the organisations we work with include theAfrican Youth Initiative on Climate Change,350 Africa,African Climate Reality Project and thePan African Climate Justice Alliance. We are also the West Africa Regional Node forACCESS Coalition, a global network with about 70 members advocating for people living in poverty to have access to safe, reliable and affordable energy, and for environmentally sustainable and efficient energy systems globally.
Working with all these organisations has allowed us to transcend the local level and connect to the global. To contribute to this global work, we produce position papers and give input on policies, among other things.
What issues would you like to see addressed at COP27?
Over the years global leaders have made pledges and promises but they have not fulfilled them. We hope at this year’s COP more serious commitments will be brought forward. Global leaders shouldn’t be making promises they won’t keep and should instead get to work.
Climate finance is still an outstanding issue. There should be a clear understanding of how the mitigation and adaptation measures to climate change will be rolled out. Global leaders must provide communities with resources to adapt to climate change and assist them with mitigation plans. All of this will only be possible if adequate climate finance is provided.
Another priority is loss and damage. We are aware that vulnerable people and those living in underdeveloped communities are the ones suffering the most as a result of climate change. Many people have lost their homes, land and source of livelihood, and it is only fair they are compensated for the irreparable damage caused to them.
A few weeks back we travelled around Ghana to analyse how climate change has affected communities and what demands people had for the government. We conducted interviews and asked people about the situations they are going through and the solutions they would like to see implemented. We plan to present our video documentary at COP27 to show world leaders the real situation on the ground. This will give a clearer picture of what we mean by loss and damage, and hopefully put pressure for urgent action.
Energy transition, away from fossil fuels and towards renewable energies, is also an issue we expect to see discussed. Especially since there are industrialising ambitions in Africa, it will be interesting to see how leaders plan to make energy available and affordable during this transition. Africa has plenty of resources such as wind, solar and hydro, but its progress towards renewable energies has been very slow. According to theInternational Renewable Energy Agency, only two per cent of global investment in renewable energies is invested in Africa, and only three per cent of jobs in the continent are in the sector. We want to know how global leaders plan to use their resources to help Africa with its energy transition.
Why is civil society participation in climate talks important?
The participation of civil society in COPs is important because it represents the voices of communities and is best placed to articulate people’s concerns and propose polices that will improve the lives of citizens. CSOs are also accountable to their communities, so when we attend global conferences such as COPs, we all go back to our respective countries to provide feedback and confront decisions made at the global level with the realities that people continue to live in. This pushes us to continue with our advocacy work. We continue carrying out engagement activities at the local, regional and international levels, holding our leaders accountable to their commitments and supporting their work to implement the policies agreed in global forums.
Do you think COP27 will offer enough space for civil society participation?
Because of the role we play, there is a space for CSOs to participate in COPs, although improvements in access could certainly be made. It is, however, unfortunate that CSOs only have observer status and cannot take part in negotiations. If they were offered an opportunity to interact with negotiators, they would get a better chance to convey their priorities and share their ideas.
COP27 in particular is tricky because it’s taking place in a closed civic space environment. But that is what the situation is in Egypt. More could have been done to offer a conducive environment for civil society, but we will have to work with what we are presented with. I believe there is still some room to have a discussion with the Egyptian authorities so they allow some form of demonstration and civil society can make the voices of people heard. The government should allow its citizens to participate without any restriction because their views are also important.

COP27: ‘We doubt that we will be able to mobilise as we did around COP26’
CIVICUS speaks with Sohanur Rahman, Executive Coordinator of YouthNet for Climate Justice, about civil society’s aspirations and roles in the upcoming COP27 summit on climate change. YouthNet for Climate Justice is a global platform of youth-led organisations of the global south that aims to promote climate action among young people.
What environmental issues do you work on?
YouthNet focuses on climate justice, the new human rights frontier. We want to hold global leaders accountable for the climate crisis we are currently in. We work on climate justice because we understand that young people, people from the global south and Indigenous people are bearing a disproportionate share of the consequences of the climate crisis, while not being responsible for what is going on.
Climate change must be addressed through an intersectional and intergenerational lens because vulnerable groups are the ones experiencing its worst consequences. The climate crisis is rooted in capitalism, colonialism and patriarchy. This makes the struggle for climate justice inseparable from the struggle for human rights.
We are now specifically working on the issue of loss and damage. We want world leaders to support adaptation and financing for loss and damage and provide funding facilities to help developing countries deal with the climate crisis.
What issues would you like to see addressed at COP27?
COP26 failed young people and vulnerable communities. It made clear to us that global leaders are not treating climate change as the global emergency it is. But sadly, we are currently facing one environmental catastrophe after the other. Most recently, there were massive floods in Pakistan and floods and a cyclone in Bangladesh. What else needs to happen so leaders realise we need urgent solutions to these problems?
The COP26 presidency asked state parties to submit new climate plans and nationally determined contributions (NDCs), because the previously submitted ones were not ambitious enough, and would not reduce emissions to the extent needed to stay within the 1.5°C targets. However, Only 23 of the nearly 200 countries that signed the Glasgow Climate Pact have submitted enhanced NDCs. Rather than strengthening headline targets, most of these offered more policy detail. We need commitment from all parties involved to ensure that the climate crisis is addressed effectively.
We can see the progress achieved in previous COPs is very limited. In the run-up to COP27, our major priority is loss and damage financing. Before we can pursue adaptation, we have to support communities with loss and damage. We are not asking developed countries for charity or debt, but for reparations for their historical responsibility in this climate crisis.
In 2019, developed countries pledged US$100 billion towards adaptation and mitigation but they are not disbursing this. Everything at this point is theoretical – no practical mechanism has been put in place to ensure the money is paid up. And when the funds finally come, we would like to see a 50/50 split between adaptation and mitigation, because both require equal efforts. Finally, we would like to see the financing of locally led adaptation addressed at COP27. Communities should be given a platform to develop and implement solutions that will work for them, rather than implementing universal strategies that don’t fit everybody.
This COP should be one where the focus shifts to implementation. We no longer want to hear promises that will remain unfulfilled. We want action towards solving our problems.
Why is civil society participation in climate talks so important?
Civil society participation in COPs, and specifically the participation of young people, is important because they are there to hold leaders accountable. The global community is making empty promises and commitments and not taking action. Civil society’s mission is to hold governments and companies accountable, including by making polluters pay for the loss and damage they are causing to people and the environment.
Because the current systems are failing, civil society must advocate for systemic change. To achieve such transformative change, we must be united. Those joining COP27 should use the platform to advocate for change; those observing from home countries should mobilise in their own countries to highlight the crisis we are in. We must all put pressure on decision-makers to deliver on their promises. COP27 will only bring a breakthrough if civil society is allowed to participate without any restrictions and a decision is made to start paying out climate reparations.
Do you think COP27 will offer enough space for civil society participation?
We are very frightened about the situation in Egypt. The government of Egypt should release all arrested activists before COP27 takes place. Without our participation, it will be just more greenwash. And we cannot archive climate justice if human rights are ignored. The global community should stand up and speak against what Egyptian environmental activists are going through.
COP26 was labelled as ‘inclusive’, but it was very exclusive. The pandemic came on top of persistent systemic barriers, notably the lack of resources that excludes many young people. World leaders negotiated on issues affecting us, but they did not include us at discussion tables. Unfortunately, the situation for civil society participation at COP27 will be even worse.
The government of Egypt does not respect or support human rights defenders. This was clear in the multiple arrests of activists that have taken place over the past few months. Civil society can expect to experience several barriers during the conference, and LGBTQI+ activists have expressed their concerns regarding their safety while in the country. We fear that our presence, digital footprint and communications will be monitored. We doubt that we will be able to mobilise as we did around COP26 in Glasgow where we held a climate strike.
Even though labelled ‘the African COP’, COP27 doesn’t truly represent African people. Many young African activists are still struggling to get accreditation and sponsorship. Rising hotel prices will affect the participation of people from less developed countries. There will be limited participation of young activists, Indigenous people and organisations from the global south. This event was never meant to be inclusive at all. The most affected people will be excluded. This raises the alarm that, instead of addressing the real issues people are dealing with, it may turn into a greenwashing event.

COP27: ‘We shouldn’t even be discussing why civil society needs to have a seat in climate talks’
CIVICUS speaks about civil society’s aspirations and roles in the upcoming COP27 summit with Polluters Out co-founder Ayisha Siddiqa.
Polluters Out is a global coalition founded in 2020 in reaction to the negative experience of COP25, when young and Indigenous activists were removed from the venue. Its aim is to put pressure on world leaders to adopt policies to fight climate injustice and hold them accountable.
What key environmental issues should be addressed by the upcoming COP27 summit on climate change?
A key issue is loss and damage finance. I would like to see COP27 mobilising theSantiago Network on Loss and Damage, a multi-stakeholder coalition of civil society organisations (CSOs) and governments launched at COP25 in 2019 to facilitate and support the efforts of global south countries to address loss and damages associated with the adverse impacts of climate change.
A large number of those are affected by climate change are Indigenous people and people in the global south, who contribute proportionally little to environmental problems. Global north countries should use their resources to help those that have been put in these unfortunate circumstances. They should pay up the US$100 billion they committed to at COP26 so global south countries can develop and implement mitigation and adaptation strategies, as well as early warning mechanisms to help people get life-saving information in time.
We also need to start thinking about taxing the money corporations make by exploiting emergency situations such as wars, natural disasters and economic fluctuations and channel those funds towards climate financing.
My work currently focuses on raising awareness about the issue of tax havens. Governments have pledged a lot of climate financing but most of that money comes from taxes. Estimates show that every year around US$600 billion – six times the current climate finance target – are lost because corporations and high-net-worth individuals are using tax havens to escape their responsibilities to give back to the communities that make their profits possible. They should instead be made pay their share, and the additional funds should be used to help communities affected by changing climatic conditions.
Have you faced any restrictions as a result of your work?
Prior to working on climate finance, I worked on fossil fuel de-proliferation. According to a report by the United Nations (UN) Intergovernmental Panel on Climate Change, coal, oil and gas account for 86 per cent of carbon dioxide emissions. This means governments should adopt strategies to phase out fossil fuels and adopt clean energies. But this would affect very powerful interests. Due to my work on this issue, I have faced challenges both in my home country, Pakistan, and abroad.
I also advocate for a UN conflict-of-interest policy so that COP hosts cannot take money from the fossil fuel industry when organising the summit and lobbyists cannot influence COP outcomes. So far, every single COP has been sponsored by the very same people causing the climate crisis. As a result, the outcomes of these events have been diluted and have failed to address the key issues.
For this work I have faced multiple restrictions traveling. Iam from a tribal community in northern Pakistan where fighting against dams and coal and pipelines puts people’s lives in danger.
Why is civil society participation in climate talks important?
Having people from the global south and members of Indigenous communities participate in climate talks is very important not just because they are the most affected by climate change but also because they are the main drivers of ambition for climate commitments.
As civil society, our aim is to advocate for the good of people and the environment and hold those in power accountable. Civil society doesn’t only offer diversity – it also offers the tools, the language and the practical lens to push all of this forward. At the end of the day, every decision made in COPs affects everyone. Our lives are on the line so we should have a say. It is not only our right but also our duty to protect the earth. Quite frankly, we shouldn’t even be discussing why civil society needs to have a seat in climate talks.
Do you think COP27 will offer enough space for civil society participation?
I don’t. COP27 has been labelled as the ‘African COP’ and one would think that African environmental organisations and activists would be given a platform to participate freely and make their voices heard. This was anopportunity for the global south to speak for itself and it would be a shame if that was limited. Many young people have been unable to get accreditation while others don’t have the funding to attend.
Holding a COP in a country with closed civic space such as Egypt is problematic, and the reality of a restricted civil society cannot be ignored.
Climate change is an urgent matter that must be addressed with the participation of all relevant stakeholders, who should be able to play their part without any restriction on free speech or the freedom of assembly, among many other indispensable freedoms. But many restrictions have been placed on Egyptian CSOs and activists – even on organisations outside of the country. As a result, there will most likely not be meaningful civil society participation at COP27.
The situation we are now in is the responsibility of both the UN and the African governments that nominated Egypt to host COP27. They have let COP become an obstacle to climate justice so states who bid to host the COP make money from tourism and get media attention without caring the least about the crisis at hand and the policies needed to tackle it.
The process leading to COPs is very opaque: for instance, we don’t know who the official sponsors are until the COP president announces them. And when civil society shows up with all of the hard work it has done, it can easily be erased with one vote from one state party.

EAST AFRICA: ‘The pipeline project would open up critical ecosystems to commercial oil exploitation’
CIVICUS speaks about the East African Crude Oil Pipeline (EACOP) project and its potential impacts on the climate and on the health and livelihoods of local communities with Omar Elmawi, coordinator of the Stop the East African Crude Oil Pipeline (#StopEACOP).
#StopEACOP is a global online campaign that seeks to raise awareness of the effects of the project and calls for its cancellation.
What is EACOP, and what is wrong with it?
EACOP is a project to extract and transport crude oil from Uganda to Tanzania, led by the China National Offshore Oil Corporation (CNOOC) and French energy conglomerate TotalEnergies alongside the Uganda National Oil Company and Tanzania Petroleum Development Cooperation.
If it goes on, EACOP would have disastrous consequences for local communities, for wildlife and for the entire planet. In other words, it will affect humans, nature and climate. It threatens to displace thousands of families and farmers from their land. It poses significant risks to water resources and wetlands in both Uganda and Tanzania – including the Lake Victoria basin, which over 40 million people rely on for drinking water and food production.
Additionally, EACOP would increase the severity of the global climate emergency by transporting oil that, when burned, will generate over 34 million tonnes of carbon emissions per year. The pipeline would also open up critical ecosystems in the landlocked regions of Central and Eastern Africa to commercial oil exploitation.
It would also rip through numerous sensitive biodiversity hotspots and risk significantly degrading several nature reserves crucial to the preservation of threatened species, including elephants, lions and chimpanzees.
How are you mobilising against EACOP?
Civil society came together under a global campaign that we have called #StopEACOP, aimed at sharing news related to the pipeline project and distributing resources to help people organise and take action against it.
#StopEACOP is led by an alliance of local groups and communities and African and global civil society organisations (CSOs). Over 260 CSOs have endorsed it and are working towards realising the campaign’s objectives through public mobilisation, legal action, research, shareholder activism and media advocacy.
Since environmental licences have been awarded for the pipeline and associated oil fields in Kingfisher and Tilenga, several cases have been filed against the EACOP pipeline, including at the East African Court of Justice and in French courts against TotalEnergies, under the duty of vigilance law.
We hope that our campaign will put enough pressure on the companies and governments involved so that they will put an end to the pipeline project and prioritise the wellbeing of people and the environment.
How have the governments involved responded to the #StopEACOP campaign?
The governments of both Tanzania and Uganda are committed to seeing this project through despite the fact that each will receive only 15 per cent of the proceeds from the crude oil going through the pipeline. TotalEnergies and CNOOC hold 70 per cent of the pipeline’s shares, so they will be the ones pocketing 70 per cent of the proceeds from crude oil.
Additionally, TotalEnergies and CNOOC both get tax benefits, including a waiver on payment of corporate tax for 10 years once the pipeline becomes operational and on the value-added tax on imported products and materials needed for the pipeline. They are required to pay only five per cent in withholding tax instead of the required 15 per cent.
We haven’t stopped trying to engage the Tanzanian and Ugandan governments, although some of our members, and especially community partners, have been arrested and detained, had their offices raided or been threatened with the deregistration of their organisations. The government has had a part to play in most if not all these challenges, but we have continued to engage and use all legal mechanisms and processes available to make sure our community partners are protected.
What kind of support do you need from international civil society and the wider international community?
Allied organisations, activists and regular people are welcome to visit our website and click on our action page, which suggests a variety of actions addressed at the companies involved and governments and their funders and insurers. Please take as many of the actions listed as you can, prioritising those targeting insurance companies and banks. This is key because the EACOP project will need multi-billion-dollar loans to proceed, as well as numerous insurance policies covering every component of the project.
People can also donate to the cause. All the resources we receive are shared with our community partners and support any security and legal needs that may arise, including legal representation fees.

ITALY: ‘The constitution now contemplates the interests of future generations’
CIVICUS speaks with Edoardo Zanchini, National Vice President of Legambiente Onlus, about the recent legislative vote that introduced environmental protections in the Italian Constitution, and civil society’s role in making it happen.
Established in 1980, Legambiente Onlus is an Italian civil society organisation (CSO) that works towards a clean and liveable environment by monitoring environmental issues, diagnosing problems and offering solutions, denouncing environmental crimes and seeking to hold those responsible to account, running sensitisation campaigns and educational projects, and advocating with policy makers.
What is the significance of the recent constitutional amendment that mandates the state to safeguard ecosystems and biodiversity?
It’s very important because it elevates the protection of the environment, biodiversity and ecosystems to the constitutional level. Before this amendment, the Italian Constitution did not explicitly recognise environmental protection as a fundamental value. The new text of Article 9 establishes the principle of environmental protection ‘in the interest of future generations’, a reference to the concept of sustainable development, according to which natural resources cannot be exploited in an unlimited way – that is, without taking into account that they are finite and how this will affect those who will come after us.
A change to Article 41 also establishes that economic initiatives cannot be carried out in a way that could create damage to health or the environment. Before, the only constitutionally recognised restrictions were those related to security, freedom and human dignity.
Wording was also introduced regarding the ‘protection of animals’, and this was the only point around which there were strong disagreements: pressure from hunters’ associations was strong and led to a compromise.
Do you view the amendments as a civil society victory?
Yes, it was a victory for the CSOs that have long been committed to the defence of ecosystems, the landscape and biodiversity. These amendments would not have been introduced if it hadn’t been for the growing awareness of the importance of these values and the increasing interest in their defence. And that awareness is the result of sustained civil society work.
It has been a long road to reach today’s great consensus on environmental issues. And consultations with environmental CSOs in the amendment process were a key factor in that they helped put pressure on political parties to make the right decision.
The fact that nobody openly campaigned against the amendment proposal is very telling: it shows there is a broad consensus, stronger than any political divide, around values that are recognised as being in the general interest, even as part of the identity of local communities and Italy as a whole. Aside from the strong conflict around the protection of animals, it got to the point that those who have an interest in pollution continuing to be allowed or overlooked were very careful not to take part in any controversy.
Do you see the constitutional change in Italy as part of a European trend?
In recent years several European countries have amended their constitutions to explicitly include and strengthen environmental protection. In all countries there is a strong consensus around this perspective, with an increasing public demand for information on environmental issues and increasingly active citizens who take it upon themselves to get informed, visit protected areas and valuable landscapes, and organise to demand their preservation for future generations. Environmental associations from all over Europe have been working together for many years on issues such as natural resource protection, the push towards a circular economy and the battle against climate change.
We also frame our initiatives and campaigns in the context of our membership of regional and global networks such as the Climate Action Network, which includes over 1,500 CSOs in more than 130 countries in every global region, the European Environmental Bureau, which is the largest network of environmental CSOs in Europe, with over 170 members in more than 35 countries, and Transport & Environment, Europe’s leading clean transport campaign group.
What needs to happen next, both in terms of implementation and further policy development?
Now it will be necessary to update the regulatory framework to include protection measures that had so far not been considered. The new constitutional reference to environmental protection will also allow environmentalists to appeal against laws that are in contradiction with it. Of course, Italy will have to review all its regulations related to environmental impact assessments, which were established without taking into account the protection objectives that are now part of our constitution.

NAMIBIA: ‘There is only so much civil society can do when those in power support extractive companies’
CIVICUS speaks with Rinaani Musutua of the Economic and Social Justice Trust (ESJT) about thee resistance of communities in the Okavango River Basin in Southern Africa against oil and gas exploration by the Canadian company ReconAfrica.
Founded in 2012, ESJT is a civil society organisation (CSO) that promotes social and economicr ights in Namibia and has been part of the coalition mobilising against ReconAfrica’s extractivep roject.
What are your concerns regarding ReconAfrica’s operations in the Okavango River Basin?
The Okavango River Basin, known in Namibia as the Kavango, flows from Angola through northern Namibia and empties out into the Okavango Delta in northwest Botswana. We first heard that ReconAfrica, an oil and gas company headquartered in Canada, had a petroleum exploration licence there in 2020. We were never informed when it sought and obtained its exploration licence and environmental clearance certificate. We looked it up and found it strange that the company received its environmental clearance certificate on a public holiday in Namibia. This makes us wonder who authorised its operations.
Communities in the Kavango region have never been consulted by ReconAfrica. This is worrying because, according to the law, to get to their environmental and clearance certificate companies must first consult with the people who live in the places they wish to operate in. But locals were never informed about the pros and cons of the project and had no idea what the project was about. Only recently did ReconAfrica hold one meeting with community members, after we complained. But even after this meeting, community members were confused about the project because the information provided wasn’t detailed or clear enough.
ReconAfrica decided to apply for land rights after civil society activists and organisations started questioning its legitimacy to operate and occupy land in the region. Prior to this it claimed to have received permission from traditional chiefs, but when media and activists approached them, the chiefs denied it. As it stands, the company is illegally occupying communal land and should be charged for it, but the government doesn’t seem to care.
How will local communities be affected if the project goes ahead?
The Kavango region is home to many communities, including the Indigenous San, who make their living from farming and fishing, and many more that rely on the water that flows from the Okavango Delta. ReconAfrica’s activities threatens the habitat of several wildlife species and could potentially contaminate the water people and animals depend on.
ReconAfrica has been drilling very close to the Omatako River, which is ephemeral due to the low average annual rainfall. It looks like there is not activity, but scientists have confirmed there is activity underneath the river.
When the company was conducting its seismic surveys, many local communities complained that their homes and croplands were damaged due to negligence by drivers. When people complained, ReconAfrica used local people to manipulate community members into signing papers without explaining the content. It was later found that the signed papers gave the company the right to pass through their crops and because of this those affected haven’t been compensated for their loss.
Unfortunately, works continue because our government supports the company. There is only so much civil society can do when those in power support extractive companies at the expense of local communities.
How is civil society mobilising against oil and gas exploration and drilling in the Kavango region?
As civil society we have held public meetings to inform people about the potential danger of this project. ESJT teamed up with other Namibian CSOs to petition the government to halt ReconAfrica’s activities immediately. The Parliamentary Standing Committee on Natural Resources Parliamentary Standing Committee on Natural Resources conducted an investigation but didn’t do such a good job because it failed to go to affected areas. Most of its meetings were held in town and people from the affected areas weren’t able to attend because they don’t have resources to travel to town.
We have also written a lot of newspaper articles highlighting the dangers of ReconAfrica’s activity.
Since we are not able hold public meetings all over Namibia, we are hopeful that these articles will reach people so they can stay informed.
Together with other local and international CSOs we have released a joint statement calling on the Namibian government to examine the oil and gas exploration activities taking place in the Kavango region. We have also complained about ReconAfrica to the Canadian authorities authorities, who started investigating the company. What was disappointing, however, is that it did not investigate ReconAfrica’s environmental and human rights violations in the Kavango region, but only its potentially fraudulent stock market business.
Unfortunately, it seems like our demands are falling on deaf ears. People have accused us of being against development. This makes it difficult for us to unite against ReconAfrica and the government, because they know we don’t have everyone’s full support.
What kind of support from international civil society and the wider international community would help the movement?
Fortunately,international organisations such as Re:wild have expressed support for our fight and brought awareness to what is going on in the Kavango region. Prince Harry Harry has also shown support for our fight against ReconAfrica and its activities.
But beyond international support, we still need people in the Kavango region to also stand up and speak against this project. Right now, most people organising the resistance are based in Windhoek, Namibia’s capital. People in the Kavango region should mobilise so the government can see this is an urgent matter that affects them. We need resources to continue delivering workshops to inform people about the dangers of this project. Our work is limited because we aren’t adequately equipped.

TANZANIA: ‘The government is trying to silence those who are against the pipeline’
CIVICUS speaks about the East African Crude Oil Pipeline (EACOP) project and its potential impacts on the climate and on the health and livelihoods of local communities with Tanzanian climate justice activist Baraka Lenga.
Baraka is a young climate scientist and sustainability consultant, currently volunteering with Fridays for Future to raise awareness of climate change and pressuring businesses and government leaders to act urgently to address the climate crisis.
What is EACOP, and what is wrong with it?
EACOP is a massive crude oil pipeline that will involve the transportation of crude oil from Hoima in Uganda to a Tanzanian port located in Chongoleani village, in Tanga region. It will cover 1,445 kilometres in Uganda and Tanzania, but 80 per cent of the land it will go through is in Tanzania.
Local communities depend on land as the crucial resource to support their livelihoods, which consist mostly of farming and livestock keeping, so if their land is taken or ruined by the pipeline, they will be seriously affected. The project is therefore going to affect the development of many communities and impact negatively on any effort to create a sustainable and liveable local environment.
But EACOP will not only affect people; it will also pose a threat to the animals that depend on the land that will be taken up by this project.
Further, it has been estimated that once operational the project will emit 34 million tonnes of carbon dioxide per year. This means it will amplify climate change and local communities will become poorer, more vulnerable and less resilient.
How has civil society organised to resist this project?
Very unfortunately, in my country, Tanzania, most civil society organisations (CSOs) are not organising against EACOP. One contributing factor may be the limited understanding of the pipeline project in Tanzania. Little information has been shared about the project and the consequences it will have on communities, contributing to Tanzanian civil society’s limited response.
I have been working in my capacity as a freelance activist to raise awareness about the pipeline’s consequences and explaining why it needs to be stopped. I find it crucial for local communities to know and understand the extent to which EACOP could damage their environment and impact on their lives. Fortunately, I have been receiving support from colleagues from various parts of Africa who are using their resources to amplify our voices against EACOP.
How has the government reacted so far?
As most activists and CSOs have noticed, the government is trying to silence those who are against the pipeline. Some of us have raised our concerns since the very beginning of the project but our questions have not been addressed and the project has continued regardless.
But we have continued campaigning because we cannot overlook the damage this project will have on local communities; it comes with a lot of investment that is allegedly meant to develop East African nations but in reality is going to bring more harm to innocent lives.
What kind of support does the anti-pipeline movement need from international civil society and the wider international community?
We would like environmental activists and CSOs from across the globe to join us in raising awareness about EACOP and pressuring the governments involved to put an end to this project. We want people to understand that the companies leading the project, China National Offshore Oil Corporation and TotalEnergies – along with the governments of Tanzania and Uganda, which have brought in both countries’ national oil companies into the project – are endangering wildlife, tipping the world closer to a climate crisis and affecting the livelihoods of our people.
We have seen various multinational cooperation funds pull out of the project in compliance with their obligation to protect the environment and we hope more will do the same. Hopefully, a lack of funding will ultimately force the governments of Tanzania and Uganda to stop EACOP.

UGANDA: ‘Our government cares only about profit, not people’
CIVICUS speaks about the East African Crude Oil Pipeline (EACOP) project and its potential impacts on the climate and on the health and livelihoods of local communities with Nyombi Morris, founder of Earth Volunteers.
Established in 2020, Earth Volunteers is a Ugandan civil society organisation (CSO) that brings together young people who are passionate about planting trees, protecting forests and standing up for climate justice. Earth Volunteers advocates for climate justice and promotes climate education in local schools.
What is EACOP, and what is wrong with it?
EACOP is a pipeline project that will transport oil from Uganda to Tanzania, for export through the Tanga port on the Tanzanian coast. It will travel through hundreds of miles, flowing oil through sensitive environments, including the richly biodiverse Murchison Falls National Park in western Uganda.
The project is led by China National Offshore Oil Corporation (CNOOC) and TotalEnergies, a French company, and funded by Standard Bank, among others. Ever since it kicked off in 2015, it has caused numerous activists to lose their lives and has put many natural resources on the verge of disappearing.
Local communities are already being affected by the pipeline. While pipeline construction itself hasn’t yet started, a process has begun to acquire the land required for the pipeline and related facilities. Those who own land on the projected pipeline’s path or in its vicinity are already unhappy because of the mistreatment they are experiencing and the lack of transparency in the process. They say they were not consulted about the project before it was approved and they are now being pressured to sell off their farms, homes and land at cheap prices and forced to leave to make way for the pipeline.
How is civil society in general, and your organisation in particular, mobilising against the pipeline project?
I have not seen any established CSO come out to oppose or even challenge the pipeline project. It is only us, individual activists loosely connected through informal networks, who are trying to sensitise people and mobilise them against the danger of allowing money-makers to exploit our land to take away the oil and get rich off it. We can’t drink or eat oil, and this will only make us poorer and less healthy.
As one of those activists, I have organised strikes to challenge the project, but since my last protest this March, I have received threats from unknown people who say they are police officers and tell me they are going to come and arrest me.
How has the government reacted so far?
Our government cares only about profit, not people. We have put pressure on them and urged them to be mindful about the approval they give to investors, as they only benefit the wealthy and do nothing to improve people’s lives. But the response we always get in return is threats.
Personally, I do not expect my government to listen to my concerns. The problem is, if they do not, this is a death sentence for many people in both Uganda and Tanzania. We already face the challenge of inflation and we may be heading towards famine and insecurity because people are being forced to sell off their properties in western Uganda and the capital, Kampala, is their next destination. This is one of the biggest and fastest-growing cities in Africa, with a population that has already hit four million.
What kind of support does the anti-pipeline movement need from international civil society and the wider international community?
We need three different support structures. Firstly, we need funds to continue door-to-door mobilisation. We need to speak up with a strong voice, so it is our role to wake up the public and get people to start demanding justice.
Secondly, we need the media to cover our movement and amplify our voice. We need the world to join us in challenging these perpetrators of environmental destruction. Except for Standard Bank, which is from South Africa, pipeline funders are from the global north, and we need people in their countries to know what is happening so they can join us in exposing these capitalist fundamentalists who only care about money – not about people, and not about nature.
Finally, we need protection. I am constantly receiving threats, and since last week I haven’t even been allowed to tweet for fear of my life and the lives of my family. We are in danger and nobody is helping us with security and support. I am hiding at my sisters’ place but very soon we are going to run out of resources such as food.
Every organisation I reach out to, they redirect me to CSOs that are not really independent but actually serve the government that is targeting me. I feel like there is no one I can trust in my country. This is terrible and traumatising, and many others are going through the same. We cannot imagine help coming from anywhere but international civil society.

UGANDA: ‘We’ll participate in COP28 to pressure world leaders to divert funding away from oil and gas’
CIVICUS speaks about recent developments involving the East African Crude Oil Pipeline (EACOP) project and civil society’s efforts to stop it with Zaki Mamdoo, Campaign Coordinator of Stop EACOP.
Established in 2020, Stop EACOP is a coalition of Ugandan environmental and climate justice organisations that oppose the pipeline project due to the significant threats it poses to protected ecosystems, water resources and community lands across Tanzania and Uganda.
What are your coalition’s aims?
Our aim is to halt the construction of EACOP to avert the catastrophic environmental and climate consequences associated with the pipeline and safeguard human rights and communal territories.
To achieve this, we employ a multifaceted strategy: heightening public awareness, exerting pressure on financial institutions and raising their reputational costs so they distance themselves from the project, mobilising impacted communities and rallying to force governments and oil corporations to suspend the project.
A cornerstone of our approach is engaging with young people. Our partner programmes in both Tanzania and Uganda are focused on youth. We proactively seek out young people in various initiatives, including security training sessions. Recently, we’ve identified student leaders from various universities who had organised to spread awareness about the project’s impacts among their peers. We are actively pursuing funding and other opportunities to bolster their efforts.
Internally, we give space to youth representatives to contribute their perspectives. We’re committed to amplifying young voices and offering avenues for their growth and development as activists. A reflection of this is that I am 26 years old and trusted with the leadership as campaign coordinator.
How has the situation evolved since welast spoke over a year ago?
There have been significant changes over the past year. Drilling has started in one of the most important biodiversity hotspots. One of the companies leading the project, French energy conglomerate Total Energies, has launched oil drilling in Uganda’s Murchison Falls National Park, home to diverse animal and bird species, including elephants, giraffes and lions. Its ecological significance is heightened by the presence of the Murchison Falls-Albert Delta Wetland System, essential for Lake Albert fisheries.
The pipeline threatens the park’s biodiversity and tourism appeal. It will also have economic impacts, as the park is a major contributor to Uganda’s economy, accounting for 59 per cent of exports and having generated over US$1 billion in revenue in 2022.
Negative consequences are already evident, with displaced elephants damaging crops and posing threats to human lives in nearby communities. Tragic incidents involving elephants have already occurred in Buliisa district, where the park is located.
This is clearly just another a case in which profit is prioritised over environmental and socioeconomic considerations.
Our demands, however, remain unaltered: we adamantly call for the project’s complete cancellation due to its intolerable environmental and human risks. And while governmental authorities have largely remained unresponsive, we’ve achieved progress with financial institutions. Remarkably, 27 banks have already denied funding for EACOP, and an additional 23 major insurers and reinsurers have declined to support the pipeline.
What restrictions do Stop EACOP activists face?
We operate in fairly restrictive environments in which the freedom to protest is often violated. Recently, for instance, four of our activists were forcibly arrested on charges of ‘inciting violence’, transported in police vehicles and kept in jail overnight for protesting against the pipeline in Kampala, Uganda’s capital.
The activists, three women and one man, were protesting peacefully, but their arrests were unnecessarily violent. It must be emphasised that only four protesters were involved, so the degree of force applied was clearly excessive, yet not entirely unexpected. Historically, Ugandan authorities have responded aggressively to any demonstrations perceived as anti-government, in line with a dictatorial regime indifferent to public sentiments or alternate viewpoints. This reaction is not unprecedented, although it’s intriguing that the government seems threatened by even small-scale protests like this four-person event.
But this won’t stop us: we will continue to demonstrate peacefully. Several of our members maintain a fund to secure bail or engage lawyers whenever activists are arrested. We arrange legal representation and explore the possibility of anticipatory bail when possible. However, given the sporadic nature of these protests, support is often provided post-arrest. We’ve also partnered with organisations that specialise in security training so that we can provide tools for advocates to voice their concerns without jeopardising their personal safety.
How do you connect with the global climate movement?
We connect with climate activists worldwide by sharing experiences and strategies and providing each other with support across borders. Global solidarity strengthens our efforts, so we appreciate any form of international backing for our cause.
What lies ahead remains uncertain, but as demonstrated in numerous instances globally, when we come together to back local communities as they advocate for their rights and a more promising tomorrow, there is a potential to counter even the largest of corporate giants effectively.
More than a million people have already raised their voices against EACOP. We believe that together we can stop it.
Are you planning to engage with the upcoming COP28 climate summit?
We’re deliberating on the optimal way to participate in COP28 to pressure world leaders to address the pipeline project directly and divert funding away from new oil and gas developments. I will be there to represent the campaign.
Despite controversies surrounding the summit’s leadership and lack of an enabling civic space in the host country, the United Arab Emirates, we are hopeful that substantive progress will be made. But we recognise that lasting change will require continued people-powered mobilisation. We’re committed to sustaining our fight for climate justice and environmental preservation in East Africa.

UNITED NATIONS: ‘Getting a strong Ocean Treaty across the line would be nothing short of historic’
CIVICUS speaks with Ellie Hooper of GreenpeaceAotearoa about civil society’s role in the ongoing negotiations towards the development of a United Nations Ocean Treaty. Greenpeace is a global environment campaigning network that comprises 26 independent national and regional organisations in over 55 countries across all continents as well as a co-ordinating body, Greenpeace International, based in Amsterdam, the Netherlands. It uses peaceful protest and creative communication to expose global environmental problems and promote solutions that create a green and peaceful future.
What is the significance of the proposed Ocean Treaty?
A strong global treaty on the oceans could revolutionise the way oceans are managed, putting an end to fragmented governance that has failed to protect our blue planet the way we need to.
If done right, one of the key things the Ocean Treaty could deliver is the creation of fully protected marine areas on the high seas. These areas would be off limits to destructive human activities such as industrial fishing and mining. At the moment there is no legal mechanism to create fully protected areas outside of national jurisdictions, which has become a real problem. The ocean is under threat from all sides and to protect it we need to take a holistic view tackling multiple risk factors.
Getting a strong treaty across the line would be nothing short of historic. Scientists tell us that to avoid the worst of the climate and biodiversity crisis we must protect at least a third of the world’s oceans by 2030. A strong treaty would give us the mechanism to do this. The ocean is a huge carbon sink and has absorbed a great deal of global warming to this point. It’s also home to amazing biodiversity, produces the oxygen we breathe, stabilises the climate and is a food source for millions around the world.
In short, keeping the ocean healthy is vital to our survival and the entire functioning of our blue planet. But more and more research shows it is in decline. To turn this around we need to step up and protect it by reducing the multiple pressures on the system.
Science shows that fully protected marine areas are one of the best tools we’ve got to help the ocean recover and thrive. When these are put in place in the right areas – places known to be high in biodiversity, migratory pathways or unique ecosystems – ocean health improves and marine life flourishes. This has positive impacts across the board, from the number of creatures in the sea to how well the ocean can absorb carbon.
Why is the treaty process taking so long?
We’re talking about a hugely ambitious conservation effort. Getting a treaty across the line involves countries around the world agreeing to its terms, and that is not an easy feat.
While it’s disappointing that leaders failed to reach a conclusion on this at the latest round of negotiations held in August, this doesn’t mean an agreement isn’t going to happen. At the last meeting a great deal of progress was made, with countries showing more flexibility and a real sense of urgency. They ran out of time, but we are not giving up hope that this historic agreement is on the horizon. What needs to happen now is for countries to come together without delay and thrash out their remaining discrepancies.
How has civil society in general, and Greenpeace specifically, advocated for the treaty?
There’s been a great deal of civil society pressure for this treaty, with many organisations around the world pushing hard for its best version to materialise.
Greenpeace has been actively involved in the treaty process since the beginning. It sends a team to each round of negotiations and has run a global campaign to raise awareness of the threats facing the ocean and how a treaty could counter them. Our approach has been twofold: to build public momentum around the agreement while doing all the behind-the-scenes work, talking to ministers and other public officials in all the regions where we’re active.
As a consequence, millions of people around the world have joined the campaign for a strong treaty. They’ve done that in various ways, from signing petitions, sending letters and recording video messages to attending marches. Many people around the world are invested in this issue and their engagement has been critical to getting this far.
For us here at Greenpeace Aotearoa, it’s been inspiring to see the number of people willing to stand up for ocean protection, and we know that their voices have been heard. It’s fair to say that their repeated calls on New Zealand’s leaders to support a strong treaty has resulted in New Zealand supporting a far more progressive position at negotiations. That’s really people power in action. When we work together, we can make real change happen.
We’ve also met regularly with the New Zealand delegation to the treaty negotiations, as well as the Minister of Foreign Affairs, and we consistently communicate with them about what this treaty needs to look like in order to protect the ocean for the future.
What can environmental civil society organisations and activists do to ensure the treaty is adopted?
Treaty negotiations need to urgently resume. At the latest round, countries ran out of time to agree on all its terms, but they’re almost there. So it’s up to civil society activists and organisations to keep pushing world leaders to prioritise reconvening and getting this done. We don’t want it to fall to the bottom of the agenda – it’s simply too important.
In more practical terms, making noise about the need for this treaty is really important. That could look like sharing content online, signing petitions, or writing to your country’s minister of foreign affairs to show how important getting this treaty done is. None of us can survive without a healthy ocean, so we all need to up to protect it.

UNITED NATIONS: ‘Ocean Treaty negotiations are largely a backroom discussion that excludes civil society’
CIVICUS speaks John Paul Jose about civil society’s role in the ongoing negotiations towards a United Nations (UN) High Seas Treaty. John is an environmental and climate activist from India who currently serves as one of the youth ambassadors of the High Seas Alliance (HSA) and a member of the Youth Policy Advisory Council of the Sustainable Ocean Alliance. The HSA is a partnership of more than 40 civil society organisations (CSOs) plus the International Union for the Conservation of Nature. It aims to build a strong common voice and constituency for ocean conservation.
What is the significance of the proposed treaty?
Seventy-one per cent of the surface of the Earth is covered by ocean, 64 per cent of which are high seas. The ocean regulates the global climate and sustains life on the planet. It sequesters much of the historic and cumulative carbon emissions: phytoplankton, marine forests and whales, in particular, play a significant role in locking carbon in the ocean. However, the ocean has been systematically ignored in efforts to address the climate crisis and the loss of biodiversity, which have focused almost exclusively on the land.
As the high seas are a global commons, it is largely governed by the International Maritime Organization, a UN agency responsible for regulating shipping that was established in 1948, and the 1982 UN Convention on the Law of the Sea and its autonomous intergovernmental body, the International Seabed Authority, established in 1994.
But high seas are experiencing unprecedented threats that were not foreseen when those agreements were reached, such as the accumulation of plastics, chemical and industrial waste, acidification, deep sea mining, bottom trawling and, last but not least, the overall impacts of climate change. Rising temperatures and the overexploitation of marine habitats and species increase the danger of ocean collapse.
This is why it is urgent to develop a global treaty on biodiversity beyond national jurisdiction – a High Seas Treaty. This would provide the legal basis for the conservation of marine ecosystems and the protection from extinction of countless species yet to be discovered. Only one per cent of the high seas are currently protected, and the treaty aims to make it 30 per cent by 2030.
This would be the equivalent of the Paris Agreement for the oceans. Through marine conservation and the sustainable use of marine resources, it will preserve the carbon cycle. By creating marine protected areas, it will contribute to the restoration of marine habitats and the replenishment of the marine resources on which many communities around the world rely for their livelihoods. It will further contribute to global climate resilience. Once it comes into effect, many practices harmful to the ocean will cease to exist within the protected areas.
Why is the treaty process taking so long?
It has been 15 years since the negotiations started, but cooperation has been lacking regarding many aspects of the treaty. Differences would need to be resolved in between sessions, and a treaty should be finalised to include all the aspects where agreements have been reached, leaving space for future amendments as differences over more contested elements are subsequently resolved. And intergovernmental conferences should definitely happen more often.
One element being discussed is the equitable distribution among states of marine genetic resources, which are essential in the pharmaceutical, cosmetic, agricultural and other industries. The current overemphasis on benefit sharing is an illusion, as we don’t know enough about such benefits, since much of the ocean is still unexplored. But it is a fact that 10 countries account for 71 per cent of global fishing and 98 per cent of patents of genetic codes of marine life in the high seas. Those few countries’ greed and unwillingness to share benefits and marine technology and knowledge, and the obvious concerns this creates among less powerful countries, are one big reason for the deadlock.
There is also a stalemate on defining criteria for environmental impact assessments and the implementation of marine protected areas. What is at stake here are the interests of deep-sea mining industries and industrial fisheries.
However, the treaty process has seen a lot of success in convening discussions and negotiations. As of now, more than 100 states are highly committed to backing the treaty as it stands and some, such as Costa Rica, are leading by example by pushing forward regionally, opening up additional avenues for conservation.
The treaty is likely to be finalised at the next session, so further efforts should be put into funding delegations from global south countries so they can be a stronger voice and bring more balance into negotiations.
How has civil society in general, and the HSA in particular, advocated for the development and adoption of a treaty?
Since its inception, the HSA has advocated for protecting at least 50 per cent of the ocean, engaging decision-makers, experts and civil society. We are now focused on keeping up the momentum of the intergovernmental conferences, as this is a once-in-a-lifetime opportunity to have a legally binding treaty to protect the planet by changing the way we govern the high seas. This process has created a lot of awareness about the importance of the high seas, so governments that used to be unfamiliar with them are now supporting a robust treaty.
That said, it should be noted that only states are considered as parties to the treaty, so non-state voices have no space in the negotiations. Treaty negotiations are largely a backroom discussion that excludes civil society and experts. Many of us cannot even witness live negotiations and documents are only made available once discussions have been closed.
There are also clear inequalities among participating states. Many states with limited resources bring very small delegations and lack the expertise to engage productively in the discussions. It would make a difference to all parties involved if civil society were able to bring its expertise into the process.
What can environmental CSOs and activists do to ensure the treaty’s adoption?
There are clear limits to what we can do to expedite the treaty’s adoption. We believe it is crucial to have a treaty as soon as possible, and it is better to have an incomplete one than to have none. So states should move forward on all the issues where agreements have been reached and design an amendment process to integrate further issues and stakeholders’ concerns in the future.
CSOs and activists can contribute to the process by bringing diverse perspectives to the table. As current negotiations are closed discussions among states in which civil society, scientists and the private sector don’t have a seat, we only can do so by advocating with receptive states that do have a seat at the table.
We can also campaign to bring bottom-up pressure into the process, by bringing the concerns the treaty tries to address into the discussion of the global climate movement and getting the wider public engaged. Resources such as the HSA’s Treaty Tracker provide access to useful information regarding the treaty and negotiations. This information should reach across the globe and empower people to demand that world leaders finalise the treaty, and to call on their own governments to hear them in environmental policy process.
A treaty would provide a legal basis for action, but even without one, states, communities and corporations can act to protect the high seas. Many countries already have marine protected areas within their national jurisdictions, and more can be established with public participation. Civil society should engage in these processes but should not be limited by national boundaries. It’s time for us to transcend borders and advocate for the global commons as well.
